November 4, 2013 Ms. Tasha McCormick USACE Asheville Regulatory Field Office 151 Paton Ave, Rm 208 Asheville, NC 28801 -5006 RE: Thorns Estate Residential Development Buncombe County, NC Permit Modification Dear Ms McCormick: 3764 Rominger Rd Banner Elk, NC 28604 Ph: 828 - 297 -6946 Fax: 828-297-1982 e -mail: wccJv @skybest.com The purpose of this letter is to request a permit modification for the referenced project. The modification requested involves a net reduction in wetland impact of approximately 25 sq. -ft., although, due to rounding, the revised wetland impact table in the PCN reflects no change in total impact. Changes needed at two locations are the cause of this request. There are no changes to permitted stream impacts associated with this modification. The specific changes associated with this request are as follows: 1. Impact to wetland W -5 eliminated: The proposed road layout in the northern portion of the site has been modified to eliminate approximately 400 linear feet of subdivision road. The proposed lot configuration in this area has also been modified resulting in the loss of one lot and a slight increase in the size of several lots. The change to the road layout eliminates two loops, providing instead two dead -end streets with turn -a- rounds. As a result of these changes the impact to wetland W -5 has been eliminated and the area surrounding W -5 is now a common area. Wetland W -5 is approximately 360 sq. -ft. The impacts to W -5 had been permitted under NWP -29. 2. New impact to wetland W -7: There have not been any major changes to roads or other infrastructure in the vicinity of wetland W -7. The proposed modification is necessary because of discrepancies between design topo and actual field conditions in this area. As the final layout and construction staking was done in this area it was discovered that to provide the required 3:1 slopes below Rain - Garden #1, there would be some impact to Wetland W -7. The proposed quantity of new impact will be 335 sq. -ft. This new impact will need to be permitted under NWP -18 as the fill slopes are associated with a stormwater management BMP. Attached are the following maps and documents supporting this request: 1. Existing site plan dated 2 -28 -13 from original PCN 2. Proposed Modified Site Plan dated 11 -4 -13 showing road and lot changes in northern part of site 3. Revised Impact Area Map showing eliminated impact W4 and new impact W5 4. Impact Map for new wetland impact W5 5. Revised sheet 8 of 15 from the PCN showing proposed impact changes • Page 2 Summary November 4, 2013 The current permit modification request is to: • Eliminate Impact W4 (wetland unit 5) 360 sq.ft. (0.008 acres) permitted under NWP -29 • Add new Impact W5 (wetland unit 7) 335 sq.ft. (0.008 acres) using NWP -18 • Proposed Permanent NWP -29 impacts = 0.046 acres (previous = 0.054 ac) • Proposed Permanent NWP -18 impacts = 0.035 acres (previous = .027 ac) • Proposed Total wetland impacts = 0.082 (previous = 0.082 acres) ** both include 0.001 acres of temporary impact If you need to schedule a site visit please contact me.
