Effective August 1, 2013, the State Stormwater program was transferred from the Division of Water
Quality (DWQ) to the Division of Energy, Mineral and Land Resources (DEMLR). Please note that this
letter and permit references DEMLR as the Division responsible for issuance of the permit.
The Wilmington Regional Office received a complete, modified Stormwater Management Permit
Application for Emmerdale Apartments on November 21, 2014. Staff review of the plans and
specifications has determined that the project, as proposed, will comply with the Stormwater
Regulations set forth in Title 15A NCAC 2H.1000 and Session Law 2008-211, as applicable. We are
forwarding Permit No. SW8 060650 dated November 24, 2014, for the construction, operation and
maintenance of the BMP's and built -upon areas associated with the subject project.
On August 5, 2009, the Governor signed Session Law 2009-406. This law impacted any development
approval issued by the former Division of Water Quality under Article 21 of Chapter 143 of the General
Statutes, which was current and valid at any point between January 1, 2008, and December 31, 2010.
The law extended the effective period of any stormwater permit that was set to expire during this time
frame to three (3) years from its current expiration date. On August 2, 2010, the Governor signed
Session Law 2010-177, which granted an extra year for a total of four (4) years extension. Accordingly,
this permit shall now be effective from the date of issuance until July 17, 2020, which includes all
available extensions. The permittee and/or project remain subject to the conditions and limitations as
specified therein.
Please pay special attention to the conditions listed in this permit regarding the Operation and
Maintenance of the BMP(s), recordation of deed restrictions, procedures for changing ownership,
transferring the permit, and renewing the permit. Failure to establish an adequate system for operation
and maintenance of the stormwater management system, to record deed restrictions, to transfer the
permit, or to renew the permit, will result in future compliance problems.
The following modifications are included and covered by this permit:
• The addition of on -site built -upon area associated with the driveway and sidewalk connection to
the adjacent property, Wellington Grove (SW8 120110), and draining to Pond 2.
If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to
request an adjudicatory hearing by filing a written petition with the Office of Administrative Hearings
(OAH). The written petition must conform to Chapter 150E of the North Carolina General Statutes, and
must be filed with the OAH within thirty (30) days of receipt of this permit. You should contact the OAH
with all questions regarding the filing fee (if a filing fee is required) and/or the details of the filing
process at 6714 Mail Service Center, Raleigh, NC 27699-6714, or via telephone at 919-431-3000, or
visit their website at www.NCOAH.com. Unless such demands are made this permit shall be final and
binding.

construction, operation and maintenance of two (2) wet detention pond(s) in compliance with
the provisions of 15A NCAC 2H .1000 and Session Law 2008-211, as applicable, (hereafter
referred to as the "stormwater rules') the approved stormwater management plans and
specifications and other supporting data as attached and on file with and approved by the
Division and considered a part of this permit.
This permit shall be effective from the date of issuance until July 17, 2020, and shall be
subject to the following specified conditions and limitations:
I. DESIGN STANDARDS
1. This permit is effective only with respect to the nature and volume of stormwater
described in the application and other supporting data.
2. This stormwater system has been approved for the management of stormwater runoff
as described in Section 1.6 of this permit. The runoff from all built -upon area within the
permitted drainage areas of this project must be directed into the permitted stormwater
control systems. The stormwater controls labeled Pond 1 and Pond 2 have been
designed to handle the runoff from 59,141 and 73,768 square feet of built -upon area,
respectively.
3. The maximum built -upon area allowed for the entire project is 132,909 square feet.
4. The drainage areas will be limited to the amounts of built -upon area indicated in
Sections 1.2 and 1.6 of this permit, and per approved plans. There is no allocation of
future built -upon area for this development.
5. A vegetated filter strip is not required for this pond as it has been designed for a 90%
total suspended solids removal efficiency.

