The Wilmington Regional Office received a complete Stormwater Management Permit
Application for Covil Gardens on May 12, 2011. Staff review of the plans and specifications has
determined that the project, as proposed, will comply with the Stormwater Regulations set forth
in Title 15A NCAC 2H.1000 and Session Law 2008-211 and Session Law 2006-246. We are
forwarding Permit No. SW8 080317 dated May 24, 2011, for the construction, operation and
maintenance of the BMP's and built -upon areas associated with the subject project.
This permit shall be effective from the date of issuance until June 24, 2018, and shall be subject
to the conditions and limitations as specified therein. Please pay special attention to the
Operation and Maintenance requirements in this permit. Failure to establish an adequate
system for operation and maintenance of the stormwater management system will result in
future compliance problems.
If any parts, requirements, or limitations contained in this permit are unacceptable, you have the
right to request an adjudicatory hearing upon written request within thirty (30) days following
receipt of this permit. This request must be in the form of a written petition, conforming to
Chapter 150E of the North Carolina General Statutes, and filed with the Office of Administrative
Hearings, 6714 Mail Service Center, Raleigh, NC 27699-6714. Unless such demands are made
this permit shall be final and binding

construction, operation and maintenance of one wet detention pond and one sand filter
in compliance with the provisions of 15A NCAC 2H .1000, Session Law 2008-211, and
Session Law 2006-246 (hereafter collectively referred to as the "stormwater rules') the
approved stormwater management plans and specifications and other supporting data
as attached and on file with and approved by the Division of Water Quality and
considered a part of this permit.
This permit shall be effective from the date of issuance until June 24, 2018, and shall be
subject to the following specified conditions and limitations:
I. DESIGN STANDARDS
This permit is effective only with respect to the nature and volume of stormwater
described in the application and other supporting data.
2. This stormwater system has been approved for the management of stormwater
runoff as described in Section 1.8 on page 3 of this permit. The wet detention
pond has been designed to handle the runoff from 50,760 square feet of
impervious area which includes 6,626 square feet of future impervious area. The
sand filter has been designed to handle the runoff from 8,734 square feet of
impervious area. No future impervious area is available to drain to the sand filter.
3. A 50' wide vegetative buffer must be provided adjacent surface waters,
measured horizontally from and perpendicular to the normal pool of impounded
structures, the top of bank of both sides of streams and rivers and the mean high
water line of tidal waters.
4. The tract will be limited to the amount of built -upon area indicated on page 3 of
this permit, and per approved plans. '
5. All stormwater collection and treatment systems must be located in either
dedicated common areas or recorded easements. The final plats for the project
will be recorded showing all such required easements, in accordance with the
approved plans.

The runoff from all built -upon area within the permitted drainage areas of this
project must be directed into the permitted stormwater control system.

II. SCHEDULE OF COMPLIANCE
The stormwater management system shall be constructed in its entirety,
vegetated and operational for its intended use prior to the construction of any
built -upon surface.
2. During construction, erosion shall be kept to a minimum and any eroded areas of
the system will be repaired immediately.
3. The permittee shall at all time provide the operation and maintenance necessary
to assure the permitted stormwater system functions at optimum efficiency. The
approved Operation and Maintenance Plan must be followed in its entirety and
maintenance must occur at the scheduled intervals including, but not limited to:
a. Semiannual scheduled inspections (every 6 months).
b. Sediment removal.
C. Mowing and re -vegetation of slopes and the vegetated filter.
d. Immediate repair of eroded areas.
e. Maintenance of all slopes in accordance with approved plans and
specifications.
f. Debris removal and unclogging of outlet structure, orifice device, flow
spreader, catch basins and piping.
g. Access to the outlet structure must be available at all times.
4. Records of maintenance activities must be kept and made available upon
request to authorized personnel of DWQ. The records will indicate the date,
activity, name of person performing the work and what actions were taken.
5. Decorative spray fountains will be allowed in the stormwater treatment system,
subject to the following criteria:
a. The fountain must draw its water from less than 2' below the permanent
pool surface.
b. Separated units, where the nozzle, pump and intake are connected by
tubing, may be used only if they draw water from the surface in the
deepest part of the pond.
c. The falling water from the fountain must be centered in the pond, away
from the shoreline.
6. The facilities shall be constructed as shown on the approved plans. This permit
shall become void unless the facilities are constructed in accordance with the
conditions of this permit, the approved plans and specifications, and other
supporting data.
7. Upon completion of construction, prior to issuance of a Certificate of Occupancy,
and prior to operation of this permitted facility, a certification must be received
from an appropriate designer for the system installed certifying that the permitted
facility has been installed in accordance with this permit, the approved plans and
specifications, and other supporting documentation. Any deviations from the
approved plans and specifications must be noted on the Certification. A
modification may be required for those deviations.
8. If the stormwater system was used as an Erosion Control device, it must be
restored to design condition prior to operation as a stormwater treatment device,
and prior to occupancy of the facility.
9. Access to the stormwater facilities for inspection and maintenance shall be
maintained via appropriate recorded easements at all times.

