Everhart, CWB Southeastern Permit Coordinator Habitat Conservation Program Date: July 26, 2007 RE: Kings Grant Club - Lionshead Condominiums, 404/401 Application, Public Notice USACE AID# 2000-671-026, Cumberland County Biologists with the North Carolina Wildlife Resources Commission (NCWRC) have reviewed the subject application for impacts to wildlife and fishery resources. Our comments are provided in accordance with provisions of the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661 et. seq.), and Sections 401 and 404 of the Clean Water Act (as amended). The project is located adjacent to McPherson Creek (College Lake) and approximately one mile west of the intersection of US 401 and Shawcroft Rd. in Fayetteville. The site is surrounded by residential subdivisions, a golf course, and forested land. The applicant proposes to expand an existing residential subdivision by constructing four multi- family buildings and access/parking. This would require impacts to approximately 0.17 acre of wetlands in addition to 0.71 acre that was previously impacted. No mitigation for these impacts is offered. The directional bore method should be used for utility crossings wherever practicable. These should begin and end outside the 100 yr floodplain or the forested buffer, whichever is greater. 3. We recommend that all remaining wetlands on-site are to be preserved through conservation easement/deed restriction using language consistent with U. S. Army Corps of Engineers (USAGE) guidelines for the preservation of wetlands. It is not clear from the application if any of the wetlands on this site are a part of the 10.42 acres of wetlands that had previously been offered in preservation as mitigation for expansion of the single-family portion of the subdivision in March 2007.
