Staff review of the plans and specifications has determined that the project, as proposed, will comply with the Stormwater Regulations set forth in Title 15A NCAC 2H.1000. We are forwarding Permit No. SW8 080908 dated September 18, 2008, for the construction of the subject project. This permit shall be effective from the date of issuance until September 18, 2018, and shall be subject to the conditions and limitations as specified therein. Please pay special attention to the Operation and Maintenance requirements in this permit. Failure to establish an adequate system for operation and maintenance of the stormwater management system will result in future compliance problems. If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to request an adjudicatory hearing upon written request within thirty (30) days following receipt of this permit. This request must be in the form of a written petition, conforming to Chapter 150E of the North Carolina General Statutes, and filed with the Office of Administrative Hearings, P.O. Drawer 27447, Raleigh, NC 27611-7447. Unless such demands are made this permit shall be final and binding. This permit shall be effective from the date of issuance until September 18, 2018, and shall be subject to the following specified conditions and limitations: I. DESIGN STANDARDS This permit is effective only with respect to the nature and volume of stormwater described in the application and other supporting data. 2. This stormwater system has been approved for the management of stormwater runoff as described in Section 1.6 on page 3 of this permit. The stormwater control has been designed to handle the runoff from 116,897 square feet of impervious area. An additional 27,979 square feet of BUA is permitted in other areas of this redevelopment project. 3. This basin must be operated with a 50 foot vegetated filter. 4. The tract will be limited to the amount of built -upon area indicated on page 3 of this permit, and per approved plans. There is no built -upon area allocated for the future development. Any additional BUA requires a permit modification. 5. All stormwater collection and treatment systems must be located in either dedicated common areas or recorded easements. The runoff from all built -upon area within the permitted drainage area of this project must be directed into the permitted stormwater control system. 7. SCHEDULE OF COMPLIANCE The stormwater management system shall be constructed in its entirety, vegetated and operational for its intended use prior to the construction of any built -upon surface. 2. During construction, erosion shall be kept to a minimum and any eroded areas of the system will be repaired immediately. The permittee shall at all times provide the operation and maintenance necessary to assure the permitted stormwater system functions at optimum efficiency. The approved Operation and Maintenance Plan must be followed in its entirety and maintenance must occur at the scheduled intervals including, but not limited to: a. Semiannual scheduled inspections (every 6 months). b. Sediment removal. C. Mowing and re -vegetation of slopes and the vegetated filter. d. Immediate repair of eroded areas. e. Maintenance of all slopes in accordance with approved plans and specifications. f. Debris removal and unclogging of bypass structure, infiltration media, flow spreader, catch basins, piping and vegetated filter. g. A clear access path to the bypass structure must be available at all times. 4. Records of maintenance activities must be kept and made available upon request to authorized personnel of DWQ. The records will indicate the date, activity, name of person performing the work and what actions were taken. Page 3 of 7 State Stormwater Management Systems Permit No. SW8 080908 5. The facilities shall be constructed as shown on the approved plans. This permit shall become void unless the facilities are constructed in accordance with the conditions of this permit, the approved plans and specifications, and other supporting data. 6. If the stormwater system was used as an Erosion Control device, it must be restored to design condition prior to operation as a stormwater treatment device, and prior to occupancy of the facility. 7. Upon completion of construction, prior to issuance of a Certificate of Occupancy, and prior to operation of this permitted facility, a certification must be received from an appropriate designer for the system installed certifying that the permitted facility has been installed in accordance with this permit, the approved plans and specifications, and other supporting documentation. Any deviations from the approved plans and specifications must be noted on the Certification. A modification may be required for those deviations. 8. Access to the stormwater facilities shall be maintained via appropriate easements at all times. 9. The permittee shall submit to the Director and shall have received approval for revised plans, specifications, and calculations prior to construction, for any modification to the approved plans, including, but not limited to, those listed below: a. Any revision to any item shown on the approved plans, including the stormwater management measures, built -upon area, details, etc. b. Project name change. C. Transfer of ownership. d. Redesign or addition to the approved amount of built -upon area or to the drainage area. e. Further subdivision, acquisition, lease or sale of all or part of the project area. The project area is defined as all property owned by the permittee, for which Sedimentation and Erosion Control Plan approval or a CAMA Major permit was sought. f. Filling in, altering, or piping of any vegetative conveyance shown on the approved plan. 10. The permittee shall submit final site layout and grading plans for any permitted future areas shown on the approved plans, prior to construction. 