The overall tract built -upon area percentage for the project must be maintained at 30%, per the requirements of Section .1005 of the stormwater rules. The size of the overall tract used to base the density on is 36.33 acres which encompasses The Village at Mariner's Pointe under SW8 131212 and the Cottages at Mariner's Pointe. 3. Approved plans and specifications for projects covered by this permit are incorporated by reference and are enforceable parts of the permit. 4. Projects covered by this permit will maintain a minimum 30 foot wide vegetative buffer between all impervious areas and surface waters. 5. The only runoff conveyance systems allowed will be vegetated conveyances such as swales with minimum side slopes of 3:1 (H:V) as defined in the stormwater rules and approved by the Division. II. SCHEDULE OF COMPLIANCE Swales and other vegetated conveyances shall be entirely constructed, vegetated, and operational for their permitted use prior to the construction of any built -upon surface. Page 1 of 4 State Stormwater Management Systems Permit No.SW8 021215 Mod. 2: During construction, erosion shall be kept to a minimum and any eroded areas of the swales or other vegetated conveyances will be repaired immediately. 3. The permittee shall at all times provide the operation and maintenance necessary to operate the permitted stormwater conveyance and control measures at optimum efficiency to include: a. Inspections b. Sediment removal. c. Mowing, and revegetating of the side slopes. d. Immediate repair of eroded areas. e. Maintenance of side slopes in accordance with approved plans and specifications. 4. Deed restrictions are incorporated into this permit by reference and must be recorded with the Office of the Register of Deeds prior to the sale of any lot. Recorded deed restrictions must include, as a minimum, the following statements related to stormwater management: a. The following covenants are intended to ensure ongoing compliance with State Stormwater Management Permit Number SW8 021215, as issued by the Division Energy, Mineral and Land Resources under NCAC 2H.1000. b. The State of North Carolina is made a beneficiary of these covenants to the extent necessary to maintain compliance with the Stormwater Management Permit. c. These covenants are to run with the land and be binding on all persons and parties claiming under them. d. The covenants pertaining to stormwater may not be altered or rescinded without the express written consent of the State of North Carolina. e. Alteration of the drainage as shown on the approved plans may not take place without the concurrence of the Division. f. The maximum built -upon area per lot is 2,645 square feet. This allotted amount includes any built -upon area constructed within the lot property boundaries, and that portion of the right-of-way between the front lot line and the edge of the pavement. Built upon area includes, but is not limited to, structures, asphalt, concrete, gravel, brick, stone, slate, and coquina, but does not include raised, open wood decking, or the water surface of swimming pools. g. Filling in or piping of any vegetative conveyances (ditches, swales, etc.) associated with the development except for average driveway crossings, is strictly prohibited by any persons. 5. The permittee shall submit a copy of the recorded deed restrictions within 30 days of the date of recording. 6. The permittee shall submit all information requested by the Director or his representative within the time frame specified in the written information request. 7. No piping shall be allowed except that minimum amount necessary to direct runoff beneath an impervious surface such as a road and that minimum amount needed under driveways to provide access to lots. 8. Unless specified elsewhere, permanent seeding requirements for the swales must follow the guidelines established in the North Carolina Erosion and Sediment Control Planning and Design Manual. Page 2 of 4 State Stormwater Management Systems Permit No.SW8 021215 Mod. 9, The permittee shall review all lot plans for compliance with the terms and conditions of this permit, and the recorded declaration of restrictive covenants. The plans reviewed must include all proposed built -upon area (BUA), existing and proposed conveyances, and grading. No approvals shall be granted for any new construction, or modification or addition to any lot if such construction shall cause the lot to be in violation of the terms and conditions of this permit. 10. The permittee is responsible for the routine monitoring of the project to verify that the built -upon area does not exceed the maximum allowed amount under this permit. The permittee shall notify any lot owners that are found to be in noncompliance with the terms and conditions of this permit and/or with the stormwater provisions of the recorded declaration of covenants and restrictions in writing. The permittee shall require remediation from the lot owner within a reasonable time frame, and shall follow-up with the lot owner to assure that the noncompliance has been properly abated. 11. Within 30 days of constructing the project's infrastructure, roads and stormwater control measures, the permittee shall provide written certification to the Division that the project's stormwater control measures and impervious surfaces have been constructed in accordance with the approved plans and specifications. Any deviation from the approved plans or specifications must be noted on the Certification. 