Thanks for providing the permit number for the site across the street. In looking at SW8 991111, it expired on June 11,
2015. When I originally tried to find SW8 991111, 1 came across SW8 960611 for M&M Storage in Winnabow (which also
has Mark Kennedy as the permittee) and that one expired on May 7, 2012. Please note that renewals can only be
submitted to the regular program and that each 8-year renewal costs $505. What is the status of submitting those
renewals?
Applying for a separate permit would expedite the approval since SW8 991111 needs to be renewed and brought back
to an active status before any actions can be takin on it. The downside to obtaining another permit is that there will be
one more permit for the permittee to keep up with and renew.

I-li Christine - I don't know what "permit information" you are referring to but I noticed that the facility does not
show up on the interactive GIS stormwater permits page. The permit number; I believe; is sw89e1111. Yes, this is a
separate permit because I don't know how it would be tied into the existing permit nor how It would be any advantage to my client to do so. The
tract of land has only been recently purchased by Mr. Kennedy, my client. If there is an advantage to tying it to the original permit without
jeopardizing the approval time, please advise.

The Division of Water Quality issued a Coastal Stormwater Management Permit, Number SW8 960611 to M & M Storage
Buildings for a High Density project on May 7, 1998, with a Permit Extension letter issued on March 2, 2011. This permit
expires on May 7, 2012. Per 15A NCAC 211.1003(h) (the stormwater rules), applications for permit renewals shall be submitted
180 days prior to the expiration of a permit and must be accompanied by a processing fee, which is currently set at $505.00. If
this is still an active project please complete and submit the enclosed renewal application prior to November 7, 2011. If this
project has not been constructed and a permit is no longer needed, please submit a request to have the permit rescinded. If you
have sold the project please provide the name, mailing address and phone number of the person or entity that is now
responsible for this permit. Enclosed is a form for change of ownership, which should be completed and submitted if the
property has changed hands.
Your permit requires that upon completion of construction and prior to operation of the permitted stormwater treatment system,
a certification of completion be submitted to the Division from an appropriate designer for the type of system installed. This is to
certify that the permitted facility has been installed in accordance with the permit, the approved plans, specifications and
supporting documentation. If you have not already provided a Designer's Certification to our office, please include a copy with
your permit renewal request and processing fee. A copy of the certification form is enclosed for your convenience.
You should be aware that failure to provide the Designers Certification and the operation of a stormwater treatment facility
without a valid permit, are violations of NC General Statute 143-215.1 and may result in appropriate enforcement action
including the assessment of civil penalties of up to $10,000 per day.

On August 5, 2009, the Governor signed Session Law 2009-406. This law impacts any
development approval issued by the Division of Water Quality under Article 21 of
Chapter 143 of the General Statutes, which is current and valid at any point between
January 1, 2008, and December 31, 2010. The law extends the effective period of any
stormwater permit that is set to expire during this time frame to three (3) years from its
current expiration date. On August 2, 2010, the Governor signed Session Law.2010-
177 which grants an extra year for a total of four (4) years extension.
Accordingly, Stormwater Permit # SW8 960611 which has already expired on May 7,
2008, is now in effect until May 7, 2012. Please resubmit the renewal application and
fee at least 180 days prior to May 7, 2012, which would be November 7, 2011. A copy
of the Renewal Application can be obtained from the following website:
