Effective August 1, 2013 the State Stormwater program has been transferred from the Division of Water
Quality (DWQ) to the Division of Energy, Mineral and Land Resources (DENB R). All previous references to
DWQ will remain in older stormwater permits issued prior to August 1, 2013 until they are modified. Please
note that this permit will now reference DEMLR as the Division responsible for issuance of the permit.
The Wilmington Regional Office received a complete 8 year Stormwater Management Permit Renewal
Application for Kure Dunes Phase II on January 12, 2017. The Division is hereby notifying you that permit
SW8 920807 has been renewed on March 21, 2017, and shall be effective until October 8, 2020. For your
records, please find enclosed a renewed, updated, and re -issued permit and a copy of the renewal application.
Please keep this permit on file at all times. Please note that the renewed, updated, and re -issued permit does
not impose new or different terms; it merely restates some of the previous terms to provide you with a better
understanding of your obligations under the permit.
The renewal and reissuance of this stormwater permit does not imply that the site is currently in compliance
with the terms and conditions of this state stormwater permit. The plans originally approved on December 2,
1992 and subsequently revised on December 9, 1993 and modified on October 8, 1998, will remain in full
force and effect in accordance with the regulations set forth in Title 15A NCAC 2H.1000 effective September
L 1995.
This permit is subject to the conditions and limitations as specified therein. Please pay special attention to the
conditions listed in this permit regarding the Operation and Maintenance of the BMP(s), recordation of deed
restrictions, procedures for changes of ownership, transferring the permit, and renewing the permit. Failure to
establish an adequate system for operation and maintenance of the stormwater management system, to record
deed restrictions, to transfer the permit, or to renew the permit, will result in future compliance problems.
If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to
request an adjudicatory hearing by filing a written petition with the Office of Administrative Hearings (OAH).
The written petition must conform to Chapter 150B of the North Carolina General Statutes, and must be filed
with the OAH within thirty (30) days of receipt of this permit. You should contact the OAH with all questions
regarding the filing fee (if a filing fee is required) and/or the details of the filing process at 6714 Mail Service

construction of impervious areas to be treated in an off -site permitted stormwater facility, and for the
construction of impervious surfaces to be treated in underground infiltration trenches, in compliance
with the provisions of 15A NCAC 2H 1000 (hereafter referred to as the "stormwater rules') and the
approved stormwater management plans and specifications and other supporting data as attached and
on file with and approved by the Division of Energy, Mineral and Land Resources (hereafter referred to
as the Division or DEMLR) and considered a part of this permit The stormwater runoff from the site will
be routed to a detention pond operated and maintained by Beachwalk Development, Inc. under the
terms and conditions set forth in Permit No. SW8 960518.
This permit shall be effective from the date of issuance until October 8, 2020, and shall be subject to
the following specified conditions and limitations:
I. DESIGN STANDARDS
1 This permit is effective only with respect to the nature and volume of stormwater described in
the application and other supporting data.
2. The stormwater system permitted under #SW8 960518 has been approved for the management
of stormwater runoff as described on page 2 of this permit, the Protect Data Sheet. The built -
upon area allotted to this development by Stormwater Management Permit #SW8 960518 is
182,577 square feet. This project proposes a total of 29 single family lots, each allowed a
maximum of 70% of their lot area as built -upon area, per Kure Beach ordinance. In addition,
Lots 31, 32 and 33 drain to an underground trench system, and 4,960 square feet of entrance
road drain to an underground trench system, as shown on the approved plans. Page 3 of this
permit describes the design requirements for the infiltration trench systems, which will be
operated and maintained by the Town of Kure Beach
3 Approved plans and specifications for this project are incorporated by reference and are
enforceable parts of the permit.

