The Wilmington Regional Office received a complete State Stormwater Management Permit
Application for Hampstead Lifestyle Center on December 22, 2010. Staff review of the plans
and specifications has determined that the project, as proposed, will comply with the
Stormwater Regulations set forth in Session Law 2008-211 and Title 15A NCAC 2H.1000. We
are forwarding Permit No. SW8 081114 dated December 23, 2010, for the construction of the
subject project.
This permit shall be effective from the date of issuance until April 2, 2019, and shall be subject
to the conditions and limitations as specified therein. Please pay special attention to the
Operation and Maintenance requirements in this permit. Failure to establish an adequate
system for operation and maintenance of the stormwater management system will result in
future compliance problems.
If any parts, requirements, or limitations contained in this permit are unacceptable, you have the
right to request an adjudicatory hearing upon written request within thirty (30) days following
receipt of this permit. This request must be in the form of a written petition, conforming to
Chapter 150E of the North Carolina General Statutes, and filed with the Office of Administrative
Hearings, P.O. Drawer 27447, Raleigh, NC 27611-7447. Unless such demands are made this
permit shall be final and binding.

In accordance with the provisions of Article 21 of Chapter 143, General Statutes of
North Carolina as amended, and other applicable Laws, Rules, and Regulations
PERMISSION IS HEREBY GRANTED TO

construction, operation and maintenance of one wet detention pond in compliance with
the provisions of Session Law 2008-211 and 15A NCAC 2H .1000 (hereafter separately
and collectively referred to as the "stormwater rules') and the approved stormwater
management plans and specifications and other supporting data as attached and on file
with and approved by the Division of Water Quality and considered a part of this permit.
This permit shall be effective from the date of issuance until April 2, 2019 and shall be
subject to the following specified conditions and limitations:
I. DESIGN STANDARDS
1. This permit is effective only with respect to the nature and volume of stormwater
described in the application and other supporting data.
2. This stormwater system has been approved for the management of stormwater
runoff as described in Section 1.8 of this permit. The subdivision is permitted for
the phased development of Hampstead Lifestyle Center, Outparcel #1 and
Outparcel #2 to drain to the pond described in Section 1.8 of this permit. This
subdivision is also permitted for two additional parcels, Parcel B and Parcel C,
which are not permitted to drain to the pond described in Section 1.8 of this
permit. The owner of each of these parcels, Parcels B and C, must provide an
engineered stormwater Best Management Practice (BMP) that is sized to store
and treat the runoff from their parcel as well as any area that drains to their
parcel as offsite drainage, per the applicable North Carolina Stormwater rules
found in NCAC 2H.1000 and SL 2008-211.
3. The runoff from all built -upon area within the permitted drainage areas of this
project must be directed into the permitted stormwater control systems. The wet
pond has been designed to treat the runoff from 273,630, square feet of Built -
Upon Area.

4. A 50' wide vegetative buffer must be provided adjacent surface waters,
measured horizontally from the normal pool of impounded structures, the banks
of each side of streams and rivers and the mean high water line of tidal waters.
The wet detention pond may not be located within the buffer and no built -upon
area is allowed within the buffer.
5. Each lot within the subdivision whose ownership is not retained by the permittee,
must submit a separate Offsite Stormwater Management Permit application
package to the Division of Water Quality and receive a permit prior to any
construction on the lot.

No homeowner/lot owner/developer shall fill in, alter, or pipe any drainage feature
(such as swales) shown on the approved plans as part of the stormwater
management system without submitting a revision to the permit and receiving
approval from the Division.
The permittee is responsible for routine monitoring of the project's built -upon
area and verifying that the built -upon area for the entire project and for each lot
does not exceed the maximum allowed by this permit. Once the lot transfer is
complete, the lot owner may not increase the built -upon area above the permitted
maximum for that lot without approval from both the permittee and the Division of
Water Quality. The permittee shall not approve any requests for additional built -
upon area on any lot without first submitting for and receiving a permit
modification from the Division.

