Skvarla, III Secretary The Wilmington Regional Office received a complete State Stormwater Management Permit Application for Serenity Point on February 21, 2013. Staff review of the plans and specifications has determined that the project, as proposed, will comply with the Stormwater Regulations set forth in Session Law 2008-211 and Title 15A NCAC 2H.1000. We are forwarding Permit No. SW8130103 dated February 22, 2013, for the construction, operation, and maintenance of the BMP's and built -upon area associated with the subject project. This permit shall be effective from the date of issuance until February 22, 2021, and shall be subject to the conditions and limitations as specified therein. Please pay special attention to the Operation and Maintenance requirements in this permit. Failure to establish an adequate system for operation and maintenance of the stormwater management system will result in future compliance problems. If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to request an adjudicatory hearing by filing a written petition with the Office of Administrative Hearings (OAH). The written petition must conform to Chapter 150B of the North Carolina General Statutes, and must be filed with the OAH within thirty (30) days of receipt of this permit. This permit shall be effective from the date of issuance until February 22, 2021, and shall be subject to the following specified conditions and limitations: I. DESIGN STANDARDS This entire project is within 575ft of a saltwater outstanding resource water (ORW). Per 15A NCAC 2H .1007(2), the ORW Area of Environmental Concern (AEC) is delineated on the plans. The area inside the ORW AEC must maintain a 25% maximum impervious area. 2. This project is within a half mile of and draining to shellfish (SA) waters. Per SL2008-211, Section 2(b), (1)(c), stormwater discharges are prohibited. This project complies with this requirement by infiltrating the design stone. 3. Both infiltration trenches have been designed to infiltrate the 10yr24hr storm at half the infiltration rate reported in the soils report. Therefore the oftline bypass and the vegetated filter strip are not required for either infiltration trench. 4. This permit is effective only with respect to the nature and volume of stormwater described in the application and other supporting data. 5. This stormwater system has been approved for the management of stormwater runoff as described in Section 1.8 of this permit. The stormwater control has been designed to handle the runoff from 11,525 square feet of impervious area in drainage area 1 and 10,775 square feet of impervious area in drainage area 2. 6. The tract will be limited to the amount of built -upon area indicated in Section 1.10 of this permit, and as shown on the approved plans. The built -upon area for the future development is limited to 840 square feet in each drainage area. Page 2 of 7 State Stormwater Management Systems Permit No. SW8130103 7. All stormwater collection and treatment systems must be located in either dedicated common areas or recorded easements. The final plats for the project will be recorded showing all such required easements, in accordance with the approved plans. 8. The runoff from all built -upon area within the permitted drainage area of this project must be directed into the permitted stormwater control system. 9. The project shall provide a 50' wide vegetated buffer adjacent surface waters, measured horizontally from and perpendicular to the normal pool of impounded structures, the top of bank of streams and rivers, and the mean high water line of tidal waters. 10. Therefore, the trenches are 2ft above the seasonal high water table, but the stone base is within 2ft. The `bottom elevation' refers to the bottom of the trenches. *** Both trenches can infiltrate the 10y24hr storm event at half the reported rate without discharge. Therefore no vegetated filter strip or bypass is required. Page 3 of 7 State Stormwater Management Systems Permit No. SW8130103 II. SCHEDULE OF COMPLIANCE 1. The stormwater management system shall be constructed in its entirety, vegetated and operational for its intended use prior to the construction of any built -upon surface. 2. During construction, erosion shall be kept to a minimum and any eroded areas of the system will be repaired immediately. 3. The permittee shall at all times provide the operation and maintenance necessary to assure the permitted stormwater system functions at optimum efficiency. The approved Operation and Maintenance Plan must be followed in its entirety and maintenance must occur at the scheduled intervals including, but not limited to: a. Semiannual scheduled inspections (every 6 months). b. Sediment removal. C. Mowing and revegetation of slopes and the vegetated filter. d. Immediate repair of eroded areas. e. Maintenance of all slopes in accordance with approved plans and specifications. f. Debris removal and unclogging of bypass structure, infiltration media, flow spreader, catch basins, piping and vegetated filter. g. A clear access path to the bypass structure must be available at all times. 