The Wilmington Regional Office received a complete, Stormwater Management Permit Application for Advance Auto
Parts on May 24, 2012. Staff review of the plans and specifications has determined that the project, as proposed, will
comply with the Stormwater Regulations set forth in Title 15A NCAC 2H.1000 and Session Law 2008-211. We are
forwarding Permit No. SW8120507 dated May 25, 2012, for the construction, operation and maintenance of the
BMP's and built -upon area associated with the subject project.
This permit shall be effective from the date of issuance until May 25, 2020, and shall be subject to the conditions and
limitations as specified therein. Please pay special attention to the conditions listed in this permit regarding the
Operation and Maintenance of the BMP(s), recordation of deed restrictions, certification of the BMP's, procedures for
changes of ownership, transferring the permit, and renewing the permit. Failure to establish an adequate system for
operation and maintenance of the stormwater management system, to record deed restrictions, to certify the BMP's,
to transfer the permit, or to renew the permit, will result in future compliance problems.
If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to request an
adjudicatory hearing by filing a written petition with the Office of Administrative Hearings (OAH). The written petition
must conform to Chapter 150E of the North Carolina General Statutes, and must be filed with the OAH within thirty
(30) days of receipt of this permit. You should contact the OAH with all questions regarding the filing fee (if a filing
fee is required) and/or the details of the filing process at 6714 Mail Service Center, Raleigh, NC 27699-6714, or via

FOR THE
construction, operation and maintenance of a wet detention pond discharging to Class
SA waters in compliance with the provisions of 15A NCAC 2H .1000 and Session Law
2008-211 (hereafter collectively referred to as the "stormwater rules') the approved
stormwater management plans and specifications and other supporting data as
attached and on file with and approved by the Division of Water Quality and considered
a part of this permit.
This permit shall be effective from the date of issuance until May 25, 2020, and shall be
subject to the following specified conditions and limitations:
I. DESIGN STANDARDS
This permit is effective only with respect to the nature and volume of stormwater
described in the application and other supporting data.
2. This stormwater system has been approved for the management of stormwater
runoff as described in Section 1.9 on page 3 of this permit. The stormwater
control has been designed to handle the runoff from 23,774 sf of impervious
area.
3. A 50' wide vegetative buffer must be provided adjacent to surface waters,
measured horizontally from and perpendicular to the normal pool of impounded
structures, the top of bank of both sides of streams and rivers and the mean high
water line of tidal waters.
4. The overflow from the wet pond must flow overland through a level spreader and
50-foot vegetated filter strip designed to pass the peak flow from the 10 year
storm in a diffuse, non -erosive manner.
5. The drainage area will be limited to the amount of built -upon area indicated in
Sections 1.2 and 1.8 of this permit, and per approved plans.

6. All stormwater collection and treatment systems must be located in either
dedicated common areas or recorded easements. The final plats for the project
will be recorded showing all required easements.
7. The runoff from all built -upon area within the permitted drainage area(s) of this
project must be directed into the permitted stormwater control system.

9. A secondary BMP in series with the wet pond must be provided to treat the

It. SCHEDULE OF COMPLIANCE
1. The stormwater management system shall be constructed in its entirety,
vegetated and operational for its intended use prior to the construction of any
built -upon surface.
2. During construction, erosion shall be kept to a minimum and any eroded areas of
the system will be repaired immediately.
3. If the permanent pool volume is less than 30,000 cubic feet, a decorative spray
fountain in not allowed in the stormwater treatment system. This stormwater
pond does not meet the minimum criteria to be allowed a spray fountain.