II. SCHEDULE OF COMPLIANCE
No person or entity, including the permittee, shall alter any component of the approved
stormwater system shown on the approved plans unless and until the Division has
approved of the revised plan.
2. The stormwater management system shall be constructed in its entirety, vegetated
and operational for its intended use prior to the construction of any built -upon surface.
During construction, erosion shall be kept to a minimum and any eroded areas of the
system will be repaired immediately.
4. The permittee shall at all times provide the operation and maintenance necessary to
assure that all components of the permitted stormwater system function at design
condition. The approved Operation and Maintenance Agreement is incorporated by
reference into this permit and must be followed in its entirety and maintenance must
occur at the scheduled intervals.
Records of maintenance activities must be kept and made available upon request to
authorized personnel of the Division. The records will indicate the date, activity, name
of person performing the work and what actions were taken.
Decorative spray fountains will not be allowed in the stormwater treatment systems, as
the permanent pool volumes of both ponds are less than 30,000 cf.
The facilities shall be constructed in accordance with the conditions of this permit, the
approved plans and specifications, and other supporting data.

8. Upon completion of construction, prior to issuance of a Certificate of Occupancy, and
prior to operation of this permitted facility, the permittee shall cause a certification from
an appropriate designer for the system installed to be submitted, certifying that the
permitted facility has been installed in accordance with this permit, the approved plans
and specifications, and other supporting documentation. Any deviations from the
approved plans and specifications must be noted on the Certification. A modification
may be required for those deviations.
9. If the stormwater system is used as an Erosion Control device, it must be restored to
design condition prior to operation as a stormwater treatment device, and prior to
occupancy of the facility.
10. All stormwater collection and treatment systems must be located in either public.
rights -of -way, dedicated common areas or recorded easements. The final plats for the
project will be recorded showing all such rights -of -way, common areas and
easements, in accordance with the approved plans. Access to the stormwater facilities
for inspection and maintenance shall be maintained via appropriate recorded
easements at all times.
11. The permittee shall submit to the Director and shall have received approval for revised
plans, specifications, and calculations prior to construction, for any modification to the
approved plans, including, but not limited to, those listed below:
a. Any revision to any item shown on the approved plans, including the
stormwater management measures, built -upon area, details, etc.
b. Redesign or addition to the approved amount of built -upon area or to the
drainage area.
C. Further development, subdivision, acquisition, lease or sale of any, all or part of
the project area. The project area is defined as all property owned by the
permittee, for which Sedimentation and Erosion Control Plan approval or a
CAMA Major permit was sought.
d. Filling in, altering, or piping of any vegetative conveyance shown on the
approved plan.
e. The construction of any future BUA listed on the application.
12. Prior to transfer of the permit, the stormwater facilities will be inspected by Division
personnel. The project and the stormwater facility must be in substantial compliance
with all permit.conditions. Any items not in substantial compliance must be repaired,
replaced or restored to design condition prior to the transfer. Records of maintenance
activities performed to date will be required.
13. The Director may notify the permittee when the permitted site does not meet one or
more of the minimum requirements of the permit. Within the time frame specified in
the notice, the permittee shall submit a written time schedule to the Director for
modifying the site to meet minimum requirements. The permittee shall provide copies
of revised plans and certification in writing to the Director that the changes have been
made.
III. GENERAL CONDITIONS
Any individual or entity found to be in noncompliance with the provisions of a
stormwater management permit or the Stormwater rules is subject to enforcement
procedures as set forth in NCGS 143 Article 21.
2. The issuance of this permit does not preclude the Permittee from complying with any
and all statutes, rules, regulations, or ordinances, which may be imposed by other
government agencies (local, state, and federal) having jurisdiction.

