submittal.

a. It is noted that a copy of the recorded deed restrictions and protective covenants wcis provided,
hovvever, they do not include all of the required staiement cis listed in Permit Condition 11.16.
Please provide a copy of the amended and rerecorded deed restrictions and protective
covenants that include all of the statements in Permit Condition, LL 16.
b. Based on the provided tables, it appears that the As -Built BUA on 84 of the lots exceed their
Permitted BEA. el permit moditieation must be submitted in order to address this overbuilding.
Response:
a. A copy of the recorded deed restrictions has been included in this submittal.
b. There were several math errors in the previoushF submitted tables. The tables have been revised
and all lots remain in compliance.
4. Ort Eebruary 25. 2020. the Wilmington Regional Ofjice oj7he Division of Enera hneral and
Land Resources (DE,411,R) inspected the subject project to determine the status of compliance with
this pertnit, lost issued on October 10. 2017. DE:WLRfile review and site inspection revealed that
the .cite is not in compliance with the terms and conditions ofthis permit A copy of the completed
form entitled "Compliance Inspection Report "stanmarizing the findings of the recent inspection is
attached to this letter. Please either address the following items to demonstrate compliance with
the permit or submit a platl of action that provides a timeline in which the followina compliance
issues will be resolved.
a. Permit Condition III. I2 and 15A A7CAC 02H.1045(3): This permit is currenlly set to
expire oil September 21, 2020. Per the cited permit condition and rule, on application to
renew the permit must be submitted a minimum of 180 do vs prior to the permit's
expiration date. which would he Harch 25, 2020. Please ensure a complete permit
renewal application is submitted prior to Illarch 25, 2020.
b. Permit Condition H..6: The outlet pipe of Pond H5 does not continue to the bridge on
Grayson Parkway as shown on the approved plans.
c. Permit Condition 1i.5 and 11.13: Pond as has bare areas that are eroding. Addilionally.
several hontes are tinder construction with some recently stabilized Some of the recently
stabilized lots (ire eroding at the rear.
d. Permit Condition 11.5: The 20 foot drainage easement between Lots 74 and 75 extencling
to Pond ='4 has been fencect
Response:
a. A permit renewal application and fee have been included with this submittal.
b. We have confirmed that the outlet pipe of pond #5 does continue to the bridge as reflected
on the approved plans. In 2018 the permittee engaged a contractor to repair the Pond 5
outlet as shown on the attached plan.
c. The onsite contractor has provided maintenance and repair of these areas and will
continue to monitor the areas and repair as needed.
d. The developer and their attorney are working with the lot owners of 74 & 75 to provide an
encroachment agreement for the fence including provisions for maintenance access as
needed. A draft of the agreement has been provided for review. Please confirm that this
agreement, when executed and recorded with Brunswick County Register of Deeds will
satisfactorily address any concerns.

THIS AGREEMENT REGARDING FENCE ENCROACHMENT (this
"Agreement") is made this day of 2020. by and between EDWARD R.
LEWIS and wife. LORI A. LEWIS ("Lot 74 Owner'), GUDER QUEZADA HERNANDEZ
and wife. TYWANIA QUEZADA ('Lot 75 Owner', and together with Lot 75 Owner,
collectively the "Owners"); MACO ROAD PARTNERS, LLC. a North Carolina limited
liability company ('Declarant'); and GRAYSON PARK OF LELAND HOMEOWNERS
ASSOCIATION, INC.. a North Carolina non-profit corporation (the "Association');
WITNESSETH:
WHEREAS, Declarant previously executed that certain Declaration of Covenants.
Conditions and Restrictions for Grayson Park Subdivision, recorded in Book 2565, Page 531 in
the Brunswick County Registry (as the same has been or may be amended and/or supplemented
heretofore and hereafter, the "Declaration') and is the current declarant thereunder:
WHEREAS. the Association is the master homeowners' association for the Grayson
Park Subdivision as referenced in the Declaration and governed by the Board of Directors (as
defined in the Declaration) of the Association;
WHEREAS. Lot 74 Owner is the owner of that certain real property being more
particularly described as Lot 74, Phase 1B, Grayson Park as shown on a map recorded in Map
Book 56, Page 13 of the Brunswick County Registry (the ."Plat'), such lot being further
described on Exhibit A attached hereto (the "Lewis Tract');
WHEREAS. Lot 75 Owner is the owner of that certain real property being more
particularly described as Lot 75, Phase I B, Grayson Park as shown on the Plat, such lot being
further described on Exhibit B attached hereto (the "Quezeda Tract');

