Dear Mr. McFadden:
A Division of Energy, Mineral, and Land Resources file review has determined that
Stormwater Permit SW7111109 for a stormwater treatment system consisting of a wet
detention pond serve Pet Smart located at 2210 S. Croatan Hwy., Nags Head, NC
expires on December 7, 2021. This is a reminder that permit renewal applications are
due 180 days prior to expiration. We do not have a record of receiving a renewal
application.
Please submit a completed permit renewal application along with a $505.00 fee for
permit renewal. Permit application forms for renewal can be found on our website at:
https://deq.nc.gov/about/divisions/energy-mineral-and-land-
resources/stormwater/stormwater-program/post-construction-2. North Carolina General
Statutes and the Coastal Stormwater rules require that this property be covered under a
stormwater permit.

At the request of Rebkee Partners Satterfield, LLC, the purpose of this correspondence is to
confirm and/or otherwise acknowledge to the North Carolina Department of Environment and
Natural Resources (NCDENR) that:
The Town of Nags Head is the current owner of property that immediately abuts a
portion the above referenced "Petsmart" development project. The Town owned site
(ref. DB 0917, PG 0811; PIN 989317017832; Dare County Registry) is located west /
northwest of the "Petsmart" site on S. Lark Avenue.
2. This Town owned property features a portion of an existing stormwater management
pond. The remaining portion of the pond contiguously extends into and exists on
adjacent property owned by Rebkee Partners Satterfield, LLC. The pond serves as a
stormwater mitigation feature for the Town, Rebkee, and other surrounding and defined
properties. A respective pond/drainage cross easement is in place to legitimize the pond
orientation across separate properties.
The Town is fully aware of Rebkee's intention to develop a new Petsmart retail store.
Furthermore, the Town understands and acknowledges that Rebkee will need to secure
an NCDENR Division of Water Quality "High Density" Stormwater Management Permit to
accommodate the proposed development. This permit, if granted, will encompass the
aforementioned stormwater management pond.

4. Rebkee Partners Satterfield, LLC, its successors and assigns, shall be the responsible
entity for operation and maintenance of the facility as defined by the pending High
Density stormwater permit.
