Dear Mr. Caldwell:
The Wilmin.9ton Regional Office received a complete, modified Stormwater Management
Permit Application for Clear Water Place at Winding River on January 30, 2007. Staff review
of the plans and specifications has determined that the project, as proposed, will comply with
the Stormwater Regulations set forth in Title 15A NCAC 2H.1000. We are forwarding Permit
No. SW8 970936 dated January 30, 2007, for the construction of the subject project.
This permit shall be effective from the date of issuance until January 30, 2017, and shall be
subject to the conditions and limitations as specified therein. Please pay special attention to
the Operation and Maintenance requirements in this permit. Failure to establish an adequate
system for operation and maintenance of the stormwater management system will result in
future compliance problems.
If any parts, requirements, or limitations contained in this permit are unacceptable, you have
the right to request an adjudicatory hearing upon written request within sixty (60) days
following receipt of this permit. This request must be in the form of a written petition,
conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of
Administrative Hearings, P.O. Drawer 27447, Raleigh, NC 27611-7447. Unless such demands
are made this permit shall be final and binding.

construction, operation and maintenance of a wet detention pond in compliance with
the provisions of 15A NCAC 2H .1000 (hereafter referred to as the "stormwater rules')
and the approved stormwater management plans and specifications and other
supporting data as attached and on file with and approved by the Division of Water
Quality and considered a part of this permit.
This permit shall be effective from the date of issuance until January 30, 2017, and
shall be subject to the following specified conditions and limitations:
I. DESIGN STANDARDS
This permit is effective only with respect to the nature and volume of stormwater
described in the application and other supporting data.
2. This stormwater system has been approved for the management of stormwater
runoff as described in Section 1.6 on page 3 of this permit. The stormwater
control has been designed to handle the runoff from 237,576 square feet of
impervious area.
3. The tract will be limited to the amount of built -upon area indicated on page 3 of
this permit, and per approved plans. The built -upon area for the future
development within Phase I onsite is 882 ft .
4. All stormwater collection and treatment systems must be located in either
dedicated common areas or recorded easements. The final plats for the project
will be recorded showing all such required easements, in accordance with the
approved plans.
5. The runoff from all built -upon area within the permitted drainage area of this
project must be directed into the permitted stormwater control system.

II. SCHEDULE OF COMPLIANCE

1. The stormwater management system shall be constructed in its entirety,
vegetated and operational for its intended use prior to the construction of any
built -upon surface.
2. During construction, erosion shall be kept to a minimum and any eroded areas of
the system will be repaired immediately.
3. The permittee shall at all times provide the operation and maintenance
necessary to assure the permitted stormwater system functions at optimum
efficiency. The approved Operation and Maintenance Plan must be followed in
its entirety and maintenance must occur at the scheduled intervals including, but
not limited to:
a. Semiannual scheduled inspections (every 6 months).
b. Sediment removal.
C. Mowing and revegetation of slopes and the vegetated filter.
d. Immediate repair of eroded areas.
e. Maintenance of all slopes in accordance with approved plans and
specifications.
f. Debris removal and unclogging of outlet structure, orifice device, flow
spreader, catch basins and piping.
g. Access to the outlet structure must be available at all times.
4. Records of maintenance activities must be kept and made available upon
request to authorized personnel of DWQ. The records will indicate the date,
activity, name of person performing the work and what actions were taken.
5. The facilities shall be constructed as shown on the approved plans. This permit
shall become void unless the facilities are constructed in accordance with the
conditions of this permit, the approved plans and specifications, and other
supporting data.