3. In the event that the facilities fail to perform satisfactorily the Permittee shall take
immediate corrective action, including those as may be required by this Division, such
as the construction of additional or replacement stormwater management systems.
Additional or replacement stormwater management systems shall receive a permit
from the Division prior to construction.
4. This permit is not transferable to any person or entity except after notice to and
approval by the Director. The permittee shall submit a completed and signed
Name/Ownership Change Form, accompanied by the supporting documentation as
listed on the form, to the Division at least 60 days prior to any one or more of the
following events:
a. An ownership change including the subdivision, sale or conveyance of the project
area in whole or in part;
b. The sale or conveyance of the common areas to a Homeowner's or Property
Owner's Association, subject to the requirements of Session Law 2011-256;
c. Bankruptcy;
d. Foreclosure;
e. Dissolution of the partnership or corporate entity;
f. A name change of the current permittee;
g. A name change of the project;
h. A mailing address change of the permittee;
5. The permittee is responsible for compliance with all permit conditions until such time
as the Division approves the transfer request. Neither the sale of the project, in whole
or in part, nor the conveyance of common area to a third party constitutes an
approved transfer of the stormwater permit.
6. The permittee grants DENR Staff permission to enter the property during normal
business hours for the purpose of inspecting all components of the permitted
stormwater management facility.
7. The permit issued shall continue in force and effect until modified, revoked, terminated
or renewed. The permit may be modified, revoked and reissued or terminated for
cause. The filing of a request for a permit modification, revocation and re -issuance or
termination does not stay any permit condition.
Approved plans and specifications for this project are incorporated by reference and
are enforceable parts of the permit. The permittee shall maintain a copy of the permit,
O&M agreements, and the approved plans at all times.
Unless specified elsewhere, permanent seeding requirements for the stormwater
control must follow the guidelines established in the North Carolina Erosion and
Sediment Control Planning and Design Manual.
10. The issuance of this permit does not prohibit the Director from reopening and
modifying the permit, revoking and reissuing the permit, or terminating the permit as
allowed by the laws, rules and regulations contained in Session Law 2006-246, Title
15A NCAC 2H.1000, and NCGS 143-215.1 et.al.

11. The permittee shall submit a permit renewal application request at least 180 days prior
to the expiration date of this permit. The renewal request must include the appropriate
application, documentation and the processing fee.

VI. SUBMITTAL REQUIREMENTS
Only complete application packages will be accepted and reviewed by the Division of Energy, Mineral and
Land Resources (DEMLR). A complete package includes all of the items listed below. A detailed application
instruction sheet and BMP checklists are available from

submitted to the appropriate DEMLR Office. (The appropriate office may be found by locating project on the

Information, item 1.
6. A USGS map identifying the site location. If the receiving stream is reported as class SA or the
receiving stream drains to class SA waters within 33z mile of the site boundary, include the 11-2
mile radius the map.
7. Sealed, signed
and dated calculations (one copy).
8. Two sets of plans folded to 8.5" x 14" (sealed, signed, & dated), including:
a. Development/Project name.
b. Engineer and firm.
c. Location map with named streets and NCSR numbers.
d. Legend.
e. North arrow.

g. Revision number and dates.
h. Identify all surface waters on the plans by delineating the normal pool elevation of
impounded structures, the banks of streams and rivers, the MHW or NHW line of tidal
waters, and any coastal wetlands landward of the MHW or NHW lines.
• Delineate the vegetated buffer landward from the normal pool elevation of impounded
structures, the banks of streams or rivers, and the MHW (or NHW) of tidal waters.
i. Dimensioned property/project boundary with bearings & distances.
j. Site Layout with all BUA identified and dimensioned.
k. Existing contours, proposed contours, spot elevations, finished floor elevations.
1. Details of roads, drainage features, collection systems, and stormwater control measures.
m. Wetlands delineated, or a note on the plans that none exist. (Must be delineated by a
qualified person. Provide documentation of qualifications and identify the person who
made the determination on the plans.
n. Existing drainage (including off -site), drainage easements, pipe sizes, runoff calculations.
o. Drainage areas delineated (included in the main set of plans, not as a separate document).
p. Vegetated buffers (where required).
9. Copy of any applicable soils report with the associated SHWT elevations (Please identify /T/,4
elevations in addition to depths) as well as a map of the boring local ons with the existing
elevations and boring logs. Include an 8.5"xll" copy of the NRCS County Soils map with the
project area clearly delineated. For projects with infiltration BMPs, the report should also
include the soil type, expected infiltration rate, and the method of determining the infiltration rate.

