Guidelines for Access: The staff of the Regional Office is dedicated to making public records in our
custody readily available to the public for review and copying. We also have the responsibility to the public
to safeguard these records and to carry out our day-to-day program obligations. Please read carefully the
following before signing the form.
1. Due to the large public demand for file access, we request that you call at least a day in
advance to schedule an appointment for file review so you can be accommodated.
Appointments are scheduled between 9 00 a.m. and 3 00 p.m. Viewing time ends at 4 45
p.m. Anyone arriving without an appointment may view the files to the extent that time and
staff supervision are available.
2. You must specify files you want to review by facility name or incident number, as
appropriate. The number of files that you may review at one appointment will be limited to
five.
3.. You may make copies of a file when the copier is not in use by the staff and if time permits.
There is no charge for 25 or less copies. cost per copy after the initial 25 is 2.5 per copy.
Payment is to be made by check, money order, or cash in the administrative offices.
4. Files must be kept in the order you received them. Files may not be taken from the office.
No briefcases large totes, etc. are permitted in the file review area To remove, alter,
deface, mutilate, or destroy material in public files is a misdemeanor for which you can be
fined up to $500.00.
5. In accordance with GS 25-3-512, a $25.00 processing fee will be charged and collected for
checks on which payment has been refused.
6. The customer must present a photo ID, sign -in, and receive a visitor sticker prior to
reviewing files.

The Wilmington Regional Office received a response to the Notice of Violation issued to you on July 24,
2002. This response was received on August 5, 2002. A follow-up letter was received on August 26, 2002.
This letter gives a detailed plan of action as requested and a proposed completion date of October 7, 2002.
Under most circumstances, this order of construction would not be allowed. The stormwater system must be
constructed and completely operational prior to the construction of impervious surfaces. I have visited this
site, however, and feel that due to fact that the existing dry ponds that are located adjacent to the ICW W are
temporarily collecting and holding or infiltrating the stormwater runoff from this site, the proposed method
of construction is acceptable.
Please closely monitor the erosion control devices on site and repair any problems immediately. If at anytime
stormwater runoff from this site begins to discharge into the ICW W, you must contact this office immediately.
Once this project is complete, the engineer's certification must be submitted to this office as required by your
Stormwater Permit. If the proposed plan of action cannot be met or if the completion date cannot be met,
please notify this office in writing.

Dear Mr. Shiver,
As I discussed by phone with Noelle Lutheran of your office on July 29, 2002 the
construction of the stormwater management system for the referenced project is
scheduled to begin August 9, 2002. The system has not yet been installed due to the
necessary sequence of construction events (i.e. pouring building foundation). The
stormwater tanks should be delivered and set following the completion to the building
foundation. Also, at this time, there is no electrical service provided to the proposed
building to operate the stormwater pumps. It is anticipated that the electrical service will
be installed in the next two weeks and at that time the tanks should be installed. As soon
as these two items are complete the pumps and piping installation will follow.

Carteret County
On July 16, 2002, Wilmington Regional Office personnel performed a Compliance
Inspection of the project known as Fisheries Research Lab and Shop Building Replacement, located
at 3134 Arendell Street in Carteret County, North Carolina. The inspection was performed to
determine the status of compliance with Stormwater Permit Number S W 8 011020, issued to you on
March 6, 2002.
The project has been found in violation of Stormwater Permit Number SW8 011020, issued
pursuant to the requirements of 15A NCAC 211.1000. The violations -found are:
Section Il, Part I - The stormwater management system shall be constructed in it's
entirely, vegetated and operational for its intended use prior to the consn-uciion of
any built -upon sin face.
The building is under construction, and the foundation is in, but construction
of the stormwater treatment system has not began.
To correct these violations you must :
Provide a written "Plan of Action" which outlines the actions you will take to correct
the violation(s) and a time frame for completion of those actions, on orbefore August
24, 2002.
Completely construct the stormwater management system prior to constructing
anymore impervious surfaces.

Failure to provide the "Plan of Action" by August 24, 2002, or to correct the violations by
the date designated in the "Plan of Action", are considered violations of 15A NCAC 2H.1000, and
may result in the initiation of enforcement action which may include recommendations for the
assessment of civil and criminal penalties, pursuant to NCGS 143-215.6A.
By copy of this letter to the Carteret County Building Inspector, this Office is
requesting that the Building Inspector consider withholding building permits and Certificates
of Occupancy for this project until this matter is satisfactorily resolved.
