Skvada, III Secretary Effective August 1, 2013 the State Stormwater program has been transferred from the Division of Water Quality (DWQ) to the Division of Energy, Mineral and Land Resources (DEMLR). All previous references to DWQ will remain in older stormwater permits issued prior to August 1, 2013 until they are modified. Permit Extension On August 5, 2009, the Governor signed Session Law 2009-406. This law impacts any development approval issued by the Division of Water Quality under Article 21 of Chapter 143 of the General Statutes, which is current and valid at any point between January 1, 2008, and December 31, 2010. The law extends the effective period of any stormwater permit that is set to expire during this time frame to three (3) years from its current expiration date. On August 2, 2010, the Governor signed Session Law 2010-177 which grants an extra year for a total of four (4) years extension. Accordingly, Stormwater Permit # SW8 970128, which was set to expire on March 7, 2015, is now in effect until March 7, 2019. Please resubmit the renewal application and fee at least 180 days prior to March 7, 2019, which would be September 7, 2018. A copy of the Renewal Application can be obtained from the following website: http://portal.ncdenr.org/web/wq/ws/su/statesw/forms_docs. Plan Revision On May 29, 2014, the Wilmington Regional Office received a complete request to revise the approved plans for Stormwater Management Permit Number SW8 970128. The revisions include drainage improvements along Cahill Drive that results in narrowing the roadway and adding curbing. Project Narrative The University of North Carolina — Wilmington (UNCW) has undertaken this project as a means to alleviate roadside drainage issues along Cahill Drive between Walton and Reynolds Drive. The project will install several drainage structures that will drain the road and prevent roadside pending. A strip of asphalt will be removed from the road, reducing the BUA within the project limits. This portion of Cahill Drive is permitted under two separate permits SW8 980427 and SW8 980428. The drainage work is configured such that the drainage divide along Cahill between the two permits is not revised. BUA is being reallocated as per the table below. The permit for SW8 980427, the Price Road Pond, is expired. A plan revision cannot be approved on an expired permit; it must be renewed as the same time. We often process renewals and modifications together, but the fees get complicated with plan revisions, renewals and looking at submitting through the Express program. The problem is that a fee category has not been established for renewals through the Express program. The renewal fee is $505 through the Regular program. I have discussed this situation with Georgette. The plan revision for SW8 970128 can be submitted through the Express program for $500. However, the renewal/plan revision combo for SW8 980427 will have to be submitted through the Regular program. If you choose to submit SW8 970128 through the Express program and submit SW8 980427 to the regular program at the same time, we will expedite the renewal/plan revision process for SW8 980427 in the regular program as much as possible as we acknowledge that the projects are related. The existing permits affected include SW8 970128 and SW8 980427. The project will provide a reduction in built upon areas, and the drainage boundaries from the existing permits will not be affected. Since there is an effort underway to reduce overlap where possible we need to address this issue with permitting. Repair eroded areas immediately, re -seed as necessary to maintain good vegetative cover, mow vegetative cover to maintain a maximum height of six inches, and remove trash as needed. 3.