11. A copy of the approved plans and specifications shall be maintained on file by the Permittee for a minimum of ten years from the date of the completion of construction. 12. The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made. Ill. GENERAL CONDITIONS This permit is not transferable to any person or entity except after notice to and approval by the Director. In the event of a change of ownership, or a name change, the permittee must submit a completed Name/Ownership Change form to the Division of Water Quality, signed by both parties, and accompanied by the appropriate documentation as listed on page 2 of the form. The approval of this request will be considered on its merits and may or may not be approved. Page 4 of 7 State Stormwater Management Systems Permit No. SW8 080908 2. The permittee is responsible for compliance with all permit conditions until such time as the Division approves the transfer request. 3. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to enforcement action by the Division of Water Quality, in accordance with North Carolina General Statute 143-215.6A to 143-215.6C. 4. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances, which may be imposed by other government agencies (local, state, and federal) having jurisdiction. 5. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Permittee shall take immediate corrective action, including those as may be required by this Division, such as the construction of additional or replacement stormwater management systems. 6. The permittee grants DENR Staff permission to enter the property during normal business hours for the purpose of inspecting all components of the permitted stormwater management facility. 7. The permit may be modified, revoked and reissued or terminated for cause. The filing of a request for a permit modification, revocation and re -issuance or termination does not stay any permit condition. 8. Unless specified elsewhere, permanent seeding requirements for the stormwater control must follow the guidelines established in the North Carolina Erosion and Sediment Control Planning and Design Manual. 9. Approved plans and specifications for this project are incorporated by reference and are enforceable parts of the permit. 10. The permittee shall notify the Division in writing of any name, ownership or mailing address changes within 30 days. Permit issued this the eighteenth day of September 2008. Description of Project Island Harbor Marina is proposed as a boat storage facility with amenities for their customers. The property is located at 510 West Marina Drive (off NC Hwy 58), Emerald Isle, Carteret County (P.I.N. 5384.20.80.0196) approximately miles south and east of the intersection of NC Highways 24 and 58. This tract of land comprises of 7.6 acres and is located within the White Oak River Basin. The site has been evaluated by the Army Corps of Engineers and determined the presence of a wetland fringe along parts of the shoreline as indicated on the attached plans. The site presently drains north into Bogue Sound, which is Class "SA-ORW", Stream Index # 20- 36-(0.5). The site is being submitted as a Redevelopment State Stormwater project with impervious areas totaling less than the existing coverage of the tract. The existing impervious area for the site is 43.12% and the proposed impervious area for the project, including the existing to remain, is 42.84%. Since the tract is adjacent to outstanding resource waters, the requirements of the 575' Area of Environmental Concern and 30' CAMA buffer are applicable. Some of the existing impervious will be removed from the 30' buffer and only water dependant structures are proposed as being constructed within this buffer. There are three infiltration basins proposed within this redevelopment plan as being graded to hold and infiltrate the runoff from the drainage area. These BMP's are proposed to reduce the stormwater runoff from impervious surfaces draining into Bogue Sound, while satisfying the NC Division of Marine Fisheries. The site is proposed at 7.92% with the construction of these infiltration areas. The impervious area treated by these infiltration areas decreases the runoff by 35% from the current site conditions. This plan provides greater stormwater control than what currently exists and has been designed for a 2" rain, exceeding the 1.5" NCDENR requirement. Level spreaders are also proposed to aid in diffuse flow of excess stormwater providing further treatment through the grassed buffer. B. Coastal Stormwater Regulations The North Carolina Division of Environmental Management implemented coastal stormwater regulations in coastal counties on January 1, 1988. These regulations are detailed in 15 NCAC 2H.1000 Stormwater Management. These rules allow for a development to be considered under various options. Current NCDENR- DWO "Stormwater Management" rules and regulations (NCAC 15-21-1-1000) were used as guidelines in making this evaluation. Only limited observations were made within designated areas for potential stormwater infiltration usage. This is a historically developed tract with extensive impervious surfaces existing. This is a re -development project where existing impervious surfaces should be credited and exempt from current stormwater rules. When the proposed project is greater than 1 acre in size, has >25% impervious surfaces, is within 1/2 mile of, and/or drains directly to Class S.A. or S.A.-O.R.W. Waters or their unclassified tributaries, stormwater must be treated by infiltration basins or an equivalent alternative method. This tract is immediately adjacent to and drains to S.A.