Dear Mayor Medlin:
On November 23, 1994, Wilmington Regional Office personnel performed a Compliance Inspection
of the project known as Kure Dunes, Phase H, located off US 421 South in Kure Beach in New Hanover
County, North Carolina. The inspection was performed to determine the status of compliance with
Stormwater Certification Number 920807, issued to the Town through J.E. Foster on December 2, 1992,
and revised December 9, 1993.
The inspection revealed that the berm/swale along the north and east property lines of lots 32, 33
and 34 had been removed. In addition, lot #33's yard has been regraded and sodded without the
berm/swale. At one point in time, the berm/swale was observed to be in place and built in accordance with
the approved plan. It has been reported that Mr. Joe Hearne, the developer, and the owner of Lot 33
reached an understanding whereby the runoff would be allowed to exit the site and enter Spotter's Court.
This would be accomplished by eliminating the berm/swale at the east property line of Lot 33. Any
agreement between Mr. Hearne and a lot owner concerning this berm/swale does not supersede the
requirements of the Certification of Compliance issued by the State of North Carolina. The revised
Certification, issued on December 9, 1993, required that the affected homeowners be notified that the
berm/swale was required to be sodded and to remain functional. The owners of Lots 32 and 34 have not
sodded that portion of the Swale located on their respective lots.

The project has been found in violation of Stormwater Certification Number 920807, issued
pursuant to the requirements of 15A NCAC 2H.1003(a)(i) and (h). The violations found are:
1. Modification to the approved stormwater plan without review and approval by this Office.
2. The Swale has not been maintained in accordance with the approved plan.
3. Failure to provide the engineer's certification.
To correct these violations you must:
1. Provide a written "Plan of Action" which outlines the actions you will take to correct the
violations and a time frame for completion of those actions, on or before December 23,
1994.
2. Replace the missing swale so that runoff from Lots 32, 33 and 34 is directed into the
infiltration trench. If the Town accepted responsibility for maintenance of this system then
actions on the part of others, especially the developer and a homeowner, to revise the system
so that it is out of compliance with the State's Certification should be met with immediate
action by Town officials.
3. Request the engineer to complete the engineer's certification and return it to this Office.
Failure to provide the "Plan of Action" or to correct the violations by the date designated in the
"Plan of Action", are considered violations of 15A NCAC 2H.1000, and may result in the initiation of
enforcement action which may include recommendations for the assessment of civil and criminal penalties,
pursuant to NCGS 143-215.6A.
By copy of this letter to the Kure Beach Building Inspector, this Office is requesting that he
consider withholding building permits and Certificates of Occupancy for this project until this matter is
satisfactorily resolved.

4. Maintenance Problems:
1. The pond water level is approximately 1 foot below the spillway overflow at elevation 20.
The permanent pool elevation for this pond is 19.0. This means that the water stored from
the previous storm on Saturday, has not been released and is still in the pond.
2. The outlet ditch is full, preventing the stored water from releasing.
5. PE Certification Received? NO Deed Restrictions Received? NO
6. Comments:
1. The stored water is required to be released in 2-5 days. It is a violation of your
Certification if this requirement cannot be met. You must keep the pond functioning as
designed. The question of who must do the maintenance on an outlet ditch that is not
owned by you is something to be worked out between you and the ditch owners.
Regardless, you are required to maintain the pond as designed.
2. The revised swale at Lots 32 and 33 looks OK. Please remind the lot owners that when
grading and sodding their yard, the swale must not be altered as concerns depth, width,
or slope. A revised Certification has been sent separately.

Inspection Date: October 7, 1993

Comparison of Approved plans vs. As -Built:
Maintenance Problems:
Compared better than previous inspection.
1. The pond slopes have been seeded, however, no stabilizer mat or hay was used to hod the
seed in place to allow germination. As a result, grass clumps, uneven coverage, and bare
spots are very evident. There is still a long way to go before final stabilization.
PE Certification Received? NO

Deed Restrictions Received? NO
1. Please monitor the grass stabilization weekly and provide a stabilization material to allow
germination of the seed before it washes down into the pond. I will inspect the site weekly
to make sure progress is ongoing.
2. The swale along Lots 32 and 33 is not in the correct location and is not really a swale,
merely a banked up area at the toe of a fill section. The plans call for the Swale to follow
the rear and side property lines of Lots 32 and 33. This is still not the case, even though
filling of the lots has occurred. The difference in elevation between Spotters Court and
Kure Dunes is much more than shown on the approved plan. The approved plan shows Lot
33 of Kure Dunes and Lot 4 of Spotters Court sharing a common 22' contour, with the
major grade changes occurring at the front of Lot 4 of Spotters Court and in the comer
of Lots 33 and 29 of Kure Dunes. From the approved plan, it appears that the Spotters
Court Lot 4 is not graded as shown and is therefore making it difficult to grade Lots 29
and 33 of Kure Dunes. While the swale as constructed will serve it's purpose in collecting
the runoff from the homes and directing it into the infiltration areas, the homeowner may
want to get some assurance from the developer concerning the upkeep of the swale and
infiltration areas. The Town of Kure Beach will take over maintenance when the facilities
meet their criteria.

3. Lots 53-46 have been graded per the approved plans. Mr. Hanna will assure that any roof
drainage will directed towards Sandman Drive.
4. The Engineer's Certification has not been received. Upon completion of the maintenance
items and the establishment of grass, please return the attached Certification.

Comparison of Approved plans vs. As -Built:
Maintenance Problems:
Grading of site is not per approved plan.
1. Unstabilized sand has washed into the road at various points and is entering both the
detention pond and the exfiltration stormwater systems. It is of the utmost importance that
this sand not enter the exfiltration system during construction.
2. The pond side slopes have absolutely no grass stabilization at all. Grass must be planted
IMMEDIATELY and the side slopes must be stabilized within 1 month of the planting.
PE Certification Received? NO Deed Restrictions Received? YES
Comments:
1. Provide grass stabilization on the site to prevent sediment -laden runoff from entering the
streets, exfiltration system, and pond.
2. The swale along Lots 32 and 33 has not been graded to flow into the drop inlet #14 which
is tied into the exfiltration system. This area must be graded per the approved plan and
provide positive drainage into the drop inlet.
3. Lots 53-46 must be graded per the approved plan -toward Sandman Drive. Presently, half
of the lot drains toward the Phase I lots.
