Locating the alignment further south would have added significant amounts of stream and buffer impacts. (SEI) has reviewed information obtained from Environmental Data Resources, Inc. (EDR) and the North Carolina Natural Heritage Program (NCNHP) to determine if the subject property (Wake County parcels cited above) contains rare and/or protected species and/or their critical habitat(s), or if either is recorded in federal and/or state databases within or near the subject property. The NCNHP report provides information about the subject property and lists all protected species that have been documented within one mile of the property and critical habit corresponding to that species identified on the property through site reconnaissance or regulatory records review. Data Review: Based on our review, there are no records of rare, threatened, or endangered species within the subject property. Additionally, according to the NNHP data, there are no records for important natural communities, managed areas, natural areas and/or conservation areas occurring within the project boundary. According to NCNEP data, element occurrences of listed species documented within a one -mile radius of the subject property include the Regal Darner (Coryphaeschna ingens) which is state listed as significantly rare. In addition, nine managed areas were identified within one mile of the site. These managed areas included Town of Cary Mills School Park, Town of Cary Open Space, Town of Morrisville Northwest Park, Wake County Greenway OS-034, and five Town of Cary Future Parks. Site Reconnaissance: A site reconnaissance was completed on October 15, 2019. Topographic maps, hydrologic maps, and aerial maps of the tract were reviewed in order to determine areas with the highest likelihood of presenting characteristics marking them as a distinct habitat. Habitats were classified according to vegetation, topography, hydrology, and soil type. Special care was given to identify the potential presence of the regal damer. In addition, data were requested and reviewed again in November 2020. The review resulted in no new NCNHP occurrences. Regal Darner Regal Darner is a small species of dragonfly currently given a State Status of Significantly Rare, most commonly seen in the spring. This species has no federal protection status. Regal Darner habitat includes lakes and slow 4338 Bland Road Raleigh, N.C. 27609 phone 919-875-4288 fax 919-875-4287-8351 1-866-SPANGLER www.spanglerenvironmental.corn flowing streams with heavy vegetation. The subject property does contain slow flowing streams that would roughly fit the description of this species' habitat; however, no individuals were observed during the site visit. Given the fact that the species is not identified as occurring on the subject property, is not federally protected, the accuracy of its finding is very low and historical, and that the species was not observed on the subject property, SEI believes that the species is not present and will, therefore, not be impacted. Conclusions: Based on field observations and the review of available data, SEI did not observe any individual specimens of protected species, nor did we determine there to be a significant likelihood of impacts to transient occurrences of these species, based on habitat evaluation of the subject property. Therefore, no further investigation of the presence of protected species on this tract is recommended at this time. TC5819125.8s Page 53 of 70 WETLANDS CLASSIFICATION SYSTEM National Wetland Inventory Maps are produced by the U.S. Fish and Wildlife Service, a sub -department of the U.S. Department of the Interior. In 1974, the U.S. Fish and Wildlife Service developed a criteria for wetland classification with four long range objectives: to describe ecological units that have certain homogeneous natural attributes, to arrange these units in a system that will aid decisions about resource management, to furnish units for inventory and mapping, and to provide uniformity in concepts and terminology throughout the U.S. High altitude infrared photographs, soil maps, topographic maps and site visits are the methods used to gather data for the productions of these maps. In the infrared photos, wetlands appear as different colors and these wetlands are then classified by type. Using a hierarchical classification, the maps identify wetland and deepwater habitats according to: system subsystem class subclass modifiers (as defined by Cowardin, et al. U.S. Fish and Wildlife Service FWS/OBS 79/31. 1979.) The classification system consists of five systems: 1. marine 2. estuarine 3. riverine 4. lacustrine 5. palustrine The marine system consists of deep water tidal habitats and adjacent tidal wetlands. The riverine system consists of all wetlands contained within a channel. Thelacustrine systems includes all nontidal wetlands related to swamps, bogs & marshes. The estuarine system consists of deepwater tidal habitats and where ocean water is diluted by fresh water. The palustrine system includes nontidal wetlands dominated by trees and shrubs and where salinity is below .5% in tidal areas. All of these systems are divided in subsystems and then further divided into class. National Wetland Inventory Maps are produced by transferring gathered data on a standard 7.5 minute U.S.G.S. topographic map. Approximately 52 square miles are covered on a National Wetland Inventory map at a scale of 1:24,000. Electronic data is compiled by digitizing these National Wetland Inventory Maps. The spine road was located to provide transportation connectivity to the site, while avoiding stream, buffer and wetland impacts to the maximum extent practicable. In the original design it was located further north to be centered into the proposed development. This would have resulted in approximately twice the impact acreage as proposed. Locating the alignment further south would have added significant amounts of stream and buffer impacts. Other impacts (stream and buffer) were unavoidable based on the design density and resultant location required to provide the necessary return on investment. 4. Your submitted project plans are insufficient. It appears there is proposed rip rap/outlet protection proposed along NC Hwy 55, associated with road widening in this area. The rip rap/outlet protection west of NC 55 widening as shown on Sheet 4/4 is existing and not proposed. At this time it is unclear if outlet protection impacts Stream SIB (as labeled on the JD). Please provide further clarity for this area. No impacts to SIB anticipated by outlet protection. Limited to buffer impacts. Furthermore, please provide plan and profile views of proposed culverted road crossing in order to ensure regional condition 9. is met. See attached plans and below response from our Client regarding condition 9: 9. Culvert Placement. For all NWPs that allow for culvert placement, the following conditions shall be applied: a. For all NWPs that involve the construction/installation of culverts, measures shall be included in the construction/installation that will promote the safe passage of fish and other aquatic organisms Understood. Placement of culverts and other structures in streams shall be below the elevation of the