Lake Park Blvd., Suite A Carolina Beach, NC 28428 Subject: Request for Additional Information Stormwater Project No. SW8 080818 MOD Coral Ridge New Hanover County Dear Mr. Murphy: The Wilmington Regional Office received and accepted a modified State Stormwater Management Permit Application for Coral Ridge on July 14, 2010. A preliminary in- depth review of that information has determined that the application is not complete. The following information is needed to continue the stormwater review: 1. Please provide a notarized letter of authorization allowing Kenneth Coffer to sign on your behalf for Coral Ridge LLC. 2. Please update Section Ill.1.a on page 2 of the application to identify the manager of Coral Ridge LLC. Although you have submitted a letter allowing Mr. Coffer to sign the application and other documents on your behalf, the applicant must still identified as the manager of Coral Ridge LLC. 3. The deeds provided for this property indicate that both Coffer Investment Properties II, LLC and Murphy Investment Properties II, LLC own the land. Provide documentation demonstrating the relationship between these owners and Coral Ridge, LLC, identify that relationship in Section 111.1.c of the application, and identify these two property owners under Section 111.2 of the application. Both owners of Coffer Investment Properties 11, LLC and Murphy Investment Properties 11, LLC must also sign Section IX of the application. 4. Please verify the total impervious area listed for Pond 2 in Section IV.10 on page 4 of the application. The total impervious area listed on the application is inconsistent with the supplement. 5. Please provide the spreadsheets demonstrating the volume provided in the wet ponds without the dark shading. The shading makes it very difficult to read the contour elevations and surface areas. 6. Turn right on Bonaire Rd. The site is on both sides of Bonaire Rd. Total site acreage is 40.732 ac. Acreage to be disturbed is approx. 32.53 ac. Soils on site are mainly Wa, St, Ly, Kr, & Pm. The purpose of this project is to create a residential subdivision. The project will be low density overall with 2 pockets of high density. The stormwater in the pockets of high density will be treated in wet ponds. There are 4 existing off -site lots that will drain to pond #1. The lots were assumed to be 100% impervious. The stormwater from the remainder of the site will be treated by sheet flow over grassed areas. Erosion Control Measures: The attached plans and specifications state or show required Sediment and Erosion Control measures to be taken. A gravel construction entrance will be constructed at the entrance off Carolina Beach Road. Silt fence will be installed as shown on plan and anywhere else sediment has the ability to leave the site. -Inlet protection -Outlet protection -Temporary Baffles -Berm -Sediment Basin (skimmer) Construction Sequence: The gravel construction entrance off Carolina Beach Road and silt fence will be installed as shown on the plan. Then, construct the ponds, which will serve as sediment basins, and install the temporary baffles. Install the storm drain pipe, inlet protection, outlet protection, & utilities while only disturbing the minimum area necessary to install these items. Then, clearing of the remaining portion of the site may begin. Upon completion of any phase of activity disturbed areas will be seeded within 21 days of no construction. 1 opo/-one - Usub Caroima tseaen kNL,) Norm Uaroiuus 1 upu map 1 aSc 1 VI I Oqpt_ Ya4 tc 4 y • . Lake Park Blvd, Suite A Carolina Beach, NC 28428 Division of Water Quality Colleen H. Sullins Director Subject: APPLICATION RETURN Coral Ridge — SW8 080818 New Hanover County Dear Mr. Coffer: Dee Freeman Secretary On May 14, 2010, the Division received an incomplete State Stormwater Management Application for the project listed above. The application and check number 21583, in the amount of $505 are being returned because the application package lacked the necessary elements to accept it for review. Please provide the following information upon the next submittal of this application package: 1. Wetlands: The permitted plans show a wetland where the clubhouse and pool are shown in this application. I understand that you are working with the DWQ 401 Staff, Chad Choburn, to resolve wetland issues on this site and that 401 has put this project on hold. Please resolve this issue prior to resubmittal because building in wetlands is prohibited without the appropriate 401 and/or 404 approvals. 2. Deed Restrictions: Deed restrictions must be recorded prior to the sale of any lot. If lots have been sold, please submit recorded deed restrictions with your resubmittal. 3. Designer's Certification: For both Partially Complete and Completed projects, a Designer's Certification must accompany the modified application. A partial Designer's Certification is need for Partially Complete projects, and would cover just the BMP itself and any constructed BUA to date. The Designer's Certification for a Complete project would encompass the BMP, the drainage area and the built -upon area. Please submit a partial certification with your resubmittal. 