6. If the stormwater system was used as an Erosion Control device, it must be
restored to design condition prior to operation as a stormwater treatment device,
and prior to occupancy of the facility.
7. Decorative spray fountains will be allowed in the stormwater treatment system,
subject to the following criteria:
a. The fountain must draw its water from less than 2' below the permanent
pool surface.
b. Separated units where the nozzle, pump and intake are connected by
tubing, may be used only if they draw water from the surface in the
deepest part of the pond.
c. The falling water from the fountain must be centered in the pond, away
from the shoreline.
d. The maximum horsepower for a fountain in this pond is listed in Section
1.6 (1) of this permit.
8. Upon completion of construction, prior to issuance of a Certificate of Occupancy,
and prior to operation of this permitted facility, a certification must be received
from an appropriate designer for the system installed certifying that the permitted
facility has been installed in accordance with this permit, the approved plans and
specifications, and other supporting documentation. Any deviations from the
approved plans and specifications must be noted on the Certification. A
modification may be required for those deviations.
9. Access to the stormwater facilities shall be maintained via appropriate
easements at all times.
10. The permittee shall submit to the Director and shall have received approval for
revised plans, specifications, and calculations prior to construction, for any
modification to the approved plans, including, but not limited to, those listed
below:
a. Any revision to any item shown on the approved plans, including the
stormwater management measures, built -upon area, details, etc.
b. Project name change.
C. Transfer of ownership.
d. Redesign or addition to the approved amount of built -upon area or to the
drainage area.
e. Further subdivision, acquisition, lease or sale of all or part of the project
area. The project area is defined as all property owned by the permittee,
for which Sedimentation and Erosion Control Plan approval or a CAMA
Major permit was sought.
f. Filling in, altering, or piping of any vegetative conveyance shown on the
approved plan.
11. The permittee shall submit final site layout and grading plans for any permitted
future areas shown on the approved plans, prior to construction.
12. A copy of the approved plans and specifications shall be maintained on file by
the Permittee for a minimum of ten years from the date of the completion of
construction.
13. The Director may notify the permittee when the permitted site does not meet one
or more of the minimum requirements of the permit. Within the time frame
specified in the notice, the permittee shall submit a written time schedule to the
Director for modifying the site to meet minimum requirements. The permittee
shall provide copies of revised plans and certification in writing to the Director
that the changes have been made.

III. GENERAL CONDITIONS
This permit is not transferable except after notice to and approval by the Director.
In the event of a change of ownership, or a name change, the permittee must
submit a formal permit transfer request to the Division of Water Quality,
accompanied by a completed name/ownership change form, documentation
from the parties involved, and other supporting materials as may be appropriate.
The approval of this request will be considered on its merits and may or may not
be approved. The permittee is responsible for compliance with all permit
conditions until such time as the Division approves the transfer request.
Failure to abide by the conditions and limitations contained in this permit may
subject the Permittee to enforcement action by the Division of Water Quality, in
accordance with North Carolina General Statute 143-215.6A to 143-215.6C.
3. The issuance of this permit does not preclude the Permittee from complying with
any and all statutes, rules, regulations, or ordinances, which may be imposed by
other government agencies (local, state, and federal) having jurisdiction.
4. In the event that the facilities fail to perform satisfactorily, including the creation
of nuisance conditions, the Permittee shall take immediate corrective action,
including those as may be required by this Division, such as the construction of
additional or replacement stormwater management systems.
5. The permittee grants DENR Staff permission to enter the property during normal
business hours for the purpose of inspecting all components of the permitted
stormwater management facility.
6. The permit may be modified, revoked and reissued or terminated for cause. The
filing of a request for a permit modification, revocation and reissuance or
termination does not stay any permit condition.
7. Unless specified elsewhere, permanent seeding requirements for the stormwater
control must follow the guidelines established in the North Carolina Erosion and
Sediment Control Planning and Design Manual.
8. Approved plans and specifications for this project are incorporated by reference
and are enforceable parts of the permit.
9. The permittee shall notify the Division in writing of any name, ownership or
mailing address changes within 30 days.