3. The permittee must maintain compliance with the overall BUA limit for the project
established by this permit, the permit documents and the recorded deed
restrictions. If any lot is found to have exceeded the permitted BUA limit for that
lot without the approval of the Division and the permittee, the permittee shall
notify the lot owner in writing and require resolution.
4. If an Architectural Review Board or Committee is set up by the permittee to
review new and modified lot plans for compliance with the BUA limit, the plans
reviewed must include all proposed built -upon area. Any approvals given by the
Board or Committee on behalf of the permittee do not relieve the permittee or the
lot owner of the responsibility to maintain compliance with the BUA limit
established by the permit and in the recorded deed restrictions.
The Director may notify the permittee when the permitted site does not meet one
or more of the minimum requirements of the permit. Within the time frame
specified in the notice, the permittee shall submit a written time schedule to the
Director for modifying the site to meet minimum requirements. The permittee
shall provide copies of revised plans and certification in writing to the Director
that the changes have been made.
6. The stormwater management system shall be constructed in its entirety,
vegetated and operational for its intended use prior to the construction of any
built -upon surface.
7. The permittee shall submit to the Director and shall have received approval for
revised plans, specifications, and calculations prior to construction, for any
modification to the approved plans, including, but not limited to, those listed
below:
a. Any revision to the approved plans, regardless of size.
b. Project name change.
C. Transfer of ownership.
d. Redesign or addition to the approved amount of built -upon area.
e. Further development, subdivision, acquisition, or sale of any, all or part of
the project area. The project area is defined as all property owned by the
permittee, for which Sedimentation and Erosion Control Plan approval or a
CAMA Major permit was sought.
f. Filling in, altering, or piping of any vegetative conveyance shown on the
approved plan.
8. Prior to the construction of any permitted future development areas shown on the
approved plans, the permittee shall submit final site layout and grading plans to
the Division for approval.
9. All stormwater collection and treatment systems must be located in either
dedicated common areas or recorded easements. The final plats for the project
will be recorded showing all such required easements, in accordance with the
approved plans.
10. During construction, erosion shall be kept to a minimum and any eroded areas of
the system will be repaired immediately.
11. Upon completion of construction, prior to issuance of a Certificate of Occupancy,
and prior to operation of this permitted facility, a certification must be received
from an appropriate designer for the system installed certifying that the permitted
facility has been installed in accordance with this permit, the approved plans and
specifications, and other supporting documentation. Any deviations from the
approved plans and specifications must be noted on the Certification.

12. If the stormwater system was used as an Erosion Control device, it must be
restored to design condition prior to operation as a stormwater treatment device,
and prior to occupancy of the facility.
13. The permittee shall at all times provide the operation and maintenance
necessary to assure that all components of the permitted stormwater system
function at optimum efficiency. The approved Operation and Maintenance Plan
must be followed in its entirety and maintenance must occur at the scheduled
intervals including, but not limited to:
a. Semiannual scheduled inspections (every 6 months).
b. Sediment removal.
C. Mowing and re -vegetation of side slopes.
d. Immediate repair of eroded areas.
e. Maintenance of side slopes in accordance with approved plans.
f. Debris removal and unclogging of structures, orifice, catch basins and
piping.
g. Access to all components of the system must be available at all times.
14. Records of maintenance activities must be kept by the permittee. The records will
indicate the date, activity, name of person performing the work and what actions
were taken.
15. This permit shall become void unless the facilities are constructed in accordance
with the conditions of this permit, the approved plans and specifications, and
other supporting data.
16. Prior to transfer of the permit, the stormwater facilities will be inspected by DWQ
personnel. The project and the stormwater facility must be in compliance with all
permit conditions. Any items not in compliance must be repaired, replaced or
restored to design condition prior to the transfer. Records of maintenance
activities performed to date will be required.
17. If the permanent pool volume is greater than 30,000 cubic feet, a decorative
spray fountain will be allowed in the stormwater treatment system, subject to the
following criteria:
a. The fountain must draw its water from less than 2' below the permanent
pool surface.
b. Separated units, where the nozzle, pump and intake are connected by
tubing, may be used only if they draw water from the surface in the deepest
part of the pond.
C. The falling water from the fountain must be centered in the pond, away from
the shoreline.
d. The maximum horsepower for the fountain's pump is based on the
permanent pool volume. The maximum pump power for a fountain in this
pond is 1/3.
18. If permeable pavement credit is desired, the permittee must submit a request to
modify the permit to incorporate such language as required by the Division of
Water Quality. The request to modify must include a soils report identifying the
type of soil, the Seasonal High Water Table elevation and the infiltration rate.
Upon the successful completion of a permit modification, the individual lot owners
that request to utilize permeable pavements shall submit the necessary forms
and documentation to the permittee, or a designated agent, and receive approval
prior to construction of the permeable pavement.