4. It does not appear that you are adding impervious area in excess of what has already been permitted or that you are increasing the size(s) of the pond(s). If you are doing either of these, or if you do so in your resubmittal please be advised that the excess BUA and the re -designed pond(s) will be considered a Major Modification under SL2008- 211. In that case, the excess BUA will be subject to the SL2008-211 requirements, and the re -designed pond(s) would be subject to the latest design requirements. Please visit DWQ's website at h_ttp://h2o.enr.state.nc.us/su/bmp forms.htm to download the latest available forms. Please provide the requested information and return the package to the address below. Note that the 90-day statutory permit review time begins upon receipt of a complete application. The DWQ has determined that your application was incomplete and/or provided inaccurate information as discussed below. The DWQ will require additional information in order to process your application to impact protected wetlands and/or streams on the subject property. Therefore, unless we receive the additional information requested below, we will have to move toward denial of your application as required by 15A NCAC 2H .0506 and will place this project on hold as incomplete until we receive this additional information. Please provide the following information so that we may continue to review your project. Additional Information Requested: 1. The applicant for this project is Mr. Matt Murphy for Coffer Investment Properties II, LLC. On the Secretary of State's website, Mr. Murphy is not identified as a member or agent. Please send the Secretary of State information that lists Mr. Murphy as a new member or re -do the application with an existing member/agent as applicant. 2. Please locate any planned sewer lines on the site plan. 3. Please provide cross sectional drawings of the proposed impact areas. 4. You are proposing two stub roads on the site plan drawings that directly impact wetlands. The DWQ cannot permit such "roads to nowhere". Your Pre -Construction Notification application indicates, "No future permit requests are anticipated, this application reflects all necessary impacts for the successful completion of this project" under Item V. Please remove or change this stub road to a terminal feature such as a cul-de-sac or provide details on the future development to which `Street A' is pointed. 5. Based on the submitted plan drawings, and from review of the State Stormwater Permit SW8080818, it appears that hydrology will be removed from some of the wetlands. Explain how the hydrology will be maintained to the wetlands specifically those adjacent to Pond A, Pond 2A, and Pond 2B. 6. Based on the "Request For Additional Information" letter from the U.S. Army Corps of Engineers dated October 16, 2008, it does not appear that all impacts were disclosed. Please indicate all wetland and stream impacts including all fill slopes, dissipaters, and bank stabilization on the site plan. .0m. _ ry w munn North Carolina Division of Water Quality 127 Cardinal Drive Extension Phone (910) 796-7215 Customer Service1A77$23-67!Jt!liRf Wilmington Regional Office Wilmington, NC 28405-3845 FAX (910)350-2004 Internet: h2o.enrstaleoc.us An Equal OpportunitylAffirrnafive Action Employer - 50 % Recycled110% Post Consumer Paper 2 13PG Properties Brunswick County 2008-1407 7. General Certification 3705 (GC3705) requires that deed notifications or similar mechanisms be placed on all retained jurisdictional wetlands and waters. Please provide a Draft Copy that includes the proposed preservation language that will be recorded to accomplish this. 8. Several areas of possible non-compliance with the NCG010000 permit were noted during the site visit of October 28, 2008. Please provide a written narrative explaining how you intend to comply with this Permit and who will be delegated to inspect the site and maintain required rain gauge and monitoring reports. 9. Based on the "Request For Additional Information" letter from the U.S. Army Corps of Engineers dated October 16, 2008, the accuracy of the wetland delineation map provided with the application appears to be inaccurate with regards to the tributary located along the west side of the main road. Please provide a wetland delineation map signed and approved by the U.S. Army Corps of Engineers. 10. Based upon review of the Pre -Construction Notification application as submitted, a revision or modification of the existing State Stormwater Permit SW8080818 may be necessary. Please contact Malcolm Boney with State Stormwater at 910-796-7215 to discuss possible revisions. Please respond in writing within 30 calendar days of the date of this letter by sending a copy of this information to me and to Ian McMillan, 401 Wetlands Unit, 2321 Crabtree Blvd, Raleigh, NC 27604-2260. If you will not be able to provide the requested information within that timeframe, please provide written confirmation that you intend to provide the requested information, and include a specific timetable delineating when the requested materials will be provided. If we do not hear from you in 30 calendar days, we will assume that you no longer want to pursue this project and we will consider the project as returned. This letter only addresses the application review and does not authorize any impacts to wetlands, waters or protected buffers. Please be aware that any impacts requested within your application are not authorized (at this time) by the DWQ. Please call me at 910-796-7215 or Ian McMillan at 919-733-1786 if you have any questions regarding or would like to set up a