IV. DEED RESTRICTIONS AND PROTECTIVE COVENANTS
The following italicized deed restrictions and protective covenants are required to be recorded for all
subdivisions, outparcels and future development prior to the sale of any lot. If lot sizes vary significantly, a
table listing each lot number, size and the allowable built -upon area for each lot must be provided as an
attachment.
1. The following covenants are intended to ensure ongoing compliance with state stormwater management permit
number as issued by the Division of Water Quality. These covenants may
not be changed or deleted without the consent of the State.
2. No more than square feet ofany lot shall be covered by structures or impervious materials.
Impervious materials include asphalt, gravel, concrete, brick, stone, slate or similar material but do not include
wood decking or the water ,surface ofswimming pools.
3. Swales shall not be filled in, piped, or altered except as necessary to provide driveway crossings.
4. Built -upon area in excess of the permitted amount requires a state stormwater management permit modification
prior to construction.
5. All permitted runoff from outparcels or future development shall be directed into the permitted stormwater control
system. These connections to the stormwater control system shall be performed in a manner that maintains the
integrity and performance of the system as permitted.
By your signature below, you certify that the recorded deed restrictions and protective covenants for this project
shall include all the applicable items required above, that the covenants will be binding on all parties and persons
claiming under them, that they will run with the land, that the required covenants cannot be changed or deleted
without concurrence from the State, and that they will be recorded prior to the sale of any lot.

Phase II and the Amenity Center as 4.55 acres, 3.96 acres, and 1.54
acres. When you add them all up, the total DA to the pond is 10.05
acres, however, the revised calculations submitted on January 25, 2007,
only use a drainage area of 8.85 acres. Please revise the calculations
to reflect the correct DA to the pond of 10.0E acres. This is the only
outstanding item. The permit has been drafted and upon receipt of the
revised, signed, sealed and dated calculations, the permit will be
issued. To save time, please either attach the revised calculations to
an email, or fax them to me.

2. The individual built upon areas for Phase I, Phase II and the Clubhouse are
provided separately, one column for each referenced area, on page 2 of the
enclosed stormwater management permit application form.
3. A revised, signed, dated and notarized wet detention basin supplement form is
enclosed.
4. The total built upon area for all three columns on page 2 of the stormwater

This project has become quite complicated. Please see my attached review comments.
Essentially, I.cannot knowingly write a permit for Clearwater Place Townhomesto
Bluegreen Carolina since they do NOT own the pond. Apparently, Stonebridge Homes,
which is the developer for Phase 2 of Clearwater Townhomes, bought the Phase 2
property AND the -pond property. They were completely unaware of the existing
stormwater permit for Clearwater. So, I advise that Stonebridge Homes continue with
their application for Phase 2 of Clearwater showing Phase 1 of Clearwater and the
POA Clubhouse as "Offsite" projects.
Bluegreen will need to amend their current application to an offsite project to
cover Phase 1 of Clearwater.
The POA Clubhouse doesn't have to do anything until the mess at. Clearwater is
resolved.
Hard copies of the attached letter will be sent out today.

Dear Mr. Dorm:
The Wilmington Regional Office received a letter from your consultant requesting that your
application to develop the second phase of Clearwater Townhomes be placed on hold pending
the issuance of the permit modification to Bluegreen Carolina Land, LLC, for the additional
offsite Clubhouse runoff. Unfortunately, the Division will be unable to issue a permit
modification to Bluegreen Carolina Land, LLC, if Stonebridge Carolina Homes, LLC, is the true
owner of the Clearwater Townhomes pond. The following information is needed to continue
the stormwater review:
As the true owners of the Clearwater Townhomes pond, the permit application from
Bluegreen Carolina Land, LLC, should be revised to an offsite application. You
should continue with your permit application to transfer the wet detention pond
permit for Clearwater Townhomes into your name and to receive approval to
construct Phase 11. The existing Phase I and the Clubhouse would be considered as
offsite projects.
2. The rules allow only the designated manager or member/manager of an LLC to sign
the permit application. Your signature as the registered agent can be accepted only
if accompanied by a signed letter of authorization from one of the aforementioned
parties, which authorizes you to sign the application on behalf of Stonebridge
Carolina Homes, LLC. The NC Secretary of State has a J. Mark Caldwell listed as
the current manager of this LLC.
3. The handwriting on the application is very unclear, especially where it asks for the
applicant's name. Please either print clearly, or preferably, type in the requested
information.
4. The drainage area columns on the application are to be completed, one for each
proposed treatment device. Since there is only one pond being utilized for treatment
of this runoff, please condense the 18 individual drainage areas your consultant has
provided on the application into one. Additionally, a portion of the adjacent Property
Owner's Clubhouse, and the existing Phase I Clearwater Townhome development
will be permitted as "offsite" projects to drain into the Clearwater pond. This is the
subject of the current modification that is being done by ESP Associates. The BUA
associated with the clubhouse (39,438 ftz) and the BUA associated with Phase I of
Clearwater Townhomes (?) will need to be reported in the "offsite" box on your
application.