4. Upon completion of construction, prior to issuance of a Certificate of Occupancy,
and prior to operation of this permitted facility, the permittee shall cause a
certification from an appropriate designer for the system installed to be
submitted, certifying that the permitted facility has been installed in accordance
with this permit, the approved plans and specifications, and other supporting
documentation. Any deviations from the approved plans and specifications must
be noted on the Certification. A modification may be required for those
deviations.
5. The permittee shall at all times provide the operation and maintenance
necessary to assure the permitted stormwater system functions at optimum
efficiency. The approved Operation and Maintenance Plan must be followed in its
entirety and maintenance must occur at the scheduled intervals including, but not
limited to:
a. Semiannual scheduled inspections (every 6 months).
b. Sediment removal.
C. Mowing and re -vegetation of slopes and the vegetated filter.
d. Immediate repair of eroded areas.
e. Maintenance of all slopes in accordance with approved plans and
specifications.
f. Debris removal and unclogging of outlet structure, orifice device, flow
spreader, catch basins and piping.
g. Access to the outlet structure must be available at all times.
6. Records of maintenance activities must be kept and made available upon
request to authorized personnel of DWQ. The records will indicate the date,
activity, name of person performing the work and what actions were taken.
7. The facilities shall be constructed in accordance with the conditions of this
permit, the approved plans and specifications, and other supporting data.
8. If the stormwater system was used as an Erosion Control device, it must be
restored to design condition prior to operation as a stormwater treatment device,
and prior to occupancy of the facility.
9. The permittee shall submit to the Director and shall have received approval for
revised plans, specifications, and calculations prior to construction, for any
modification to the approved plans, including, but not limited to, those listed
below:
a. Any revision to any item shown on the approved plans, including the
stormwater management measures, built -upon area, details, etc.
b. Redesign or addition to the approved amount of built -upon area or to the
drainage area.
C. Further development, subdivision, acquisition, lease or sale of any, all or
part of the project area. The project area is defined as all property owned
by the permittee, for which Sedimentation and Erosion Control Plan
approval or a CAMA Major permit was sought.
d. Filling in, altering, or piping of any vegetative conveyance shown on the
approved plan.
e. The construction of any permitted BUA within the undeveloped future
areas shown on the approved plans.
10. Access to the stormwater facilities for inspection and maintenance shall be
maintained via appropriate recorded easements at all times.
11. The Director may notify the permittee when the permitted site does not meet one
or more of the minimum requirements of the permit. Within the time frame
specified in the notice, the permittee shall submit a written time schedule to the
Director for modifying the site to meet minimum requirements. The permittee
shall provide copies of revised plans and certification in writing to the Director
that the changes have been made.

11. A copy of the approved plans and specifications shall be maintained on file by
the Permittee at all times.
III. GENERAL CONDITIONS
This permit is not transferable to any person or entity except after notice to and
approval by the Director. At least 30 days prior to a change of ownership, or a
name change of the permittee or of the project, or a mailing address change, the
Frmittee must submit a completed and signed Name/Ownership Change Form
o the Division of Water Quality, accompanied by the supporting documentation
as listed on the form. The approval of this request will be considered on its merits
and may or may not be approved.
2. The permittee is responsible for compliance with all permit conditions until such
time as the Division approves the transfer request. Neither the sale of the project
nor the conveyance of common area to a third party constitutes an approved
transfer of the stormwater permit.
3. Failure to abide by the conditions and limitations contained in this permit may
subject the Permittee to enforcement action by the Division of Water Qualityy, in
accordance with North Carolina General Statute 143-215.6A to 143-215.6C.
4. The issuance of this permit does not preclude the Permittee from complying with
any and all statutes, rules, regulations, or ordinances, which may be imposed by
other government agencies (local, state, and federal) having jurisdiction.
5. In the event that the facilities fail to perform satisfactorily the Permittee shall take
immediate corrective action, including those as may be required by this Division,
such as the construction of additional or replacement stormwater management
systems. Additional or replacement stormwater management systems shall
receive a permit from the Division prior to construction.
6. The permittee grants DENR Staff permission to enter the property during normal
business hours for the purpose of inspecting all components of the permitted
stormwater management facility.
7. The permit remains in force and effect until modified, revoked, terminated or
renewed. The permit may be modified, revoked and reissued or terminated for
cause. The filing of a request for a permit modification, revocation and re -
issuance or termination does not stay any permit condition.
8. Unless specified elsewhere, permanent seeding requirements for the stormwater
control must follow the guidelines established in the North Carolina Erosion and
Sediment Control Planning and Design Manual.
9. Approved plans, specifications, application forms, and design calculations for this
project are incorporated by reference and are enforceable parts of the permit.
10. The permittee shall submit a permit renewal request at least 180 days prior to the
expiration date of this permit. The renewal request must include the appropriate
documentation and the processing fee.

