Dear Mr. Miller:
The Wilmington Regional Office received the Stormwater Application for Kure Beach Village Phase III on August 15,
1995, with final information on October 19, 1995. Staff review of the plans and specifications has determined that the
project, as proposed, will comply with the Stormwater Regulations set forth in Title 15A NCAC 2H.1000. We are
forwarding Permit No. SW8 950814 dated November 6, 1995 to Gulf Stream Development Group, Inc. The project has
been approved with the built -upon areas more particularly described on page 3 of this permit.
This permit shall be effective from the date of issuance until November 6, 2005 and shall be subject to the conditions and
limitations as specified therein. Please pay special attention to the Operation and Maintenance requirements in this permit.
Failure to establish an adequate system for operation and maintenance of the Stormwater management system will result
in future compliance problems.
If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to request an
ajudicatory hearing upon written request within thirty (30) days following receipt of this permit. This request must be
in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the
Office of Administrative Hearings, P.O. Drawer 27447, Raleigh, NC 27611-7447. Unless such demands are made this
permit shall be final and binding. If you have any questions, or need additional information concerning this matter, please

of 15A NCAC 2H .1000 (hereafter referred to as the "stormwater rules' and the approved stormwater
management plans and specifications and other supporting data as attached and on file with and approved by
the Division of Environmental Management and considered a part of this permit.
This permit shall be effective from the date of issuance until November 6, 2005 and shall be subject to the
following specified conditions and limitations:
I. DESIGN STANDARDS
1. This permit is effective only with respect to the nature and volume of stormwater described in the
application and other supporting data.
2. This stormwater system has been approved for the management of stormwater runoff as described on
page 3 of this permit, the Project Data Sheet. There is no off -site runoff into this Pond.
3. Approved plans and specifications for this project are incorporated by reference and are enforceable
parts of the permit.

4. No homeowner/lot owner/developer shall be allowed to fill in, alter, or pipe any vegetative practices
(such as swales) shown on the approved plans as part of the stormwater management system without
submitting a revision to the permit and receiving approval from the Division.
5. Each of the lots in the subdivision will be limited to the amount of built -upon area indicated in the
supporting calculations and per approved plans.
6. The permittee is responsible for verifying that the proposed home plans do not exceed the allowable
built -upon area. Once the lot transfer is complete, the home plan may not be revised without approval
from the permittee, and responsibility for meeting the built -upon area limit is transferred to the
individual homeowner.
7. The following items will require a modification to the permit:
a. Any revision to the approved plans, regardless of size.
b. Project name change.
C. Transfer of ownership.
d. Redesign or addition to the approved amount of built -upon area.
e. Further subdivision of the project area.
In addition, the Director may determine that other revisions to the project should require a modification
to the permit.
9.. The Director may notify the permittee when the permitted site does not meet one or more of the
minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall
submit a written time schedule to the Director for modifying the site to meet minimum requirements.
The permittee shall provide copies of revised plans and certification in writing to the Director that the
changes have been made.
II. SCHEDULE OF COMPLIANCE
1. The permittee will comply with the following schedule for construction and maintenance of the
stormwater management system:
a. The stormwater management system shall be constructed in it's entirety, vegetated and
operational for it's intended use prior to the construction of any built -upon surfaces except roads.
b. During construction, erosion shall be kept to a minimum and any eroded areas of the system will
be repaired immediately.
2. The facilities must be properly maintained and operated at all times. The approved Operation and
Maintenance Plan must be followed in it's entirety and maintenance must occur at the scheduled
intervals.