19. Prior to the sale of Outparcel 1 or 2, the following deed restrictions must be
recorded for Outparcels 1 and 2:
a. The following covenants are intended to ensure ongoing compliance with
State Stormwater Management Permit Number SW8 081114, as issued
by the Division of Water Quality under NCAC 2H.1000.
b. The State of North Carolina is made a beneficiary of these covenants to
the extent necessary to maintain compliance with the Stormwater
Management Permit.
c. These covenants are to run with the land and be binding on all persons
and parties claiming under them.
d. The covenants pertaining to stormwater may not be altered or rescinded
without the express written consent of the State of North Carolina, Division
of Water Quality.
e. Alteration of the drainage as shown on the approved plans may not take
place without the concurrence of the Division of Water Quality.
f. The maximum built -upon area for Outparcel 1 is 35,000 square feet. The
maximum built -upon area for Outparcel 2 is 44,000 square feet. This
allotted amount includes any built -upon area constructed within the lot
property boundaries, and that portion of the right-of-way between the front
lot line and the edge of the pavement.,Built upon area includes, but is not
limited to, structures, asphalt, concrete, gravel, brick, stone, slate, coquina
and parking areas, but does not include raised, open wood decking, or the
water surface of swimming pools.
g. All runoff from the built -upon areas on the lot must drain into the permitted
system. This may be accomplished through providing roof drain gutters,
which drain to the pond or street, grading the lot to drain toward the street
or directly into the pond, or grading perimeter swales and directing them
into the pond or street.
h. Built -upon area in excess of the permitted amount will require a permit
modification.
i. Each lot within the subdivision whose ownership is not retained by the
permittee, must submit a separate Offsite Stormwater Management Permit
application package to the Division of Water Quality and receive a permit
prior to any construction on the lot.
j. If permeable pavement credit is requested, the property owner must
submit a request, with supporting documentation, to the permittee and
receive approval prior to construction of BUA.
20. Prior to the sale of Parcel B or C, the following deed restrictions must be
recorded for Parcels B and C:
a. The following covenants are intended to ensure ongoing compliance with
State Stormwater Management Permit Number SW8 081114, as issued
by the Division of Water Quality under NCAC 2H.1000.

