The following comments address the information requested: 1. We have verified the ownership of the property that is identified in the permit application for each of the lots 1 through 14, as well as the adjacent properties. This information has been added to Sheet C2 of the design plans. Ucq-+,� 2. We have included lot 5 on the deed restrictions and protective covenants. We have also included lot 5 in the Stormwater Project Boundary, and are requesting this existing BUA be exempt from stormwater controls. The tax records for this lot were previously provided as documentation. The tax card shows the building was built in 1986, with building dimensions drawn as 102' x 60' plus 50' x 60'. According to our client the additional impervious areas were constructed at the same time, to serve the building. 3. Pond 2 orifice has been revised to a 1 %2" orifice to utilize readily available pipe size. The calculations for all ponds have been revised to show the drawdown utilizing actual inside diameter. A table showing the values used for these calculations has been added to the calculation package. We have verified that the drawdown time is between the required 2 to 5 days for all ponds. 4. We have placed a note stating "All roof drains are to be directed to stormwater collection system" on Sheet C2. 5. The plans have been revised to show the existing impervious area (BUA) in DA 4. The applications and deed restrictions have also been revised to reflect this modification. The drainage area to Pond 2 incorrectly stated an area designated as `common asphalt', at this time it is only considered common area, and there is no existing BUA in this area. The existing BUA on lot 4 has been revised. A preliminary review of that information has determined that the application is not complete. The following information is needed to continue the stormwater review: Please verify the ownership of the property that is identified in this permit application for each of lots numbered 1 through 14 and the adjacent properties. The stormwater permit issued on April 10, 2003 and associated plans identified one small existing building with paving on each of lots numbered 5 and 6 only. [re: East Coast erosion control plan , sheet 1, ECEC project no. 0518]. The plans submitted with this application for modification, that were received by this office on August 31, 2006, reflect built -upon areas for buildings and paving for lots numbered 4 and 8 [in addition to the BUA on lots 5 and 6]; and these built -upon areas have not been permitted on lots 4 and 8. Please verify ownership for all lots on this property and adjacent. This property appears to be common plan development, which require stormwater controls for the entire area. Please be advised that only clearing, grading, and stormwater controls were permitted with the April 10, 2003 stormwater permit. The permittee must submit a modification and receive approval prior to the construction of any built -upon surfaces, regardless of ownership or the amount of land disturbance. Please be advised that prior to any development and at least 30 days prior to the sale of any part of this project, the permittee must notify DWQ and provide the legal entity name, contact name, mailing address and telephone number of the party that will purchase the site, and the permittee must initiate the transfer of this permit, or part thereof, to the purchasers -Te B e i 1 �CD�.O�J routs k 2. Include project area and built upon for lot 5 on the deed restrictions and protective covenants. Although the built upon area was initiated in 1986, the project area and BUA must still be included in the stormwater permit. If you are claiming exemption for stormwater controls for areas developed prior to 1988 as stated on drawing C2 and project description, then provide documentation reflecting development prior to 1988. All areas developed since 1988 require stormwater controls and inclusion in the pond sizing calculations. Verify orifice sizing for pond numbers 2 and 4. Use true inside diameter of pipe for sizing calculations and readily available pipe sizes. For example, pipe is not readily available in 1-3/4 inch diameter as specified for pond 2. Pipe is sold in 1 '/ inch or 2-inch diameter increments. Pond 4 using true inside diameter of 1.476 inch results in draw down time of 4 days. Consider using 2 inch nominal, with an ID of 1.913 inch, will achieve a lower drawn down time. Recalculate and submit revised plans and calculations. 4. Locate roof drains such that the runoff is directed to the pond. The proposed development on the site is thirteen (13) lots to be used for industrial purposes, with Lot #5 grandfathered as the building and parking area were constructed in 1986. Construction is scheduled to begin as soon as all permits and approvals are obtained. STORMWATER MEASURES The stormwater runoff from the site is estimated using the rational method. The stormwater will be directed to yard and drop inlets through grading of the area as well as swales. The stormwater will then be directed to four (4) separate stormwater ponds. EROSION CONTROL MEASURES The attached plans give the requirements for erosion control measures. Silt fence will be located along all existing ditches/swales already on site. The silt fence will be installed prior to any land disturbing activity. There will a total of three (3) Temporary Construction Entrances. The grading contractor and the developer will provide the maintenance for the erosion control measures. Each sediment storage device must be inspected after each storm event. Maintenance and/or clean out is necessary anytime the device is at 50% capacity. 