5. The pond design criteria listed on the wet pond supplement form do not
reflect what is currently proposed by ESP Associates. Please submit a
supplement form with the correct pond information.

6. Please dimension all of the proposed built -upon area, including parking areas,
buildings and sidewalks.
7. Please add the nearest intersection of two major roads to the vicinity map. A
major road is any 1, 2 or 3 digit NC, US or interstate highway. Ideally, the
vicinity map should be geared toward driving to the site from Wilmington.
8. Please specify the width of the vegetated shelf and provide a list of the
wetlands species to be planted on the shelf.
9. Please locate, label and provide a detail of the outlet structure including
permanent pool and temporary pool elevations, overflow elevation, and orifice
diameter.
Please note that this request for additional information is in response to a preliminary
review. The requested information should be received in this Office prior to February 3,
2007, or the application will be returned as incomplete. The return of a project will
necessitate resubmittal of all required items, including the application fee.
If you need additional time to submit the information, please mail or fax your request for
a time extension to the Division at the address and fax number at the bottom of this
letter. The request must indicate the date by which you expect to submit the required
information.
The construction of any impervious surfaces, other than a construction entrance under
an approved Sedimentation Erosion Control Plan, is a violation of NCGS 143-215.1 and
is subject to enforcement action pursuant to NCGS 143-215.6A.
Please reference the State assigned project number on all correspondence. Any
original documents that need to be revised have been sent to the engineer or agent. All
original documents must be returned or new originals must be provided. Copies are not
acceptable. If you have any questions concerning this matter please feel free to call me

Dear Ms. Lewis
I am sending this letter as a representative for Stonebridge Carolina homes, LLC. This is in response to
your request for information sent Dec. 7, 2006.
Stonebridge is the current owner of the "phase 11" portion of the Clearwater Townhomes Project, and
associated lands, which includes the stormwater pond. Stonebridge was unaware that the existing
stormwater plan and construction was not certified by engineering. As such, a permit application ( SW8
97036 ) was presented as a new permit, with the associated "existing" offsite flows from the developed
areas utilizing the same stormwater pond.
At this point, Stonebridge is requesting that we proceed in the following manner. We allow ESP
Associates to finish their certification of the existing stormwater system. However, Stonebridge does not
wish to have the additional clubhouse flows included in this certification. This will give Stonebridge a
clear accounting of existing stormwater flows to the pond on the land that they purchased.
When the Certification/Mod is accepted by DWQ, we will then submit a new permit request for the Phase
11 property allowing for the offsite flows from the existing certified system. The offsite flows from the
clubhouse will be considered on the Stonebridge permit. Also, Stonebridge does not wish to accept any
offsite flows other than the existing flows ( those certified by ESP ) and any flows indicated on the
Stonebridge applications. Thus, all flow rates, timing, and volumes from the clubhouse will need to be
provided to J W Huggins Engineering and Surveying if they are to be considered for the Stonebridge
Stormwater Pond. A request will be sent to Brad Sedgewick, P.E. to obtain such information.
As such, we are requesting that the Stonebridge Application be put on hold until the ESP certification is
accepted. At such time we will obtain a copy of the certified existing system and would ask for 2 weeks
after that point to resubmit.