3. The permittee shall at all times provide the operation and maintenance necessary to assure the permitted
stormwater system functions at optimum efficiency including, but not limited to:
a. Semiannual scheduled inspections (every 6 months).
b. Sediment removal.
C. Mowing and revegetation of side slopes.
d. Immediate repair of eroded areas.
e. Maintenance of side slopes in accordance with approved plans and specifications.
f. Debris removal and unclogging of outlet structure, orifice device and catch basins and piping.
4. Records of maintenance activities must be kept and made available upon request to authorized personnel
of DEM. The records will indicate the date, activity, name of person performing the work and what
actions were taken.
5. Deed restrictions must be recorded which limit the built -upon area per lot to the amount as shown on
the Project Data Sheet, per Part I N2. The recorded statements must follow the form:
a. "The allowable built -upon area per lot is 3,200 square feet, inclusive of that portion of the right-
of-way between the lot line and the edge of pavement, structures, pavement, walkways of brick,
stone, or slate, but not including open wood decking."
b. "The covenants pertaining to stormwater regulations may not be changed or deleted without
concurrence of the State."
C. "Alteration of the drainage as shown on the approved plan may not take place without the
concurrence of the State."
6. This permit shall become voidable unless the facilities are constructed in accordance with the conditions
of this permit, the approved plans and specifications, and other supporting data.
7. Upon completion of construction, prior to issuance of a Certificate of Occupancy, and prior to operation
of this permitted facility, a certification must be received from an appropriate designer for the system
installed certifying that the permitted facility has been installed in accordance with this permit, the
approved plans and specifications, and other supporting documentation. Mail the Certification to the
Wilmington Regional Office, 127 Cardinal Drive Extension, Wilmington, North Carolina, 28405,
attention Water Quality Section.
8. A copy of the approved plans and specifications shall be maintained on file by the Permittee for a
minimum of five years from the date of the completion of construction.

III. GENERAL CONDITIONS
This permit is not transferable. Iu the event there is a desire for the facilities to change ownership, or.
there is a name change of the Permittee, a formal permit request must be submitted to the Division of
Environmental Management accompanied by an application fee, documentation from the parties
involved, and other supporting materials as may be appropriate. The approval of this request will be
considered on its merits and may or may not be approved.
2. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to
enforcement action by the Division of Environmental Management, in accordance with North Carolina
General Statute 143-215.6(a) to 143-215.6(c).
The issuance of this permit does not preclude the Permittee from complying with any and all statutes,
rules, regulations, or ordinances which may be imposed by other government agencies (local, state, and
federal) which have jurisdiction.
4. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions,
the Permittee shall take immediate corrective action, including those as may be required by this
Division, such as the construction of additional or replacement stormwater management systems.
5. The permit may be modified, revoked and reissued or terminated for cause. The filing of a request for
a permit modification, revocation and reissuance or termination does not stay any permit condition.

Dear Ms. Lewis:
In response to your request for additional information regarding the
subject project, we are submitting the following information:
1. Since the project is a revision to the previously permitted SW8 940217
(Keys at Kure Beach), please use the previously submitted plans and
calculations for project No. SW8 950814 (Kure Beach — Phase III) as
revisions to SW8 940217.
2. An Operation and Maintenance Plan is unnecessary for Kure Beach Village
— Phase III since it was previously submitted for the Keys at Kure Beach.
3. A revised submittal form for The Keys at Kure Beach is enclosed. The
first column of the calculations section shows Keys at Kure Beach built —
upon area and the second column shows total built —upon area from both
projects draining to the pond. A revised submittal form for Kure Beach
Village — Phase III shows only built —upon information for that project.
On the form for Kure Beach Village — Phase III, the description of
stormwater treatment states that the previously permitted pond for The
keys at Kure Beach (SW8 940217) will be used.
4. The drop inlets are located within the street pavement with the back
of the inlets at the gutter line as stated in a note beside the drop
inlet detail on sheet #5.
5. A note on the plan (sheet #1) states, "All runoff from the tennis
court/recreation area must be directed to the stormwater pond.
6. The deed restriction will include the statement, "Drainage from all
impervious surfaces and lots shall be routed to the stormwater detention
pond by grading the front two—thirds of each lot to slope toward the

street, and/or using gutters on all structures to route flow to the
street, and/or providing swales to route rear and side lot drainage to
the street." (See deed restrictions section on Kure Beach Village —
Phase III submittal form).
7. A cul—de—sac detail is added to the plans.
8. The orifice size of 3.25" is corrected on the riser detail.
Enclosed are revised submittal forms for The Keys of Kure Beach (940217)
and Kure Beach Village (950814). Included are two (2) complete sets of
revised plans.

Dear Mr. Hill:
The Wilmington Regional Office received a Stormwater Submittal for the Kure Beach Village,
Phase III on August 15, 1995. A preliminary review of that information has determined that the submittal
for the subject project is not complete. The following information is needed to continue the stormwater
review:
1. The submitted project is actually a revision to the previously permitted SW8 940217, so
revised plans and calculations must be submitted for 940217, showing the new design storage
elevations and design of the new pond. With your permission, I can use sheets 2 and 5 of
5 of the submitted plans and the submitted calculations as revisions to 940217.
2. An Operation and Maintenance plan has already been signed for the pond and it's drainage
piping. It is not necessary to do another.
3. A revised submittal form for 940217 must be done. The first column should contain the
Keys at Kure Beach built -upon areas, and the second column can be used to show the total
B/U area from both projects that will drain to the pond. Additionally, the 950814 submittal
form should contain only the information about the current project. In the description of the
stormwater treatment, say that the previously permitted pond for SW8 940217 will be used.