WHEREAS, a portion of a wooden fence located on both the Lewis Tract and the
Quezeda Tract currently encroaches (the "Encroachment') onto that certain 20' Access/Drainage
Easement (10' of such easement being on each of the owners' lots) as shown on the Plat (the
"Easement'), said Encroachment being more particularly shown on the survey attached hereto as
Exhibit A and incorporated herein by reference (NOTE: Matt, will we have anything showing
the fence? I,- and
WHEREAS. Declarant, the Association, and any other related governmental or
regulatory authorities require use of the Easement and access through the fence in order to access
and maintain certain stormwater facilities and ponds in order to comply with permits and
regulatory requirements, including, without limitation, North Carolina State Stormwater
Management Permit Number SW8 060238 (as to Phase 1). SW8 191106 (as to Phase 2A & 2B—
Section 1), and SW8 070706 (as to Phase 2B & 2C), and any subsequently issued permits or
modifications (the "Permits");
WHEREAS, rather than remove of the fence from the Encroachment area, the Owners
are willing to install a gate, and confirm to Declarant and the Association all rights as are
necessary in regard to use of the Access Easement in order to comply with the Permits, such
rights also beins for the benefit of all related regulatory and governmental authorities;
WHEREAS, the parties hereto have agreed that the Encroachment may remain in its
present location, subject to the other terms and conditions set forth herein.
NOW, THEREFORE, in consideration of Ten Dollars ($10.00) and for other good and
valuable consideration, the receipt and sufficiency of which are hereby acknowledged, the parties
herebv agree as follows:
I. Recitals. The parties hereto acknowledge the accuracy of the foregoing recitals
which are incorporated by reference herein and are made a part of this Agreement.
2. Fence and Gate: Use of Easement. Owners shall, at their cost and expense, install
and maintain a gate in the fence that opens at least to the full width of the Easement. Such gate
may include a latch to prevent it from swinging open, but shall not, unless otherwise agreed or
requested by Declarant and the Association, be locked at any time. Access through such gate
and use of the Easement shall be allowed and permitted at all times, and the rights of Declarant
and the Association in regard to the Easement shall include all rights as are necessary in regard
to the requirements under the Permits. including the right of such parties to allow use of the
Easement by any related governmental or regulatory authority.
3. Limited Allowance for Encroachment. Subject to the other terms and conditions
herein. Declarant and the Association hereby agree to allow the Encroachment to remain in its
present location, without any rights of expansion, enlargement. or extension. Notwithstanding
the foregoing, if at any time Declarant or the Association are required to remove the
Encroachment by applicable govemmental authorities or pursuant to the Pen -nits, this Agreement
and the Owners' rights herein shall termination automatically and Declarant or the Association
shall have all rights to enforce removal of the Encroachment, and Owners agree to execute anv

documents acknowledging the termination of this Agreement. Owners shall not erect any other
improvement in the Easement area and shall use the Easement area only to allow the
Encroachment to remain in its present location.
4. Binding. This Agreement shall run with the land and be binding upon and shall
inure to the benefit of the parties hereto. their respective heirs. successors and assigns.
5. Miscellaneous. This Agreement may be recorded and the party recording the
same shall incur the cost thereof. This Agreement may not be modified or amended without the
prior written consent of the parties named herein. or their respective successors and assigns. as
the case may be. This Agreement shall be governed by, and construed in accordance with. the
laws of the State of North Carolina. This Agreement may be executed in one or more
counterparts each of which in the aggregate shall constitute one and the same instrument.

expenses to the next year without paying income tax on the excess. There being no objections, Resolution 70-604 has
passed.
POINT OF ORDER: Owner Charles Fish requested a Point of Order in regard to the conduct of the Election process. Deanna
King, answering with rationale on behalf of the Chair, explained the use of ballots by mail is legal and acceptable, and
the way in which the Board of Directors chose to collect ballots this year.

ANNOUNCEMENT OF THE BOARD OF DIRECTORS: Article VIII of the project Bylaws specifies that the affairs of the
Association shall be governed by a Board of Directors composed of not less than two (2) nor more than nine (9) persons.
There were three (3) vacancies on the Board to fill -- one position will be for a one-year term, the other two positions
are for three-year terms.
A Call for Candidate Notice was mailed to all owners of record. Four candidates responded with self -nominations. They
were: Max McIntyre (1 year), Jamie Collier (1 or 3 years), Katie Clawson (1 or 3 years), and Tyler Yaw (1 or 3 years).
Voting Ballots were included in the Annual Meeting package with instructions for voting and returning the ballot in
advance of the meeting. The ballots were tallied and the results announced at the Annual Meeting. Max McIntyre
(1 year only), Katie Clawson, and Tyler Yaw were the three candidates
2020 Board of Directors.