The Wilmington Regional Office received a Stormwater Management Permit Application for
Clearwater Townhomes @Winding River on November 15, 2006. A preliminary review of that
information has determined that the application is not complete. The following information is
needed to continue the stormwater review:
The Division has already received and reviewed a permit modification for this
project from Bluegreen Carolina Land, LLC. It is not possible to process a permit
modification for the same project to 2 different owners. Please get with Bluegreen
Carolina Land to discuss this matter and coordinate your applications into one. If
Stonebridge Carolina Homes, LLC, has purchased the second phase of the
townhome project from Bluegreen Carolina Land, LLC, then you will need to
apply for a new offsite permit.
2. The rules allow only the designated manager or member/manager of an LLC to
sign the permit application. Your signature as the registered agent can be
accepted only if accompanied by a signed letter of authorization from one of the
aforementioned parties, which authorizes you to sign the application on behalf of
Stonebridge Carolina Homes, LLC. The NC Secretary of State has a J. Mark
Caldwell listed as the current manager of this LLC.
3. The handwriting on the application is very unclear, especially where it asks for
the applicant's name. Please either print clearly, or preferably, type in the
requested information.
4. The drainage area columns on the application are to be completed, one for each
proposed treatment device. Since there is only one pond being utilized for
treatment of this runoff, please condense the 18 individual drainage areas your
consultant has provided on the application into one. Additionally, a portion of the
adjacent offsite Property Owner's Clubhouse will be permitted to drain into the
Clearwater pond. This is the subject of the current modification that is being done
by ESP Associates. The BUA associated with the clubhouse (39,438 ft2) will
need to be reported in the "offsite" box on your application.
5. The pond design criteria listed on the wet pond supplement form do not reflect
what is currently proposed by ESP Associates. Please get together and submit
one application to cover all the proposed changes to this pond and the tl

Please add the nearest intersection of two major roads to the vicinity map.
A major road is any 1, 2 or 3 digit NC, US or interstate highway. Ideally,
the vicinity map should be geared toward driving to the site from
Wilmington.
Please specify the width of the vegetated shelf and provide a list of the
wetlands species to be planted on the shelf.
Please locate, label and provide a detail of the outlet structure including
permanent pool and temporary pool elevations, overflow elevation, and
orifice diameter.
Please note that this request for additional information is in response to a preliminary
review. The requested information should be received in this Office prior to January 7,
2007, or the application will be returned as incomplete. The return of a project will
necessitate resubmittal of all required items, including the application fee.

was submitted as required by the North Carolina Sedimentation Pollution Control Act (G.S. 113A-57 (4)).
The Act requires that all persons disturbing an area of one or more acres of land must obtain approval
of a soil erosion control plan prior to the commencement of the land -disturbing activity (G.S. 113A-54(d) (4)).
The Act further states that this plan must be filed a minimum of 30 days prior to the activity and the approving
authority must approve or disapprove the submitted plan within 30 days of receipt. Failure of the approving
authority to approve or disapprove the submitted plan within the 30-day period will be deemed approval of the
plan.
Commencement or continuation of a land -disturbing activity under the jurisdiction of this Act prior to
the approval of an erosion and sediment control plan is a violation of the Act.
We have performed a preliminary review of your submitted plan and have determined that additional

The Wilmington Regional Office received a modified Stormwater Management Permit
Application for Clear Water Place @Winding River on November 7, 2006, with a scheduled
Express Review date of November 9, 2006. A preliminary review of that information has
determined that the application is not complete. The following information is needed to
continue the stormwater review:
The fee for new and modified high density Express permits is $4000.00. Please
either submit a new check for the full amount, or submit another check for
$2000.00.
There is a discrepancy between the amount of built -upon area allotted to the
POA Clubhouse under this application (25,922 sq. ft.) and the amount that has
been reported on the pending offsite POA Clubhouse application (39,438 sq. ft.)
under SW8 990543. Additionally, the offsite supplement form that was submitted
with the POA Clubhouse application indicates that the total amount of built -upon
area draining to this pond from the POA Clubhouse is 48,905 sq. ft.
Please list the built -upon area for the POA Clubhouse in the box marked "Offsite"
in the lower half of Section 111.6 on page 2 of the application.
4. Please add the mailbox area to the revised plans. An inspection report was
issued on June 9, 2003, indicating that the mailbox area was not shown on the
approved plans. My understanding of the reason for this modification was to
accommodate the increased BUA from the POA Clubhouse and to revise the
plans to add the mailbox area.
Please note that this request for additional information is in response to a preliminary review.