10. The permittee shall submit to the Director and shall have received approval for
revised plans, specifications, and calculations prior to construction, for any
modification to the approved plans, including, but not limited to, those listed
below:
a. Any revision to any item shown on the approved plans, including the
stormwater management measures, built -upon area, details, etc.
b. Redesign or addition to the approved amount of built -upon area or to the
drainage area.
C. Further development, subdivision, acquisition, lease or sale of any, all or
part of the project area. The project area is defined as all property owned
by the permittee, for which Sedimentation and Erosion Control Plan
approval or a CAMA Major permit was sought.
d. Filling in, altering, or piping of any vegetative conveyance shown on the
approved plan.
11. Prior to the construction of any permitted future areas shown on the approved
plans, the permittee shall submit final site layout and grading plans to the
Division for approval.
12. The Director may notify the permittee when the permitted site does not meet one
or more of the minimum requirements of the permit. Within the time frame
specified in the notice, the permittee shall submit a written time schedule to the
Director for modifying the site to meet minimum requirements. The permittee
shall provide copies of revised plans and certification in writing to the Director
that the changes have been made.
13. Approved plans and specifications for this project are incorporated by reference
and are enforceable parts of the permit. A copy of the approved plans and
specifications shall be maintained on file by the Permittee at all times.
III. GENERAL CONDITIONS
This permit is not transferable to any person or entity except after notice to and
approval by the Director. At least 30 days prior to a change of ownership, or a
name change of the permittee or of the project, or a mailing address change, the
permittee must submit a completed and signed Name/Ownership Change Form
to the Division of Water Quality, accompanied by the supporting documentation
as listed on the form. The approval of this request will be considered on its merits
and may or may not be approved.
2. The permittee is responsible for compliance with all permit conditions until such
time as the Division approves the transfer request. Neither the sale of the project
in whole or in part, nor the conveyance of common area to a third party
constitutes an approved transfer of the stormwater permit.
3. Failure to abide by the conditions and limitations contained in this permit may
subject the Permittee to enforcement action by the Division of Water Quality, in
accordance with North Carolina General Statute 143-215.6A to 143-215.6C.
4. The issuance of this permit does not preclude the Permittee from complying with
any and all statutes, rules, regulations, or ordinances, which may be imposed by
other government agencies (local, state, and federal) having jurisdiction.
5. In the event that the facilities fail to perform satisfactorily, including the creation of
nuisance conditions, the Permittee shall take immediate corrective action,
including those as may be required by this Division, such as the construction of
additional or replacement stormwater management systems.

6. The permittee grants DENR Staff permission to enter the property during normal
business hours for the purpose of inspecting all components of the permitted
stormwater management facility.
7. The permit remains in force and effect until modified, revoked, terminated or
renewed. The permit may be modified, revoked and reissued or terminated for
cause. The filing of a request for a permit modification, revocation and re -
issuance or termination does not stay any permit condition.
8. Unless specified elsewhere, permanent seeding requirements for the stormwater
control must follow the guidelines established in the North Carolina Erosion and
Sediment Control Planning and Design Manual.
9. The permittee shall submit a permit renewal request at least 180 days prior to the
expiration date of this permit. The renewal request must include the appropriate
documentation and the processing fee.

