1. Due to the large public demand for file access, we request that you call at least a day in advance to schedule
an appointment to review the files. Appointments will be scheduled between 9:00am and 3:00pm.

that time and staff supervision is available.
2. You must specify files you want to review by facility name. The number of files that you may review at one
time will be limited to five.

Dear Mr. Miller:
On January 13, 2010, Angela Hammers of the Wilmington Regional Office of the
Division of Water Quality (DWQ) inspected The Keys @ Kure Beach in Kure Beach,
New Hanover County to determine compliance with Stormwater Management Permit
Number SW8 940217 issued on November 6, 1995. DWQ file review and site
inspection revealed that the site is not compliant with the terms and conditions of this
permit. Please find a copy of the completed form entitled "Compliance Inspection
Report" attached to this letter, which summarizes the findings of the recent inspection.
As indicated in the attached inspection report, the following deficiencies must be
resolved:
1. A copy of the recorded deed restrictions as required by state stormwater permit
condition was not found in the file. Submit a copy of recorded deed restrictions to
this Office.
2. Rectify the areas (3) observed during this inspection that differ from the approved
DWQ plan via plan revision or plan modification.
Please inform this Office in writing before February 22, 2010, of the specific actions that
will be undertaken and the time frame that will be required to correct the deficiencies.
Failure to provide the requested information, when required, may initiate enforcement
action including the assessment of civil penalties of up to $25,000 per day. If a written
plan of action is not submitted to this office by February 22, 2010 then DWQ staff will re-
inspect the site and issue a Notice of Violation if the listed deficiencies have not been
addressed.
Please be reminded that if any ownership or name change has occurred it is the
permittee's responsibility to notify this office in writing.

was not shown on the plans, the fourplex across from the poolhouse is shown as a duplex on the plans; the fourplex at
Sloop Pointe Lane and Anchor Way is shown as a duplex on the plans.
To bring this system into compliance, the following must be completed:
1. Submit a copy of deed restrictions to this office.
2. Submit documentation to address the differences from the approved plan and the structures observed during the
inspection.

Dear Mr. Miller:
This Certification is pursuant to the revised application for The Keys at Kure Beach received on
April 4, 1995, in response to the Notice of Violation issued on. Additional information was received on
May 1, 1995. Staff review of the revised project plans and specifications has determined that the
stormwater control system as proposed for The Keys at Kure Beach, Revision will comply with the
Stormwater Regulations set forth in Title 15A NCAC 2H.1003(i). The runoff from 8.68 acres of
impervious area will be treated in a detention pond sized to achieve 90% reduction in Total Suspended
Solids.
Any modification of the plans submitted to and approved by this Office or further development
of this site regardless of the fact that the modification may be less than 1 acre, will require an additional
Stormwater Submittal/Modification and approval prior to initiation of construction. Modifications include
but are not limited to; project name changes, transfer of ownership, redesign of built -upon surfaces,
addition of built -upon surfaces, redesign or further subdivision of the project area.
This Certification shall be effective from the date of issuance until rescinded. The project shall
be constructed and maintained in accordance with the plans and specifications approved by the
Wilmington Regional Office. This Certification supersedes the one issued to youon March 16, 1994.
The developer is responsible for obtaining any and all permits and approvals necessary for the
development of this project. This could include the Division of Coastal Management under CAMA
requirements, the Division of Environmental Management under Wetland 401 Water Quality Certification
and/or a Dredge and Fill Permit and/or a Sewer Extension/Collection Permit, U.S. Army Corps of
Engineers 404 Wetland Permit, NPDES Stormwater Permit if disturbing five acres or more, local County
or Town Agency permits under their local ordinances, or others that may be required.

A professional engineer must certify that the stormwater system has been installed in accordance
with the approved plans and specifications upon completion of construction. The attached certification
should be received by this Office within 30 days of completion of construction.
The detention pond must be constructed in it's entirety, operational for it's intended use, and
permanently vegetated prior to the construction of any impervious surfaces proposed as a part of the
project, except roads.

Dear Mr. Miller:
On March 3, 1995, Wilmington Regional Office personnel performed a Compliance Inspection of
the project known as The Keys of Kure Beach, located on Kure Village Way in Kure Beach, New Hanover
County, North Carolina. The inspection was performed to determine the.status of compliance with
Stormwater Certification Number SW8 940217, issued to you on March 16, 1994.
The project has been found in violation of Stormwater Certification Number SW8 940217, issued
pursuant to the requirements of 15A NCAC 2H.1003(a)(i). The violations found are:
1. Revisions to the plan including different size buildings, additional buildings, and deletion
of the pool area, without notifying this Office and obtaining a revised Certification of
Compliance. Please reread the second paragraph of Stormwater Certification No. SW8
940217.
To correct these violations you must :
1. Provide a written "Plan of Action" which outlines the actions you will take to correct the
violation and a time frame for completion of those actions, on or before April 3, 1995.
2. Provide three sets of revised plans and calculations.

Failure to provide the "Plan of Action" or to correct the violations by the date designated in the
"Plan of Action", are considered violations of 15A NCAC 2H.1000, and may result in the initiation of
enforcement action which may include recommendations for the assessment of civil and criminal penalties,
pursuant to NCGS 143-215.6A.
By copy of this letter to the Kure Beach Building Inspector, this Office is requesting that the
Building Inspector consider withholding building permits and Certificates of Occupancy for this project
until this matter is satisfactorily resolved.
