Box 1237 Jacksonville, NC 28541 Subject: State Stormwater Management Permit No. SW8 121110 School Street Center High Density Commercial Sand Filter Project onslow County Dear Mr. Lanier: Effective August 1, 2013, the State Stormwater program was transferred from the Division of Water Quality (DWQ) to the Division of Energy, Mineral and Land Resources (DEMLR). All previous references to DWQ will remain in older stormwater permits issued prior to August 1, 2013 until they are modified. Please note that this permit references DEMLR as the Division responsible for issuance of the permit. The Wilmington Regional Office received a complete, modified Stormwater Management Permit Application for School Street Center on July 31, 2019. Staff review of the plans and specifications has determined that the project, as proposed, will comply with the Stormwater Regulations set forth in Session Law 2008-211 and Title 15A NCAC 2H.1000. We are forwarding modified Permit No. SW8 121 1 10, dated August 2, 2019, for the construction, operation and maintenance of the BMP's and built - upon area associated with the subject project. Please replace the previously approved plan sheets with the attached modified and approved versions. Please replace the previous application (SWU-101), supplement, and operation and maintenance agreement with the attached modified versions. Please note that the renewed, updated, and re -issued permit does not impose new or different terms; it merely restates and clarifies some of the previous terms to provide you with a better understanding of your obligations under the permit. This permit shall be effective from the date of issuance until May 2, 2021, and shall be subject to the conditions and limitations as specified therein, and does not supersede any other agency permit that may be required. Please pay special attention to the conditions listed in this permit regarding the Operation and Maintenance of the BMP(s), stormwater collection system, and/or vegetated conveyances; the limitation of built -upon area; modification of the project; the procedures for changing ownership of and/or transferring the permit; and the need to renew the permit. Please also pay attention to the permit conditions that requires the recordation of deed restrictions and protective covenants, easements, and the maintenance agreement, which must all be provided along with certification upon completion of the project. Failure to comply with these requirements will result in future compliance problems. Please refer to Attachment C for a detailed description of the current proposed major modification approved during the effective period of the permit. If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to request an adjudicatory hearing by filing a written petition with the Office of Administrative Hearings (OAI-I). The written petition must conform to Chapter 150B of the North Carolina General Statutes and must be filed with the OAH within thirty (30) days of receipt of this permit. School Street Center W Corbett Avenue, Swansboro, Onslow County FOR THE construction, operation and maintenance of one (1) sand filter in compliance with Session Law 2008-211 and the provisions of 15A NCAC 2H .1000 (hereafter collectively referred to as the "stormwater rules') and the approved stormwater management plans and specifications and other supporting data as attached and on file with and approved by the Division of Energy, Mineral and Land Resources (the "Division" or "DEMLR") and considered an enforceable part of this permit. This permit shall be effective from the date of issuance until May 2, 2021 and shall be subject to the following specified conditions and limitations: I. DESIGN STANDARDS 1. This permit is effective only with respect to the nature and volume of stormwater described in the application and other supporting data. The maximum amount of built - upon area (BUA) allowed for the entire project is 166,518 square feet. 2. This stormwater system has been approved for the management of stormwater runoff as described in Section 1.6 of this permit. The runoff from all built -upon area within the permitted drainage area of this project must be directed into the permitted stormwater control measure. The stormwater control measure has been designed to handle the runoff from 166,518 square feet of impervious area. 3. The drainage area will be limited to the amount of built -upon area indicated in Sections 1.2 and 1.6 of this permit, and per approved plans. The built -upon area for the future development is limited to 166,518 square feet. 4. The project shall maintain a 50' wide vegetated buffer adjacent to surface waters, measured horizontally from and perpendicular to the normal pool of impounded structures, the top of banks of each side of rivers and streams and the mean high water line of tidal waters. 5. All runoff being directed into wetlands shall flow into and through those wetlands at a non -erosive velocity per 401/404 requirements. Stream Classification "SA, HQW" >/ mile of and drainin to SA Per Section .1008 (h) of the stormwater rules, this alternative design provides equal or better protection under the rules because it closely follows the BMP manual sections for both open and closed sand filters, thus it is considered a "hybrid" design. As an added safety factor, the design includes a curtain drain located around the perimeter of the sand filter to provide for proper drainage under high water table conditions. The design meets the requirements for surface area, volume, and drawdown time for the 1.5" design storm. In addition, the design has an adequate sediment chamber where diffuse flow is distributed over the weir to the top surface of the sand chamber. II. SCHEDULE OF COMPLIANCE No person or other legal entity shall alter the approved stormwater management system, or fill in, alter, or pipe any drainage feature, including swales, shown on the approved plans as part of the stormwater management system, unless and until the permittee submits a modification to the permit and receives approval from the Division. 