Dear Mr. Dale:
The Wilmington Regional Office received a complete Stormwater Management Permit
Application for the clearing and grading of the project, North Brunswick Industrial Park, on
February 12, 2003. Staff review of the plans and specifications has determined that the clearing
and grading of the project, as proposed, will comply with the Stormwater Regulations set forth in
Title 15A NCAC 2H .1006. We are forwarding Permit No. SW8 021101, dated April 10, 2003,
for the clearing and grading only of the subject project.
This permit shall be effective from the date of issuance until rescinded and shall be subject to the
conditions and limitations as specified therein.
If any parts, requirements, or limitations contained in this permit are unacceptable, you have the
right to request an adjudicatory hearing upon written request within thirty (30) days following
receipt of this permit. This request must be in the form of a written petition, conforming to
Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative
Hearings, P.O. Drawer 27447, Raleigh, NC 27611-7447. Unless such demands are made this
permit shall be final and binding.

In accordance with the provisions of Article 21 of Chapter 143, General Statutes of North
Carolina as amended, and other applicable Laws, Rules and Regulations

clearing and grading of the subject site in compliance with the provisions of 15A NCAC 2H
A 000 (hereafter referred to as the "stormwater rules") and the approved stormwater management
plans and specifications, and other supporting data as attached and on file with and approved by
the Division of Water Quality and considered a part of this permit.
The Permit shall be effective from the date of issuance until rescinded and shall be subject to the
following specific conditions and limitations:
I. DESIGN STANDARDS
I Only clearing and grading activities are permitted. The permittee must submit a
modification and receive approval prior to the construction of any built -upon surfaces.
2. The clearing and grading activity approved for this site is subject to the Sedimentation
Erosion Control (SEC) requirements of North Carolina, therefore, a stormwater
management permit is required for any future development on any part of the project area
covered by the SEC -Plan, regardless of ownership or the amount. of land disturbance.
3. Approved plans and specifications for projects covered by this permit are incorporated by
reference and are enforceable parts of the permit.
4. No new stormwater piping shall be allowed except that minimum amount necessary to
direct runoff beneath an impervious surface such as a road, that minimum amount needed
under driveways to provide access to lots, and that amount currently shown as existing on
the approved plans.
The only runoff conveyance systems allowed will be vegetated conveyances such as
swales with minimum side slopes of 3:1 (H:V) as defined in the stormwater rules and
approved by the Division.
II. SCHEDULE OF COMPLIANCE
The permittee shall at all times provide adequate erosion control measures in
conformance with the approved Sedimentation and Erosion Control Plan.

2. The permittee shall submit all information requested by the Director or his representative
within the time frame specified in the written information request.
3. The permittee shall submit to the Director and shall have received approval for revised
plans, specifications, and calculations prior to construction, for any modification to the
approved plans, including, but not limited to, those listed below:
a. Any revision to the approved plans, regardless of size.
b. Project name change.
C. Transfer of ownership.
d. Redesign of, addition to or deletion of the approved amount of built -upon area,
regardless of size.
C. Subdivision of the project area.
f. Alteration of the proposed drainage.
4. The Director may determine that other revisions to the project should require a
modification to the permit.
5. The Director may notify the permittee when the permitted site does not meet one or more
of the minimum requirements of the permit. Within the time frame specified in the notice,
the permittee shall submit a written time schedule to the Director for modifying the site to
meet minimum requirements. The permittee shall provide copies of revised plans and
certification in writing to the Director that the changes have been made.
6. Any ponds built or expanded on this project after land disturbance has begun, that might
be used as a stormwater. treatment device later on, must be constructed with a forebay and
a' 10' wide 6:1 sloped vegetated shelf, per the requirements of the stormwater rules.
7. _ The site may not be subdivided or developed with impervious surfaces until a
modification to this permit is submitted and approved.
S. Prior to any development and at least 30 days prior to the sale of this project, the
permittee must notify DWQ and provide the company, contact name, mailing address and
telephone number of the party that will purchase the site, and initiate the transfer of this
permit to the purchaser.
III. GENERAL, CONDITIONS
1. Failure to abide by the conditions and limitations contained in this permit may subject the
Permittee to an enforcement action by the Division of Water Quality, in accordance with
North Carolina General Statutes 143-215.6A to 143-215.6C.
2. The permit issued shall continue in force and effect until revoked or terminated.
3. The permit maybe modified, revoked and reissued or terminated for cause. The filing of
a request for a permit modification, revocation and reissuance, or termination does not
stay any permit condition.
4. The issuance of this permit does not prohibit the Director from reopening and modifying
the permit, revoking and reissuing the permit, or terminating the permit as allowed by the
laws, rules, and regulations contained in Title 15A of the North Carolina Administrative
Code, Subchapter 2H.1000; and North Carolina General Statute 143-215.1 et. al.