Only complete application packages will be accepted and reviewed by the Division of Water Quality (DWQ).
A complete package includes all of the items listed below. A detailed application instruction sheet and BMP
checklists are available from http://portal.ncdenr.org/web/wq/ws/su/statesw/forms does. The complete
application package should be submitted to the appropriate DWQ Office. (The appropriate office may be
found by locating project on the interactive online map at http://portal.ncdenr.org/web/wq/ws/su/maps.)
Please indicate that the following required information have been provided by initialing in the space provided
for each item. All original documents MUST be signed and initialed in blue ink. Download the latest versions

receiving stream drains to class SA waters within t/z mile of the site boundary, include the r/2
mile radius on the map.
7. Sealed, signed and dated calculations.
8. Two sets of plans folded to 8.5" x 14" (sealed, signed, & dated), including:

conveyed by this Deed (the "Property") is and shall be subject to the restrictive covenants set
forth herein.
2. Uses. The Property may be used only for those certain Permitted Uses set forth

3. Subdivision. The Property shall not be subdivided without the prior written
consent of Lanwillo Development Company, which consent shall be in the sole discretion of

The Wilmington Regional Office received a Stormwater Management Permit Application for Advance
Auto Parts on May 22, 2012. A preliminary review of that information has determined that the application
is not complete. The following information Is needed to continue the stormwater review:
The outlet structure is located near the inlet pipes and forebay. Please relocate the outlet
structure to the far end of the wet pond furthest away from the inlet pipes so as to prevent
potential short circuiting of the sediment.
2. The wet pond section view on sheet C-9 shows a 2:1 slope on the forebay above the
permanent pool elevation, please correct to 3:1.
Please note that this request for additional information is in response to a partial, preliminary review. The
requested information should be received by this Office prior to May 31, 2012, or the application will be
returned as incomplete. The return of a project will necessitate resubmittal of all required items,
including the application fee.
If you need additional time to submit the information, please mail, email or fax your request for a time
extension to the Division at the address and fax number at the bottom of this letter. The request must
indicate the date by which you expect to submit the required information. The Division is allowed 90 days
from the receipt of a completed application to issue the permit.
The construction of any impervious surfaces, other than a construction entrance under an approved
Sedimentation Erosion Control Plan, is a violation of NCGS 143-215.1 and is subject to enforcement
action pursuant to NCGS 143-215.6A.

need to be revised have been sent to the engineer or agent. All original documents must be returned or

OVERVIEW
Background
This report contains the storm water and erosion control calculations for the proposed
Advance Auto Parts retail site. The project site is located on US Highway 17 at the
intersection with Headwaters Drive. The project consists of 1.342 acres and will be
developed as an Advance Auto Parts retail store with the associated parking & loading areas.
Approximately 1.8 acres will be disturbed as part of this project for the construction of the
site improvements. The entire property is located outside of special flood hazard zones per
the FEMA flood insurance program. The proposed storm water management facility (wet
detention pond) outlined in this report has been designed to treat 0.8 acres of the site with a
maximum impervious area of 68.22% for the drainage area to the wet pond. The overall
impervious area for the site is 40.65% when on -site areas not draining towards the
proposed wet detention pond are accounted for. The site is draining to SA waters, therefore
the storm water management wet detention pond is designed to treat a 1.5" design storm
and 90% TSS with a level spreader/vegetative filter to provide secondary treatment.
There are delineated wetlands on the property that will be disturbed due to the construction
of the site improvements. The USACOE has conducted a site investigation of the wetland
delineation and approved the delineation of the wetland limits as shown on the construction
documents. The US Army Corps of Engineers has issued a Nationwide Permit #39 (Action
ID 2011-02306) for the impact to 0.09 acres of wetlands and 0.01 acres of relatively
permanent waters associated with the development of the proposed project.
Erosion Control
Erosion control measures have been designed in accordance with the NCDENR erosion
control standards and regulations to minimize sediment laden runoff from exiting the site.
Silt fence will be installed along the low sides of the site prior to construction. The
construction entrance will be installed prior to construction commencing. Inlet protection
will be installed around all existing inlets and will be utilized for the proposed curb inlets and
drop inlets. A skimmer basin will be used to treat stormwater runoff prior to leaving the site.
Accumulated sediment within the project site will need to be removed and the pond
constructed to final design conditions prior to final acceptance of the project.
Soils
The Pender County Soils Survey indicates that Alpin Fine Sand and Murville Muck soils are
present on the site.
Site Stabilization
After final grading is completed, permanent vegetation shall be applied in:accordance with=
the seeding requirements and landscape plan for this site. `"- �adj41( V -``