4. This subdivision is limited to the amount of built -upon area indicated in the supporting
calculations and per approved plans. The portion of the project that is treated in the detention
pond must have a built -upon area less than or equal to the amount permitted under Stormwater
Permit #SW8 960518. Additional built -upon area will require a modification to SW8 960518.The
portion of the project treated in the infiltration system is limited to a total of 18,474 square feet
The Town of Kure Beach is responsible for verifying that the proposed built -upon area per lot
does not exceed the allowable built -upon area, proposed as 70% of the total lot area, for every
lot in the subdivision. Once the lot transfer is complete, the built -upon area may not be revised
without approval from the permittee and the Division, and responsibility for meeting the built -
upon area limit is transferred to the individual property owner.
The following items will require a modification to the permit
a Any revision to the approved plans; regardless of size.
b. Protect name change.
c Transfer of ownership
d. Redesign or addition to the approved amount of built -upon area.
e Further subdivision of the project area.
f. Alteration of any drainage feature (piping, swales, etc.) shown on the approved plan
The Director may determine that other revisions to the project should require a modification to
the permit.
II. SCHEDULE OF COMPLIANCE
1. No person or entity, including the permittee, shall alter any component of the approved
stormwater system shown on the approved plans unless and until the Division has approved of
the revised plan
2. The stormwater management system shall be constructed in its entirety, vegetated and
operational for its intended use prior to the construction of any built -upon surface except roads.
3 During construction, erosion shall be kept to a minimum and any eroded areas of the system
will be repaired immediately.
4. Beachwalk Development, Inc shall at all times provide the operation and maintenance
necessary to assure the permitted stormwater detention pond functions at optimum efficiency.
The approved Operation and Maintenance Plan must be followed in its entirety and maintenance
must occur at the scheduled intervals including, but not limited to.
a Semiannual scheduled inspections (every 6 months).
b. Sediment removal.
C. Mowing and revegetation of side slopes.
d. Immediate repair of eroded areas.
e. Maintenance of side slopes in accordance with approved plans and specifications
f Debris removal and unclogging of outlet structure, orifice device and catch basins and
piping
g. Access to the outlet structure must be available at all times.
The Town of Kure Beach is responsible for keeping the collection system in Phase II clear of
debris, and for the maintenance of the infiltration systems for Lots 31, 32 and 33, and the
entrance road. Maintenance shall include those same items as indicated in #3, page 5 above,
except that two additional items will be required: 1-If the system is not drawing down within 5
days: notify the Division; and 2- The system will be tested annually for compliance with the
volume and drawdown rate. The system will be restored or repaired to design condition if a
problem is found.
6. Beachwalk Development, Inc. and the Town of Kure Beach, must keep records of maintenance
activities for their respective systems, and make them available upon request to authorized
personnel of the Division The records will indicate the date, activity, name of person performing
the work and what actions were taken.

7. The facilities shall be constructed; operated and maintained in accordance with the provisions
of this permit, the approved plans and specifications, and the supporting documents attached to
this permit and on file with the Division
8. Beachwalk Development, Inc has provided a certification from an appropriate designer for the
system installed, certifying that the permitted facility has been installed in accordance with
Stormwater Permit #SW8 960518, the approved plans and specifications, and other supporting
documentation The Town of Kure Beach is responsible for providing a Certification from an
appropriate designer for the infiltration trench system, certifying that the system has been
installed in accordance with the design conditions listed on Page 3 of this permit.
9 A copy of the approved plans and specifications shall be maintained on file by the Permittee for
a minimum of ten years from the date of the completion of construction
10. All runoff from the lots permitted to drain into the offsite system must be directed into that system.
Runoff from the 3 lots and road to be treated in the infiltration systems must be directed into the
appropriate system, as shown on the approved plans.
11 The Director may notify the permittee when the permitted site does not meet one or more of the
minimum requirements of the permit. Within the time frame specified in the notice, the permittee
shall submit a written time schedule to the Director for modifying the site to meet minimum
requirements The permittee shall provide copies of revised plans and certification in writing to
the Director that the changes have been made
III. GENERAL CONDITIONS
1. Any individual or entity found to be in noncompliance with the provisions of a stormwater
management permit or the stormwater rules, is subject to enforcement action as set forth in
NCGS 143, Article 21.
2. This permit is not transferable to any person or entity except after notice to and approval by
the Director The permittee shall submit a completed and signed Name/Ownership Change
Form, accompanied by the supporting documentation as listed on the form, to the Division of
Energy, Mineral and Land Resources at least 60 days prior to any one or more of the following
events
a. An ownership change including the sale or conveyance of the protect area in whole or
in part, except in the case of an individual lot sale that is made subject to the recorded
deed restrictions,
b. The sale or conveyance of the common areas to a Homeowner's or Property Owner's
Association; subject to the requirements of Session Law 2011-256,
c Bankruptcy,
d. Foreclosure, subject to the requirements of Session Law 2013-121;
e. Dissolution of the partnership or corporate entity, subject to NCGS 57D-2-01(e) and
NCGS 57D-6-07:
f. A name change of the current permittee,
g A name change of the project;
h A mailing address change of the permittee;
3. The permittee is responsible for compliance with all permit conditions until such time as the
Division approves the transfer request Neither the sale of the project, in whole or in part, nor
the conveyance of common area to a third party constitutes an approved transfer of the
stormwater permit
4 The issuance of this permit does not preclude the Permittee from complying with any and all
statutes, rules, regulations, or ordinances which may be imposed by other government agencies
(local, state, and federal) which have jurisdiction.
5. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance
conditions, Beachwalk Development, Inc. (for the detention pond) or the Town of Kure Beach
(for the infiltration systems) as appropriate, shall take immediate corrective action, including
those as may be required by this Division, such as the construction of additional or replacement
stormwater management systems.

