The meeting was called to order at 2:00 p.m.

COVID Issues
The Board discussed the ABCPOA Fitness Center survey received from Teresa Casey.
Eileen will share and discuss this survey with POC Chair Chuck Lewis.
Approval of Minutes
Motion: To approve the December 9, 2020 Working Meeting Minutes as presented.
Moved by Lois; seconded by Susan. All Aye. Motion carried.
Treasurer's Report
Jim Phlegar, new Board Treasurer, announced the Finance Committee membership:
Jim Phlegar, Chair; Charlie Wezwick, Vice Chair; Mary Wezwick, Rick Banchansky, Pe-
ter Panzarella, and Matt Keresman, members. Jim reviewed the financial packet pro-
vided to the Board. He reported the Finance Committee is exploring clearer, more suc-
cinct formats to share information with the Board and Community, compliant with CCRS
requirements.
Motion: To approve payment in December 2020 of approximately $64,000 from Operat-
ing Funds to Turner Asphalt for work completed in 2020. (This payment was previously
deferred until January, 2021.) Moved by Lois; seconded by Wendy. All Aye. Motion
carried.
Motion: To approve the $100,000 proposal from Storm Water Pipe Solutions for 2021
work, with the condition that the Storm Water Pipe Solutions contract is included as an
addendum/appendix to the standard Winding River Plantation contract, to be returned to
the Board for its final acceptance. Moved by Roger; seconded by Eileen. All Aye. Motion
carried.
Marina Dredging
The Board discussed the information Steve Speer emailed regarding this 2021 project.
Landscape Committee Projects
The Board supports the Committee's efforts to complete and pay for in 2020 several
H planned landscape projects.

2021 Open Meetings' Speakers
January - Teresa Casey and Margaret Kidder invited Brunswick County representatives
to present information about 211 road widening and the Greenway project.
February - WRP resident Shelbourn Stevens, President of Novant Health Brunswick
Medical Center, will address COVI D/vacci nation and the recent merger with New
Hanover. John Seebert or Tom Brennan will also be consider as presenters at this
meeting.
Annual Committee Chair Meeting
Roger will schedule for the 3rd week in January.
CAMS and Attorney/New Board Meetings
Roger will ask Cyndi to schedule in February.
Insurance Appraisal
The appraisal document was provided to the Board.
Community Support Committee Newsletter
Information about this online newsletter was provided to the Board. The Board will re-

Effective August 1, 2013 the State Stormwater program has been transferred from the Division of Water Quality
(DWQ) to the Division of Energy, Mineral and Land Resources (DEMLR). All previous references to DWQ will
remain in older stormwater permits issued prior to August 1, 2013 until they are modified, transferred, or
renewed. Please note that this letter references DEMLR as the Division responsible for issuance of the permit.
State Stormwater Management Permit #SW8 961109 and #SW8 970936 have expired on the dates listed below.
This is a reminder that permit renewal applications are due 180 days prior to their expiration per 15A NCAC
2H.1045(3). North Carolina General Statutes and the Coastal Stormwater rules require that this property be
covered under a stormwater permit. Failure to maintain a permit subjects the owner to assessment of civil
penalties.

Steve forwarded your emailed letter regarding your concerns about stormwater permitting in Winding
River. Our Division, (DEMLR) has issued several stormwater permits for Winding River, which the
Community Association currently holds.
I believe Ms. Flora's reference to the year 2002 was for the County stormwater permit, not the state.
The state starting requiring stormwater permits on January 1, 1988. Winding River is permitted by
the state. Your lot at 432 Cypress Ridge Drive (Lot #58) appears to be located in Phase 2, under the
master permit SW8 961109. Your lot also appears to be located adjacent to a stream and/or
wetlands.
Phase 2 is low density, and the approved plans for Phase 2 indicate that the majority of the runoff is
handled via curb outlet swales, which are designed to pass the peak flow from the 10 year storm in a
non -erosive manner. Many of these approved and permitted swales are located upstream and drain
runoff into the same wetlands that eventually pass between your lot #58 and lot #57, on its way to
Sandy Creek. The Community Association as the permit holder, is responsible for maintaining all of
the designated curb outlet swales, and ensuring that each lot maintains compliance with their
maximum BUA limit. The Association is NOT responsible for maintaining the natural stream or
wetland which runs between your lot #58 and Lot #57.
If your streets are private, then the Association should be maintaining the pipe under the road where
the wetland drains through on its way to Sandy Creek. If your streets are public, and maintained by
the DOT, please contact the DOT maintenance division for Brunswick County if the pipe appears
clogged or is crushed or has collapsed, or perhaps needs to be resized.
Please note that DEMLR does not regulate flooding - it is not a violation of the stormwater permit if
flooding occurs. Our area received a record rainfall of over 100 inches in 2018, which has led to a lot
of water being directed into our wetlands, causing those water levels to rise. Wetlands are a natural
flood protection device, but we cannot require the Association to maintain them. Wetlands are
regulated by the Division of Water Resources.
You are free to schedule a file review appointment to view the stormwater file and make copies. We
do not have a scanner that is large enough for plan sheets in-house, so you will need to make
arrangements with Cameron Weaver after your appointment to get a copy of the approved
stormwater plans made at a local print shop at your expense.

I am writing this email to request assistance in understanding responsibilities in residential development communities for
stormwater drainage. I spoke with Brigit Flora from the Corp of Engineers and she indicated to me that Winding River
development started before the legal requirement in 2002 to obtain a stormwater permit. The stormwater plan that the
Winding River Board has provided to me when requested is a map only showing wetlands 404 between my neighbor and
my property. I am wanting to obtain information on the long term stormwater plan because the environment in the 404
wetlands has changed radically over the last 4 years due to development growth upstream from me. I have notified the
POC manager several times but nothing really has come of it except for them giving me a map of the area indicating that
was the stormwater plan. I want to understand the long term plan or lack of because there are obvious problems now and
it is only going to get worse.
Details are that 17 homes were built between 2001 and 2005, creating the first of the impervious roofs, decks, patios and
driveways that increase runoff into the area. From 2006 to the present, an additional 17 homes have been built, doubling
(roughly) the impervious surfaces and doubling (again, roughly) the amount of runoff. Another 18 lots remain to be
developed that are "upstream" from the wetlands 404 of concern.
If a stormwater plan is on file I would like to obtain a copy of the full detailed plan and I would like to confirm if that is
correct about the stormwater permit not being required. This is a major development so I would think something of detail
was provided before development began.
