Pond 2 must be operated with a vegetated filter. 3. Approved plans and specifications for this project are incorporated by reference and are enforceable parts of the perm it. 4. The tract will be limited to the amount of built -upon area indicated on page 3 ofthis permit, and per approved plans. 5. The 32 acre offsite area is currently undeveloped due to a 40' "No Build" zone. SCHEDULE OF COMPLIANCE I. Required maintenance on Pond 1 must be performed prior to occupancy of the new facility. 2. The stormwater management system shall be constructed in it's entirety, vegetated and operational for its intended use prior to the construction of any built -upon surface except roads. 3. During construction, erosion shall be kept to a minimum and any eroded areas of the system will be repaired immediately. 4. The permittee shall at all times provide the operation and maintenance necessary to assure the permitted stormwater system functions at optimum efficiency. The approved Operation and Maintenance Plan must be followed in its entirety and maintenance must occur at the scheduled intervals including, but not limited to: a. Semiannual scheduled inspections (every 6 months). b. Sediment removal. C. Mowing and revegetation of side slopes. d. Immediate repair of eroded areas. e. Maintenance of side slopes in accordance with approved plans and specifications. f. Debris removal and unclogging of outlet structure, orifice device and catch basins and piping. g. Access to the outlet structure must be available at all times. h. The vegetated filter will be kept grassed with no erosion. The spreader mechanism will be kept clear 5. ?Records of maintenance activities must be kept and made available upon request to authorized personnel of DWQ. The records will indicate the date, activity, name of person performing the work and what actions were taken. t 6. Decorative spray fountains will not be allowed in the stormwater treatment system. 7. The facilities shall be constructed as shown on the approved plans. This permit shall become voidable unless the facilities are constructed in accordance with the conditions ofthis permit, the approved plans and specifications, and other supporting data. 8. Upon completion of construction, prior to issuance of a Certificate of Occupancy, and prior to operation of this permitted facility, a certification mast be received from an appropriate designer for the system installed certifying that the permitted facility has been installed in accordance with this permit, the approved plans and specifications, and other supporting documentation. Any deviations from the approved plans and specifications must be noted on the Certification. A copy of the approved plans and specifications shall be maintained on file by the Permittee for a minimum of ten years from the date of the completion of construction. 10. Prior to the sale of any portion of the property, an access/maintenance easement to the stormwater facilities shall be granted in favor of the permittee if access to the stormwater facilities will be restricted by the sale of any portion of the property. 1 l . The permittee is responsible for verifying that the proposed built -upon area does not exceed the allowable built -upon area. 12. The runoff from all built -upon area on the project must be directed into the permitted stormwater control system. 13. If the stormwater system was used as an Erosion Control device, it must be restored to desi,n condition prior to operation as a stormwater treatment device, and prior to occupancy of the facility. Any revision to the approved plans, regardless of size. b. Project name change. C. Transfer of ownership. d. Redesign or addition to the approved amount of built -upon area. e. Further subdivision of the project area. f. Filling in, altering, or piping of any vegetative conveyance shown on the approved plan 15. The Director may determine that other revisions to the project should require a modification to the permit. 16. The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made. III. GENERAL CONDITIONS 1. This permit is not transferable. In the event there is a desire for the facilities to change ownership, or there is a name change of the Permittee, a formal permit request must be submitted to the Division of Water Quality accompanied by an application fee, documentation from the parties involved, and other supporting materials as may be appropriate. The approval of this request will be considered on its merits and may or may not be approved. 2. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to enforcement action by the Division of Water Quality, in accordance with North Carolina General` Statute 143-215.6A to 143- 215.6C. 3. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances which may be imposed by other government agencies (local, state, and federal) which have jurisdiction. 4. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Permittee shall take immediate corrective action, including those as may be required by this Division, such as the construction of additional or replacement stormwater management systems. 5. Deed Restriction Language The following statements must be recorded for all low density projects and for all projects that involve the subdivision and selling of lots or outparcels: 1. No more than _ square feet of any lot, including that portion of the right-of-way between the edge of pavement and the front lot line, shall be covered by impervious structures including asphalt, gravel, concrete, brick, stone, slate or similar material but not including wood decking or the surface of swimming pools. This covenant is intended to insure continued compliance with the stormwater permit issued by the State of North Carolina. The covenant may not be changed or deleted without the consent of the State. 2. No one may fill in, pipe, or alter any roadside swale except as necessary to provide a minimum driveway crossing. NOTE: If lot sizes vary significantly, the owner/developer must provide an attachment listing each lot number, size and the allowable built -upon area for each lot. For commercial projects that have outparcels or future development the following statements must also be recorded: 3. The connection from the outparcel or future area into the stormwater system must be made into the forebay such that short-circuiting of the system does not occur. 4. A preliminary review of that information has determined that the application is not complete. The following information is needed to continue the stormwater review: A detail of the vegetated filter itself has not been added. A level spreader is not the same as a vegetated filter. Please show a detailed cross-section of the proposed vegetated filter. Level spreaders are mostly suited for use as a temporary Erosion Control device to disperse flow from channels and ditches into sheet flow. They are not recommended for permanent use as the flow spreader mechanism for a vegetated filter. Please see the enclosed detail. The stormwater permit cannot be issued until the wetlands permit is issued. The proposed pond is located in existing wetlands. Please forward a copy of that permit when issued to complete the review of this project. Please label the outlet structure in the pond. The trash guard diameter has not been specified on the outlet structure detail. The only diameter shown is for the 48" riser. Necessarily, the trash guard must be larger than 48" in order to fit over the riser. 