PROJECT SUMMARY: The applicant proposes to construct a Petsmart commercial building, enlarge an existing stormwater system and add parking spaces within 1,200' of the fresh pond between Nags Head and Kill Devil Hills. Petsmart Nags Head Rebkee Partners Satterfield, LLC Dare County Express Permit Review Program Project setting Brian Rubino with Quible & Associates, on behalf of Rebkee Partners Satterfield, LLC, has requested the attached application be processed under the Express Permit Review Program, for the construction of a Petsmart store. The project site is located at 2210 S. Croatan Highway (US 158) in the Town of Nags Head immediately south of the town limits with Kill Devil Hills. A small portion of the project site is within the 1,200' Public Water Supply Area of Environmental Concern (AEC) as identified in North Carolina Administrative Code 15A NCAC 07H.0405(c)(1)(A). All development within this AEC is subject to authorization by the Division of Coastal Management. The 9.84 acre project site is located in a commercial business area that includes a TJ Maxx, Staples, Nags Head Bowling Alley, Whalebone Surf Shop, commercial office building, and a large paved parking lot. The site also includes a 1.64 acre stormwater pond and a large mounded septic system. The stormwater pond is entirely located within the 1,200' Public Water Supply AEC. The TJ Maxx store was previously a Food Lion grocery store and the oversize septic system serviced the large wastewater needs of this store. Currently, the TJ Max and Staples stores only have 4 bathrooms and the septic system is not being fully utilized. The site is 8 - 13' above sea level. Project description The applicant proposes to construct a ±12,757 ft2 Petsmart store and additional paved parking spaces on the location of the south half of the existing septic system. The septic system will be removed as per agreement with the County of Dare (see attached letter dated 15 November 2011). The majority of the development will occur outside the Fresh Pond AEC with the exception of a new 6,466 ft2 (0.15 acre) stormwater pond adjacent to the existing stormwater pond, land disturbance associated with the stormwater system, and 97 ft2of impervious asphalt parking. Total disturbance within the Fresh Pond AEC will be 30,398 W. The onsite stormwater retention system as proposed has been submitted to the Division of Water Quality for approval. Water will be provided by the Town of Nags Head via the Dare County Regional Public Water Supply System. Anticipated impacts The project as proposed will result in the disturbance of ±83,629 ft2 (1.92 acres) of uplands as a result of the development. CC: Brian McNeal, Rebkee Partners Express CAMA Major Project Narrative 11/22/2011 Petsmart Nags Head Rebkee Partners Satterfield, LLC Existing Conditions The subject property is 9.84 acres and is comprised of three existing parcels in the Town of Nags Head, Dare County, North Carolina. This is the existing Satterfield Landing Retail Shopping Center and currently contains retail facilities (TJ Max, Staples and a vacant building) and associated parking, stormwater management system and on -site septic treatment system. Adjacent to the north is a self storage facility and retail, to the east is US 158, to the south are offices and a bowling alley, to the west is a Town of Nags Head Maintenance Facility. Two of the three parcels (as identified on the CAMA Major Plan) are owned by Rebkee Partners Satterfield, LLC (Rebkee) and the third parcel is under contract to be purchased by Rebkee from Sobin, LLC. Included in this CAMA Major Application package is a copy of the deed for the Rebkee owned property and the purchase agreement for the Sobin Property. Closing on the Sobin parcel is scheduled for sometime in mid -December 2011. There is an existing on -site septic system for the shopping center that was permitted through Dare County Health Department and is located entirely outside of the Fresh Pond AEC. At one time Satterfield Landing was a mixed use Center and included a grocery store and restaurants that required much higher flow of wastewater than retail use. Therefore, the existing septic system is significantly oversized. There is also a stormwater management system on the property that was not previously permitted through NCDWQ (development described herein involves NCDWQ permitting) and includes the use of an existing pond and associated conveyances. Located further to the west of the property is a fresh water lake (known as Fresh Pond) that is reserved as a raw water supply source for both the Town of Nags Head and the Town Kill Devil Hills. To protect this water source, the North Carolina Coastal Resource Commission has designated Fresh Pond as a Small Surface Water Supply Watershed Area of Environmental Concern (AEC) and adopted specific detailed development standards as set out below: "To adequately protect the fresh pond, it is necessary