4. The facilities shall be constructed as shown on the approved plans. This permit shall become voidable unless the facilities are constructed in accordance with the conditions of this permit, the approved plans and specifications, and other supporting data. 5. If the stormwater system was used as an Erosion Control device, it must be restored to design condition prior to operation as a stormwater treatment device, and prior to occupancy of the facility. 6. A copy of the approved plans and specifications shall be maintained on file by the Permittee for a minimum of ten years from the date of the completion of construction. 7. Records of maintenance performance activities must be kept for each permitted BMP. The reports will indicate the date, activity, name of person performing the work and what actions were taken. S. Upon completion of construction, prior to issuance of a Certificate of Occupancy, and prior to operation of this permitted facility, a certification must be received from an appropriate designer for the system installed certifying that the permitted facility has been installed in accordance with this permit, the approved plans and specifications, and other supporting documentation. Any deviations from the approved plans and specifications must be noted on the Certification. A modification may be required for those deviations. 9. Access to the stormwater facilities shall be maintained via appropriate easements at all times. 10. The permittee shall submit to the Director and shall have received approval for revised plans, specifications, and calculations prior to construction, for any modification to the approved plans, including, but not limited to, those listed below: a. Any revision to any item shown on the approved plans, including the stormwater management measures, built -upon area, details, etc. b. Redesign or addition to the approved amount of built -upon area or to the drainage area. C. Further development, subdivision, acquisition, lease or sale of any, all or part of the project area. The project area is defined as all property owned by the permittee, for which Sedimentation and Erosion Control Plan approval or a CAMA Major permit was sought. d. Filling in, altering, or piping of any vegetative conveyance shown on the approved plan. 11. The permittee shall submit final site layout and grading plans for any areas noted as future development on the approved plans, prior to construction. 12. The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made. GENERAL CONDITIONS Approved plans, application, supplement forms, Operation and Maintenance agreements, design calculations and specifications for this project are incorporated by reference and are enforceable parts of the permit. 2. This permit is not transferable to any person or entity except after notice to and approval by the Director. At least 30 days prior to a change of ownership, or a name change of the permittee or project, or a mailing address change, the permittee must submit a completed and signed Name/Ownership Change form to the Division of Water Quality, accompanied by the appropriate documentation as listed on the form. The approval of this request will be considered on its merits and may or may not be approved. 3. The permittee is responsible for compliance with all permit conditions until such time as the Division approves the transfer request. Neither the sale of the project area in whole or in part, nor the conveyance of common area to a third party constitutes an approved transfer request. 4. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to enforcement action by the Division of Water Quality, in accordance with North Carolina General Statute 143- 215.6A to 143-215.6C. 5. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances, which may be imposed by other government agencies (local, state, and federal) having jurisdiction. 6. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Permittee shall take immediate corrective action, including those as may be required by this Division, such as the construction of additional or replacement stormwater management systems. The permittee grants DENR Staff permission to enter the property during normal business hours for the purpose of inspecting all components of the permitted stormwater management facility. 8. The permit issued shall continue in force and effect until revoked or terminated. The permit may be modified, revoked and reissued or terminated for cause. The filing of a request for a permit modification, revocation and reissuance or termination does not stay any permit condition. 