Stormwater Analysis
Storm water runoff from the developed areas of the site will be treated within a wet
detention pond. The pond has been designed to treat a drainage area of 0.8 acres. The site
grading and storm drainage pipe systems are used to divert storm water runoff from the site
to the wet detention pond. The storm water management pond is designed for an
impervious area of 68.22% for the area draining to the pond. The site is draining to SA
waters, therefore the storm water management wet detention pond is designed to treat a
1.5" design storm and 90% TSS with a level spreader/vegetative filter to provide secondary
treatment.
Water Quantity
Post -development peak flows from the site will not exceed pre -development flows for the 1-
year, 10-year, or the 50-year storms. The site is designed for the 1.5" storm and 90% TSS.
A level spreader/vegetative filter will be utilized to provide secondary treatment. The wet
detention pond will utilize a concrete riser structure with a low flow orifice, intermediate
weir, and an emergency spillway to reduce peak flows. Please reference the Water Quantity
section of this report for details regarding drainage areas and stormwater routing.
Water Quality
For water quality purposes the site is designed so that storm water runoff is treated in a wet
detention BMP pond. The proposed wet detention pond will provide 90% removal of Total
Suspended Solids (TSS) as well as nutrient removal benefits. A level spreader and
vegetative filter will be constructed at the outlet of the pond to provide secondary water
quality benefits.
Methods
The stormwater conveyance system was analyzed using "Hydraflow Storm Sewers" and
"Hydraflow Hydrographs" computer software program.

Development Plan: The proposed development will consists of an Advance Auto Parts retail

Description
Hydrologic soil groups are based on estimates of runoff potential. Soils are
assigned to one of four groups according to the rate of water infiltration when the
soils are not protected by vegetation, are thoroughly wet, and receive precipitation
from long -duration storms.
The soils in the United States are assigned to four groups (A, B, C, and D) and
three dual classes (A/D, B/D, and C/D). The groups are defined as follows:
Group A. Soils having a high infiltration rate (low runoff potential) when thoroughly
wet. These consist mainly of deep, well drained to excessively drained sands or
gravelly sands. These soils have a high rate of water transmission.
Group B. Soils having a moderate infiltration rate when thoroughly wet. These
consist chiefly of moderately deep or deep, moderately well drained or well drained
soils that have moderately fine texture to moderately coarse texture. These soils
have a moderate rate of water transmission.
Group C. Soils having a slow infiltration rate when thoroughly wet. These consist
chiefly of soils having a layer that impedes the downward movement of water or
soils of moderately fine texture or fine texture. These soils have a slow rate of water
transmission.
Group D. Soils having a very slow infiltration rate (high runoff potential) when
thoroughly wet. These consist chiefly of clays that have a high shrink -swell
potential, soils that have a high water table, soils that have a claypan or clay layer
at or near the surface, and soils that are shallow over nearly impervious material.

for drained areas and the second is for undrained areas. Only the soils that in their
natural condition are in group D are assigned to dual classes.

4.4 Groundwater Conditions
Porewater pressure measurements were made at all sounding locations during exploration.
The groundwater depths range from approximately 8.0 to 9.0 feet below the existing grade.
There also may be shallow ground water levels indicating a "perched" condition due to the
presence of days approximately six feet below existing grades.
The highest groundwater observations are normally encountered in the late winter and early
spring. Variations in the location of the long-term water table may occur as a result of changes
in precipitation, evaporation, surface water runoff, and other factors not immediately apparent at
the time of this exploration. If long term water levels are crucial to the development of this site,
It would be prudent to verify water levels with the use of perforated pipes or piezometers.