The permit is not transferable except after notice to and approval by the Director. The
Director may require modification or revocation and reissuance of the permit to change
the name and incorporate other requirements as may be necessary. A formal permit
transfer request must be submitted to the Division of Water Quality accompanied by
documentation from both parties involved, and other supporting materials as may be
appropriate. The approval of this request will be considered on its merits, and may or
may not be approved. The permittee is responsible for maintaining compliance with the
permit conditions until such time as the Director approves the transfer.
6. The issuance of this permit does not preclude the Permittee from complying with any and
all statutes, rules, regulations, or ordinances which may be imposed by other government
agencies (local, state and federal) which have jurisdiction.
The permittee grants permission to DENR Staff to enter the property for the purpose of
inspecting the project.
8. The permittee shall notify the Division of any name, ownership or mailing address
changes within 30 days.

On November 1, 2002, the Wilmington Regional Office received a copy of a Notice of
Receipt of Erosion & Sedimentation Control Plan for North Brunswick Industrial Park. The
North Carolina Administrative Code requires any project that must receive either Sedimentation
and Erosion Control Plan approval and/or a CAMA Major permit to apply for and receive a
Stormwater Management Permit by the Division of Water Quality. Any construction on the
subject site, prior to receipt of the required permit, will constitute a violation of 15A NCAC
2H.1000 and may result in appropriate enforcement action by this Office.
Either a Stormwater Permit Application Package including 2 sets of plans, completed
application form, fee, and supporting documentation, or a written response regarding the status of
this project and the expected submittal date must be received in this Office no later than February
28, 2003. Failure to respond to this request may result in the initiation of enforcement action, and
construction may experience a subsequent delay.
The NPDES 010000 Federal Stormwater Permit that accompanies the Erosion Control
Plan approval letter must NOT be considered the Coastal Stormwater Management Permit,
which will be signed by the Water Quality Supervisor. Please reference the Project Number

In accordance with your application received November 25, 2003, we are forwarding herewith
Permit No. WQ0023321, dated December 5, 2003, to Mr. Ezra G. Dale for the construction and
operation of the subject wastewater collection system extension. This permit shall be effective from the
date of issuance until rescinded and shall be subject to the conditions and limitations as specified
therein. This cover letter shall be considered a part of this permit and is therefore incorporated therein
by reference.
Please pay particular attention to Permit Condition 3, which requires that the wastewater
collection facilities be properly operated and maintained in accordance with 15A NCAC 2H .0227 or any
individual system -wide collection system permit issued to the Permittee. Also, note Permit Conditions
12 and 13 regarding future flow allocation to the subject wastewater collection system.
By copy of this permit the Brunswick County Health Department and Brunswick County Building
Inspections Department are hereby notified that building or occupancy permits shall only be issued for
14 commercial lots as part of the North Brunswick Industrial Park Proiect until further notification is
received from this Division indicating that additional connections will be allowed
Permitting of this project does not constitute an acceptance of any part of the project that does
not meet 15A NCAC 2H .0200; the Division of Water Quality's (Division) Gravity Sewer Minimum
Design Criteria adopted February 12, 1996 as applicable; and the Division's Minimum Design Criteria
for the Fast -Track Permitting of Pump Stations and Force Mains adopted June 1, 2000 as applicable,
unless specifically mentioned herein. Division approval is based on acceptance of the certification
provided by the North Carolina -licensed Professional Engineer named in the application. It shall be the
Permittee's responsibility to ensure that the as -constructed project meets the appropriate design criteria
and rules. Failure to comply may result in penalties in accordance with North Carolina General Statute
§143-215.6A through §143-215.6C, construction of additional or replacement wastewater collection
facilities, and/or referral of the North Carolina -licensed Professional Engineer to the licensing board.

