Dear Mr. Palmatier
On November 9, 2021, the Wilmington Regional Office of the Division of Energy, Mineral and Land Resources
(DEMLR) inspected the subject project, located at 3600 Andrew Jackson Hwy. in Brunswick County to determine
the status of compliance with the State Stormwater Management Permit Number SW8 010815, DEMLR file review
and site inspection revealed that the site is NOT in compliance with the terms and conditions of this permit. Please
find a copy of the completed form entitled "Compliance Inspection Report" attached to this letter, which summarizes
the findings of the recent inspection.
As indicated in the attached inspection report, the following deficiencies must be resolved:
1. Permit Condition L7:
The 30' vegetated buffer between the edge of the gravel parking area and the wetlands must be
maintained, as shown on the approved plans.
It appears that this buffer has been eliminated, and this project now has built -upon area (BUA) in
the form of gravel parking in this area.
2. Permit Condition II.4.
Prior to the sale or lease of any of this project area, in whole or in part, the permittee most submit a
permit modification. Based on the proposed modifications, the Division may require any or all of the
following deed restrictions, or others as may be needed, to be recorded with the Office of the Register of
Deeds and submitted with the permit modification-
a. "Construction of additional built -upon area in excess of 67,866 square feet will require a permit
modification."
b. "Construction of additional impervious areas such that low density requirements are no longer met
must be submitted to DWQ and a permit modification must be issued prior to construction. An
engineered system will be required to collect and treat the runoff from all built -upon area associated
with the project, including that area permitted under the low density option."
c. "Filling in or piping of any vegetative conveyances (ditches, swales, etc.) associated with this development,
except for average driveway crossings, is strictly prohibited by any persons."
d. "A minimum of 30' of vegetated buffer area shall be provided between surface waters and all impervious
surfaces.":
It appears that items a) and possibly b) in this section are applicable. Therefore, please submit a
modification to the permit to address these issues.

Permit Condition IL7: The following items will require a modification to the permit. Revised plans,
specifications and calculations must be permitted prior to the permittee beginning construction on the
modification:
a. Any revision to the approved plans, regardless of size or amount of disturbed area.
b. Project name change.
C. Transfer of ownership.
d. Redesign or addition to the approved amount of built -upon area or the drainage area.
e. Further subdivision, acquisition, sale or lease of the project area. The project area is defined as all
property owned by the permittee, for which either a CAMA Major permit or Sedimentation and
Erosion Control Plan approval was sought.
f. Filling in, altering or piping any vegetative conveyance shown on the approved plan.
g. Channelization of runoff such that sheet flow is no longer occurring.
Based on aerial imagery, it appears the site has been developed extensively beyond what is shown
on the approved plans without a modification to the permit. A modification will be needed to
address the additional development. Gravel parldng and several structures have been added on
Lots 1— 3.
4. Permit Condition IL3: The Director may notify the permittee when the permitted site does not meet one
or more of the minimum requirements of the permit. Within the time frame specified in the notice, the
permittee shall submit a written time schedule to the Director for modifying the site to meet minimum
requirements. The permittee shall provide copies of revised plans and certification in writing to the
Director that the changes have been made.
Please be advised that, as the permittee, you are required to comply with the terms, conditions and limitations of
the Stormwater Management Permit under Title 15A North Carolina Administrative Code 2H .1003 and North
Carolina General Statute 143-214.7. including the operation and maintenance of the permitted stormwater system
and the requirement to submit any changes from the approved plans to the Division for approval.
Failure to provide the requested information, or to respond to this letter with a plan of action, including a timeline
to resolve the identified deficiencies, by December 22, 2021, are considered violations of the permit. If the
requested information is not submitted to this office by the due date, then DEMLR staff will re -inspect the site
and may issue a Notice of Violation. Please also note that any individual or entity found to be in noncompliance
with the provisions of a stormwater management permit or the stormwater rules is subject to enforcement action
as set forth in NCGS 143 Article 21, including the assessment of civil penalties of up to $25,000 per day.

