Dear Mr. Breslow:
This correspondence is in reference to the Cape Fear 02 Umbrella Mitigation Bank,
Cloud and Banner Mitigation Site. The site includes unnamed tributaries in the Black
Creek watershed, Cataloging Unit (03030002) and is located at 2209 N. NC Highway
119, in Mebane, Alamance County, North Carolina. The purpose of this letter is to
transmit comments provided by the NC Interagency Review Team (NCIRT) during the
review of the monitoring report (see attached) and to confirm the Year 2 credit release for
this mitigation site.
Pursuant to the Mitigation Banking Instrument (UMBI) entitled, Agreement to Establish
the RES Cape Fear 02 Umbrella Mitigation Bank in the Cape Fear River Basin within the
state of North Carolina, approved February 9, 2018; the site -specific Cloud and Banner
Stream and Wetland Site Final Mitigation Plan (Plan), approved April 16, 2019; and the
Cloud and Banner Mitigation Project Year 2 Monitoring Report of September 2021, 10
percent of the site's total restoration and enhancement credits shall be available for sale
provided the Year 2 monitoring report demonstrates interim performance standards are
being met.
Based on a review of the data provided for the stream restoration on the site, we
confirm that you have satisfied the above requirements for the Year 2 Monitoring credit
release, and 412.5 warm water stream mitigation units (SMUs) and 0.72 riparian wetland
mitigation units (WMUs) are now available for sale. To date, 2,175.6 SMUs and 4.6
WMUs (50 percent of the total enhancement and restoration credits and 100% of the
preservation credits) and have been released for sale.

Please review the comments provided by the NCIRT during their review of the
monitoring report. While it is not necessary to provide a response to specific comments
at this time, please be sure to address the issues raised in future monitoring report
submittals.

1. Please make sure to keep up with management of the beaver on site.
2. Gauge AW3 has not met the performance standard for either the 1 st or 2nd year —
I recommend placing another gauge in the SE portion of Wetland WB to better
cover the area.
Erin Davis, NCDWR:
1. What species were used in the January 2021 supplemental planting effort?
2. Figure 2 CCPV — Moving forward, please callout beaver dam removal
locations.
3. Groundwater Gauge AW12 Graph — It would be helpful to have a callout for
the consecutive date range given how close to the 12-inch threshold the data
line is.
4. A few supplemental winter photos could be helpful in showing stream features
stability/development.