In accordance with the provisions of Article 21 of Chapter 143, General Statutes of North
Carolina as amended, and other applicable Laws, Rules, and Regulations, permission is hereby
granted to the Mr. Ezra G. Dale for the construction and operation of approximately 1,275 linear feet of
8-inch gravity sewer to serve 14 commercial lots as part of the North Brunswick Industrial Park project,
and the discharge of 2,100 gallons per day of collected domestic wastewater into the Town of Leland's
and Brunswick County's existing sewerage system, pursuant to the application received November 25,
2003 and in conformity with 15A NCAC 2H .0200; the Division's Gravity Sewer Minimum Design
Criteria adopted February 12, 1996 as applicable; the Division's Minimum Design Criteria for the Fast -
Track Permitting of Pump Stations and Force Mains adopted June 1, 2000 as applicable; and other
supporting data subsequently filed and approved by the Department of Environment and Natural
Resources and considered a part of this permit.
The sewage and wastewater collected by this system shall be treated in the Northeast
Brunswick Regional Wastewater Treatment Facility (Permit No. NC0086819) prior to being discharged
into the receiving stream.
This permit shall become voidable unless the agreement between Mr. Ezra G. Dale and the
Town of Leland and Brunswick County for the collection and final treatment of wastewater is in full force
and effect.
A stormwater management plan shall be submitted to and approved by the Wilmington Regional
Office in accordance with 15A NCAC 2H .1000. Please note that you currently only hold a Clearing
& Grading permit for land disturbing activities.
If any parts, requirements, or limitations contained in this permit are unacceptable, you have the
right to request an adjudicatory hearing upon written request within 30 days following receipt of this
permit. This request must be in the form of a written petition, conforming to Chapter 150E of North
Carolina General Statutes, and filed with the Office of Administrative Hearings, 6714 Mail Service
Center, Raleigh, NC 27699-6714. Unless such demands are made, this permit shall be final and
binding.

WASTEWATER COLLECTION SYSTEM EXTENSION PERMIT
This permit shall be effective from the date of issuance until rescinded and shall be subject to the
following specified conditions and limitations:
This permit shall become voidable unless the wastewater collection facilities are constructed in
accordance with the conditions of this permit; 15A NCAC 2H .0200; the Division of Water Quality's
(Division) Gravity Sewer Minimum Design Criteria adopted February 12, 1996 as applicable; the
Division's Minimum Design Criteria for the Fast -Track Permitting of Pump Stations and Force
Mains adopted June 1, 2000 as applicable; and other supporting materials unless specifically
mentioned herein.
2. This permit shall be effective only with respect to the nature and volume of wastes described in the
application and other supporting data.
3. The wastewater collection facilities shall be properly maintained and operated at all times. The
Permittee shall maintain compliance with an individual system -wide collection system permit for the
operation and maintenance of these facilities as required by 15A NCAC 2H .0227. If an individual
permit is not required, the following performance criteria shall be met as provided in 15A NCAC 2H
.0227:
a. The sewer system shall be effectively maintained and operated at all times to prevent
discharge to land or surface waters, and any contravention of the groundwater standards in
15A NCAC 2L .0200 or the surface water standards in 15A NCAC 213.0200.
b. A map of the sewer system shall be developed prior to January 1, 2004 and shall be actively
maintained.
C. An operation and maintenance plan shall be developed and implemented.
d. Pump stations that are not connected to a telemetry system shall be inspected every day (i.e.
365 days per year). Pump stations that are connected to a telemetry system shall be
inspected at least once per week.
e. High -priority sewer lines shall be inspected at least once per every six-month period of time.
f. A general observation of the entire sewer system shall be conducted at least once per year.
g. Inspection and maintenance records shall be maintained for,a period of at least three years.
h. Overflows and bypasses shall be reported to the appropriate Division regional office in
accordance with 15A NCAC 2B .0506(a), and public notice shall be provided as required by
North Carolina General Statute §143-215.1C.
4. This permit shall not be transferable. In the event there is a desire for the wastewater collection
facilities to change ownership, or there is a name change of the Permittee, a formal permit request
shall be submitted to the Division accompanied by documentation from the parties involved, and
other supporting materials as may be appropriate. The approval of this request shall be
considered on its merits and may or may not be approved.
Construction of the gravity sewers, pump stations, and force mains shall be scheduled so as not to
interrupt service by the existing utilities nor result in an overflow or bypass discharge of wastewater
to the surface waters of the State.
6. Upon completion of construction and prior to operation of these permitted facilities, a certification, a
copy of the construction record drawings, as well as supporting design calculations for any pump
stations permitted as part of this project shall be received from a North Carolina -licensed
Professional Engineer certifying that the facilities have been installed in accordance with this
permit; 15A NCAC 2H .0200; the Division's Gravity Sewer Design Criteria adopted February 12,
1996 as applicable; the Division's Minimum Design Criteria for the Fast -Track Permitting of Pump
Station and Force Main adopted June 1, 2000 as applicable; and other supporting materials. If this
project is to be completed in phases and partially certified, you shall retain the responsibility to
track further construction approved under the same permit, and shall provide a final certificate of
completion once the entire project has been completed. A copy of the construction record
drawings, indicating the facilities constructed in the phase being certified, shall be submitted with
each partial certification. Mail the Engineer's Certification, one copy of the "Construction Record
Drawings," and one copy of the supporting design calculations to the Non -Discharge Permitting
Unit, 1617 Mail Service Center, Raleigh, NC 27699-1617.
7. A copy of the construction record drawings shall be maintained on file by the Permittee for the life
of the wastewater collection facilities.
8. Failure to abide by the conditions and limitations contained in this permit; 15A NCAC 2H .0200; the
Division's Gravity Sewer Design Criteria adopted February 12, 1996 as applicable; the Division's
Minimum Design Criteria for the Fast -Track Permitting of Pump Station and Force Mains adopted
June 1, 2000 as applicable; and other supporting materials may subject the Permittee to an
enforcement action by the Division, in accordance with North Carolina General Statutes §143-
215.6A through §143-215.6C.
In the event that the wastewater collection facilities fail to perform satisfactorily, including the
creation of nuisance conditions, the Permittee shall take immediate corrective action, including
those as may be required by this Division, such as the construction of additional or replacement
facilities.
10. The issuance of this permit shall not exempt the Permittee from complying with any and all
statutes, rules, regulations, or ordinances that may be imposed by other government agencies
(local, state and federal) which have jurisdiction, including but not limited to applicable river buffer
rules in 15A NCAC 2B .0200, erosion and sedimentation control requirements in 15A NCAC Ch. 4
and under the Division's General Permit NCG010000, and any requirements pertaining to wetlands
under 15A NCAC 28 .0200 and 15A NCAC 2H .0500.
11. Noncompliance Notification:
The Permittee shall report by telephone to the Wilmington Regional Office, telephone number
(910) 395-3900, as soon as possible, but in no case more than 24 hours or on the next working
day, following the occurrence or first knowledge of the occurrence of either of the following:
Any process unit failure, due to known or unknown reasons, that renders the facility incapable
of adequate wastewater transport, such as mechanical or electrical failures of pumps, line
blockage or breakage, etc.; or
b. Any failure of a pumping station or sewer line resulting in a by-pass directly to receiving waters
without treatment of all or any portion of the influent to such station or facility.
Persons reporting such occurrences by telephone shall also file a written report in letter form within
five days following first knowledge of the occurrence. This report must outline the actions taken or
proposed to be taken to ensure that the problem does not recur.
12. No flow in excess of the quantity permitted herein, 2,100 GPD, shall be made tributary to the
subject sewer system until an application for permit modification for an increase in flow has been
submitted to and approved by the Division of Environmental Management.
13. If, at any time, the additional wastewater flow volume made tributary to this sewer extension is
believed to exceed the value permitted herein, a modification shall be requested for this permit
from the Division of Water Quality to properly allocate the subject wastewater flow.