12. The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made. 13. The permittee shall submit to the Director and shall have received approval for revised plans, specifications, and calculations prior to construction, for any modification to the approved plans, including, but not limited to, those listed below: a. Any revision to any of the items shown on the approved plans, including the stormwater management system, design concept, built -upon area, grading, details, etc. b. Redesign or addition to the approved amount of built -upon area, and/or increases or decreases to the maximum assigned BUA per lot. c. Further subdivision, acquisition, or selling of the project area. d. Filling in, piping, altering, rerouting, relocating, resizing or regrading any vegetative conveyance shown on the approved plan. 14. The Director may determine that other revisions to the project should require a modification to the permit. 15. All stormwater conveyances must be located in a public right-of-way, dedicated common area, or drainage easement. The final plats for the project must be recorded showing all such rights -of -way, common areas and easements in accordance with the approved plans. III. GENERAL CONDITIONS The permit issued shall continue in force and effect until revoked or terminated. Page 3 of 4 State Stormwater Management Systems Permit No.SW8 021215 Mod. 2: Any individual or entity found to be in noncompliance with the terms and conditions of a stormwater management permit or the requirements of the stormwater rules is subject to enforcement procedures in accordance with North Carolina General Statute 143 Article 21. 3. The permit may be modified, revoked and reissued or terminated for cause. The filing of a request for a permit modification, revocation and reissuance, or termination does not stay any permit condition. 4. The issuance of this permit does not prohibit the Director from reopening and modifying the permit, revoking and reissuing the permit, or terminating the permit as allowed by the laws, rules, and regulations contained in Title 15A of the North Carolina Administrative Code, Subchapter 2H.1000, and North Carolina General Statute 143-215.1 et. al. 5. This permit is not transferable to any person or entity except after notice to and approval by the Director. The permittee shall submit a completed and signed Name/Ownership Change Form, accompanied by the supporting documentation as listed on the form, to the Division of Energy, Mineral and Land Resources at least 60 days prior to any one or more of the following events: a. An ownership change including the sale or conveyance of the project area in whole or in part, except in the case of an individual lot sale that is made subject to the recorded deed restrictions; b. The sale or conveyance of the common areas to a Homeowner's or Property Owner's Association, subject to the requirements of Session Law 2011-256; c. Bankruptcy; d. Foreclosure, subject to the requirements of Session Law 2013-121; e. Dissolution of the partnership or corporate entity, subject to NCGS 57D-2- 01(e) and NCGS 57D-6-07; f. A name change of the current permittee; g. A name change of the project; h. A mailing address change of the permittee; 6. The permittee is responsible for compliance with all permit conditions until such time as the Director approves a request to transfer the permit. 7. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances which may be imposed by other government agencies (local, state and federal) which have jurisdiction. 8. The 10.23 acre project area associated with The Cottages at Mariner's Pointe is too small to stand alone for density, while the Village at Mariners' Pointe is under the maximum allowed limit. The BUA assigned to the 10.23 acre Cottages is dependent on the Village at Mariners Pointe individual project area remaining at its currently permitted density level. There will be no opportunity for the Village at Mariners Pointe to add BUA without causing the entire Village at Mariners Pointe project and The Cottages at Mariner's Pointe to become a high density project. Skvarla, III, Secretary Subject: Request for State Stormwater Management Permit Application Carter Chappell Lots at The Village at Mariners Pointe Stormwater Project No. SW8 not assigned Brunswick County Dear Mr. Chappell: On April 23, 2012, the Wilmington Regional Office received notification that you received a letter from Landon Weaver of Bill Clark Homes, LLC, requesting that Carter Chappell, LLC (Chappell) take over the stormwater permit for The Village at Mariners Pointe, formerly Sweetbay Village, SW8 021215. We understand that you have not responded to their transfer request. The Division would like to offer the following information for your reconsideration of this permit transfer. In April 2006, as part of the sale of 92 lots to Bill Clark Homes of Wilmington, LLC (BCH), Mr. Fred Hathaway transferred stormwater permit SWS 021215, for a 136 lot subdivision known as Sweetbay Village, to Bill Clark Homes of Wilmington, LLC. Bill Clark Homes subsequently modified the permit to account for the addition of a connector road between their adjoining development, Mariners Pointe Subdivision (permit #SW8 941206) and eliminated 3 of the lots in the newly connected subdivisions. On November 12, 2008, Mr. Fred Hathaway and Sweetbay Village, LLC, assigned its developer's rights for Sweetbay Village to Mr. Carter Chappell, Carter Chappell, LLC, (Chappell) along with the remaining 44 lots in Sweetbay Village, now referred to as the Village at Mariners Pointe. By assigning the developer rights to Mr. Chappell, Mr. Hathaway has placed BCH in a precarious and difficult situation. The problem for BCH lies in the fact that the 44 lots owned by Mr. Chappell are currently subject to the requirements of Stormwater Permit Number SW8 021215, which is owned by BCH. As part of the compliance with that permit, the Division expects BCH to ensure that Mr. Chappell is developing those 44 lots in accordance with the permit, i.e., the lots are made subject to the deed restrictions and comply with the BUA limits of the permit. Please note that BCH is obligated by this permit to disapprove any lot plans Chappell proposes that do not comply with the permit limits, and to notify Chappell of any permit compliance issues. Again, BCH does not own the 44 Chappell lots, but BCH holds the stormwater permit that governs their development. Chappell owns those 44 lots, but does not hold a stormwater permit to develop them. Unless Chappell chooses to obtain their own permit for the 44 lots they currently own in the Village at Mariners Pointe, Chappell must abide by the requirements of the existing SW8 021215 stormwater permit owned by BCH. Failure of Chappell to abide by the SW8 021215 permit is grounds for enforcement action. The Division is a third party beneficiary of the covenants and restrictions and per Section 02H.1003 (h)(4), any person or entity who fails to comply with the permit or with the stormwater rules is subject to enforcement procedures set forth in NCGS 143, Article 21. Accept the permit transfer from BCH for permit SW8 021215; Request that a separate permit be written for the 44 lots owned / developed by Carter Chappell, LLC. If this option is chosen the project area and BUA assigned to the 44 lots will be the same as is currently provided for in the SW8 021215 permit. Chappell would not be allowed to recalculate the maximum BUA per lot based on their individual project area. However, this new permit will make Chappell responsible only for the streets (as holder of the developer's rights) and the 44 lots that they own. The SW8 021215 permit will be modified to make BCH only responsible for compliance on the lots they developed and own until all permits can be transferred to the HOA. 3.. Do not accept the permit transfer. The 44 Chappell lots are already subject to the requirements of SW8 021215 as managed by BCH, and you are obligated to follow and comply with those permit requirements. Upon meeting the requirements of Session Law 2011-256 (an Act to transfer a compliant stormwater permit from the declarant to the owners association), the permit can then be transferred to the HOA. If there are two permits for the site, they can both be transferred once they meet the Session Law, and then consolidated into one permit during the transfer or at a later date by the HOA. If you have chosen option 2 above please submit a Stormwater Permit Application Package for. the 44 lots Chappell is developing, including 2 sets of plans (or recorded plats), road and Swale construction details, a completed SWU-101 application form, a completed low density supplement form, a $505.00 fee, and supporting documentation, to this Office no later than December 14, 2013. The initial transfer of 62 lots of the 136 original lots from Sweet Bay Village LLC, (Hathaway) to BCH happened in 2006. The modified permit reduced the number of lots to 133. Subsequent property transfers of 25 more lots occurred to BCH leaving only 46 of the 133 permitted lots for Hathaway in Sweetbay Village. The last transfer happened in 2007. In 2008,Sweet Bay Village, LLC, i.e., Fred Hathaway, assigned it's declarant's rights for the remaining 46 lots, to Carter Chappell, LLC. Our position is that since Hathaway transferred his permit which covered all 133 lots to BCH, instead of modifying it, Chappell cannot develop those lots because they do not hold a permit for those lots. I think it may be best to let Chappell know of our position and require Chappell to apply for a new permit instead of taking over the BCH permit. We should modify the BCH permit to apply only to the 87 lots that BCH actually obtained from Hathaway, and then each permittee can deal with the HOA to take over their permits. In this case because the subdivision was not made subject to Chapter 47F (the Planned Community Act) David could not accept the transfer request because the form had not been signed by Mr. Chappell. You are going to have to appeal to his sense of right and wrong and make your case to him that he should be the permittee of record. The file also contained various documents indicating that Bill Clark Homes was aware that the permit would be transferred. In retrospect, it would have been better if you had convinced Mr. Hathaway to sign the modification. Then, if. you needed to reconfigure the lots or reallocate the BUA on the lots you purchased, as the co -declarant, you could have applied for your own permit. I sympathize with your situation.