f. In lieu of a common Best Management Practice to be shared by all of the
lots, the declarant has opted to require each owner of an individual lot to
provide an engineered stormwater Best Management Practice (BMP) that
is sized to store and treat the runoff from that lot and from any offsite
drainage onto that lot, per the applicable North Carolina Stormwater rules
found in NCAC 21-1.1000, or SL 2008-211 or SL 2006-246.
g. The owner of each lot must submit a stormwater management permit
application to the NC Division of Water Quality and receive a permit prior
to any construction on the lot.
h. At a minimum, all runoff on the lot must drain into the permitted system.
This may be accomplished through one or a combination of one or more
of the following: providing roof drain gutters which direct runoff into the
system; grading the lot such that the runoff drains into the system; and/or
grading perimeter swales which capture and direct runoff into the system.
Any drainage entering the lot from the road right-of-way must be treated in
the lot's proposed BMP. Any other drainage entering the lot from outside
the lot's property boundary, can be rerouted around the lot's proposed
BMP. If the other offsite drainage is not rerouted, it must be accounted for
in the lot's proposed BMP.
21. A copy of the recorded deed restrictions must be submitted to the Division within
30 days of the date of recording the plat, and prior to selling lots. The recorded
copy must contain all of the statements above, the signature of the Permittee, the
- deed book number and page, and the stamp/signature of the Register of Deeds.
III. GENERAL CONDITIONS
This permit is not transferable except after notice to and approval by the Director.
At least 30 days prior to the sale of the property in whole or in part, a change of
ownership, or a name change of the permittee or of the project, or a mailing
address change, the permittee must submit a completed and signed
Name/Ownership Change form, to the Division of Water Quality, accompanied by
the supporting documentation as listed on the form. The approval of this request
will be considered on its merits and may or may not be approved. .
The permittee is responsible for compliance with all permit conditions until such
time as the Division approves a request to transfer the permit. Neither the sale of
the project in whole or in part, nor the conveyance of common area to a third
party constitutes an approved transfer of the permit.
Failure to abide by the conditions and limitations contained in this permit may
subject the Permittee to enforcement action by the Division of Water Quality, in
accordance with North Carolina General Statute 143-215.6A to 143-215.6C.
4. The issuance of this permit does not preclude the Permittee from complying with
any and all statutes, rules, regulations, or ordinances, which may be imposed by
other government agencies (local, state, and federal) having jurisdiction.
5. In the event that the facilities fail to perform satisfactorily, including the creation of
nuisance conditions, the Permittee shall take immediate corrective action,
including those as may be required by this Division, such as the construction of
additional or replacement stormwater management systems.
6. The permittee grants DENR Staff permission to enter the property during normal
business hours for the purpose of inspecting all components of the permitted
stormwater management facility.

7. The permit issued shall continue in force and effect until revoked or terminated.
The permit may be modified, revoked and reissued or terminated for cause. The
filing of a request for a permit modification, revocation and re -issuance or
termination does not stay any permit condition.
8. Unless specified elsewhere, permanent seeding requirements for the stormwater
control must follow the guidelines established in the North Carolina Erosion and
Sediment Control Planning and Design Manual.
9. Approved plans and specifications for this project are incorporated by reference
and are enforceable parts of the permit.
10. The issuance of this permit does not prohibit the Director from reopening and
modifying the permit, revoking and reissuing the permit, or terminating the permit
as allowed by the laws, rules and regulations contained in Session Law 2006-
246, Title 15A NCAC 2H.1000, and NCGS 143-215.1 et.al.
11. The permittee shall submit a permit renewal application at least 180 days prior to
the expiration date of this permit. The renewal request must include the
appropriate documentation and the processing fee.

VII. DEED RESTRICTIONS AND PROTECTIVE COVENANTS
For all subdivisions, outparcels, and future development, the appropriate property restrictions and protective
covenants are required to be recorded prior to the sale of any lot. If lot sizes vary significantly or the proposed
BUA allocations vary, a table listing each lot number, lot size, and the allowable built -upon area must be provided
as an attachment to the completed and notarized deed restriction form. The appropriate deed restrictions and
protective covenants forms can be downloaded from
http://h2o.enr.state.nc.us/su/bmp forms.htmkdeed restrictions. Download the latest versions for each submittal.
In the instances where the applicant is different than the property owner, it is the responsibility of the property
owner to sign the deed restrictions and protective covenants form while the applicant is responsible for ensuring
that the deed restrictions are recorded.

rather than the provided volume (79,406cf). A 3.5" orifice would draw down the provided volume in this timeframe, but
the required volume would discharge in only 1.6 days. I attached my calcs on this, and I think that you could use a 2.0-
3.0" pipe and get the required drawdown time.
1.) Please update the necessary items (plan, supplement, calcs, and any other info) where the orifice size effects the
data.
2.) Also, I just want to verify the numbers of the pages of the full set of plans. The November set had a sheet C-3.
This set has C-1, C-2, C-3.1, C-3.2, C-3.3, C-4, C-5, and C-6 (no sheet C-3). Should I add C-3 from the previous set
to this set, or is it no longer necessary?
This isn't actually due until 1/13 so I thought I would just send an email rather than a formal letter requesting this
change. If I don't receive it by 1/13 1 will send a formal letter. I have already written the permit. I just need to put a
date on it when I hear back from you.