that construction of septic tanks and other sources of pollution within the limits of the cone of depression be regulated as follows: (1) Within 500 feet, horizontal distance of the edge of the pond, no construction of sewers, septic tanks, nitrification fields or other possible sources of pollution shall be permitted. (ii) Between the distances of 500 feet and 1200 feet from the edge of the pond, construction of septic tank systems shall be limited to one single tank system serving a single family residence not to exceed four bedrooms or its equivalent volume of sewage, on a lot or tract of land not less than 40,000 square feet." The western portion of the site is within 1,200 feet of the edge of Fresh Pond but entirely outside of the 500 foot distance. As a result of proposing development within the 1,200 ft. AEC, this project must submit for and receive a CAMA Major Permit from NCDENR Division of Coastal Management. With respect to natural surface waters, the project is located approximately one mile east of the Roanoke Sound and approximately one-half mile west of the Atlantic Ocean. The site is geographically separated from the Roanoke Sound by Nags Head Woods which is a forested sand ridge with high elevations (relative to the area). Stormwater runoff draining from this area drains east to the Atlantic Ocean. There are no wetlands on the subject property lies entirely within a "X" FIRM Zone. Proposed Project The proposed project involves development of a portion of the property as a Petsmart Retail and Pet Grooming facility. The project proposes to construct a 12,757 sq.ft. detached building and parking lot addition to the existing Satterfield Landing Shopping Center. The majority of development work within the Fresh Pond AEC involves grading associated with expansion of the stormwater management system. Stormwater runoff from the proposed site improvements will be directed to an existing stormwater pond located in the western portion of the property. The existing stormwater pond is a 1.64 acre pond and manages a drainage area of approximately 9.12 acres. The existing pond is situated on the subject site parcel (after recombination) and a portion of the parcel of land owned by the Town on Nags Head. Included in this CAMA submittal is a letter from the Town of Nags Head that acknowledges the use and future use of this pond for stormwater management purposes. To accommodate runoff draining from added impervious surfaces to the existing site, improvements to the existing stormwater pond including pond expansion and outfall BMPs are proposed and will be permitted with a State Stormwater Permit (Express Submission). In order to meet the requirements of NCDENR and the Town of Nags Head, the project proposes to expand the pond size such that the additional storage capacity provides temporary storage volumes in excess of the 1.5" (NCDENR) rainfall event for the entire drainage area and will accommodate the 4.3" (Nags Head) rainfall event for all additional built upon areas. Improvements include construction of a vegetated shelf between the pond expansion area and the existing pond, and the expansion of the pond's outfall vegetated filter. A vegetated shelf is proposed to be constructed between the pond expansion area and the existing pond. The vegetated shelf will be 20' in width with 10:1 side slopes. The shelf will extend 0.5' above the normal water level at the center of the shelf. The wet pond plantings on the vegetated shelf will provide additional stormwater filtration and nutrient uptake as stormwater is progressed toward the overflow structure. In combination with the relocation of the pond's overflow structure, the pond's overflow swale/vegetated filter will be extended and widened to a typical grassed lined swale section consisting of a 5.0' bottom width with 6:1 side slopes. In addition to the stormwater improvements, there will also be some minor site grading associated with building and parking infrastructure that extends into the Fresh Pond AEC. In addition, there will be 97 sq.ft. total of impervious surface added to the Fresh Pond AEC in association with the northwest corner of the new proposed parking area. This equates to 0.07% impervious cover in the Fresh Pond AEC. Total land disturbance for the project is 83,629 sq.ft. (1.92 ac.) and the area of disturbance within the Fresh Pond AEC will be 30,398 sq.ft.(070 ac.). Upgrades to the existing on -site septic treatment system have been permitted through Dare County Health Department (see enclosed Improvement Permit dated 11/15/2011. This includes abandonment of the existing southernmost drainfield that is located in the location of the proposed Petsmart. The northernmost existing drainfield will continue be utilized for Petsmart and other retail stores in Satterfield Landing. New pump tanks and lines will be installed. There is no portion of on -site septic system improvements that lie within the AEC.