NARRATIVE
SITE DESCRIPTION:
The site is an existing 8.85-acre tract. The tract is bounded by Goley Hewitt Road
and a golf course to the west, residential uses to the east and north, and a clubhouse with
amenities to the south. All runoff from the site drains to an unnamed tributary to
Lockwoods Folly River (SC) and the Cape Fear River. There are no wetlands located in
the proposed project area.
PROJECT DESCRIPTION:
The project is an existing residential condominium community with asphalt parking
and access previously permitted as a high density stormwater project. The permit no. is
SW8 970936 and was issued on January 13, 1998. A stormwater detention pond was
constructed for stormwater treatment. Design impervious for the entire site was computed
at 58%. The existing pond has not been certified by the design registered engineer and is
now requiring a modification. ESP Associates, P.A. has conducted an as -built on the
existing pond and periodically observed the condition of the existing pond and outlet
structure. Upon as-builting the existing pond, we have found that the surface area
exceeds the required area, but is not the same as the permitted surface area. Same is
true for the storage volume required and provided. Therefore, a modification to the
existing state stormwater management permit is required. We have revised the wet
detention basin supplement and calculations based on our findings.
STORMWATER MANAGEMENT MEASURES:
The site drainage area is 8.85 acres. The site is high density, with a project built
upon area of 58%. The site was developed under the high -density guidelines using one
wet detention basin for treatment.
The grading contractor and developer will provide maintenance during
construction. The developer will provide maintenance after completion.

I've done the review for this project- this is a modification to a high density
project, so the fee is $4000, not $2000. We'll need either a new check for the full
amount, or an additional check for $2000.
I copied the previous email regarding the discrepancy between the BUA allotted for
the amenity area on this application, versus the BUA being accounted for as offsite
drainage to this pond under the POA Clubhouse application, to Brad Sedgwick. No
response yet.
Please revise the built -upon area reported in Section III.6 on page 2of the
application as indicated in my November8, 2006, email.
These plans do not show the addition of the mailbox area, as was noted in an
inspection report dated June 9, 2003. It was my understanding that in addition to
accounting for the increased BUA from the POA Clubhouse area, the site layout plans
for Clear Water Place were to be updated to include the mailbox area.

Thank you for submitting the Express application package for this permit yesterday.
I've got a few problems that need to be addressed:
1. Instead of listing the BUA associated with the amenity area as "Other on site",
please move that number to the "Offsite" box on page 2 of the application. This
will make it clear that the amenity area is an offsite project draining to this
pond, and not future on site BUA allotted to the Clear Water Place project.
2. You are only reporting 25,992 sq. ft. of BUA from the amenity area that will be
draining to this pond, which was the amount permitted in 1999. However, the SW8
990543 application from Mr. Sedgwick indicates that a total of 39, 436 sq. ft. will
now be draining to the SW8 970936 pond. Additionally, the offsite supplement
submitted for the SW8 990453 project indicates that a total of 48,905 sq. ft. of
BUA is being allocated under the SW8 970936 permit for the amenity area. I'm
copying this email to Mr. Sedgwick for his comment.

4. Built -upon area in excess of the permitted amount requires a state stornwater management permit modification
prior to construction.
5. All permitted runofffrom outparcels or future development shall be directed into the permitted stormwaler control
system. These connections to the stormwater control system shall be performed in a manner that maintains the
integrity and performance of the system as permitted.