3. Any and all existing ditches on this project site are assumed to be left undisturbed by the proposed development unless otherwise noted. The removal of vegetation within any existing ditch or channel is prohibited unless the ditch or channel is to be regarded with side slopes of 2 horizontal to 1 vertical or less steep. Bank slopes may be mowed, but stripping of vegetation is considered new earth work and is subject to the same erosion control requirements as new ditches. 4. The developer is responsible for obtaining any and all permits and approvals necessary for the development of this project prior to the commencement of this land disturbing activity. This could include agencies such as the Division of Water Quality's stormwater regulations, their enforcement requirements within Section 401 of the Clean Water Act, the U.S. Army Corps of Engineers' jurisdiction of Section 404 of the Clean Water Act, the Division of Coastal Management's CAMA requirements, the Division of Solid Waste Management's landfill regulations, the Environmental Protection Agency and/or The U.S. Army Corps of Engineers jurisdiction of the Clean Water Act, local County or Municipalities' ordinances, or others that may be required. This approval cannot supersede any other permit or approval; however, in the case of a Cease and Desist Order from the Corps of Engineers, that Order would only apply to wetland areas. All highland would still have to be in compliance with the N.C. Sedimentation Pollution Control Act. 5. If any area on site falls within the jurisdiction of Section 401 or 404 of the Clean Water Act, the developer is responsible for compliance with the requirements of the Division of Water Quality, the Corps of Engineers and the Environmental Protection Agency (EPA) respectively. Any erosion control measures that fall within jurisdictional wetland areas must be approved by the aforementioned agencies prior to installation. The Land Quality Section must be notified of a relocation of the measures in question to the transition point between the wetlands and the uplands to assure that the migration of sediment will not occur. If that relocation presents a problem or contradicts any requirements of either DWQ, the Corps, or the EPA, it is the responsibility of the developer to inform the Land Quality Section regional office so that an AUG 3 1 2006 Letter of Approval with Modifications and Performance Reservations E. Any borrow material brought onto this site must be from a legally operated mine or other approved source. A single use borrow site or an area to waste material is only permissible if it is operated under the total control of the Financially Responsible person or firm who is developing this site and has been separately permitted and incorporated as part of this plan meeting all the requirements of NC General Statue 74-49(7)f. 7. This permit allows for a land disturbance, as called for on the application plan, not to exceed 13 acres. Exceeding that acreage will be a violation of this permit and would require a revised plan and additional application fee. Any addition in impervious surface, over that already noted on the approved plan, would also require a revised plan to verify the appropriateness of the erosion control measures and stormwater retention measures. 8. The construction detail for the proposed silt fence requires reinforcing wire and posts a maximum of 8.0 feet apart. Omission of the reinforcing wire is a construction change that necessitates more posts for support, i.e., the spacing distance needs to be reduced to no greater than 6 feet apart. 9. Because the stormwater retention ponds are shown on the plan as the primary sedimentation and erosion control devices on this project, it is necessary that the ponds and their collection systems be installed before any other grading takes place on site. If that proves to be impractical, a revised plan must be submitted and approved that addresses erosion and sediment control needs during the interim period until the ponds are fully functioning. 10. A graveled construction entrance must be located at each point of access and egress available to construction vehicles during the grading and construction phases of this project. Access and egress from the project site at a point without a graveled entrance will be considered a violation of this approval. Routine maintenance of the entrances is critical. 11. The North Carolina Sedimentation Pollution Control Act mandates a shortened time frame in which to re-establish vegetative groundcover. Slopes (including cuts, fills, and ditch banks) left exposed will, within 21 calendar days after completion of any phase of grading, be planted or otherwise provided with groundcover sufficient to permanently restrain erosion. 12. If the spoil from the proposed ponds cannot be used to balance the cut and fill, a revised plan to include stockpile areas (with a design detail and temporary erosion control ) must be submitted to this office for review. North Carolina. The proposed development on the site is twelve (12) lots to be used for industrial purposes. Construction is scheduled to begin as soon as all permits and approvals are obtained. STO"IWATER MEASURES The stormwater runoff from the site is estimated using the�onal�hod. The stormwater Will be directed to yard and drop inlets through grading of the area as \Vell-as swales. The stormwater will then be directed to three (3) separate stormwater ponds. EROSION CONTROL MEASURES The attached plans give the requirements for erosion control measures. Silt fence will be located alone all <existim, ditches/swales)already on site. The silt fence will be installed prior to any land disturbing activItV. The grading contractor and the developer will provide the maintenance for the erosion control measures. CONSTRUCTION SEQUENCE The Contractor will install the silt fence.