V. SUPPLEMENT AND O&M FORMS
The applicable state stormwater management permit supplement and operation and maintenance (O&M) forms
must be submitted for each BMP specified for this project. The latest versions of the forms can be downloaded
from http://partal.ncdenr.org/web/wq/ws/su/bmp-manual.
VI. SUBMITTAL REQUIREMENTS
Only complete application packages will be accepted and reviewed by the Division of Water Quality (DWQ).
A complete package includes all of the items listed below. A detailed application instruction sheet and BMP
checklists are available fromhttp://portal.ncdenr.org/web/wg/ws/su/statesw/forms dots. Thecomplete
application package should be submitted to the appropriate DWQ Office. (The appropriate office may be

4. Permit application processing fee of $505 payable to NCDENR. (For an Express review, refer to
http://www.envhelp.org/pages/onestopexpress.html for information on the Express program
and the associated fees. Contact the appropriate regional office Express Permit Coordinator for
additional information and to schedule the required application meeting.)
5. A detailed narrative (one to two pages) describing the stormwater treatment/managementfor
the project. This is required in addition to the brief summary provided in the Project
Information, item 1.
6. A USGS map identifying the site location. If the receiving stream is reported as class SA or the
receiving stream drains to class SA waters within 1/2 mile of the site boundary, include the 1/2
mile radius on the map.
7. Sealed, signed and dated calculations.
8. Two sets of plans folded to 8.5" x 14" (sealed, signed, & dated), including:
a. Development/Project name.
b. Engineer and firm.
c. Location map with named streets and NCSR numbers.
d. Legend.
e. North arrow.
f. Scale.
g. Revision number and dates.
h. Identify all surface waters on the plans by delineating the normal pool elevation of i
impounded structures, the banks of streams and rivers, the MHW or NHW line of tidal
waters, and any coastal wetlands landward of the MHW or NHW lines. I Al

elevations in addition to depths) as well as a map of the boring locations with the exnstmg
elevations and boring logs. Include an 8.5"xll" copy of the NRCS County Soils map with the
project area clearly delineated. For projects with infiltration BMPs, the report should also
include the soil type, expected infiltration rate, and the method of determining the infiltration rate.

VII. DEED RESTRICTIONS AND PROTECTIVE COVENANTS
For all subdivisions, outparcels, and future development, the appropriate property restrictions and protective
covenants are required to be recorded prior to the sale of any lot. If lot sizes vary significantly or the proposed
BUA allocations vary, a table listing each lot number, lot size, and the allowable built -upon area must be provided
as an attachment to the completed and notarized deed restriction form. The appropriate deed restrictions and
protective covenants forms can be downloaded from
http://portal.ncdennorg/web/wq/ws/su/statesw/forms does. Download the latest versions for each submittal.
In the instances where the applicant is different than the property owner, it is the responsibility of the property
owner to sign the deed restrictions and protective covenants form while the applicant is responsible for ensuring
that the deed restrictions are recorded.
By the notarized signature(s) below, the permit holder(s) certify that the recorded property restrictions and
protective covenants for this project, if required, shall include all the items required in the permit and listed
on the forms available on the website, that the covenants will be binding on all parties and persons claiming

To keep my calcs the same (meet vol and SA req.) and to provide the emergency overflow for the City, I can lower all of
the elevations in the box by 0.5' and make everything work. However I'll need to revert back to what the BMP manual
says for minimum separation of 1' for closed sand filters to the SHWT (see page 2 of the attachment). Will this work for
you?
Also, what is the definition of the "bottom of the concrete box"? Is it the elevation of the bottom of sand, or is it the
bottom of the concrete slab (8" below the sand per our detail)? The BMP manual isn't very clear on this. Either way, if I
can use the minimum 1' separation, then worst case scenario (bottom of slab) I am still at least 1' above the SHWT.

Closed sand filters should have 2ft between the bottom of the concrete box and the SHWT. If you don't have that, you
need to 1.) provide buoyancy calculations showing that the box won't float, and 2.) provide some statement that the box
will be adequately sealed such that it does not take on water from the groundwater.
I think your current design is just shy of 2ft if I remember correctly (although I have done a couple of these lately so I
may have it confused with another project). I didn't push it because it was pretty close, but if you have to redesign it
that is something to consider. There should be 2ft from the bottom of the concrete to the SHWT and the ponding inside
the system should be to the maximum elevation that water can pond in the system. I think yours was a little more
complicated if I remember correctly because the sediment chamber and the sand filter chamber had different "top'
elevations. I don't think I pushed too hard on those details because it was pretty close and our manual is the way it is.
But, just some small points to consider.
I will be working on something this afternoon that has to be done today, then out tomorrow, and will speaking at a
conference on Monday so I will be back in the office on Tuesday.