2. The permittee is responsible for verifying that the proposed built -upon area for the entire project does not exceed the allowable built -upon area. 3. The stormwater management system shall be constructed in its entirety, vegetated and operational for its intended use prior to the construction of any built -upon surface. Page 2 of 7 State Stormwater Management Systems Permit No. SW8 121110 4. During construction, erosion shall be kept to a minimum and any eroded areas of the system will be repaired immediately. Infiltration systems should not be used as erosion control devices, due to the potential clogging. If the stormwater system was used as an Erosion Control device, it must be restored to design condition prior to operation as a stormwater treatment device, and prior to occupancy of the facility. 5. All stormwater collection and treatment systems must be located in either dedicated common areas or recorded easements. The final plats for the project will be recorded showing all such required easements, in accordance with the approved plans. 6. The permittee shall submit to the Director and shall have received approval for revised plans, specifications, and calculations prior to construction, for any modification to the approved plans, including, but not limited to, those listed below: a. Any revision to the approved plans, regardless of size. b. Redesign or addition to the approved amount of built -upon area. C. Further subdivision, acquisition, or sale of all or part of the project area. The project area is defined as all property owned by the permittee, for which Sedimentation and Erosion Control Plan approval or a CAMA Major permit was sought. d. Filling in, altering, or piping of any vegetative conveyance shown on the approved plan. 7. The Director may determine that other revisions to the project should require a modification to the permit. 8. Upon completion of construction, prior to issuance of a Certificate of Occupancy, and prior to operation of this permitted facility, a certification must be received from an appropriate designer for the system installed certifying that the permitted facility has been installed in accordance with this permit, the approved plans and specifications, and other supporting documentation. Any deviations from the approved plans and specifications must be noted on the Certification. A modification may be required for those deviations. 9. The permittee shall at all times provide the operation and maintenance necessary to assure that all components of the permitted stormwater system function at the design condition. The approved Operation and Maintenance Agreement must be followed in its entirety and maintenance must occur at the scheduled intervals including, but not limited to, a. Semiannual scheduled inspections (every 6 months). b. Sediment removal. C. Mowing and revegetation of side slopes. d. Immediate repair of eroded areas. e. Maintenance of side slopes in accordance with approved plans and specifications. f. Debris removal and unclogging of filter media, bypass structures, orifice, catch basins and piping. g. Access to all components of the system must be available at all times. 10. Records of maintenance activities must be kept and made available upon request to authorized personnel of the Division. The records will indicate the date, activity, name of person performing the work and what actions were taken. 11, Prior to transfer of the permit, the stormwater facilities will be inspected by Division personnel. The facility must be in compliance with all permit conditions. Any items not in compliance must be repaired or replaced to design condition prior to the transfer. Records of maintenance activities performed to date will be required. 12. The facilities shall be constructed, operated and maintained in accordance with the provisions of this permit, the approved plans and specifications, and the supporting documents attached to this permit and on file with the Division. 13. Built upon area includes, but is not limited to, structures, asphalt, concrete, gravel, brick, stone, slate, coquina and parking areas, but does not include raised, open wood decking, or the water surface of swimming pools. The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made. III. GENERAL CONDITIONS Any individual or entity found to be in noncompliance with the provisions of a stormwater management permit or the stormwater rules is subject to enforcement action as set forth in NCGS 143 Article 21. 2. Current Permittee Name or Address Changes: The permittee shall submit a completed "Permit Information Update Application Form" (available on the Division website) to the Division within 30 days to making any one or more of the following changes: a. A name change of the current permittee; b. A name change of the project, c. A mailing address change of the permittee; 3. Permit Transfer: This permit is not transferable to any person or entity except after notice to and approval by the Director. The permittee shall submit a completed and signed "Permit Transfer Application Form" (available on the Division website) accompanied by the required fee and supporting documentation as listed on the form, to the Division at least 60 days prior to any one or more of the following events: a. The sale or conveyance of the project area in whole or in part, except in the case of an individual lot sale that is made subject to the recorded deed restrictions and protective covenants; b. The assignment or conveyance of declarant rights to another individual or entity; c. The sale or conveyance of the common areas to a Homeowner's or Property Owner's Association, subject to the requirements of NCGS 143-214.7(c2), d. Dissolution of the partnership, corporate, or LLC entity, subject to NCGS 55-14- 05 or NCGS 57D-6-07 and 08; e. Bankruptcy, f. Foreclosure, subject to the requirements of Session Law 2013-121; 4. The permittee is responsible for compliance with all of the terms and conditions of this permit until such time as the Director approves the transfer request. Neither the sale of the project area in whole or in part, nor the conveyance of common area to a third party, constitutes an approved permit transfer. 5. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances which may be imposed by other government agencies (local, state, and federal) which have jurisdiction. 6. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Permittee shall take immediate corrective action, including those as may be required by this Division, such as the construction of additional or replacement stormwater management systems. 7. The permit issued shall continue in force and effect until the permittee files a request with the Division for a permit modification, transfer, renewal, or rescission; however, these actions do not stay any permit conditions. 8. Approved plans, calculations, supplement forms, operation and maintenance agreements and specifications for this project are incorporated by reference and are enforceable parts of the permit. A copy of the approved plans and specifications shall be maintained on file by the Permittee at all times. 9. Permittee grants permission to staff of the Division to access the property for the purposes of inspecting the stormwater facilities during normal business hours. 15. Permanent seeding requirements for the stormwater control must follow the guidelines established in the North Carolina Erosion and Sediment Control Planning and Design Manual. The issuance of this permit does not prohibit the Director from reopening and modifying the permit, revoking and reissuing the permit, or terminating the permit as allowed by the laws, rules and regulations contained in Session Law 2006-246, Title 15A NCAC 2H.1000, and NCGS 143-215.1 et.al. 17. A permit renewal request must be submitted at least 180 days prior to the expiration date of this permit. The renewal request must include the appropriate application, documentation and the processing fee as outlined in Title 15A NCAC 02H1045(3). I had figured that would all be a part of my Final certification if/when this gets built. I do a lot of Septic system designs with pumps and they all require some field adjustments, that is why we always show a valve. There is no way to 100% accurately calculate the operating nature of the pump, two of the exact same pumps will often times have small but noticeably different pumping rates. Just like with my septic designs we have to do a pump startup and made adjustments to the system. Of course it's much more critical in Septic Drainfield design than stormwater, but I suspect we will fill up the pump station with water turn the pumps on, see how much they pump and adjust accordingly. Sorry, 1 must have missed updating that cell ... 15,069 CF is correct. 2. Also, the supplement says the sand filter will draw down in 40 hours. However, the hydroCAD printouts make it look like it will be pumped down before the 40 hours. Can you confirm the drawdown time? The calculations that are provided in the old BMP Manual show using 40 hrs to calculate the sand chamber size. Jason said that in HydroCAD he assumed 1.75 in/hr as a Rate at which the stormwater will escape through the sand and that this seemed like a conservative number. He is not sure what rate the old BMP assumed. I suppose this is why there is a discrepancy. Using a Rate of 1.75 in/hr it takes approximately 20 hrs for the sand filter to full drain down the design storm based on the above assumptions. It will require at least two modifications (Walmart/SW8 160501 & School Street Center/SW8 121110). But, Walmart is a subdivision and so if this change will impact any of the offsite parcels' permits then'those would have to be modified as well. Another thing to consider would be whether or not there is enough room in the systems for SW8 160501 & SW8 121110 to accommodate the change. (I am not sure if this is a 1:1 impervious area exchange or not?) You will also need to consider if any changes are needed to the deed restrictions for Walmart. The language that you are looking for to include in the deed will be determined during the permit reviews to modify the various permits. The Swansboro Walmart (SW8 160501) is actually in-house and in review currently. My coworker, Christine, is working on that one. The change they are making right now does not include the change for the access road that you are describing, and so it would have to be issued and then it can be modified again. You will want to modify the various permits prior to exchanging the deeds so that all of this can be worked out. (It is actually required by Section II(6) of your permit.) 6. The permittee shall submit to the Director and shall have received approval for revised plans, specifications, and calculations prior to construction, for any modification to the approved plans, including, but not limited to, those listed below: a. Any revision to the approved plans, regardless of size. b. Redesign or addition to the approved amount of built -upon area. C. Further subdivision, acquisition, or sale of all or part of the project area. The project area is defined as all property owned by the permittee, for which Sedimentation and Erosion Control Plan approval or a CAMA Major permit was sought. d. The Swansboro Walmart store is open and an operating business. Walmart will extend Norris Rd to their site. KCI will convey to WAL-MART a 0.46 acre tract for extending Norris Rd. The runoff from the 0.46 acre will be treated by Walmart storm water facilities. WAL-MART will convey KCI a 0.44 acre tract. The 0.44 acre tract will be recombined with the remaining portion of the KCI tract located on the east side of the the Norris Rd extended. It will have a total area of 0.83 acres tract. The runoff from the 0.83 acre tract will be piped under Norris Rd. extended and will be treated by the SW8-12110 facility.
