The Wilmington Regional Office received a complete 8 year Stormwater Management Permit
Renewal Application for Liberty Commons on February 22, 2012. This site was inspected on
March 15, 2012. As noted in the enclosed inspection report the site is currently in compliance
with the terms and conditions of the current state stormwater permit. The Division is hereby
notifying you that permit SW8 901210 has been renewed on March 16, 2012, and shall be
effective until April 16, 2020. The plans previously approved on April 16, 1991, in accordance
with the regulations set forth in Title 15A NCAC 2H.1000 effective September 1, 1995, remain in
full force and effect. Please attach this cover letter and new page 2 of the permit to your High
Density Permit originally issued on April 16, 1991.
This permit is subject to the conditions and limitations as specified therein. Please pay special
attention to the conditions listed in this permit regarding the Operation and Maintenance of the
BMP(s), recordation of deed restrictions, procedures for changes of ownership, transferring the
permit, and renewing the permit. Failure to establish an adequate system for operation and
maintenance of the stormwater management system, to record deed restrictions, to transfer the
permit, or to renew the permit, will result in future compliance problems. .
If any parts, requirements, or limitations contained in this permit are unacceptable, you have the
right to request an adjudicatory hearing by filing a written petition with the Office of
Administrative Hearings (OAH). The written petition must conform to Chapter 150E of the North
Carolina General Statutes, and must be filed with the OAH within thirty (30) days of receipt of
this permit. You should contact the OAH with all questions regarding the filing fee (if a filing fee
is required) and/or the details of the filing process at 6714 Mail Service Center, Raleigh, NC
27699-6714, or via telephone at 919-431-3000, or visit their website at www.NCOAH.com.
Unless such demands are made this permit shall be final and binding.

FOR THE
construction, operation and maintenance of a wet detention pond in compliance with the
provisions of 15A NCAC 2H .1000 (hereafter referred to as the "stormwater rules') and
the approved stormwater management plans and specifications and other supporting
data as attached and on file with and approved by the Division of Water Quality and
considered a part of this permit.
The permit is hereby renewed subject to the following addendums, clarifications,
conditions and limitations:
1. The original permit conditions contained in the permit issued on April 16,
1991 remain in full force and effect, except as amended herein. (An additional
copy of this original Permit can be obtained from the Division of Water
Quality, Wilmington Regional Office.)
2. This permit shall be effective from the date of issuance until April 16, 2020.
3. The permittee shall submit a permit renewal application request at least 180
days prior to the expiration date of this permit. The renewal request must
include the applicable documentation and the processing fee.
4. Decorative spray fountains are allowed in a wet detention pond,subject to the
following criteria:
a. The fountain must draw its water from less than 2' below the permanent
pool surface.
b. Separated units, where the nozzle, pump and intake are connected by
tubing, may be used only if they draw water from the surface in the
deepest part of the pond.
c. The falling water from the fountain must be centered in the pond, away
from the shoreline.
d. The maximum horsepower for a fountain in this pond is 1/8 horsepower.
e. A fountain is not allowed if the permanent pool volume of the pond is less
than 30,000 cubic feet.
5. If the use of permeable pavement is desired, this permit must be modified to
add the permeable pavement conditions.
Operations and Maintenance Verification

A. Remove debris from the trash rack.
B. Check and clear the orifice of any obstructions. If a pump is used as the drawdown mechanism, check for
pump operation.
C. Check the pond side slopes; remove trash, repair eroded areas before the next rainfall even.
D. If the pond is operated with a vegetated filter, check the filter for sediment accumulation, erosion and
proper operation of the flow spreader mechanism. Repair as necessary.
Quarterly
A. Inspect the collection system (i.e., catch basin, piping, grassed swales) for proper functioning. Clear
accumulated trash from basin grates and basin bottoms, and check piping for obstructions.
B. Check pond inlet pipes for undercutting, replace riprap, and repair broken pipes.
C. Reseed grassed males, including the vegetated filter if applicable, twice a year as necessary. Repair
eroded areas immediately.
III. Every 6 months
A. Remove accumulated sediment from the bottom of the outlet structure.
B. Check the pond depth at various points in the pond. If depth is reduced to 75% of original design depth,
sediment will be removed to at least original design depth, 2.6 feet.

N. General
A. Mow the side slopes, not including normally submerged vegetated shelf, according to the season.
Maximum grass height will be 6"
B. Cattails, and other indigenous wetland plants, are encouraged along the pond perimeter; however, they must
be removed when they cover the entire surface area of the pond.
C. The orifice is designed to draw down the pond in 2-5 days. If drawdown is not accomplished in that time,
the system may be clogged. The source of the clogging must be found and eliminated.
D. All components of the detention pond system must be kept in good working order.

General Description: The project consists of construction of an 18,450 square foot addition
to the existing building and additional parking areas, walks and miscellaneous site
improvements. The existing stormwater detention pond will be enlarged and a new outlet
structure and vegetative Swale constructed to handle this project plus the runoff from a
future additional wing and parking area. The revised pond is designed to meet both the
State stormwater regulations (water quality) and City of Wilmington requirements (quantity)
for the ultimate development of the project. Controlled release of the first one inch of
runoff from the impervious surfaces is through an orifice on a negatively sloped outlet pipe.
Operation: The wet detention pond is designed to maintain a permanent water pool with
an average depth of 3.5 feet. The pond is designed to temporarily store an amount of water
equivalent to 1 inch of storm water runoff from the impervious areas above the normal pool.
In the event of a 1 inch rainfall, the wet detention pond is designed such that the water
surface will rise approximately 1.50 feet above the normal pool level. This increase in water
depth wil] slowly recede to the normal pool level in a two to three day time period. This
drawdown time is controlled by a 1 : inch diameter PVC drawdown pipe submerged 1 foot
below the normal pool elevation to reduce the possible accumulation of trash on the orifice.
In rain events which produce more than the I inch runoff, excess runoff will be routed over
a riser weir to a vegetative swale downstream of the pond outlet. This diversion system is

designed based on the ten year frequency storm event. Additional storage is provided for
containing the 50 year storm to conform with the City of Wilmington stormwater regulations.
An emergency spillway is provided for storm events in excess of a 50 year magnitude.
Maintenance: Several areas will need attention by Owner's maintenance personnel for the
continued performance of this system as designed and as required by the Division of
Environmental Management. These items are detailed as follows:
1. Grassing around the wet detention pond shall be maintained to prevent the erosion
of these areas. The areas shall be periodically mowed to maintain the aesthetic
quality of the site and to prevent a reduction in capacity of the storm water system.
2. Landscaping of the areas around the wet detention pond shall be of the type and
located such that it will not reduce the capacity or operation of the storm water
system.
3. Following each rain event at the site, the drawdown tube orifice shall be checked for
accumulation of debris and cleared of any blockage that is present. If the water level
following a rain event fails to recede to the normal pool elevation within the two to
five day time period, the Engineer must be notified as soon as possible. If the water
level fails to recede within a period of five days following a rain event, the Owner
must notify the Division of Environmental Management, 7225 Wrightsville Avenue,

4. Storm drainage pipes and culverts shall be inspected periodically for debris and sand
build-up. These shall be cleaned as necessary to provide for the conveyance of storm
water as designed.
5. The wet detention pond depth shall be maintained at the design depth. The pond
shall be inspected a minimum of every six months and cleaned as necessary.
6. No modifications shall be made to the system without notification of the Engineer
or approval from the Division of Environmental Management.