In response to your comments dated April 19, 2011, we offer the following:
r 1. a) An elevation of 33.3 has been assigned to the 6" Emergency Overflow Outlet
detail on Sheet C3. The emergency overflow outlet is 9.5" above the sand filter
elevation which will allow the stormwater to filtrate through the sand filter but
will also provide an emergency overflow outlet in the case that the sand filter
becomes clogged.
v'6) Per the Sand Filter Detail on Sheet C3, the proposed curbline will define the
sand filter drainage area. The proposed curb will force the stormwater to flow
into the sand filter. See Sheet C 1 for grading.
2. a) Attached is a copy of the updated Corps approval for the wetland impact that
shows the location and size of the proposed outlet structure.
'6) i) The sand filter outlet routing has been revised to not discharge into the
pond. The sand filter stormwater now discharges on the north side of the
existing wetlands. See revised Sheet C 1 for the location of the sand filter
outlet.
✓i) Attached are the revised stormwater pond calculations and supplements
based on the most current pond dimensions. The Wet Detention Basin
Supplement form is the old version that was used for the original permit.
✓ii) The revised bottom of pond is at elevation 20.0. The pond calcs and
supplement forms have been revised to reflect this change.

SPECIAL CONDITIONS:
1. In order to compensate for impacts to 0.09 acres of non -riparian wetlands, the permittee shall make
payment to the North Carolina Ecosystem Enhancement Program (NC EEP) in the amount determined
by the NC EEP, sufficient to perform the restoration of 0.18 acres of non -riparian wetlands in the Cape
Fear River Basin, Cataloging Unit 03030005.
Construction within jurisdictional areas on the property shall begin only after, the permittee has made
full payment to the NC EEP and provided a copy of the payment documentation to the Corps, and the
NC EEP has provided written confirmation to the Corps that it agrees to accept responsibility for the
mitigation work required, in compliance with the MOU between the North Carolina Department of
Environment and Natural Resources and the United States Army Corps of Engineers, Wilmington
District, dated November 4, 1998.
2. The Pennittee shall execute and cause to be recorded in the New Hanover County Register of Deeds the
Declaration of Restriction (see attached) for the purpose of maintaining 0.12 acres of wetlands, as
shown on the Preliminary Wetlands Preservation Map (attached), in their natural and/or mitigated state
in perpetuity, prior to the sale or conveyance of any portion or all of the 2.22 acre tract. At the time of . .
recordation of the Covenants, the Permittee must also record with the New Hanover County Register of
Deeds, a final survey map of the development, sealed by the licensed surveyor, which clearly depicts the
surveyed areas of Conservation and lot/infrastructure layout.
These provisions relating to wetlands cannot be amended or modified without the express written
consent of the U.S. Army Corps of Engineers, Wilmington District. *This I includes changes as a result
of any local government drainage easement requirements*.
The permittee shall enforce the terms of the Covenants and, prior to conveyance of the property, shall
take no -action on the property described in the Covenants inconsistent'with the terms thereof - The
permittee shall provide a copy of the recorded Covenants and recorded Survey to the Corps of Engineers
within 15 days of recording.

The Wilmington Regional Office received and accepted a modified State Stormwater
Management Permit Application for Covil Gardens on April 6, 2011. A preliminary in-depth
review of that information has determined that the application is not complete. The following
information is needed to continue the stormwater review:
Sand Filter:
a. Emergency Outlets: Water should pond on top of the sand between the top
of the sand and the bottom of the cover grate over the sand filter. There
appears to be an emergency outlet between these two elevations on the
plans. Please clarify how the water will be contained.
b. Grading: Please provide grading and/or spot elevations describing the ridge
which defines the sand filter drainage area.
2. Wet Pond:
a. Outlet Structure: I see from the file that the outlet structure was moved via
Plan Revision on November 17, 2008 at the request of the USACE. The
outlet structure shown in this application appears to be larger than it was
previously. Did either the placement of the outlet structure in the wetland or
the change in size of the outlet structure in the wetland require a 401 and/or
404? If so, what is the status of obtaining those approval(s)?
b. Calculations
i. Sand Filter Outlet: It appears that the outlet invert, which is at 31 msl
collects in SDMH No 4 and then drains to the pond. Please clarify
through calculations that the pond will be able to hold/treat the
required volume with the additional sand filter volume flowing to it. If
the sand filter is not intended to drain to the pond, please show where
it drains and please also the invert of the receiving ditch/pipe.
ii. Volume Calculations: Though the wet pond was previously permitted
and both the drainage area and impervious area have decreased
such that there should be no issue with being able to contain the