We received this application, and I went through it this morning. I have a few questions for you:
1.) Project Area: The site is currently permitted to 28.55ac all treated by a single pond. It appears that you intend
to still cover the entire 28.55ac project under this permit number, but instead of having the whole thing drain to
a single pond you want to have only 11.8acres (514,138sf) of the site drain to the pond. Is that correct? If that
is the case, then the property area on the application (Section IV, 4) should be 28.55ac. If this is correct I will
make and initial the change to the application if you authorize me to do so. Otherwise, you would have to get a
separate permit for the area in excess of 11.8ac.
2.) Deed Restrictions: It also looks like you intend to subdivide two outparcels in the 11.80ac that will drain to the
pond because you have submitted deed restrictions for those two parcels. The remaining area that does not
drain to the pond is shown to be Parcel B which is 11.78ac.
a. Totaling 28.55ac: If the area that will drain to the pond is 11.78ac and Parcel B is 11.80ac where is the
remaining 4.97acres? Is there another parcel on this site that covers 4.97acres? Sheet C-3 shows
distance and bearing lines for some of the project boundaries, but the western edge is not labeled.
Please show the entire area to be permitted (28.55ac) either on Sheet C-3 or as a matchline from that
sheet to another sheet.
b. Deed Restrictions: It appears that you will require Parcel B (and the remaining 4.97ac) to provide

didn't go through the entire list, these are just items I noticed off -hand. But, the review engineer who
eventually gets assigned to this project will send an add info letter for any of the items on the list that are not on
the plan/in the package.
I generally go through each package when it comes in and ask that any items that need to be resolved (such as Items
1&2 above) be resolved by COB the next business day or I have to return the package because I cannot hold packages
with uncashed checked for too long. But, since this is Friday before Thanksgiving that may not be feasible. So, please
return this package as soon as you can. If I don't hear back from you pretty soon I will try to get up with you and we will
work out some sort of deadline.

We have received your request for additional information, dated December 13, 2010.
The following notes outline our responses to your requests and address how the requests
have been addressed, and identify the changes to the plan:
1. Drawdown:
a. Drawdown time: Please checkyour drawdown calculation to ensure
that it is done as shown in the example in Section 3.5.2 of the BMP
M Manual and draws down in 2-5 days. Please also ensure that the
vz� diameter in calculations match the supplement and plans.
Response: The drawdown calculations are done based on the formula of
Orifice Equation as shown in Section 3.5.2. The drawdown calculation is
attached as well as the revised Wet Detention Basin Supplement and both
the calculation, supplement and plans signify a 3.5" orifice.
b. Discharge Rate: Please provide calculations showing that the
discharge rate (orifice,flow rate) is less than the pre -development
discharge rate.for the lyr24hr storm.
Response: The drawdown calculations show the discharge from the pond
to the infiltration area to be 0.249 cfs and the infiltration rate of the
infiltration area is 0.258 cfs as shown on the attached calculations sheet
which is greater than the pond drawdown into the infiltration area signifying
that the 1-year 24-hour storm volume will infiltrate into the ground and not
leave the site.
Plans:
a. Elevations: It appears that the pond will be excavated to elevation
21.0, and the sediment will be removed when it reaches 22.0. Please
show elevation 2 1. 0 on the cross-section on sheet C-5.
Response: Elevation 21.0 has been shown on the pond cross section on
Sheet C-6.
b. Drainage Easement: Please show its location and dimensions on the
plans.

