The level of water in the pond after 5 days without rain still indicates that either the orifice is not functioning, or the outlet ditch watel level is higher than originally estimated. This will result in the pond never being able to drawdown, and having insufficient storage for the first 1" of runoff. The inspection was performed to determine the status of compliance with Stormwater Certification Number 910501, issued to you on July 16, 1991. The project has been found in violation of Stormwater Certification Number 910501, issued pursuant to the requirements of 15A NCAC 211.1003(i). The violations found are: 1. Failure to respond to the November 17, 1994 Compliance Inspection. 2. Failure to maintain the pond according to the approved Operation and Maintenance plan. To correct these violations you must : 1. Perform routine maintenance on the pond. Unclog the small diameter orifice. The pond level after 5 days without rain was approximately 2.0' above the design permanent pool elevation. A large hole next to the outlet structure has opened up and is possibly allowing water to escape the pond without treatment. Trash has accumulated on the trash rack and may be blocking the flow of water over the grate during large storms. The functioning of the orifice is of utmost importance in meeting water quality standards in this pond. Per the Jertification, you must maintain the pond according to the agreement. Failure to provide the "Plan of Action" or to correct the violations by the date designated in the "Plan of Action", are considered violations of 15A NCAC 2H.1000, and may result in the initiation of enforcement action which may include recommendations for the assessment of civil and criminal penalties, pursuant to NCGS 143-215.6A. By copy of this letter to the Attorney General's Office, I am requesting that they review this case for possible enforcement action, including the assessment of penalties.