9. Unless specified elsewhere, permanent seeding requirements for the stormwater controls must follow the guidelines established in the North Carolina Erosion and Sediment Control Planning and Design Manual. 10. The issuance of this permit does not prohibit the Director from reopening and modifying the permit, revoking and reissuing the permit, or terminating the permit as allowed by the laws, rules and regulations contained in Session Law 2008-211, Title 15A NCAC 2H.1000, and NCGS 143-215.1 et. al. 11. The permittee shall submit a permit renewal application at least 180 days prior to the expiration date of this permit. Seasonal High Watertable Estimate Hand auger borings were advanced at two locations to a depth of approximately 5 feet below the existing ground surface in areas proposed by the civil designer for infiltration structures. The encountered soils were logged and visually classified by depth and a Munsell Soil Color Chart was used to determine the hue. value, and chroma of the visually distinct soil layers. Our soil logs are presented in Table 1. INF-1 Soils encountered in our boring at this location consisted of interbedded relatively clean fine sands with the exception of the soils in the upper 7 inches which were clayey sands and are likely fill soils. No distinct zones of soil cementation were encountered in the profile. Based on our experience with similar soils and comparisons of the soil coloration to the Munsell Chart, it is Our opinion that the seasonal high water table occurs approximately 45 inches below the ground surface. For purposes of sizing the structure we recommend an ultimate application rate of 13 and 7.7 inches per hour, respectively. Per our conversation on 2/20/13, the entire project is located within 575' of the ORW. Therefore allocating the impervious area per drainage area is not applicable. 2. Per our conversation, the stone bed layer below the Ecorain Tanks is for structural integrity of the system (not for stormwater storage). All stormwater storage volume is located within the Ecorain Tanks. For clarification, a note was added to the "EcoRain Tank Cross Section A -A" detail on Sheet C3 that reads "Stone base is required for structural integrity of system." Therefore the bottom of both the infiltration systems are 2' above the SHWT elevation. 3. Attached is a second soils report in the location of infiltration trench #2 (do not disregard previously submitted soils report). Per the soils report, the infiltration rate below trench 42 is 3.5 in/hr. Also note that the bore test in the location of infiltration trench #2 has been changed to Bore Test #3 to match the soils report dated 1-18-13. The infiltration rates for each bore location have been added to Sheet C1. The "Infiltration System Investigation" report has been revised and is attached to reflect the information for bore test 93. When the houses are constructed, the roof drains will be connected to the infiltration trenches by the house builder. The roof drains can be connected at any point in the infiltration system. The "Fabric Pipe Boot for Raintank" detail on Sheet C3 is intended for the larger drainage pipes that will be connected during the site construction. 6. The existing road is already in place. No off -site work is proposed. 7. A 50' buffer has been added to Sheet CI that is offset from the Mean High Water Line. 8. Drainage easements have been added and labeled on Sheet C1. 9. Bearings and distances have been added to the lot lines on Sheet C1. 10. The delineated wetlands have been added and labeled to Sheet C1. 11. New Hanover County requires an emergency overflow device for the infiltration trenches. The control structure detains the 10-yr, 24-hour storm event. The control structure is sized such that it will activate for storms greater than the I0-year even. The proposed system exceeds NCDENR requirements. 12. A note has been added to Sheet C 1 that the proximity of the infiltration trench to the proposed structures should not compromise the structural integrity of the building foundation. 13. It is unlikely that the off -site well is for water supply because the adjacent lot has a water service line provided by CFPUA. 14. The stone base is required by the manufacturer. It helps with the stability/support of the raintanks and to decrease washout/erosion around the raintanks when it begins to infiltrate into the ground. The detail shows that a filter fabric will be wrapped around the raintanks (not the stone). Therefore all of the stormwater storage will be contained in the raintanks, not in the stone. The stone bed layer beneath the raintank is not used for storm water storage. Only for structural integrity of the system. This may not be of relevance to DENR, but with the City of Wilmington we have established that the stone layer of these systems may encroach within the 2' limit of SHWT since they are not used for storage purposes. This helps due to the fact that the SHWT is generally very shallow around here. Serenity Point is one of these cases where we need all the clearance we can get. Is this something you can work with us on? Thanks. 