5. Please add the outlet structure detail for the existing pond. Since these plans will replace and supersede those currently approved, all required details must be shown for the existng pond. 6. The data for the existing pond on the application indicates a .32 acre offsite area, but the drainage area delineation on the grading plan does not show any offsite drainage areas. Please clarify. If offsite drainage is indeed entering the existing pond, please include it in the drainage area delineation and make any needed revisions to the acreage of the drainage area and in the calculations to account for it. The regulations require that offsite runoff be accounted for at the full buildout potential. Based on the average area method used, the volume provided at the storage elevation reported is not sufficient to meet the minimum required, albeit by a small amount. The required work of fixing the existing pond can be included in the scope of this modification. There will be a permit condition to this effect. The store may not receive a Certificate of Occupancy until the system is inspected and certified by a design professional. Please note that this request for additional information is in response to a preliminary review. The requested information should be received by this Office prior to June 5, 1999, or the application will be returned as incomplete. The return of a project will necessitate resubmittal of all required items, including the application fee. The Division is allowed 90 days from the receipt of a completed application to issue the permit. The existing store will be expanded from a +/-75,780 sf Wal- Mart store to a +/-186,130 sf Wal-Mart SuperCenter. All of the development has been accounted for in the stormwater calculations. The stormwater system will be a combination of catch basins and pipes which will convey all runoff from this development to the stormwater management (SWM) facilities. The existing development currently has a water quality pond on site. The amount of impervious area to this pond will be significantly reduced with the expansion. The only modification to this facility will be reducing the size of the orifice for the release of the first one (1 ") inch of rainfall. The proposed SWM facility is required to control the first one 0 ") inch of runoff from the site, and it has been sized to release the 100 year storm event through the top of the riser. All runoff will be directed to the western portion of the site. This SWM facility will also serve as a sediment basin during the construction phase. Please also note that the pond will be a wet detention pond in order to satisfy the requirements of the Division of Water Quality of NCDENR. Those calculations are also included with this report. The first one 0 ") inch of rainfall volume will be released over a period of between two and five days. DRAINAGE AREAS: In the pre -expansion condition, approximately 14.77 acres drains to the existing pond. Out of this 14.77 acres, 9.54 acres is impervious. With the expansion of the existing Wal- Mart Store, the impervious area directed to the existing pond is decreased to 5.05 acres. The decrease is mainly due to the rerouting of the roof drainage from the building. Currently the roof drainage is collected underground and piped to the pond. After the expansion of the store, the roof will discharge all drainage to the rear of the building via downspouts which release onto the pavement. The runoff will then enter the storm drain system and flow to the forebay of the proposed pond in the rear of the store. The entire drainage area to the existing pond will be decreased from 14.77 acres to 6.47 acres. The drainage area to the proposed pond in the rear of the store is 11.08 acres. Of this area, 7.73 acres is to be impervious. This results in an impervious area equal to 69:8% of the drainage area. The corresponding calculations for water quality are included with this report. SWM FACILITY SIZING: The proposed SWM facility will be constructed in the northwestern corner of the site to the rear of the building. The facility will have a bottom elevation of 5.0 and the top of the berm will be 15.0. The permanent pool elevation is 11.0 with side slopes of 6:1 for the first twelve (12') feet. From this point, (elevation 9.0), the side slopes are to be 3:1 to elevation 5.0. Also, the side slopes from elevation 11.0 to the top of the berm are to be 3:1. The proposed pond is to have a forebay volume equal to +/-20% of the volume of the permanent pool. The forebay shown on our plans has a volume equal to 20.0% of the total permanent pool volume. The stormwater runoff from the site is directed to the forebay through the storm drain system. The runoff discharges from the 36" storm drain pipe accross the energy dissipater shown and into the forebay. The calculations attached show that the first one (I ") inch of rainfall from the site will be released from the proposed outlet structure over a period of 3.34 days. The calculations also show that the 100 year storm runoff will pass through the top of the riser. Please delineate all jurisdictional wetlands, or note on the plans that none exist. Ponds may not be located in wetlands. 11. Please provide the dimensions and radii of each side of the figure created by the permanent pool. 12. Please add the vegetated filter detail to the plans for both ponds. Include the flow spreader mechanism type, elevations, and type of grass to be planted. Also include calculations indicating a non -erosive velocity for the 10 year storm. 13. Please indicate the diameter of the trash rack on the detail. 14. If the orifice is to be placed into the riser with no slope, ie., flat, please specify a trash guard for the orifice. You may also elect to place the orifice at a negative slope, ie., the pond side inlet 6" below the permanent pool elevation, with the outlet end into the riser at the permanent pool elevation. This design eliminates the need for additional trash screens. 15. The outlet detail has a note that says to extend the trash rack below the weir. What weir is that note referring to? No other outlets except the orifice are allowed between the permanent pool and the storage elevation. 16. Please label and delineate the permanent pool and storage pool contours on the grading plan. The existing pond must have the sediment removed and be brought back into compliance prior to issuing this permit modification. Please note that this request for additional information is in response to a preliminary review. The requested information should be received by this Office prior to March 3, 1999, or the application will be returned as incomplete. The return of a project will necessitate resubmittal of all required items, including the application fee.