6. The permittee grants permission for DENR Staff to enter the property for the purpose of
inspecting all components of the permitted stormwater management facility.
7 The permit issued shall continue in force and effect until modified, revoked, terminated or
renewed. The permit may be modified, revoked and reissued or terminated for cause The filing
of a request for a permit modification, revocation and reissuance or termination does not stay
any permit condition.
8 The issuance of this permit does not prohibit the Director from reopening and modifying the
permit; revoking and reissuing the permit, or terminating the permit as allowed by the laws,
rules and regulations contained in Session Law 2008-211, Title 15A NCAC 2H 1000, and
NCGS 143-215.1 et. al.
9 The permittee shall submit a permit renewal application request at least 180 days prior to the
expiration date of this permit. The renewal request must include the appropriate application,
documentation and the processing fee.

SECTION 1: BRIEF HISTORY AND BACKGROUND OF THE SYSTEM
The proposed project is a 25 lot residential subdivision located west of
U.S. 421 (Fort Fisher Boulevard) in northern Kure Beach, North Carolina. The
stormwater management system consists of a detention pond and an
infiltration system. The detention pond, located in the southwest corner, shall
serve 14.34 acres including Phase II (5 acres), future development area to the
west of Phase II, and an existing off -site area.
The infiltration systems shall serve part of the entrance road to Phase II
(Kure Dunes Lane), and Lots 31, 32, and 33. The systems are located within
the street right of way, in a public utility easement adjacent to U.S. 421 and
drainage easement on Lots 31, 32, and 33.
SECTION 2: OPERATING PERSONNEL RESPONSIBILITIES
A. The Owner of the subdivision is a partnership, Kure Beach
Associates, P. O. Box 179, Wilmington, NC. The local contact person is
Joseph C. Hearne, (919) 458-4046.
B. Kure Beach Associates shall construct the stormwater facilities and
when complete turn over to the Town of Kure Beach to own and maintain.
The Town contact person shall be Mayor J. E. Foster, II, Town of Kure Beach,
P. O. Box 3, Kure Beach, NC 28449, telephone (919) 458-8216.