2. Bottom Elevation of the Trench: The bottom elevation should be the bottom of the system. In this case, the EcoRain Tank shows a stone bed underneath the tank. The bottom elevations are therefore 3.08msl (rather than 3.75ms1) for infiltration trench #1, and 3.33msl (rather than 4.Omsl) for infiltration trench #2. Serenity Point is owned by Coba Ventures, LLC. The entire site is approximately 2.04 acres of land, of which 1.5 acres is proposed for disturbance. Serenity Point will be serviced by CFPUA for public sewer and water. The site is adjacent to the Intracoastal Waterway and includes CAMA setbacks as shown on the plan. Coba Ventures, LLC is proposing four residential lots, gravel roadway, future sidewalks, and two underground infiltration systems. New impervious area for this project is estimated to be 22,645 sf. (0.52 acres). After project completion, the total amount of impervious area for this site will be approximately 25.0% of the entire site. The estimated amount of disturbed area is 1.5 acres. The site will have two drainage areas. No off -site runoff flows onto the site and therefore, none will be routed to the proposed BMP's. All outflow from the drainage basins will drain to the Intracoastal Waterway; classification SA;ORW, Index No. 18-87- (25.5), in the Cape Fear River Basin. All built up areas (BUAs) will be collected and routed to the underground infiltration system BMP's. The infiltration basins are designed to meet the State's 1.5" requirement and alternately sized for the 1-yr, 10-yr, 25-yr, and 100-yr storm events. Calculations have also been provided to demonstrate that the 10-yr 24-hour storm event can be infiltrated without discharging the system using an infiltration rate of one-half of the infiltration rate reported in the soils report, therefore waiving the State required off-line bypass and vegetated filter strip. To evenly distribute discharge to the infiltration basin, separate drop inlets are proposed around the perimeter of the basin. The maximum volume allowed per inlet is 2.0 acre -inches (NCDENR BMP Manual section 16.3.3,2). The infiltration system was designed to meet or exceed current State and County requirements and is designed for high density projects. Infiltration in fill is prohibited by rule unless it is approved on a case by case basis [15A NCAC 2H .1008(d) (7)]. This would be considerably more fill than I have seen Vince approve in the past. I just looked at his calendar and he is out until 12/27 (-2 weeks). I think it would be best to return the application until Vince can get out to the site. I will send the attached letter today. (As a side note, if infil trenches don't work out you may want to think about permeable pavement. The design as re -done in October and it now gives 75% credit for A&B soils and you can also route adjacent roofs to the pavement and get some credit for the roofs, too. You may be able to get under the LD threshold that way, and perm pavement can go on fill if you do it the way the manual specifies.) Serenity Point is owned by Coba Ventures, LLC. The entire site is approximately 2.04 acres of land, of which 1.5 acres is proposed for disturbance. Serenity Point will be serviced by CFPUA for public sewer and water. The site is adjacent to the Intracoastal Waterway and includes CAMA setbacks as shown on the plan. Coba Ventures, LLC is proposing four residential lots, gravel roadway, future sidewalks, and two underground infiltration systems. New impervious area for this project is estimated to be 22,965 sf. (0.53 acres). After project completion, the total amount of impervious area for this site will be approximately 25.4% of the entire site. The estimated amount of disturbed area is 1.5 acres. The site will have two drainage areas. No off -site runoff flows onto the site and therefore, none will be routed to the proposed BMP's. All outflow from the drainage basins will drain to the Intracoastal Waterway; classification SA;ORW, Index No. 18-87- (25.5), in the Cape Fear River Basin. All built up areas (BUAs) will be collected and routed to the underground infiltration system BMP's. The infiltration basins are designed to meet the State's 1.5" requirement and alternately sized for the 1-yr, 10-yr, 25-yr, and 100-yr storm events. Calculations have also been provided to demonstrate that the 10-yr 24-hour storm event can be infiltrated without discharging the system using an infiltration rate of one-half of the infiltration rate reported in the soils report, therefore waiving the State required off-line bypass and vegetated filter strip. To evenly distribute discharge to the infiltration basin, separate