On August 5, 2009, the Governor signed Session Law 2009-406. This law impacts any development approval issued by
the Division of Energy, Mineral and Land Resources under Article 21 of Chapter 143 of the General Statutes, which is
current and valid at any point between January 1, 2008, and December 31, 2010, The law extends the effective period of
any stormwater permit that was set to expire during this time frame up to three (3) years from its current expiration date.
On August 2, 2010, the Governor signed Session Law 2010-177, which granted an extra year for an extension of up to
four (4) years.
As a result, 120 USMC Camp Lejeune permits are impacted. Of the 120 permits, 45 permits have previously been
issued extensions and 75 permits have been extended effective today. This is summarized in Attachment A.

On November 30, 2009, the Division received a Designer's Certification for the subject project from Ken Lacy,
PE, who I am assuming works for EarthTech. The certification is a little confusing because in the "noted
deviations" section of the form, it only refers to attached revised drainage drawings. The drawings are much
too small to be able to read or understand clearly what deviations have occurred. We will need a written out list
of the specifics of what has changed. Some deviations may require a permit modification, but without knowing
exactly what the deviations are, we can't tell.

Brian and Mike: Response to comments as noted below and revised plan attached
1. Provide/ or modify existing valve box for access to the existing Blow off Valve in the new parking area adjacent to
Courthouse Road, detail pending.
RESPONSE: We have determined that top of the box can be raised to match the pavement elevations. A separate
detail will be provided.
2. Modify existing propane tank concrete slab so that rain water will not gather and stand on it, detail pending.
RESPONSE: Remove existing tank, overlay the existing concrete pad with a 3" to 4" concrete overlay, matching
the elevations of existing and proposed asphalt paving and slope to provide positive drainage. Replace tank and extend
propane lines, if needed.

3. Provide the additional work indicated on the "Permit' set of C-Sheets. C-Sheets to be modified as discussed to
salvage as much of the work placed per the "Contract" set of drawings as practical.
Modifications discussed are:
a. Rock/ Clay lined drainage swales from concrete flumes to splitter boxes, detail pending.
RESPONSE: modify existing "V" ditch from the concrete flume to the flow splitter box with a 2' wide base ditch and
line with permanent soil reinforced matting (per NCDOT spec's) or rip rap and filter fabric. Place rip rap and filter fabric at
the outlet of the concrete flume (see attached plans for locations and details)
b. Remove and provide redesigned splitter boxes, detail pending.
RESPONSE: Given that the flow splitter boxes were not built to the permitted elevations and must be removed, we have
provided in the attached plan sheets details for revised splitter boxes that should provide additional function than the
original details.
c. Modify placed concrete level splitters, detail pending.
RESPONSE: The inlet side of the level spreader shall have a saw -cut section with elevations to match the' V" ditch
entering the level spreader. The saw cut section will have a I'wide opening with 4:1 side slopes. The bottom of the 1"
wide area should be a minimum of 6" below the ditch elevation to allow rip rap and filter fabric to be placed at the invert.
In addition, a saw cut 1' by 2' rectangle shall be made in the bottom of the level spreader to allow for drainage. The
locations of the saw cut hole should be approximately 5' from each end and then 25' on center throughout the length of
the level spreader. Class 57 stone shall be placed in the holes to allow for drainage. See the attached details.
d. Rock check dams to be modified to remain, detail pending.
RESPONSE: The rock check dams are for erosion control during construction. The majority of the site is already
finished and seeded. At this time the rock check dams are not needed.
Additional comments:
1. The "v" ditches from the flow splitters to the level spreaders can remain. The contractor shall verify that the ditches
provide positive slope
2. I believe a question was raised about providing information about a proposed propane tank for the PEB. Electric unit
heaters are shown in the plans and a propane tank is not required for the PEB.
3. The "V" ditch at the PEB site to the splitter box can remain.
Please don't hesitate to call if you have any questions or need additional information. If needed, we can be on site when
the first splitter box is built to review and see if it is being built correctly.