VII. DEED RESTRICTIONS AND PROTECTIVE COVENANTS
For all subdivisions, outparcels, and future development, the appropriate property restrictions and protective
covenants are required to be recorded prior to the sale of any lot. If lot sizes vary significantly or the proposed
BUA allocations vary, a table listing each lot number, lot size, and the allowable built -upon area must be provided
as an attachment to the completed and notarized deed restriction form. The appropriate deed restrictions and
protective covenants forms can be downloaded from http://portal.ncdenr.org/web/Ir/state-stormwater-
forms does. Download the latest versions for each submittal.
In the instances where the applicant is different than the property owner, it is the responsibility of the property
owner to sign the deed restrictions and protective covenants form while the applicant is responsible for ensuring
that the deed restrictions are recorded.
By the notarized signatures) below, the permit holder(s) certify that the recorded property restrictions and
protective covenants for this project, if required, shall include all the items required in the permit and listed
on the forms available on the website, that the covenants will be binding on all parties and persons claiming

David, The version of calcs that you sent Christine say preliminary and it is hard to tell what you did because you have
writing on the side etc.
If you can send us a clean calculation page showing all of your calculations at the 1.5", With Your Stamp, because that is
what the rules require and is not something we just ask for, than that would be great.
Another reason this needs to be clean and clear is that somewhere down the road we will have to transfer the
permit. The new permittee needs to understand what the engineer did in their calculations.

Yes, I can certainly send you the revised Drainage Area plan.
I am suggesting.... since it is readily apparent that the pond is capable of accommodating (per the calculations) the small
(actually miniscule) amount of additional BUA and Drainage Area, that we do NOTHING.
Is there really any need to go through another complicated paper chase exercise here?
All water is being treated.
All treatment BMP are capable of handling the tributary BUA (per the new calcs).
That being the case.... everything we are doing here is beginning to seem like nothing more than an elaborate paper
chase .... worse yet .... a "circular" paper chase (i.e. one project impacts another project which impacts the master
permits..... and so on, so on......)
At some point..... I'd like to finally be done with this thing.

Sorry for the delay ..... I have been out of the office .... for perhaps much too long.
Regarding your below comment.... "Can you please explain why you think this modification and the 1" design storm is
applicable under this section of the rules?"
I would argue that design storm (1" or 1.5") which is to be applied is largely a mute point, as the pond is of adequate
capacity to accommodate the larger design storm (1.5") for that small portion of additional BUA and Drainage Area.
Please see that attached PRELIMINARY talcs (these are UNSEALED talcs for your consideration ONLY .... and are NOT
intended, at least at this point, as FINAL calculations).
Those talcs I think clearly demonstrate that the pond as previously designed includes more than adequate capacity
(both surface area and control volume) to accommodate the small amount of additional BUA and Drain Area (DA)
associated with the additional sidewalk you previously noted.
We wish to also make you aware that it was the CITY who asked the Developer for this additional section of
sidewalk..... There was certainly no intent of circumventing any stormwater rule .... the Developer was simply attempting
to appease a request (after SW permit issued) by the City of Jacksonville to provide sidewalk connectivity.
Please let me know if the above response adequately addresses your concern. If so, I can finalize and seal/sign these
revised talcs if you need them for your files.