Pursuant to 15A NCAC 02H.1045 and other applicable statues as reference within

current penmittee and/or the proposed permittee. Per the state stormwater rules and the state stormwater permit
conditions, the permit shall not be transferred until.
1. the current permittee resolves all non-compliance issues identified in the inspection report;
2. the current permittee negotiates a resolution with the proposed permittee (in writing and signed by both
entities. The negotiated resolution must identify the necessary actions, the responsible party(ies), and the
timelines to correct the deficiencies. The site must either be found in compliance or a copy of the
negotiated resolution must he submitted prior to the transfer of the permit.); or
3. in the case where a transfer fails under G.S. 143-214.7(c2) (see also SL 2011-256), the proposed
permittee resolves all non-compliance issues upon acquiring the permit.
Signature requirements for the named signing official (for current and proposed penmittee) must meet the following.
• Corporation - a principal executive officer of at least the level of vice-president,
• Limited Liability Company (LLC) - the designated manager; (Documentation from the NC Secretary of
State or other official documentation must be provided that states the titles and positions held by the
person who signed the application (pursuant to 02H.1040) that shows they have legal authority to sign for
the LLC)
• Municipality - a ranking official or duly authorized employee,
• Partnership or limited partnership - the general partner,

subdivision. If the Declarant chooses to use this type of transfer, the determination must be in
writing, signed by the attorney, and submitted to DEMLR with this form.

State demonstrating that the proposed permittee is a legal and viable entity able to conduct
business in North Carolina.

5. Legal documentation that the property has transferred to the proposed permittee (such as a
recorded deed for the property, uncompleted development and/or common areas) or legal
documentation demonstrating that the proposed permittee is the sole claimant of the right to
engage in the permitted activity.
6. If required by the permit and if the project has been built, a signed, sealed and dated certification
document from a licensed professional stating that the stormwater management system has been
inspected and that it has been built and maintained in accordance with the approved plans.
7. A copy of the recorded covenants and deed restrictions, if required by the permit. If the project has
been built, documentation that the maximum allowed per lot built -upon area or the maximum
allowed total built -upon area has not been exceeded. If the project has not been built, the new
owner shall provide a signed agreement to submit final recorded deed restrictions and protective
covenants.
8. If transferring under G.S. 143-214.7(c2) (i.e., Part B, Item 2 of this form is selected),
documentation verifying that 50% or more of the lots have been conveyed to individuals (not
builders). Copies of the deeds of conveyance or a chart listing the lot number, lot address,
owner's name, conveyance date and deed book and page number are acceptable.
9. If transferring under G.S. 143-214.7(c5) (i.e., Part B, Item 3 of this form is selected), provide legal
documentation supporting the dissolution of the corporation or documentation supporting the
current permittee was lawfully and finally divested of title of the property.

Pursuant to 15A NCAC 02H.1045 and other applicable statues as reference within

After this application is accepted, DEMLR will conduct a compliance inspection and report any deficiencies to the
current permittee and/or the proposed permittee. Per the state stormwater rules and the state stormwater permit
conditions, the permit shall not be transferred until.
I. the current permittee resolves all non-compliance issues identified in the inspection report,
2. the current permittee negotiates a resolution with the proposed permittee (in writing and signed by both
entities. The negotiated resolution must identify the necessary actions, the responsible party(ies), and the
timelines to correct the deficiencies. The site must either be found in compliance or a copy of the
negotiated resolution must be submitted prior to the transfer of the permit.); or
3. in the case where a transfer falls under G. S. 143-214. 7(c2)(see also SL 2011-258), the proposed
permittee resolves all non-compliance issues upon acquiring the permit.

been built, documentation that the maximum allowed per lot built -upon area or the maximum
allowed total built -upon area has not been exceeded. If the project has not been built, the new
owner shall provide a signed agreement to submit final recorded deed restrictions and protective
covenants.
8. If transferring under G.S. -t*s-z74.7(c2) (i.a., Part B, Item 2 of this form is selected),
documentation verifying that 50% or more of the lots have been conveyed to individuals (not
builders). Copies of the deeds of conveyance or a chart listing the lot number, lot address,