streambed by one foot for all culverts with a diameter greater than 48 inches, and 20% of the culvert diameter for culverts having a diameter less than or equal to 48 inches. If the culvert outlet is submerged within a pool or scour hole and designed to provide for aquatic passage, then culvert burial into the streambed is not required. Culvert burial is not required for structures less than 72 inch diameter/width, where the slope of the culvert will be greater than 2.5%, provided that all alternative options for flattening the slope have been investigated and aquatic life movement/connectivity has been provided when possible (e.g., rock ladders, cross vanes, sills, baffles etc.). Culvert burial is not required when bedrock is present in culvert locations. This condition does not apply to culvert under Lunar Walk Drive. Culvert is not placed in a stream. Installation of culverts in wetlands shall ensure continuity of water movement and be designed to adequately accommodate high water or flood conditions. When roadways, causeways, or other fill projects are constructed across FEMA- designated floodways or wetlands, openings such as culverts or bridges shall be provided to maintain the natural hydrology of the system as well as prevent constriction of the floodway that may result in destabilization of streams or wetlands. This is a concern because the land owner wants to fill all the remaining wetlands upstream of this impact. A waiver from the depth specifications in this condition may be requested, in writing, by the permittee and issued by the Corp. This waiver request must be specific as to the reasons(s) for the request. The waiver will be issued if it can be demonstrated that the proposed design would result in less impacts to the aquatic environment. Culverts placed across wetland fills purely for the purposes of equalizing surface water do not have to be buried, but the culverts must be of adequate size and/or number to ensure unrestricted transmission of water. I did not see a depth requirement for culverts in wetlands b. Bank -full flows (or less) shall be accommodated through maintenance of the existing bank -full channel cross sectional area. Additional culverts or culvert barrels at such crossings shall be allowed only to receive bank -full flows. I do not believe this condition applies. c. Culverts shall be designed and installed in such a manner that the original stream profiles are not altered and allow for aquatic life movement during low flows. The dimension, pattern, and profile of the stream above and below a pipe or culvert shall not be modified by widening the stream channel or by reducing the depth of the stream in connection with the construction activity. The width, height, and gradient of a proposed culvert shall be such as to pass the average historical low flow and spring flow without adversely altering flow velocity. If the width of the culvert is wider than the stream channel, the culvert shall include multiple boxes/pipes, baffles, benches and/or sills to maintain the natural width of the stream channel. If multiple culverts/pipes/barrels are used, low flows shall be accommodated in one culvert/pipe and additional culverts/pipes shall be installed such that they receive only flows above bankfull. No stream. 91 5. Although a large downstream portion of stream SD was avoided for the construction of SCM #1, it appears that the construction of SCM #1 will remove/redirect downstream flow away from the remaining portion of stream SD. Please provide further information regarding the potential for loss of function due to secondary and cumulative effects to this stream area. Should it be determined that a loss of function will occur from your analysis mitigation will be required, and should be included in your final compensatory mitigation plan. While ephemeral flow in response to storm events will be directed through/stored within SCM 1, the stream's connection to the water table and, thereby, its jurisdictional status and function will not be impacted by the proposed project. In fact, by holding ephemeral flows within SCM 1 and up -slope of the un-impacted portion of the intermittent stream, groundwater volume and elevation are both likely to increase, which will result in additional flows and resultant function within the stream's unimpacted reach. The Corps of Engineers believes that there may be jurisdictional aquatic resources in the review area, and the requestor of this PJD is hereby advised of his or her option to request and obtain an approved JD (AJD) for that review area based on an informed decision after having discussed the various types of JDs and their characteristics and circumstances when they may be appropriate. 2. In any circumstance where a permit applicant obtains an individual permit, or a Nationwide General Permit (NWP) or other general permit verification requiring "pre- construction notification" (PCN), or requests verification for a non -reporting NWP or other general permit, and the permit applicant has not requested an AID for the activity, the permit applicant is hereby made aware that: (1) the permit applicant has elected to seek a permit authorization based on a PJD, which does not make an official determination of jurisdictional aquatic resources; (2) the applicant has the option to request an AID before accepting the terms and conditions of the permit authorization, and that basing a permit authorization on an AJD could possibly result in less compensatory mitigation being required or different special conditions; (3) the applicant has the right to request an individual permit rather than accepting the terms and conditions of the NWP or other general permit authorization; (4) the applicant can accept a permit authorization and thereby agree to comply with all the terms and conditions of that permit, including whatever mitigation requirements the Corps has determined to be necessary; (5) undertaking any activity in reliance upon the subject permit authorization without requesting an AID constitutes the applicant' s acceptance of the use of the PJD; (6) accepting a permit authorization (e.g., signing a proffered individual permit) or undertaking any activity in reliance on any form of Corps permit authorization based on a PJD constitutes agreement that all aquatic resources in the review area affected in any way by that activity will be treated as jurisdictional, and waives any challenge to such jurisdiction in any administrative orjudicial compliance or enforcement action, or in any administrative appeal or in any Federal court; and (7) whether the applicant elects to use either an AID or a PJD, the JD will be processed as soon as practicable. Further, an AJD, a proffered individual permit (and all terms and conditions contained therein), or individual permit denial can be administratively appealed pursuant to 33 C.F.R. Part 33 1. If, during an administrative appeal, it becomes appropriate to make an official determination whether geographic jurisdiction exists over aquatic resources in the review area, or to provide an official delineation of jurisdictional aquatic resources in the review area, the Corps will provide an AJD to accomplish that result, as soon as is practicable.