4. It appears from the plans that the drop inlets are located outside of the curb line. I can only
assume that the runoff will be captured by use of transitioning the curbing. Please provide
a detail.
5. Please provide elevations for the Recreation Area, or note on the plans that all runoff must
be directed to the pond.
6. Because the subdivision does not meet 30 % low density, this Office must be assured through
the use of recorded deed restrictions that all impervious areas will be picked up by the pond,
including all lot drainage. Options to ensure this include:
a. Require that 2/3 rds of the lot be graded to the street, or directed to the pond.
b. Require that gutters be used on all structures and directed to the pond.
C. Provide swales to carry the rear and side lot drainage to the pond.
7. Please add a cul-de-sac detail to the plans.
8. I am unclear as to the orifice size. The revised calculations use 3.25", but the plan detail
calls for 4". Please clarify.
Please note that this request for additional information is in response to a preliminary review. The
requested information should be received by this Office prior to October 6, 1995, or the submittal will
be returned as incomplete.

form, and a (1) signed copy of the operation and maintenance plan.
Since the built —upon area exceeds 30 percent of total project area,
a detention pond will be used to treat runoff. An existing detention pond
serving The Keys of Kure Beach will be also be used for stormwater management
for Kure Beach Village — Phase III.
Please review this plan as soon as possible. Copies have been sent
to New Hanover County Engineering for review with regards to erosion control.

In response to your letter dated July 3, 1997, we have prepared the following calculations and analyses of the I -
inch storm on the Keys pond and the impact of the proposed Kure Dunes Phase IV pond discharging into the Keys
pond.
The DWQ regulations require the treatment of the first 1-inch of runoff from impervious areas. The volume of l-
inch runoff required for the Kure Dunes Phase IV project is 12,790 cubic feet and the volume of 1-inch runoff
required for the Keys and Kure Beach Village projects is 48,153 cubic feet. These volumes were determined
using the Schueler Method.
The first attachment is a copy of the "KURE BEACH VILLAGE - PHASE Bi Stormwater Detention Pond
Calculations" prepared by Mr. Joseph S. Hill, P.E. Mr. Hill uses a non -routing analysis to estimate that it will
take 3.9 days for the pond at the Keys to release the required 1-inch of runoff volume (56,974 cubic feet) stored in
the pond from Kure Beach Village and the Keys (see pages 1 and 5 of Mr. Hill's calculations). Based on field
topography survey of the constructed pond and using the Schueler Method, our non -routing analysis estimates it
will take 3.7 days to release the required 1-inch runoff volume (see attached "KEYS POND CALCULATIONS').
The effective storages were calculated from actual field survey data of the Keys pond.
We are proposing to discharge the outflow of the proposed Kure Dunes Phase W pond into the existing pond
serving Kure Beach Village and the Keys. To accurately model this situation, we have prepared manual
hydrogmphs of storms producing one -inch of runoff for Kure Dunes Phase W, and Kure Beach Village and the
Keys. The manual hydrographs produced are based on a quick 15 minute storm which is typical for our area.
The Kure Dunes Phase IV 15-minute storm was developed to produced 12,790 cubic feet of runoff. The peak
discharge was determined by dividing the volume (12,790 cubic feet) by 10 minutes to obtain 21.32 cfs. A
manual hydrograpb was produced to have a peak discharge of 21.32 efs at 5 and 10 minutes and 0 cfs at 0 and 15
minutes.
The same procedure was utilized for the Keys and Kure Beach Village projects. Based on Mr. Hill's calculations,
the impervious area for the Keys and Kure Beach Village projects total 13.32 acres of the total drainage area of
25.51 acre, or 52.2 % impervious. Based on the Schueler Method, the volume of runoff required to be stored and
released over a 2-5 day period is 48,153 cf.
REQUIRED STORAGE FOR 1-INCH OF RUNOFF FOR THE KEYS -POND: (use Schueler Method)
= 0.05 + 0.009,(1)
= 0.05 + 0.009(52.2) = 0.52