In the response to item 3 of the request for additional information dated October 20, 2104, you reference paragraph
143-750 of Session Law 2014-120, which states:
(a) If a permit applicant submits a permit for any type of development and a rule or ordinance changes between the time
the permit application was submitted and a permit decision is made, the permit applicant may choose which version of
the rule or ordinance will apply to the permit.
(b) This section applies to all development permits issued by the State and by local governments.
(c) This section shall not apply to any zoning permit."
Our interpretation of this section of the session law is that this rule is intended to apply to those projects whose
application was submitted prior to the rules changing but where the project has not yet been permitted. If the
application is still in house, the applicant can then select which rule they wish to apply to their project.
It's not clear how this rule applies to the Emmerdale Apt modification as the application to modify the permit was not in
place during a rule change. As you know, this modification was requested in 2012 because the adjoining property
proposed to construct an access road within the Emmerdale Apartments property area that would ultimately drain to
one of the ponds permitted under the Emmerdale Apartments stormwater permit. The application to modify the permit
was submitted on October 9, 2014. Can you please explain why you think this modification and the 1" design storm is
applicable under this section of the rules?

We are in receipt of your Request for Additional Information dated October 20, 2014 for the
referenced project. We provide the following information to allow you to continue the
stormwater review (item numbers correspond to your original letter): Ag_, i �. \o h
1. Just curious as to the source of these "up to date" on-line photos. All of my sources of 9 IV
aerial photography are dated (old) and show no such connection to Building 11.
Regardless, I did visit the site yesterday to see firsthand the configuration of the
sidewalks, and as you indicated, a portion of the sidewalk was indeed connected to
existing sidewalk at Building 11. We have revised the Drainage Area Supplement
accordingly (attached). Furthermore, we have added this slight amount of additional
BUA to Pond 2 Calculations (attached) as well as Application sheet Page 4 of 7. The
other noted differences in sidewalk configuration (i.e. clubhouse and apartment
entrance walks) appear very minor, and I suspect "cancel out" each other (i.e. result in
negligible or no additional BUA).
2. Please see attached REVISED calculations for Pond 2 which clearly demonstrate that
the existing pond design can indeed accommodate the additional BUA as well as an
additional 2,394 sf of drainage area associated with said BUA. Please also see
attached revised Page 4 of 7 of the Application on which we have increased the
drainage area as requested. Also attached is a revised Wet Pond Supplement which
also reflects that slight increase in drainage area.
3. More recent Session Law 2014-120 (Paragraph 143-750 Permit Choice) states, "If a
permit applicant submits a permit for any type of development and a rule or ordinance changes
between the time the permit application was submitted and a permit decision is made, the permit
applicant may choose which version of the rule or ordinance will apply to the permit." In other
words, "the permit applicant has the choice as to which rule%rdinance/policy shall apply'
according to the drafters (J. Warren et al) of these new rules. For the sake of simplicity and
consistency, we prefer to apply the pre-existing 1" standard.

The Wilmington Regional Office received a modified Express Stormwater Management Permit
Application for Emmerdale Apartments on October 7, 2014. A preliminary review of that information
has determined that the application is not complete. The following information is needed to continue
the stormwater review:
r\_J 1. The revised drainage area map indicates that the additional sidewalk does not connect to the
gnl- existing sidewalk. According to aerial photos available online, it appears that the additional
sidewalk extends to Building 11. Additionally, these aerial photographs appear to show other
CA1�� small changes have been made to the approved built -upon area including the clubhouse area
and nearby sidewalks as well as with several entrance walks associated with the apartment
buildings. Please confirm the extent of the additional impervious area and whether or not other
changes have been made to the approved impervious area.
/2. The drainage area for pond 2 is listed in the revised application as being the same area as
originally permitted. However, the highlighted drainage area map originally approved does not
extend beyond the traffic circle to the vicinity of the additional impervious area proposed with
this modification. Please confirm that the drainage area is remaining the same with the
additional improvements. If the drainage area is changing or is being re -delineated, please
identify the new drainage area on the plans and update the supplemental documents
accordingly.
3. Per 15A NCAC 02H. 1 005(h)(J), any increase in the net impervious area of a project is
considered a major modification to the permit and thus requires the additional impervious area
to be considered under the current rules. Please consider any increase to the drainage area or
impervious area at the 1.5" design storm required by the current rules instead of at the 1" design
storm.
✓4. The original signature provided in the application is under Section IX instead of in Section X of
the application. Section I X is intended for projects where the permit is to be issued to an entity
other than the property owner, such as a leased property or one that is under a sales contract.
Please provide an originally signed Section X of the application.
5. Due to the relatively minor nature of these comments, the express additional information review
fee has been waived.
6. Please keep in mind that changing one number may change other numbers and require the
calculations, supplements, and other supporting documentation to be updated. Verify all
numbers are correct to ensure consistency in the application documents.