-O.R.W. Waters. Thus on this tract, it is anticipated stormwater run-off is to be managed through infiltration treatment systems for high density developments and new development within 575 ft of S.A.-O.R.W. waters is required to be low density or <25% impervious surfaces. Typically historically existing (<1980's) impervious surfaces >25% should be exempted or given credit for high density re -development purposes. The portions of this tract evaluated are located on relatively level landscape positions that gently slopes (0-1%) to the north towards the Bogue Sound classified as S.A.-O.R.W. Waters. General elevations range from <5 ft to 0 It (amsl, see USGS map). The tract is extensively covered with impervious surfaces from historically existing development in the form of buildings, parking, and coquina surfaces. The portions of the tract evaluated consists of historic and variable sandy fill materials that are +24 ft thick with minor pockets of shell and rock, overlying poorly to very poorly natural soil types. Surfaces may have thin coquina / marl strata. The main soil variables are depth of the historic fill materials and depth to seasonal high water table which are designate soils 7 7SE C 9 2008 WO- 1 map" (see attached soils map). Soil types found are historic fill -2-4 ft thick, over buried and disturbed soil types similar to Duckston and Torhunta which are very poorly drained natural soil types. Historically existing impervious surfaces should be allowed a credit by NCDWQ, and with meeting current rules as much as practicable by NCDWQ. The tract appears to have no areas which are considered to be usable for stormwater infiltration treatment, unless non -prescriptive and engineered innovative or "best management practices" are utilized. If these areas are to utilized for stormwater infiltration basins, it is recommended to excavatie the existing historic fill to +5 - 6 It depths and importing with clean sand materials to allow more uniform and greater infiltrative rates. If these areas can be elevated by areal fill it would allow greater separation distances from the estimated seasonal high water table level. Careful planning and design should be exercised to insure any usable soil areas are reserved for stormwater infiltration treatment. Innovative or Best Management Practices should be utilized to attain the most practicable engineered stormwater treatment alternative. NCDENR-DWQ Stormwater Section should be contacted for a pre -planning conference and review of the site for their general concurrence of any proposed development and stormwater management system on this tract before expending further time and monies. The redevelopment activities proposed by this project must comply with the provisions of the existing stormwater rules. Under these rules, this project would be subject to low density requirements of not more that 25% built -upon area. The proposed project exceeds these limits, but does provide some advantages when compared to the existing conditions on -site. As mentioned in your letter, proposed changes to the stormwater rules could potentially allow the permitting of this project based on changes to the definition of redevelopment. However, these changes are still only proposed, and have not been formally approved. At this point the Division of Environmental Management (DEM) can only enforce the existing stormwater rules. Approval of a project based on proposed changes or intent of these changes without review and approval by the Environmental Management Commission (EMC) would be inappropriate. Therefore, I do not feel that I can issue a certification for this project at this point in time. DEM staff have addressed a number of issues concerning the proposed stormwater rule changes and anticipate taking the proposed changes to the Water Quality Committee for review at their May meeting. The rules would then have to go to the full EMC and through the public hearing process before being finalized. This process would be completed in late 1994, after which your project could be reviewed in accordance with the provisions adopted by the EMC. As I hope you recall, the hold up to issuance of the CAMA and federal permits was state stormwater regulations. As you may further recall, the plan, as ultimately revised, involved an equal or lesser amount of impervious surface than the current facility, and was generally conceded by all to be, from a stormwater management standpoint, an improvement over the current use, because additional buffering was provided for percolation purposes along the shoreline. At that point in time, we requested that you discuss with George Everett a director certification, and you indicated that George did not think it appropriate to issue a director certification because pending revisions in the stormwater regs would in fact bring the project into compliance with stormwater rules, and thus DEM could sign off to CAMA. I have now for two years been following, telephoning and otherwise attempting to urge the stormwater revisions forward. For reasons quite mysterious, and apparently unrelated to the substance of the redevelopment rule, the stormwater revision set fallow for an extended period of time. It is my understanding that, while the regs have now resurfaced, there is going to have to commence a new hearing and revision process, which will take again the better part of a year. Meanwhile, both CAMA and the Corps of Engineers are saying they will not keep their file open much longer, waiting for the state to act on its stormwater revisions. Preston Howard, Jr. January 17, 1994 municipal support for our project at this point; the project will improve stormwater runoff controls, and my client is becoming significantly disadvantaged from a commercial standpoint, as other dry stacks have been constructed.
