Guidelines for Access: The staff of Wilmington Regional Office is dedicated to making public records in our custody
readily available to the public for review and copying. We, also have the responsibility to the public to safeguard these
records and to carry out our day-to-day program obligations. Please read carefully the following guidelines signing the
form:
1. Due to the large public demand for file access, we request that you call at least a day in advance to schedule
an appointment to review the files'.' Appointments will be scheduled between 9:00am and 3:00pm.
Viewing time ends at 4:45pm. Anyone arriving without an appointment may view the files to the extent
that time and staff supervision is available.
2. You must specify files you want to review by facility name. The number of files that you may review at one
time will be limited to five.
3. You may make copies of a file when the copier is not in use by the staff and if time permits. Cost per copy is
$.05 cents. Payment may be made by check money order, or cash at the reception desk.
4. FILES MUST BE KEPT I!N ORDER YOU FOUND THEM. Files may not be taken from the office. To
remove, alter, deface, mutilate, or destroy material in one of these files is a misdemeanor for which you can
be fined up to $500.00. No briefcases lame totes etc are permitted in the file review area.
5. Necessary large plan copies can be scheduled with Cameron Weaver@ncderu.eov 919-796-7475 for a later
date/time at an offsite. location at your expense. Large plan copies needed should be attached on top of the

Inspection Summary
On July 29, 2011 Jay Houston, of Houston and Associates, P.A, submitted a transfer application for the Winding River
Master Permit # SW8 961109 and five individual permits. Permits SW8 000502, SW8 990453, SW8 990201, SW8 970936
and SW8 970850 have already been deemed compliant and transfered.
In the transfer request Mr. Houston submitted an as -built plan reflecting all the physical locations of the stormwater
collection BNI and any minor deviations that changed during the construction process.
It has been determined that Master Permit SW8 961109 is substanially in compliance with the terms and conditions of this
permit. Any future inspections of SW8 961109 should include the July 29, 2011 letter and as -built submitted by Jay
Houston on behalf of Bluegreen Corporation.

On October 6, 2011 David Cox of the Wilmington Regional Office of the Division of Water
Quality (DWQ) inspected Winding River Master Plan in Brunswick County to determine the
status of compliance with Stormwater Management Permit Number SW8 961109 issued on
April 15, 1998. DWQ file review and site inspection revealed that the site is compliant with the
terms and conditions of this permit. Please find a copy of the completed form entitled
"Compliance Inspection Report" attached to this letter. All future inspections should be based
on the October 6, 2011 report because of the following:
1. On July 29, 2011, Jay Houston submitted a through report listing minor deviations
that have been inspected and determined to be substantially in compliance with the
approved plan.
2. On July 29, 2011 Jay Houston submitted a plan that shows the as built status of all
stormwater treatment devices.
Please be advised that you are required to comply with the terms, conditions and limitations of
your Stormwater Management Permit under Title 15A North Carolina Administrative Code 2H
.1003 and North Carolina General Statute 143-214.7, including operation and maintenance of
your permitted stormwater system.
If the project has changed its name, ownership or mailing address, a completed and signed
Name/Ownership Change form must be submitted to DWQ at least 30 calendar days prior to
making the changes. Please include the name, mailing address and phone number of the
person or entity that is now responsible for this permit on the Name/Ownership Change form.

Dear Ms. Lewis:
Bluegreen Carolina Land, LLC is in receipt of the subject Compliance
Inspection Report and has requested that I respond to you. We received the
letter of violation on June 11, 2003. The plan for addressing the compliance
issues is detailed below with the expected completion date in parentheses.
(1) Submit the recorded deed restrictions (August 15)
(2) Repair repair and regrade swales as necessary (August 22)
(3) Revise plans as necessary, provide calculations (including Section N),
and submit to DENR to indicate existing and/or any relocation of
swales. (August 29)
(4) Inspect transverse cross drains and suggest improvements, if necessary
(August 15)
(5) Submit the designer's certification for wet ponds (September 19)

Please find attached a copy of the completed form entitled "Stormwater
Compliance Inspection Report". The report summarizes the findings of a recent
inspection of the project's stormwater controls conducted on June 4, 2003, to determine
compliance with Stormwater Permit Number SW8 961109 issued on July 9, 1997. Plan
modifications were approved on April 15, 1998, and October 30, 2001.
A summary of the findings and comments are noted under Section 4 of the
report. Please inform this Office in writing before July 9, 2003, of the specific actions
that will be undertaken and the time frame required to correct the deficiencies. Failure to
provide the requested information, when required, may initiate enforcement action. If

a. Almost every swale needed something to bring it into compliance. In
general, the swales needed the following: permanent stabilization,
regrading the slopes to 5:1 or flatter, lengthened to 100', and missing
swales need to be installed (even on lots that have no home yet).
b. The two wet ponds in Section I-B, which treat the collected runoff from
Riverhouse Road, were not found. Please confirm their presence and
state of compliance.
C. The wet pond in Phase II needs permanent vegetation and the outlet
structure is not per the approved plan. There is no orifice and no trash
rack.
d. The road runoff within Parcel N has been collected and its discharge point
could not be located. There are supposed to be three swales in that
section.
e. The concrete flumes do not appear to provide enough grade change to
funnel the runoff from the street into the swale. Even with the use of a
"Transverse Cross Drain", water is still ponding in the street.

Some of the 'Transverse Cross Drains' are not installed per the approved.
plan, or are so slight, they are not effective.
Recorded deed restrictions for Sections A-F have been provided, but not
for Sections G-V.
The required designer certification for the wet ponds has not been
submitted.
4. Required Actions:
a. Immediately provide the necessary items to bring the swales into
compliance with the permit. Repair and establish 5:1 or flatter side slopes,
establish permanent grass cover, construct missing swales, and provide
the required 100' lengths.
b. If field changes resulted in the deletion of swales, please submit a
modification to the permit.
C. Submit the required recorded deed restrictions.
d. Either construct the required swales in Section N, or submit a modification
to cover the addition of a wet pond to treat this runoff.
e. Improve the drainage from the street into the flume and into the swale to
eliminate the ponding water.
f. Provide the designer's certification for the wet ponds.

amount of built -upon area.
3. All the built -upon area associated with the project is graded such that the
runoff drains to the system.
4. The outlet/bypass structure elevations are per the approved plan.
5. The outlet structure is located per the approved plans.
6. Trash rack is provided on the outlet/bypass structure.
7. All slopes are grassed with permanent vegetation.
8. Vegetated slopes are no steeper than 3:1.
9. The inlets are located per the approved plans and do not cause short-
circuiting of the system.
10. The permitted amounts of surface area and/or volume have been
provided.
11. Required drawdown devices are correctly sized per the approved plans.
12. All required design depths are provided.
13. All required parts of the system are provided, such as a vegetated shelf,
and a forebay.
14. The dimensions of the system, as shown on the approved plans, are
provided.