drop inlets are proposed around the perimeter of the basin. The maximum volume allowed per inlet is 2.0 acre -inches (NCDENR BMP Manual section 16.3.3,2). The infiltration system was designed to meet or exceed current State and County requirements and is designed for high density projects. Outflow from the infiltration systems will be directed through proposed control structures that will discharge stormwater via overland flow. The SHGWT elevation is approximately 2' below the proposed bottom elevation_in the„ — infiltration systems. �Q lE M �N E DEC 112111 13v:. r TE 12033 Prior to clearing of the site, a construction entrance and temporary silt fence will be installed. The removal of trees and vegetation will occur. The roadway and building locations will then be graded. Underground utilities, including the stormwater drainage system will be installed and inlet protection put into place. Temporary erosion control measures will remain in -place until such time as when areas are stabilized. Permanent measures include permanent stands of grass. Specific measures and directions to the contractor are noted on the plans. Please refer to Sheet C2 for detail erosion control measures and construction sequence. Summary For this project, all on -site drainage will be collected by a stormwater drainage system and routed to two underground infiltration systems. The infiltration systems have been sized to detain the pre/post development runoff for the 24-hour 1-yr, 2-yr, 10-yr. 25-yr., and 100-yr. storm events and to capture the first 1.5" of runoff from the new development. October 16 2012 ,02 Reference: Infiltration Testing and Seasonal High Watertable Estimates Serenity Point Serenity Point at Channel Haven Wilmington, North Carolina RFTS Job No. 782-12 Dear Mr. Tripp: RFTS is pleased to provide testing services during the design phase of the residential development located off Serenity Point in the Channel Haven development in Wilmington, North Carolina. Specific site grading plans had not been provided to us at the time this report was prepared. DESCRIPTION OF ACTIVITIES AND FINDINGS As requested, our staff visited the site on October 9, 2012, to perform infiltration testing and estimate the seasonal high watertable at two locations identified by you. The purpose of this testing was to provide soil parameters for stormwater infiltration design. Seasonal High Watertable Estimate Hand auger borings were advanced at two locations to a depth of approximately 5 feet below the existing ground surface in areas proposed by the civil designer for infiltration structures. The encountered soils were logged and visually classified by depth and a Munsell Soil Color Chart was used to determine the hue, value, and chroma of the visually distinct soil layers. Our soil logs are presented in Table 1. fNF-1 Soils encountered in our boring at this location consisted of interbedded relatively clean fine sands with the exception of the soils in the upper 7 inches which were clayey sands and are likely fill soils. No distinct zones of soil cementation were encountered in the profile. Based on our experience with similar soils and comparisons of the soil coloration to the Munsell Chart, it is our opinion that the seasonal high water table occurs approximately 45 inches below the ground surface. Infiltration Testing Infiltration testing was performed using a model 2800 Guelph Permeameter which is a constant -head device which operates on the Mariotte siphon principle and is referenced in ASTM D-5126. The permeameter is used to determine field saturated hydraulic conductivity in centimeters per second for soil at a specified depth. This testing involves advancing a borehole to the desired infiltration depth and introducing water at a constant head to determine the steady state flow rate from which the hydraulic conductivity can be calculated. Our testing was performed at approximately 21 inches below the ground surface at both INF-1 and INF-2, and was approximately 27 inches above the seasonal high water estimate. The results of our permeameter testing are presented in Table 2. RECOMMENDATIONS Based on the results of our field testing and soil classifications at the test location, we offer the following recommendations for stormwater infiltration design: At the test locations INF-1 and INF-2, it is our opinion that in order to achieve the steady state flow rates obtained during our testing; the areas of infiltration galleries or other infiltration structure should introduce stormwater at approximately 24 inches below the existing ground surface elevation. For purposes of sizing the structure we recommend an ultimate application rate of 1.3 and 7.7 inches per hour, respectively. These recommendations should be reviewed by appropriate regulatory authorities before finalizing the details of any civil design. Tripp Engineering, P.C.
