PROJECT SUMMARY: The applicant proposes to excavate an access channel and boat basin around/beneath an existing docking facility to a final depth of -5' @ NLW adjacent to the AIWW. Tom Chadwick December 3, 2021 Page 2 9. PROJECT DESCRIPTION The proposed project is located adjacent to the AIWW at 539 Lockwood Folly Rd SE in Bolivia, Brunswick County. To locate the project site from the Wilmington Regional Office (WiRO), travel southwest from Wilmington to Sunset Beach on US 74 W (Martin Luther King Jr Pkwy) & US 17 S for approximately 24 miles until you reach NC-906. Turn left, and travel about 4 miles and turn right onto Gilbert Road. Travel 1.4 miles until you reach Clemmons Road SE, turn left and travel 2.6 miles until you reach NC-211S. Turn left, travel approximately 0.5 miles, until you reach Sunset Harbor Road SE. Travel 5.8 miles until you reach Lockwood Folly Road, turn left, and the property of interest will be on the left. Existing structures on the .53-acre project site include a single-family residence and a docking facility. The high ground is vegetated primarily with domestic grasses and ornamental landscaping. High ground elevations are approximately 5ft. above the normal high water (NHW) level, and the shoreline (-100 feet) is not currently stabilized. AIong the shoreline, there is there is a band of Coastal Wetlands, consisting primarily of Smooth chordgrass (Spartina alternifora), and Black needlerush (Juncus ramerianus) across the width of the property, and extending approximately 75' waterward from the highground to the AIWW.). There is an existing access pier (186' x 6'). The pier leads to an open platform (12' x 16') that is oriented parallel with the shoreline. On the west side of the platform, there is an existing boatlift (13' x 13'), which is serving as slip #1. A ramp extends from the pier to the east, landing on an existing floating dock (16' x 8') which serves as slip #2. Water depths in the vicinity of the boat slips range from approximately 0.8 ft. to-1.2ft., relative to normal low water (NLW). Residential properties border the project site to the north, east, and west, and the AIWW to the south. Based on existing documentation, there is a history of dredging along the AIWW, within the Corp of Engineer's channel setback; however, there is no record of any privately funded dredging events at the subject property. The approximate width of the waterbody in the project area is approximately 450'. The waters of the AIWW (adjacent to the project site) are classified SA-HQW by the Division of Water Quality and ARE NOT designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries. They are CLOSED to the harvest of shellfish. PROPOSED PROJECT The applicant proposes to excavate an access channel and boat basin around/beneath an existing docking facility to a final depth of -5' @ NLW adjacent to the AIWW. Based on the site plan, the applicant would dredge an access channel and boat basin in the center of the riparian corridor extending in a southerly direction towards the AIWW. The rectangular dredge cut (approximately 80ft. x 50ft. x -5ft. NLW) would begin just inshore of the existing boat lift and floating dock and extend to the south, perpendicular to the run of the channel, terminating approximately 60ft. inside of the Army Corps Federal Channel Setback along the AIWW. The proposed dredge cut would tie into the -6ft. NLW contour which is located inside the Corps Federal Channel Setback. Based on information presented in the application package, existing water depths around the existing docking facility range from 0.8ft. to -1.2ft. @ NLW, and an average of -2.9' @ NLW across the project area; the applicant is proposing to dredge to a final depth of -5ft. @ NLW, resulting in the removal of approximately 417 cu. yds. of shallow bottom habitat. Dredging would be performed using a clamshell "bucket to barge" method, and once loaded onto the barge, the vessel would transport and offload the material into a dump trailer, located nearby at the NCWRC boat ramp, Tom Chadwick December 3, 2021 Page 3 just west of the project site at the end of Lockwood Folly Rd. From the boat ramp, the dewatered material will be transported to 540 Lockwood Folly Road and disposed at an upland area (140' x 100') and contained with silt fence, greater than 75' from the Estuarine Shoreline Area of environmental concern. The applicant owns the proposed disposal site. 10. ANTICIPATED IMPACTS The proposed dredging would disturb approximately 4000 sq. ft. of shallow bottom area. Minor increases in turbidity should be expected during the dredging event; however, no long term adverse impacts are anticipated. Spoil disposal would be contained by a silt fence in an area outside of the CAMA Areas of Environmental Concern (greater than 75' from NHW). The proposed project would not exceed a final depth of-5.0ft. @ NLW. As proposed, it appears that the dredging and disposal activities would not impact Coastal Wetlands, SAVs or PNAs. NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed development. Enclosed you will find a "Notice of Permit Filing" postcard which must be posted at the property of your proposed development. You should post this notice at a conspicuous point along your property where it can be observed from a public road. Some examples would be: Nailing the notice card to a telephone pole or tree along the road right-of- way fronting your property; or at a point along the road right-of-way where a private road would lead one into your property.