The site is an existing 8.85-acre tract. The tract is bounded by Goley Hewitt Road
and a golf course to the west, residential uses to the east and north, and a clubhouse with
amenities to the south. All runoff from the site drains to an unnamed tributary to
Lockwoods Folly River (SC) and the Cape Fear River. There are no wetlands located in
the proposed project area.
PROJECT DESCRIPTION:
The project is an existing residential condominium community with asphalt parking
and access previously permitted as a high density stormwater project. The permit no. is
SW8 970936 and was issued on January 13, 1998. A stormwater detention pond was
constructed for stormwater treatment Design impervious for the entire site was computed
at 58%. The existing pond has not been certified by the design registered engineer and is
now requiring a modification. ESP Associates, P.A. has begun the certification process by
reviewing as-buitts on the existing pond and outlet structure. We have revised the wet
detention basin supplement and calculations based on our findings. A modification to the
existing state stormwater management permit is required. In addition to the modification,
a name change of the permit will also take place.
STORMWATER MANAGEMENT MEASURES:
The site drainage area is 8.85 acres. The site is high density, with a project built
upon area of 58%. The site was developed under the high -density guidelines using one
wet detention basin for treatment
The grading contractor and developer will provide maintenance during
construction. The developer will provide maintenance after completion.

SECOND AMENDMENT TO
DECLARATION CREATING UNIT OWNERSHIP
PURSUANT TO THE PROVISIONS OF NCGS 47C, THE UNIT
OWNERSHIP ACT FOR CLEAR WATER PLACE,
A CONDOMINIUM
THIS AMENDMENT TO THE DECLARATION CREATING UNIT OWNERSHIP
FOR CLEAR WATER PLACE, A CONDOMINIUM (herein the "Second Amendment") is made
this _.C�" day of August, 1999, by Clear Water Place, Inc., a North Carolina corporation (herein
the "Dech,rant".
On May : ? 1998, Declarant executed and recorded the "DECLARATION CREATING UNIT
OWNER,< HIP FOR CLEAR WATER PLACE, A CONDOMINIUM, in Book 1223, at Page 355,
in the Of lice of the Register of Deeds of Brunswick County, North Carolina, (herein "the
Declaration"). Pursuant to ARTICLE THREE of said Declaration, Declarant reserved the right in
its sole discretion by the execution and recording of an Amendment to the Declaration in the
Brunswicl. County Registry, among other things, to make correction in and amend the Declaration,
which action by the Declarant shall not require the approval or other action by either the individual
unit owne rs, the Board of Directors, or the members of the Association or the Master Association
of Unit 01-mers, or by any other person or entity.
Pursuant to the aforesaid rights and authority, Declarant now desires to make certain
correction; in the Declaration.
NOW THEREFORE, the Declarant does hereby amends the Declaration in the following
respects:

STORM WATER MANAGEMENT
A :atonnwater management plan has been designed which is applicable to all property
described in ARTICLE TWO and EXHIBIT A, and having the characteristics described in the
North Carlina State Stormwater Management Systems Permit No. 5W8 970936 and as outlined
in the Division of Water Quality Project Data Sheet, attached hereto as EXHIBIT F. This plan
shall be considered a part of the covenants, restrictions and conditions governing CLEAR
WATER PLACE, A CONDOMINIUM; shall run with the land, and yshhall be binding on all
parties arui persons claiming under them. This covenant shall not � '

your review and approval two copies each of the Stormwater Plans and the
executed Permit Application forms.
The proposed subject project is located within Winding River Plantation
and is covered under the overall stormwater permit # SW8 970936. A portion
of the project is collected in the storm drainage system located in the parking
areas and drains to the adjacent property's, Clear Water Place, stormwater
pond. The design and permitting, permit # SW8 961109, of the pond included
the drainage area and BUA from the Amenity Center. Enclosed is a check in
the amount of $43.0.00 to cover the required application fee.