= 48,153 CF
A peak discharge rate for a 15 minute storm was determined by dividing the volume (48,153 cubic feet) by 10
minutes to obtain 80.26 cfs. A manual hydrograph was produced to have a peak discharge of 80.26 cfs at 5 and
10 minutes and 0 cfs at 0 and 15 minutes.
In routing the storms, some assumptions were used:
1) The size of the orifice used was 3.25 inches (from Mr. Hill's calculations dated 8/14/97)
2) The crest elevation of the 36-inch riser is 16.9 (from survey data)
3) The orifice invert is elevation 14.40 (from survey data)
Please see the schematic diagram of the hydrographs. Numbers I through 7 refer to hydrographs previously
provided while hydrographs 8-12 and 13 & 14 are for the new calculations.
The first set of hydrograph calculations (STORMWATER CALCULATIONS FOR ROUTING I -INCH
RUNOFF FROM THE KEYS & KURE BEACH VILLAGE ONLY) refer to runoff from the 1-inch storm for
Kure Beach Village and the Keys. In referring to the hydrographs, hydrograph No. 13 is the 1-inch storm
hydrograph from Kure Beach Village and the Keys. Hydrograph No. 14 is the routed outflow hydrograph of the
Key's pond which indicates a maximum total storage volume in the pond of 48,039 cubic feet with a peak outflow
rate of 0.22 cfs and a peak stage elevation of 15.19 feet.
The second set of hydrograph calculations (STORMWATER CALCULATIONS FOR ROUTING 1-INCH
RUNOFF FROM KURE DUNES PHASE IV, THE KEYS & KURE BEACH VILLAGE) refer to runoff from
the 1-inch storm for Kure Dunes Phase IV, Kure Beach Village, and the Keys. In referring to the hydrographs,
hydrograph No. 8 is the 1-inch storm hydrograph for Kure Dunes Phase IV. Hydrograph No. 8 flows into No.
10, which is the Kure Dunes Phase IV pond (Reservoir No. 2). Hydrograph No. 9, which is the flow from the
Keys and Kure Beach Village, is then combined with the outflow of hydrograph No. 10 to form hydrograph No.
11. Hydrograph No. 12 is the routed outflow hydrograph of the Key's pond wluch indicates a maximum total
storage volume in the pond of 48,090 cubic feet with a peak outflow rate of 0.22 cfs and a peak stage elevation of
15.19 feet.
The routing method analyses indicate there is only a 0.04 ft difference in maximum pond elevation, a 0.02 cfs
difference in outflow at the end of 5 days and 51 cubic feet of extra storage volume in the Key's pond after the
Kure Dunes pond is allowed to discharge into the Key's pond. Therefore the impact of discharging the Kure
Dunes Phase IV pond outflow into the Keys pond will be insignificant.

Dear Mr. Hill:
The Wilmington Regional Office received the revised Stormwater Submittal for the The Keys at
Kure Beach on April 4, 1995. A preliminary review of that information has determined that the submittal
for the subject project is not complete. The following information is needed to continue the stormwater
review:
/'1. North Carolina registered Professional Engineers seal on the calculations.
1/ 2. A revised submittal form, indicating the new impervious area numbers.
3. The calculations have been based on a "mean surface area" of 14.65.. You have not
provided this Office with the new permanent pool or storage elevations and surface areas
provided at those elevations. If the pond contours have not been revised since the last
submittal, then the volume provided in the pond, 30,700 cubic feet is deficient. The pond
is not designed to hold 36,428 cubic feet which you calculate as the required volume.
Your outlet structure detail, however, indicates an orifice invert of 14.35 and a top of riser .
at 14.95. If these are your new permanent pool and storage elevations, then please provide
the surface areas at each elevation, revise your pond contours to show the 14.35 and 14.95
contours, and calculate the volume provided in the pond between those contours.
4. The orifice calculation is still referencing the old 226,113 gallons of runoff volume. Please
revise to use the new figure of 272,481 gallons.

In response to your notice of violation dated March 3, 1995, we are
submitting three (3) copies of the revised stormwater plan and calculations
for The Keys of Kure Beach.
This plan shows revised building dimensions (see typical drawings of
2—unit and 4—unit buildings at northwest project corner) and building
locations. Changes to the outlet structure necessary to accommodate the
revised building layout are shown on the detail sheet.
The proposed "Plan of Action" is as follows:
1. Obtain approval of revised plans from N.C.D.E.M.
2. Perform necessary changes to detention pond outlet structure.
3. Obtain Engineer's certification.
