Effective August 1, 2013 the State Stormwater program has been transferred from the Division of Water
Quality (DWQ) to the Division of Energy, Mineral and Land Resources (DEMLR). All previous
references to DWQ will remain in older stormwater permits issued prior to August 1, 2013 until they are
modified.
Permit Extension
On August 5, 2009, the Governor signed Session Law 2009-406. This law impacts any development
approval issued by the Division of Water Quality under Article 21 of Chapter 143 of the General
Statutes, which is current and valid at any point between January 1, 2008, and December 31, 2010.
The law extends the effective period of any stormwater permit that is set to expire during this time
frame to three (3) years from its current expiration date. On August 2, 2010, the Governor signed
Session Law 2010-177 which grants an extra year for a total of four (4) years extension.
Accordingly, Stormwater Permit # SW8 970128, which was set to expire on March 7, 2015, is now in
effect until March 7, 2019. Please resubmit the renewal application and fee at least 180 days prior to
March 7, 2019, which would be September 7, 2018. A copy of the Renewal Application can be obtained
from the following website: http://portal.ncdenr.org/web/wq/ws/su/statesw/forms_docs.
Plan Revision
On May 29, 2014, the Wilmington Regional Office received a complete request to revise the approved
plans for Stormwater Management Permit Number SW8 970128. The revisions include drainage
improvements along Cahill Drive that results in narrowing the roadway and adding curbing. These
improvements result in the following changes to the impervious area allocations within the drainage
area:

by -case basis. Any other changes to this project must be approved through this Office prior
to construction. The issuance of this plan revision does not preclude the permittee from
complying with all other applicable statutes, rules, regulations or ordinances which may
have jurisdiction over the proposed activity, and obtaining a permit or approval prior to
construction.

I was looking through the plan revision package for SW8 970128 and it looks like you are using old BUA numbers. There
was a modification issued in May 2009 that appears to have added a bit of BUA. I've attached a copy of the permit,

Project Narrative
The University of North Carolina — Wilmington (UNCW) has undertaken this project as a
means to alleviate roadside drainage issues along Cahill Drive between Walton and
Reynolds Drive. The project will install several drainage structures that will drain the road
and prevent roadside pending. A strip of asphalt will be removed from the road, reducing
the BUA within the project limits. This portion of Cahill Drive is permitted under two
separate permits SW8 980427 and SW8 980428. The drainage work is configured such that
the drainage divide along Cahill between the two permits is not revised. BUA is being
reallocated as per the table below.
Drainage Area Summary
The Drainage Area 1 in the table below is a reproduction of the table that was submitted for
permit #SW8 970128. The portions of the street (1645 so and sidewalk (742 so impervious
areas allocated for the wet pond by the current permit have been reallocated as future
impervious.

Gentlemen,
I meant to mention this in the meeting this morning, but unfortunately it slipped my mind. The permit for SW8 980427,
the Price Road Pond, is expired. A plan revision cannot be approved on an expired permit; it must be renewed as the
same time. We often process renewals and modifications together, but the fees get complicated with plan revisions,
renewals and looking at submitting through the Express program. The problem is that a fee category has not been
established for renewals through the Express program. The renewal fee is $505 through the Regular program.
I have discussed this situation with Georgette. The plan revision for SW8 970128 can be submitted through the Express
program for $500. However, the renewal/plan revision combo for SW8 980427 will have to be submitted through the
Regular program. If you choose to submit SW8 970128 through the Express program and submit SW8 980427 to the
regular program at the same time, we will expedite the renewal/plan revision process for SW8 980427 in the regular
program as much as possible as we acknowledge that the projects are related.

Following up from our conversation earlier this week, we would like to set up a meeting with Christine
Nelson next week to discuss plan revisions to two stormwater permits associated with Cahill Drive on the
UNC-Wilmington campus.

Here is a project narrative:
The revisions to the two stormwater permits are to replace the shoulders of Cahill Drive with curb
and gutter, between Reynolds Drive and Walton Drive, a distance of approximately 700 feet. The
existing permits affected include SW8 970128 and SW8 980427. The project will provide a
reduction in built upon areas, and the drainage boundaries from the existing permits will not be
affected.
Next week, we are available to meet on the afternoon of Monday (8/12), late morning Tuesday (8/13), or
anytime on Thursday (8/15).
As we discussed, we would like to get electronic copies of the approved stormwater permit plans for
permits SW8 970128 and SW8 980427. Christie Eakins at UNCW can arrange payment for the scans
through Always Graphics; Christie can be reached at 910-962-7157.

On August 30, 2011, the Division received an incomplete State Stormwater Management Plan Revision
Applications for the subject projects. The applications are being returned because they lacked the
necessary elements to accept it for review. The proposal is to alter a portion of Cahill Dr between
Reynolds Dr and Walton Dr. This change will also affect permit numbers SW8 061204 and SW8 021218.
Since there is an effort underway to reduce overlap where possible we need to address this issue with
permitting. We recommend that SW8 061204 be addressed by this change by either Plan Revision or
Permit Modification. SW8 021218 may also be addressed, but we understand that that permit is fairly
spread out over campus.

available forms. Please provide the requested information and return the package to the address below.