Emmerdale Apartments
On July 17, 2006, Emmerdale, LLC received Stormwater Management Permit SW8 060650 for development of a forty-six (46)
unit apartment complex on a 8.43 acre tract located on Carolina Forest Blvd. (off Western Blvd—NCSR 1470 - now NC 53)
within the city limits of Jacksonville, N.C. The permitted Stormwater Plan includes two (2) wet detention basins designed to
(real runoff from each of two drainage areas. The project has since been constructed and the Designers Certification was
issued on 6/1/10.
Wellington Grove Apartments, an adjacent project recently permitted with SW8 120110 n NIP
ef-khel-pemr* now wishes to extend a small section (860 so of proposed street R sidewalk onto the Emmerdale property. As
this small section of street / sidewalk will be graded so as to drain runoff into the Emmerdale Pond #2, DWQ requested a
modification of the Emmerdale Apartments permit to reflect the increase in BUA for Pond #2.
Although no "future" BUA was included in the original Emmerdale Apartments Stormwater Permit, the revised Design
Calculations for Pond #2 (attached) demonstrate that Pond #2, as currently constructed, can adequately treat the additional 860
sf of BUA.
The project site is located approximately 0.4 miles from an UT of Half Moon Creek (C;NSW) in the White Oak Basin. The
proposed (now existing) development activities are high density (percent impervious > 25 %). The attached Stormwater Plan
includes two wet detention basins. No changes are proposed for Pond 1 (4,508 so, which is situated on the northeast side of the
tract. Pond 2 (5,569 so is located at the southwest corner of the tract.

Pond 2 (5,569 so is located at the southwest corner of the tract, and was originally sized to accommodate 72,438 square feet of
impervious area. No changes are proposed to the actual pond (which has been completed, certified and is currently in service);
however, the impervious area draining to the pond will be increased by 860 square feet. This proposed increase in impervious
area can be easily accommodated by the current configuration of Pond 2 (see the attached, revised Design Calculations for
Pond 2). With the additional BUA, the total impervious area for Pond 2 is allocated as follows:

Both stormwater ponds are sized for 90% TSS removal. The ponds do not incorporate pretreatment, other than the forebays.
Neither pond includes a vegetated filter at the outlet.
All stormwater emanating from impervious surfaces that is generated on -site shall be collected and directed to Pond 1 or Pond 2
by a system of sheet drainage, grassed swales and storm drainage pipes.
The treatment system will require periodic maintenance. Maintenance frequency shall be dictated by pond depths. Pond
depths shall be checked by the owner on a quarterly basis. When measured depths are less than 3.75' (in both the main ponds
and the forebays), the pond shall be manually dewatered (pump) and accumulated sediment removed and properly disposed of.
Site topography is gently sloping (0 — 5%) generally toward the northeastern boundary of the tract. Soils are loamy sand/sandy
loam.

Considering the conflicting requests from DWQ staff...... I don't think it fair or proper to imply "information
provided... were inaccurate". It is/was a VERY COMPLEX set of applications ... requiring MULTIPLE persons to compile the
data..... We did the BEST we could with the directions/request imposed upon us.
Please give to JLP and let me know how he wants to handle this.... Frankly, I am a little pissed off at this point with the
whole mess. As per usual, I think I know who gets stuck with this additional expense.