meeting to discuss this matter. (see remarks) _Under the conditions of Nationwide Permit # 29, you are required to submit an aquatic resource mitigation plan. No mitigation is proposed with your request nor is any justification for not providing compensation for impacts (see remarks). X Your application/pre-construction notification did not include information describing measures you have implemented to minimize direct and/or secondary or cumulative losses of Waters of the United States. X Your submitted project plans or maps were insufficient, too large, or not legible (see remarks) _Your application/pre-rronstruction notification did not include a delineation of affected special aquatic sites, including wetlands, vegetated shallows, and riffle and pool complexes as required. You must submit a copy of your application to the NC Wildlife Resources Commission (WRC) since your proposed work is in a designated trout water county (see remarks section below for the address of your WRC representative) X Other (see remarks below) 0 REMARKS: In review of your permit request, I have the following comments and requests for additional information: 1. Based on my site visit with your agent, Brent Ashley, of The Clark Group, it does not appear that all of the aquatic resources on the property are accurately depicted. Specifically, there are some tributaries along the west side of the road that are not on either the survey submitted to me or illustrated on the maps submitted with the Pre -Construction Notification (PCN). Please explain and re -submit the correct surveys, site plans and impact tables. 2. Please provide a telephone number for the applicant. 3. Based on your PCN and site plan it appears that you will exceed the Loss of Waters limit authorized by Nationwide Permit (NWP) 39. Please explain how hydrology will be maintained to on -site wetlands post construction. This office recommends revising your stormwater management system to ensure that all wetlands on -site retain hydrologic input. 4. It does not appear that you have disclosed all of your impacts. a. Please include impacts to tributaries as described in 1 above. b. There are existing culverts in two places connecting wetlands across the existing dirt road. Please provide a plan view and cross section of the crossings at these locations and include the linear feet of this impact in your impact table. c. There is an existing unauthorized activity on the site between wetlands B and D as labeled on the survey. Please revise your PCN to reflect either the removal of this fill or request authorization to keep it. 5. The site plan you submitted is unclear, please address the following issues: a. Please provide a detailed plan view and cross section of each of the proposed impact areas. The information you submitted is insufficient. b. Your site plan needs to clearly indicate the locations of all utilities not within road rights -of - way and describe how you plan to install utilities without impacts to waters and wetlands of the US. Please be aware that permanently maintained rights -of -way are considered permanent impacts by this office. Please include these in your impact assessment and provide compensatory mitigation. c. It appears based on your site plan that there are two "roads to nowhere", one of which directly impacts wetlands. Please remove these stub outs or provide evidence that New Hanover County required impacts to wetlands for road interconnectivity. 6. Based on your application, it does not appear that you avoided and minimized impacts to waters and wetlands of the US to the maximum extent practicable (NWP General Condition 20 (a)). Without a detailed plan view and cross section, this office is unable to determine if this crossing has been minimized to the maximum extent practicable. a. It appears based on the typical cross section you submitted that you have not minimized crossings to the maximum extent practicable. This office recommends looking at 2:1 slopes and minimizing the road width to further minimize impacts b. This office also recommends retaining walls to further minimize impacts to wetlands. 7. Your mitigation plan is not accepted. Compensatory mitigation will be required for this project. a. Please be aware that you must comply with the Corps Final Rule on Compensatory Mitigation for Losses of Aquatic Resources. The Final Rule is available at: http://ivww.usace.army.miUcw/ceewo/re2/news/final mitig rule.pdf. b. Please explain why Mitigation Banks were not considered. c. Please explain why you believe 1:1 payment to NC EEP is appropriate given the temporal loss of wetlands due to these projects not being constructed prior to credits being released. d. This office recommends 2:1 payment to NC EEP for the proposed impacts as well as full preservation of all remaining waters and wetlands onsite. Further, this office recommends preservation of upland buffers to provide further protection to these wetlands and enhance their functions. In order for your permit request to be considered complete, the above information must be provided to our office for processing. These items are required to verify that the activity is eligible for a Nationwide Permit and pertinent to fully assess the direct and secondary impacts on the property. Please submit the above information w' n 0 day// / c ' t o Notification or we will consider your application withdrawn and close th de.