THIS DEED, made this 15th day of May, 2012 by and between ALAN M.
SOLANA, Successor Substitute Trustee in the Deed of Trust hereinafter mentioned
(hereinafter referred to as "Grantor"), and PALMATIER, LLC (hereinafter referred to as
"Grantee") of 3600 Andrew Jackson Hwy NE, Leland, NC 28451,
WITNESSETH:
WHEREAS, on July 13, 2001 CBH Construction, Inc. n/k/a Hufham Construction,
Inc., James W. Hufham, Jr., Kathy B. Hufham and James W. Hufham, Sr. executed and
delivered unto John Cameron Coburn, as Trustee, that certain Deed of Trust which is
duly recorded in the Office of the Register of Deeds of Brunswick County, North Carolina,
in Book 1481, Page 876; and
WHEREAS Alan M. Solana was appointed successor Substitute Trustee by
instrument recorded in Book 3253, Page 893, Brunswick County Registry:
WHEREAS, default having occurred in the payment of the indebtedness secured
by said Deed of Trust and in the performance of the stipulations and conditions therein
contained, due demand was made upon the Grantor by the owner and holder of the
indebtedness secured by said Deed of Trust that he foreclose the said Deed of Trust and

sell the property under the terms thereof; and
WHEREAS, under and by virtue of the power and authority in him vested by said
Deed of Trust and in accordance with the terms and the stipulations of the same, and
having instituted a special proceeding before the Clerk of Superior Court of Brunswick
County, entitled "In the Matter of Foreclosure of a Deed of Trust of CBH Construction,
Inc., James W. Hufham, Jr., Kathy B. Hufham and James W. Hufham, Sr. to James
Cameron Coburn, Trustee," petitioner, bearing Brunswick County Special Proceeding
case number 11-SP-968, and after due advertisement as in said Deed of Trust provided
and as by law as required, and due and timely notice having been given to those parties
entitled thereto, and a proper hearing having been conducted on October 24, 2011,
whereupon the Clerk of Superior Court of Brunswick County, North Carolina, authorized
Grantor to proceed under said Deed of Trust and sell the property as hereinbelow
described, Grantor did at 12:30 o'clock p.m. on May 4, 2012 expose the property
described in said Deed of Trust, and hereinafter described and conveyed, for sale subject
to any and all superior liens, taxes, special assessments, restrictions, easements,
conveyances and releases, at public auction at the Brunswick County Courthouse steps
in Bolivia, North Carolina, when and where Palmatier, LLC became the last and highest
bidder for said property at the purchase price of $630,000.00; and
WHEREAS, Grantor duly reported said sale to the Clerk of Superior Court of
Brunswick County as by law required, and thereafter said sale remained open ten (10)
days and was not upset.
WHEREAS, said purchase price has been fully paid or credited; and
WHEREAS, Grantor has filed with the said Clerk of Superior Court of Brunswick
County, North Carolina, as by law required, a Final Report and Account of Foreclosure
Sale showing all receipts and disbursements of Grantor, and said Clerk has audited and
approved the said Final Report and Account;

NOW, THEREFORE, in consideration of the premises and of the payment or
credit of said purchase price by Grantee, the receipt of which is hereby acknowledged,
and pursuant to the authority vested in him by the terms of said Deed of Trust, Grantor
does hereby bargain, sell, grant and convey unto Grantee and its successors and
assigns, without warranty and subject to any and all superior liens, taxes, special
assessments, restrictions, easements, conveyances and releases, all that certain real
and personal property lying and being in Brunswick County, North Carolina, and being
more particularly designated and described on the attached Exhibit 11W incorporated
herein by this reference.
TO HAVE AND TO HOLD the said Property, together with the privileges and
appurtenances thereto belonging unto said Grantee and his successors and assigns,
forever, in as full and ample manner as the Grantor, as Substitute Trustee, is authorized
and empowered to convey the same.