It is unfortunate that the information provided to the Division in the Wellington Grove application documents were
inaccurate. However, the procedures are that anytime the drainage area changes or the BUA increases from the
permitted conditions, it is considered a modification to the permit, not a plan revision. I understand this may seem
minor, but changes to the permitted drainage area and an increase in the BUA require the permit to be rewritten and a
quick check of the calculations.
As for fees: modifications through the Regular program are $505. If you wish to submit these through the Express
program, I am fairly certain they would be considered minor modifications with a fee of $2,000.

We are going to do WHATEVER we need to do to get this thing FINALLY FINISHED....
But, in my view, formal MODIFICATIONS seems a little un-necessary..... I fail to understand why we just cannot correct
the BUA in both permits under a simple Plan Revision.... and not subject the owners to additional Permit Expense....
They (the Permittees) still contend that they were initally told "not to worry about the little bit of BUA on
Emmerdale ...... as EVERYTHING was going to pond(s) (I was not there ... so I don'tknow).
Regardless, that have done what you asked (Emmerdale Plan Revision) ...... which necessitates the Wellington
Revision ...... I have all that info ready to submit .... I just need to know if additional permit fees are required.

If this 860 sf was included, that is truly unfortunate. The drainage area plan for Wellington Grove indicates that 15,241
sf of offsite entrance road area is contributing to the Wellington Grove Pond while the 860 sf is contributing to the
Emmerdale Pond. So are you saying the offsite numbers to Wellington Grove should have been 15,241— 860 = 14,381
sf?
If so, it does sound like modifications to both permits are in order. For both modifications, you will need to submit the
full, signed application, calculations, and supplements. (In your original e-mail you indicated you would only provide
page 3 of the Wellington Grove app). However, within Wellington Grove, if you can maintain the same drainage area
and are just reallocating the BUA from offsite to future, this can be done as a plan revision and you would need to
provide the plan revision form instead of the full application.

Regarding the 860 sf... I thought so too, but my work over the weekend showed that NOT to be the case .... (the 860 WAS
included in the OFFSITE figure permitted for Wellington).
Regarding an updated Wet Detention Pond Supplement (and possibly a new 0&M agreement).... we can certainly
provide.... but please note that REALLOCATING this 860 sf of BUA has turned into an INCREDIBLE amount of effort, as one
change to one permit package changes EVERYTHING ..... There is NO WAY WE CAN BILL for all the time we have invested
in this.
That said, just tell us exactly what you need to complete this modification/plan revision, and we will furnish.... At this
point .... I just want to get done with it.

I was under the impression that the 860 sf draining to Emmerdale was already removed from the Wellington Grove
permit when I issued it. That was the approx change in numbers between the documents you provided during the
submittal meeting and the information dropped off by Pascal. I will have to do some more digging to confirm this.
As for the modification to Emmerdale, you will also need to provide an updated wet detention pond supplement (and
possibly a new 0&M agreement depending on how old that last supplement is) and plans for the proposed
improvements.

As requested, I have prepared a Plan Modification request for Emmerdale Apartments to account for that 860 sf of BUA
(street and sidewalk) that is to be constructed in conjunction with Wellington, but is actually ON the Emmerdale tract
and draining to the existing Emmerdale Pond. That Plan Revision package includes 1) a complete Application Form (6
sheets) AND 2) revised Pond Calculations demonstrating that the existing Emmerdale Pond can accommodate the
additional BUA.
When preparing that application, we realized that it will be necessary to deduct that same 860 sf from the "offsite"
category in the recently issued Wellington Permit.... in order to avoid "Double Counting". Therefore, I have also
prepared a Plan Modification package for Wellington Grove, deducting that 860 sf that is now accounted for in the
Emmerdale Permit. That Plan Revision package includes 1) a new Page 3 of 6 which shows the corrected BUA
breakdown and 2) a revised Pond Calculations for the Wellington Pond (i.e., less BUA going to that pond).
In your opinion(s), is that the correct way to take care of this?
I hope so...because it was a LOT of work to reconcile all these numbers.....
If we are in agreement, Dewey Edwards (attorney) will incorporate these numbers into the requested Deed Restrictions
for ALL the various tracts covered by the original Low Density permit.