The Permittee is responsible for tracking all partial certifications up until a final certification is received. Any
wastewater flow made tributary to the wastewater collection system extension prior to completion of this
Engineer's Certification shall be considered a violation of the permit and shall subject the Permittee to appropriate
enforcement actions.

NOTICE OF RECEIPT OF EROSION & SEDIMENTATION CONTROL PLA

This office has received a soil erosion and sedimentation control plan for the project listed below which was
submitted as required by the North Carolina Sedimentation Pollution Control Act (NCGS 113A-57(4)).
Please be advised that this Act requires that all persons disturbing an area of one or more acres of land must
obtain approval of a soil erosion control plan prior to the commencement of said land disturbing activity (NCGS 113A-
54(d)(4)). The act further states that this plan must be filed a minimum of 30 days prior to the activity and the
approving authority must approve or disapprove the submitted plan within 30 days of receipt. Failure of the approving
authority to approve or disapprove the submitted plan within the 30 day period will be deemed approval of the plan.
Commencement or continuation of a land -disturbing activity under the jurisdiction of this Act prior to the approval of
an erosion and sediment control plan is a violation of the Act.
A copy of any erosion and sediment control plan which could involve the utilization of ditches for the purpose
of dewatering or lowering the water table is forwarded by this office to the Division of Water Quality (DWQ). It is
suggested that you contact the Division of Water Quality at (910) 395-3900 if the ditches shown on your plan will
lower the water table.
The approval of an erosion and sediment control plan is conditioned on the applicant's compliance with Federal
and State water quality laws, regulations and rules.