II. REQUIRED ITEMS CHECKLIST

(N.C. Department of Environment, Health and Natural Resources, February 1999) and Administrative Code
Section: 15 A NCAC 2H .1003.

QI. WET DETENTION BASIN OPERATION AND MAINTENANCE AGREEMENT
The wet detention basin system is defined as the wet detention basin, pretreatment including forebays and the
vegetated filter if one is provided.

Maintenance activities shall be performed as follows:
After every significant runoff producing rainfall event and at least monthly:
a. Inspect the wet detention basin system for sediment accumulation, erosion, trash accumulation,
vegetated cover, and general condition.
b. Check and clear the orifice of any obstructions such that drawdown of the temporary pool occurs within
2 to 5 days as designed.
2. Repair eroded areas immediately, re -seed as necessary to maintain good vegetative cover, mow vegetative
cover to maintain a maximum height of six inches, and remove trash as needed.

4. Remove accumulated sediment from the wet detention basin system semi-annually or when depth is
reduced to 75% of the original design depth (see diagram below). Removed sediment shall be disposed of
in an appropriate manner and shall be handled in a manner that will not adverseiy impact water quality (i.e.
O'.ckpiling near a wet detention basin or stream, etc.).
The measuring device used to determine the sediment elevation shall be such that it will give an accurate
uepih reading and not readily penetrate into accumulated sediments.

5. Remove cattails and other indigenous wetland plants when they cover 50% of the basin surface. These
plants shall be encouraged to grow along the vegetated shelf and forebay berm.
6. If the basin must be drained for an emergency or to perform maintenance, the flushing of sediment through
the emergency drain shall be minimized to the maximum extent practical.

7. All components of the wet detention basin system shall be maintained in good working order.

We have received plan revision requests for SW8 980427 and SW8 970128 to alter a portion of
Cahill Or between Reynolds Or and Walton Dr. This change will also overlap SW8 061204 and SW8
021218. Since there is an effort underway to reduce overlap where possible we need to
address this issue with permitting. We recommend that SW8 061204 be addressed by this change
by either Plan Revision or Permit Modification. SW8 021218 may also be addressed, but we
understand that that permit is fairly spread out over campus.
Please submit the appropriate paperwork to reduce the overlap by COB Friday or I will have to
return the application packages.

UNCW facilities personnel. To answer your question, we will not increase drainage areas to
permitted BMP's, and will not increase impervious area to permitted BMP's. We are only
reallocating existing permitted impervious area while maintaining existing drainage area

Christine Nelson in my office spoke with someone in Facilities at UNCW yesterday, and I
understand that he will be contacting you through his channels. I have not been personally
involved in the previous discussions with UNCW, but my understanding is that we are trying to
reduce overlapping projects where possible as projects come up now, and that the long term
plan is to have a single master permit for the university. It is my understanding that what
you are proposing will not increase drainage areas to permitted BMPs, increase impervious
area to BMPs, or an increase impervious area on any low density project for any of the
permits affected by the change. Is that the case?
If so, then this will probably turn out to be fairly simple. I just want to make sure that
we get either a plan revision (if the change WILL NOT affect the permitted elements of the
system or the permit text) or a permit modification (if the change WILL affect the permitted
elements of the system or the permit text) for each affected permit.

It appears as if there is some overlap in permits. Although, according to the documentation
we had, we were only affecting the two permits I had attached. All of Cahill affected
appeared to be contained within the two submitted permits. The break between the permits was
nearly the middle of Cahill as shown in the our drainage area exhibit. Please let us know
what would be the best way to proceed and we'll adjust accordingly. Thanks for your help.

When you say they are altering the road, what does that mean? Are they redeveloping, or
moving it to a new location, or widening it? I guess the impacts to the other permits depends
on what the proposed alteration is.
If it results in reduction of drainage area or BUA to a permitted BMP or a reduction in
density, I wouldn't worry about modifying the affected permit. if the opposite is true, an
increase in DA or BUA to a permitted BMP, or an increase in BUA for a low density permit,
then I think those affected permits need to be modified.

UNCW has proposed to alter a portion of Cahill Drive between Reynolds Dr and Walton Dr. I
have attached a map printed from Google Earth showing some permit boundaries, and this
proposal is shaded in red. (I hand -drew the red in Powerpoint so it is not exact.) They
have proposed Plan Revisions for SW8 970128 and SW8 980427. But, it also overlaps SW8 061204
and SW8 021218.
I understand that we are trying to reduce the overall number of UNCW permits by combining
overlapping permits when possible. SW8 061204 is relatively small and could be combined and
rescinded. SW8 021218 is larger and is sort of spread out all over campus so that would be
harder to combine. Should I ask them to bring in SW8 061204 and/or SW8 021218? I know this
is a case -by -case call.
