Phil -
With all the traffic backups around that area due to the road construction on Market Street, I may not have a chance to
inspect anytime soon. I may have to save that trip for a weekend - if I happen to go to Lowes, I can stop by on the way
back home on a Saturday or Sunday, if the owners would be OK with that.
Also, in order to modify the plan, I need for Mr. Cone to sign and submit a plan revision application. You can obtain a
blank copy of that form from our website at http://portal.ncdenr.org/web/ir/state-stormwater-forms dots
The permit will first be transferred by entering the new owner into the database and "issuing" the permit. Then I can
enter the plan revision the next day and issue that approval. The new owner will be getting a transferred permit that
includes the approved plan revisions.

• Plan has been revised to show the building addition of 587 sf as well as the
removal of 587 sf of concrete sidewalk resulting in no net change in
impervious area. Two copies of the revised plan are enclosed.
• All work has been completed on the site. Please re -inspect for compliance.
• Engineer's certification for stormwater is enclosed.

I respond herein to your letter to Mr. Valentino dated March 26, 2014, a copy of which you
forwarded to me. I also acknowledge herein our telephone conversation from last Wednesday, April 2.
In our conversation, I stated to you that even though the Stormwater Permit had not yet been
transferred to us, as Vice —President of Blue Gem, Inc., the new owner of the subject property, 1 felt
somewhat responsible for the confusion and delay in not responding to your November 4, 2013 letter to
Mike Valentino which addressed the site's deficiencies.
Be assured that following our conversation, I consulted with Phil Tripp, PE. He is now retained by
Blue Gem, Inc. to address DENR's concerns and to help us bring the property back into compliance. As
soon as they are available, I will provide to you Tripp Engineering's plans allowing for the additional 600
sq. ft. of sidewalk/impermeable surface area, and showing the located small diameter orifice pipe.

On November 4, 2013, the Wilmington Regional Office of DEMLR inspected Porters Neck South
Plaza in New Hanover County to determine the status of compliance with the State Stormwater
Management Permit Number SW8 991201 originally issued on May 26, 2000, and as
subsequently renewed on September 22, 2009. DEMLR notified you on November 6, 2013, of
the site's deficiencies.
On February 7, 2014, the Division received the completed Name/Ownership Change form for
the transfer of the permit to Blue Gem, Inc. However, I have not received any information from
the consultant or from you regarding these deficiencies listed in the Inspection Report:
1. The permit needs to be modified to deal with the 600 additional square feet of building
2. The inlet end of the small diameter orifice pipe could not be located.
Your letter of December 4, 2013, indicates that the retaining wall is in the process of being
redesigned and restored; but questions the observation that an additional 600 square feet of
building has been constructed. I enclose a photocopy sketch from the May 24, 2000 approved
plans for your review. The pink highlighted area depicts the additional building that was
originally intended to be just an open grassed area. I think the original building construction did
not conform to the approved plan, and that is why you are under the belief that the building size
has never changed. It was already out of compliance when you took over the project, but the
September 18, 2009 inspection did not note this discrepancy.
1 do not think it will be a problem for your consultant to check the pond's capacity due to the
addition of 600 square feet of impervious area. A preliminary evaluation of the wet detention
pond indicates that the required minimum surface area is just a few square feet more than
what's been provided and there is more than enough volume to accommodate the increase. To
date, the consultant has not submitted any information regarding whether or not the
maintenance to uncover the orifice has been completed.
Please submit the requested information before April 26, 2014, to continue with the transfer of
this permit. If Mr. Cone desires to address the compliance issues after the permit is transferred,
please have Mr. Cone provide a signed statement indicating his willingness to deal with the
compliance issues after the permit is transferred to Blue Gem, Inc. Failure to provide the
requested information, or to respond to this letter by the due date, may initiate enforcement
action including the assessment of civil penalties of up to $25,000 per day. I am available to
conduct a follow-up inspection when the compliance issues have been addressed.

Hello Mrs. Lewis,
I hope you are doing well. I am writing you in response to your letter
dated November 6 in regards to the property located at 7979 Market St,
Wilmington, NC. The Gold's Gym Porter's Neck location. I did leave a
voicemail for you a couple weeks ago, I hope you received it.
1 am the manager of&•v properties and the owner of the gyn.. As your
letter stated, we are in the process of selling the property to another
local gentleman and thru his due diligence process we have discovered
some of the issues that are being addressed. Currently Chris Holmes
engineering is finalizing a drawing for the new wall, along with
addressing the parking lot sloping for the correct run off and finally
along with Phillip Tripp the retention pond issues. I was hoping to have
the plans/drawings completed to send to you to show the process is in
effect. They are still not quit complete yet so hopefully anytime now
they will be.
In your letter you outlined 3 items, number 2 1 am confused about. It
mentions an additional 600 Sq. foot of building. The building size has
never changed, it's the same building that was there from the
beginning. Please let me know where that information has come from.
Please let me know if along with this letter what other steps I need to
be taking to be sure we are complying with this processes and Mr. Steve
Cone (buyer) and myself would like to meet you on site when you are
available to be sure we are on the right path of resolution.

It was a pleasure speaking to you this morning regarding the subject project. This is the link to our website and to the
Name/Ownership Change Form we talked about:

Please click on the "Application Forms and Documents" link, then on "Miscellaneous Forms' in the green tab at the top,
then on the first "Name/Ownership Change" form. The second one in that list is only for use by a permittee who is trying
to transfer a subdivision permit to the HOA under Chapter 47F the Planned Community Act.
After the inspection this afternoon, I will complete the Inspection Report documenting the findings of the inspection and
email it to you. The original will be sent to the current permittee (I & V Properties, LLQ for their records. Any
deficiencies will need to be resolved before the Division will approve the transfer. The 2 parties can negotiate an
agreement or the proposed permittee can accept the permit and the project "as is". In the latter case, the Division will
work with the proposed permittee to get the deficiencies resolved after the permit is transferred.