SECTION 3: MANAGEMENT RESPONSIBILITIES
It is believed that management of the facilities will require only that it be
included among other facilities requiring periodic verification from
maintenance personnel reports and repair requirements and cost.
SECTION 4: DESCRIPTION OF SYSTEM COMPONENTS
A. All piping in improved areas is underground. Pipes have been sized
to accommodate that runoff from a 10-year frequency storm. This is a
standard of design which has been found to be economically feasible for the
sizing of drainage pipelines in eastern North Carolina. Pipelines are graded so
as to maintain a velocity of at least 2 feet per second and not exceed 5 feet per
second. This will assure against deposits in the pipe system and yet not cause
intense transport of particulate and suspended solids in the flows.
B. Rainfalls of greater intensities or longer duration will not normally
exceed the capacity of the system as such flows will increase the hydraulic
gradient of the system, resulting in increased velocity and capacity. Care has
been taken to avoid flooding in the system; however, short-term ponding in the
low areas of the streets may occur during extremely heavy rains such as
accompany tropical storms. This should also deter flooding of the system.
C. The infiltration system has been designed in accordance with criteria
set out in DEHNR Division of Environmental Management Regulation Section
1000, "Stormwater Runoff Disposal'. Details are set out on the plans. The
systems will store the runoff from a one -inch (1") rainfall and infiltrate the
stormwater within five days. Overflows are provided to pass storms in excess
of one inch.
D. The detention pond system has been designed in accordance with
criteria set out in DEHNR Division of Environmental Management Regulation
2
Section 1000, "Stormwater Runoff Disposal'. Details are set out on the plans.
The system will store the runoff from a one -inch rainfall and release the
stormwater in not less than two days, and not more than 5 days. An overflow
is provided to pass storms in excess of one inch.
SECTION 5: SURVEILLANCE AND INSPECTIONS
A. It is suggested that a visual inspection be made monthly of the
surface areas of the system to detect any indications of blockages or flooding
at inlets, manholes, or erosion or damage to swales, ponds, vegetative filters
and outlet pipes. A simpler inspection should be made following heavy rainfall
and storm events.
B. A suggested semiannual inspection should be made, removing covers
of all structures, cleaning out debris or deposits from the structures. Visual
lamping of the pipelines should be made to detect any obstruction or damage
to the lines. Ground slopes should be checked and repaired where necessary.
C. Additional monitoring needs may be required by the Division of
Environmental Management in the future. These requirements will be
incorporated into the current maintenance plan.
D. A report should be prepared in simple form and maintained in the
proper file for all such inspections and maintenance actions. Copies should
be sent to Management as information.
SECTION 6: ACCIDENTAL SPILLS OR OVERWASH OF POLLUTED AREAS
A. In the event of an accidental spill or overwash of an area containing
hazardous material, the event should be immediately reported to Rick Shiver,
Regional Supervisor, Division of Environmental Management, 127 Cardinal
Drive Extension, Wilmington, N. C. 28405-3845 (Telephone 395-3900).

B. Immediate action by the Town of Kure Beach personnel should be
taken to contain the spill or overwash, if possible. Corrective actions should
be taken with the advice of the Regional Supervisor or other designated official
having authority in such matters.
SECTION 7: MAINTENANCE OF FACIIdTIES
A. Pipelines should not normally require cleaning. If required, normal
pipe cleaning equipment operating from structural openings should be used.
B. Inlets, catch basins and manholes should be cleaned by direct
removal of obstructions and debris through the top opening.
C. The infiltration system swales and ditches located along U.S. 421
will require periodic cleaning by removal of sediment deposits and eroded
material. The use of hand labor and fine grading equipment such as Gradall
type units is suggested. The material should be trucked to an approved site
for disposal.
D. The pond system should be checked periodically for siltation, algae,
or weed growth and accumulations of oil and grease. When 0.5 feet of silt
accumulates, maintenance should be accomplished to remove the material.
When algae or weed growth exceeds 25 percent of the normal water surface
area, the algae and/or weed growth should be removed and disposed of
properly. When oil or grease is visible, an absorbent material shall be used to
remove these materials.
E. Where maintenance problems appear to affect the successful
operation of the facilities, assistance should be sought from the Designers or
competent sources.

The Owner will make the necessary arrangements to be able to provide a
statement from a North Carolina Professional Engineer that the system was
constructed in accordance with the approved plans.

SECTION 1: BRIEF HISTORY AND BACKGROUND OF THE SYSTEM
The proposed project is a 25 lot residential subdivision located west of
U.S. 421 (Fort Fisher Boulevard) in northern Kure Beach, North Carolina. The
stormwater management system consists of a detention pond and an
infiltration system. The detention pond, located in the southwest corner, shall
serve 14.34 acres including Phase II (5 acres), future development area to the
west of Phase II, and an existing off -site area.
The infiltration system shall serve part of the entrance road to Phase II.
(Kure Dunes Lane), and is located adjacent to U. S. 421 in a public utility
easement.
SECTION 2: OPERATING PERSONNEL RESPONSIBILITIES
A. The Owner of the subdivision is a partnership, Kure Beach
Associates, P. O. Box 179, Wilmington, NC. The local contact person is
Joseph C. Hearne, (919) 458-4046.
B. Kure Beach Associates shall construct the stormwater facilities and
when complete turn over to the Town of Kure Beach to own and maintain.
The Town contact person shall be Mayor J. E. Foster, II, Town of Kure Beach,
P. O. Box 3, Kure Beach, NC 28449, telephone (919) 458-8216.
SECTION 3: MANAGEMENT RESPONSIBILITIES
It is believed that management of the facilities will require only that it be
included among other facilities requiring periodic verification from
maintenance personnel reports and repair requirements and cost.