Basis For Determination
The site exhibits features with Ordinary High Water and wetland criteria as defined in the 1987 Corns Wetland Delineation
Manual and appropriate Re Tonal Supplement. The waters on -site include unnamed tributaries to Mill Creek — all seasonal
Relatively Permanent waters that flow into Mill Creek which becomes a Traditionally Navigable Water — and abutting and
adjacent wetlands This determination is based on a site visit by David E. Bailey of the U.S. Armv Corps of Engineers on
12/7/2011.
Remarks.
Attention USDA Program Participants
This delineation/determination has been conducted to identify the limits of Corps' Clean Water Act jurisdiction for the particular site
identified in this request. The delineation/determination may not be valid for the wetland conservation provisions of the Food Security
Act of 1985. If you or your tenant are USDA Program participants, or anticipate participation in USDA programs, you should request

conveyed herein (the "Property") in Pender County to Lonnie B. Williams, Jr., Trustee, for the benefit of
Lonwillo Development Company, to secure the Note; and
WHEREAS, a partial interest in the property described in the Deed of Trust was conveyed by
Ashley 'tumor Building Co., Inc. to LoBall, LLC by deed dated May 29, 2008, and recorded in Book
3470, Page 236, in the Pender Counry Registry, subject to the prior lien of the Deed of Trust; and
WHEREAS, default having occurred in the payment of the indebtedness secured by the Deed of
Trust and in the performance of the stipulations and conditions therein contained, due demand was made
upon Grantor, by the owner and holder of the indebtedness secured by the Deed of Trust, that the
Grantor foreclose the Deed of Trust and sell the real property described therein under the terms and
provisions thereof and the laws of (he State of North Carolina; and

2009, was set aside by Order Setting Aside Sole and Authorizing Resole entered by the Pender County
Clerk of Superior Court on November 13, 2009; and
WHEREAS, after due notice, the Grantor conducted a resale and did expose the Property for sale
at public auction at the Pender County Courthouse on December 10, 2009, at 11:00 A.M.; and
WHEREAS, Gramar duly reported the sale to the Clerk of Superior Court for Pender County on

WHEREAS, the Purchase price has been fully paid.

Acknowledgement and Agreement
For Replacement Property
This Acknowledgement and Agreement is entered into by and between Taco Properties,
Inc. ("Exchangor') and QISS, LLC ("Intermediary").
Intermediary, as Purchaser entered into an Agreement of Purchase (as may have been
amended) effective July 30, 2014 with CK1, LLC as Seller ("Seller"); said agreement, together with
any and all assignments and amendments thereof (collectively the "Purchase Agreement"), is
incorporated herein by this reference.
Exchanger and Intermediary have executed an Exchange Agreement in which
Intermediary has agreed to acquire the subject property of the Purchase Agreement (the
"Replacement Property") and to transfer it to Exchangor, in consideration of Exchangor's transfer
of certain other property to Intermediary.
NOW, THEREFORE, the parties agree:
1. Exchangor and Intermediary hereby acknowledge and agree that Intermediary's
interests, rights, duties and obligations under the Purchase Agreement to purchase the Replacement
Property from Seller arc for the benefit of Exchangor under the Exchange Agreement obligation
and duly to purchase the Replacement Property from Seller under the Purchase Agreement. In
connection with such assignment, Intermediary is hereby substituted in place of Exchangor under
the Purchase Agreement solely for the purpose of purchasing the Replacement Property from
Seller in order to facilitate the Exchange.
2. The acknowledgments and agreements of Exchangor and Intermediary set forth herein
shall survive the closing and recordation of any grant deed or other instrument in connection
therewith.
3. This Assignment may be executed in counterparts, each of which shall be deemed an
original, but all of which, when taken together, shall constitute but one and the same instrument.
4. This Assignment may be executed by any or all of the parties hereto and delivered to
Intermediary by facsimile and Intermediary is hereby authorized to act upon all such facsimile
copies as if they were originals.
EXCEPT AS EXPRESSLY MODIFIED OR AMENDED HEREIN, ALL TERMS AND
CONDITIONS OF THE PURCHASE AGRFFMF,NT SHALL REMAIN UNCHANGED.
IN WITNESS WHEREOF, the parties have executed this agreement on the date indicated by each
signature.