Please find below a report referencing a soil and site evaluation for the above referenced
site, located near Transfer Station Road, Hampstead, North Carolina.
1.O Introduction/Purpose
The purpose.of the soil and site evaluation was to determine the seasonal high
water table within the proposed pond location and to obtain hydraulic conductivity
readings for the proposed area.
2.0 Methods
(Refer to Figure 1)
The site was evaluated using hand auger borings. Auger borings were made at
varying locations throughout the proposed pond area to a depth of at least 48
inches and profile descriptions recorded. The seasonal high water table was
determined by the indication of redoximorphic features and/or colors of chroma 2
or less (Munsell Color Book) at >2% of the soil volume in mottles or matrix of a
horizon or horizon subdivision.
The saturated hydraulic conductivity (K.,) of the unsaturated portion of the soil
profile was measured using a Compact Constant Head Permeameter (CCHP):
These in situ measurements of saturated hydraulic conductivity were obtained in
accordance with the Compact Constant Head Permeameter User's Manual by Ka„
Inc. Field work was•conducted at the site on October 6, 2008 - October 24, 2008.

3.0 Results/Findings
(Refer to Appendix A and Figure 1)
The area for the pond was characterized by soils with a seasonal high water table
that ranged from less than 12 inches from the natural soil surface to a depth of 19
inches from the natural soil "surface as indicated by the presence of redoximorphic
features and/or colors of chroma 2 or less (Munsell Color Book) at >2% of the soil
volume in mottles or matrix of a horizon or horizon subdivision. The seasonal high
water table at soil boring one (SB1) was noted to be 19 inches from natural soil
surface. ,The seasonal high water table at soil boring two (SB2) was noted to be
<12" from the natural soil surface. The in -situ saturated hydraulic conductivity
(Ksat) measurement at soil boring two (SB2) was noted to be 2,23 inches per hour
at the most limiting soil horizon in the unsaturated portion of the soil profile. A
detailed profile description and data sheet for each boring location is in Appendix
A.
4.0 Limitations
The areas analyzed as part of this investigation only provide isolated data sets and
points and do not represent, subsurface conditions at every location in the project
area. The data contained in this report is that -which was specifically requested by
Withers and Ravenel and may riot be inclusive of all field data collected. Analyses
and conclusions of this report, interpretation between data points, and subjective
subsurface interpretation, may not be completely representative of all subsurface
conditions.
This investigation, furthermore does not provide conclusive data on limits of impact
or other interpolations where indicated by question marks. or where otherwise
qualified.
Conclusions and recommendations 'ofthis investigation and report are based on the
best available data in an effort to assist in the understanding, control and/or site
planning and preparation. No guarantee is expressed or implied that new or
additional data and/or scientific measures will not be required for ultimate solution
of the existing project.

SITE DESCRIPTION
This +/- 28.55 acre site is located off Country Club Road in Pender County, North Carolina. The
site drains to existing ditches located around the property. This project is for a portion of the
overall tract. The project will consist of the construction of a Community Aquatic & Lifestyle
Center and related site appurtenances. The proposed drainage area for this project is 11.8 acres
and the total amount of impervious area draining to the stormwater management pond is 53.2%.
SOILS
The soils for this project consist of Leon (Hydrologic Soil Group 13/1)), Murville (Hydrologic
Soil Group A/D) and Onslow (Hydrologic Soil Group 13) complexes. The Leon soils are poorly
drained soils on broad interstream areas, the Murville soils are very poorly drained soils in
interstream areas and depressions and the Onslow soils are moderately well drained soils on
slightly convex uplands.
STORM DRAINAGE DESIGN
The primary stormwater measure for this project is a proposed wet detention pond located in the
eastern comer of the site. The stormwater will be conveyed via overland sheet flow and a closed
conduit system to the proposed wet detention pond. Since this site is within %-mile and drains to
SA waters the proposed wet detention pond is designed to control and treat the difference in
volume of runoff between the pre -development and post -development conditions for the 1-year
24-hour storm event. This volume will be drawn down within 5 days and be directed to an
infiltration area adjacent to the pond. Higher storm events will bypass the infiltration area and
drain directly to the existing ditch located on the property boundary. The site drains to an
unnamed tributary of Old Topsail Creek (classification SA) that drains to the Cape Fear River
once leaving the site by existing ditches and existing storm culverts.