SECTION 4: DESCRIPTION OF SYSTEM COMPONENTS
A. All piping in improved areas is underground. Pipes have been sized
to accommodate that runoff from a 10-year frequency storm. This is a
standard of design which has been found to be economically feasible for the
sizing of drainage pipelines in eastern North Carolina. Pipelines are graded so
as to maintain a velocity of at least 2 feet per second and not exceed 5 feet per
second. This will assure against deposits in the pipe system and yet not cause
intense transport of particulate and suspended solids in the flows.
B. Rainfalls of greater intensities or longer duration will not normally
exceed the capacity of the system as such flows will increase the hydraulic
gradient of the system, resulting in increased velocity and capacity. Care has
been taken to avoid flooding in the system; however, short-term ponding in the
low areas of the streets may occur during extremely heavy rains such as
accompany tropical storms. This should also deter flooding of the system.
C. The infiltration system has been designed in accordance with criteria
set out in DEHNR Division of Environmental Management Regulation Section
1000, "Stormwater Runoff Disposal'. Details are set out on the plans. The _
system will store the runoff from a one -inch (1 ") rainfall and infiltrate the
stormwater within five days. Overflows are provided to pass storms in excess
of one inch.
D. The detention pond system has been designed in accordance with
criteria set out in DEHNR Division of Environmental Management Regulation
Section 1000, "Stormwater Runoff Disposal'. Details are set out on the plans.
The system will store the runoff from a one -inch rainfall and release the
stormwater in not less than two days, and not more than 5 days. An overflow
is provided to pass storms in excess of one inch.

SECTION 5: SURVEILLANCE AND INSPECTIONS
A. It is suggested that a visual inspection be made monthly of the
surface areas of the system to detect any indications of blockages or flooding
at inlets, manholes, or erosion or damage to swales, ponds, vegetative filters
and outlet pipes. A simpler inspection should be made following heavy rainfall
and storm events.
B. A suggested semiannual inspection should be made, removing covers
of all structures, cleaning out debris or deposits from the structures. Visual
lamping of the pipelines should be made to detect any obstruction or damage
to the lines. Ground slopes should be checked and repaired where necessary.
C. Additional monitoring needs may be required by the Division of
Environmental Management in the future. These requirements will be
incorporated into the current maintenance plan.
D. A report should be prepared in simple form and maintained in the
proper file for all such inspections and maintenance actions. Copies should
be sent to Management as information.
SECTION 6: ACCIDENTAL SPELLS OR OVERWASH OF POLLUTED AREAS
A. In the event of an accidental spill or over -wash of an area containing
hazardous material, the event should be immediately reported to Rick Shiver, `
Regional Supervisor, Division of Environmental Management, 127 Cardinal l
Drive Extension, Wilmington, N. C. 28405-3845 (Telephone 395-3900). `
B. Immediate action by the Town of Kure Beach personnel should be f
taken to contain the spill or over -wash, if possible. Corrective actions should
be taken with the advice of the Regional Supervisor or other designated official
having authority in such matters.

SECTION 7: MAINTENANCE OF FACILITIES
A. Pipelines should not normally require cleaning. If required, normal
pipe cleaning equipment operating from structural openings should be used.
B. Inlets, catch basins and manholes should be cleaned by direct
removal of obstructions and debris through the top opening.
C. Swales and ditches will require careful periodic cleaning by removal
of sediment deposits and eroded material. The use of hand labor and fine
grading equipment such as Gradall type units is suggested. The material
should be trucked to an approved site for disposal.
D. The pond system should be checked periodically for siltation, algae,
or weed growth and accumulations of oil and grease. When 0.5 feet of silt
accumulates, maintenance should be accomplished to remove the material.
When algae or weed growth exceeds 25 percent of the normal water surface
area, the algae and/or weed growth should be removed and disposed of
properly. When oil or grease is visible, an absorbent material shall be used to
remove these materials.
E. Where maintenance problems appear to affect the successful
operation of the facilities, assistance should be sought from the Designers or
competent sources.
SECTION 8: SYSTEM CERTIFICATION
The Owner will make the necessary arrangements to be able to provide a
statement from a North Carolina Professional Engineer that the system was
constructed in accordance with the approved plans.