water, we will need an updated, stamped required volume Simple
Method calculation and supplement sheet for the file.
iii. Design Calculations: It also appears that the depth and potentially
other design parameters may have changed. The permitted pond
shows the bottom of the pond to be at 19msl and the proposed pond
is shown to be at 22msl. The dimensions of the surface area also
changed. Please provide updated design calculations. SL2008-211
allows you to keep a pond design under previously -permitted design
requirements if you 1.) Do not increase impervious area to the pond
(which you have not done), or 2.) Do not increase the size of the
pond. I understand that the reason for adding the sand filter was to
avoid having to make it "bigger'. If the pond still has to be "bigger",
please have your engineer contact me for further discussion.
iv. Supplement: Please provide an updated supplement form.
v. O&M Form: If the depth changes, please submit an updated O&M
form.
c. Drainage Area: There is a dashed line that appears to be the wet pond's
drainage area. Please label it on the plan.
d. Timber Wall: Please clarify why the timber wall has been removed. It
appears that it was included in the previous permit to ensure an appropriate
length to width ratio. What has changed to make it no longer necessary?
3. General:
a. Maintenance Easements: Maintenance easements are noted on the plan.
Please show their locations and dimensions.
4. Please remember that a change to one number may have a domino effect on
other numbers. Please check all plans, calculations and forms and make
changes as needed.
Please note that this request for additional information is in response to a preliminary review.
The requested information should be received in this Office prior to May 19, 2011, or the
application will be returned as incomplete. The return of a project will necessitate resubmittal of
all required items, including the application fee.
If you need additional time to submit the information, please mail, email or fax your request for a
time extension to the Division at the address and fax number at the bottom of this letter. The
request must indicate the date by which you expect to submit the required information. The
Division is allowed 90 days from the receipt of a completed application to issue the permit.
The construction of any impervious surfaces, other than a construction entrance under an
approved Sedimentation Erosion Control Plan, is a violation of NCGS 143-215.1 and is subject
to enforcement action pursuant to NCGS 143-215.6A.
Please reference the State assigned project number on all correspondence. Any original
documents that need to be revised have been sent to the engineer or agent. All original
documents must be returned or new originals must be provided. Copies are not acceptable.

Covil Gardens is a vacant 2.22-acre tract proposed for a multifamily project. Proposed
impervious areas include 14,595 sf of building, 28,700 sf of parking area, and 9,573 sf of
concrete. This a total built upon area of 54,707 sf or 56.6% total impervious area. The
impervious area will be treated by a proposed sand filter and proposed wet detention pond.
The pond is currently permitted to treat 50,760 sf (1.17 ac) of impervious area. The pond
will treat runoff for the State's 1.5", 1-year 24-hour pre -post and the City's 10-year pre -
post requirements. The sand filter is sized for 8,734 sf of total impervious area. Overflow
from this basin will be directed to Burnt Mill Creek, classification C-S W.

On October 8, 2010, Southern Environmental Group,'Inc. (SEGi) conducted soil borings to
estimate the seasonal water table at a site referred to as Covil Gardens, located off of Covil
Avenue, south of the intersection of Covil Avenue and Market Street, in New Hanover.County,
North Carolina.
At the time of the site evaluation, 2 auger borings were conducted, to depths of 45 inches below
the existing grade. Soils encountered in the boreholes predominately consisted of fine to medium
grade sands and sandy clay loams. The soils at both borings were predominantly light colored
materials (Chroma values 2 or less on the Munsell soil color chart). There was a very weak
restrictive layer noted at about 7 inches below grade at each location. Only Boring 1 had visible
water in the hole, which was measured at 44 inches below existing grade. It is worth noting that
this area received upwards of 20 inches of rain over several days ending on October 1, 2010. We
encountered indications of a seasonal high water table in the form of common, prominent high
chroma mottles (1 OYR 5/6) at 30 inches in Boring 1, and 28 inches at Boring 2. The data for each
plot area is presented in Tables 1 and 2, which has been attached to this correspondence. Also
attached, you will find a site plan showing the approximate boring locations.
