This is a reminder that permit renewal applications are due 180 days prior to expiration. We do not have a record of receiving a renewal application. Please submit a completed permit renewal application along with a $505.00 fee for permit renewal within the required time. The BUA total for DA #5 (Wetland #2) should be listed as 105,712 s.f. in all areas. The impervious area for the skate park design came back 3,500 s.f. less than originally budgeted, and I failed to adjust the number in two locations of the submittal. Attached is the letter of the modifications. Can you correct the number on the application Part IV, Section 10, Proposed Impervious Area = 105,712 and % Impervious Area = 43.37%? The plan is listed under permit number SW7111105 issued on 11-29-11. The modification is being requested for plan due to the addition of built -upon -area (BUA) for the newly proposed skate park and the parking lot south of the proposed skate park. These areas increase the previously permitted BUA for DA #5 from 82,328 s.f. to 105,712 s.f. As the result of the increase in proposed BUA in DA #5, the design of Stormwater Wetland #2 has been modified. The design for Stormwater Wetland #1 is to remain unchanged from the approved plan. The previously constructed Wet Pond shall also remain unchanged. The runoff calculations and the conveyance design within DA #5 are also changed to reflect the change in the proposed site plan. Swales will be inspected monthly or after every runoff producing rainfall event for sediment build-up, erosion, and trash accumulation. Accumulated sediment and trash will be removed as necessary. Swales will be reseeded or sodded following sediment removal. 4. Eroded areas of the swales will be repaired and reseeded. Swales will be revegetated as needed and in a timely manner based on the monthly inspections. Side slopes must be maintained at the permitted slope. SCHEDULE OF COMPLIANCE The stormwater management system shall be constructed in its entirety, vegetated and operational for its intended use prior to the construction of any built -upon surface. 2. During construction, erosion shall be kept to a minimum and any eroded areas of the system will be repaired immediately. 3. The permittee shall at all time provide the operation and maintenance necessary to assure the permitted stormwater system functions at optimum efficiency. The approved Operation and Maintenance Plan must be followed in its entirety and maintenance must occur at the scheduled intervals including, but not limited to: a. Semiannual scheduled inspections (every 6 months). b. Sediment removal. C. Mowin.9 and re -vegetation of slopes and the vegetated filter strip. d. Immediate repair of eroded areas. e. Maintenance of all slopes in accordance with approved plans and specifications. f. Debris removal and unclogging of outlet structure, orifice device, level spreader, filter strip, catch basins and piping. 4.e Access to the outlet structure must be available at all times. 4. Records of maintenance activities must be kept for each permitted BMP. The records will indicate the date, activity, name of person performing the work and what actions were taken. Access to the stormwater facilities shall be maintained via appropriate easements at all times. Decorative spray fountains will be allowed only in the wet detention basin system, subject to the following criteria: a. The fountain must draw its water from less than 2' below the permanent pool surface. b. Separated units, where the nozzle, pump and intake are connected by tubing, may be used only if they draw water from the surface in the deepest part of the pond. c. The falling water from the fountain must be centered in the pond, away from the shoreline. d. The maximum horsepower for a fountain in this pond is 1/6 horsepower. 7. The facilities shall be constructed as shown on the approved plans. This permit shall become void unless the facilities are constructed in accordance with the conditions of this permit, the approved, plans and specifications, and other supporting data. Upon completion of construction, prior to issuance of a Certificate of Occupancy, and prior to operation of this permitted facility, a certification must be received from an appropriate designer for the system installed certifying that the permitted facility has been installed in accordance with this permit, the approved plans and specifications, and other supporting documentation. Any deviations from the approved plans and specifications must be noted on the Certification. A modification may be required for those deviations. 9. If the stormwater system was used as an Erosion Control device, it must be restored to design condition prior to operation as a stormwater treatment device, and prior to occupancy of the facility. The permittee shall submit to the Director and shall have received approval for revised plans, specifications, and calculations prior to construction, for any modification to the approved plans, including, but not limited to, those listed below: a. Any revision to any item shown on the approved plans, including the stormwater management measures, built -upon area, details, etc. b. Project name change. C. Transfer of ownership. d. Redesign or addition to the approved amount of built -upon area or to the drainage area. e. Further subdivision, acquisition, lease or sale of all or part of the project area. The project area is defined as all property owned by the permittee, for which Sedimentation and Erosion Control Plan approval or a CAMA Major permit was sought. f. Filling in, altering, or piping of any vegetative conveyance shown on the approved plan. 11. The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made. 12. The permittee shall submit final site layout and grading plans for any permitted future areas shown on the approved plans and receive approval prior to the start of construction. 13. A copy of the approved plans and specifications shall be maintained on file by the Permittee at all times. 14. This permit shall become void unless the facilities are constructed in accordance with the conditions of this permit, the approved plans and specifications, and other supporting data. 15. Prior to transfer of the permit, the stormwater facilities will be inspected by DWQ personnel. The facility must be in compliance with all permit conditions. Any items not in compliance must be repaired or replaced to design condition prior to the transfer. Records of maintenance activities performed to date will be required. 16. Prior to the subdivision and/or sale of this project, in whole or in part, the following deed restrictions must be recorded with the Office of the Register of Deeds: a. Construction of additional built -upon area in excess of this amount will require a permit modification. g. Construction of additional impervious areas such that low -density requirements are no longer met will require a permit modification prior to construction. An engineered system will be required to collect and treat the runoff from all built -upon area associated with the project, including that area permitted under the low density option. i. Filling in or piping of any vegetative conveyances (ditches, swales, etc.) associated with this development, except for average driveway crossings, is strictly prohibited by any persons. j. The built -upon areas shall be located a minimum of 50 feet landward of all perennial and intermittent surface waters. 17. A copy of the recorded deed restrictions must be submitted to the Division within 30 days of the date of recording the plat, and prior to selling lots. The recorded copy must contain all of the statements above, the signature of the Permittee, the deed book number and page, and the stamp/signature of the Register of Deeds. III. GENERAL CONDITIONS This permit is not transferable except after notice to and approval by the Director. In the event of a change of ownership, or a name change, the permittee must submit a completed Name/Ownership Change form, to the Division of Water Quality, signed by both parties, and accompanied by supporting documentation as listed on page 2 of the form. The project must be in good standing with the Division. The approval of this request will be considered on its merits and may or may not be approved. 2. The permittee is responsible for compliance with all permit conditions until such time as the Division approves the transfer request. 3. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to enforcement action by the Division of Water Quality, in accordance with North Carolina General Statute 143-215.6A to 143-215.6C. 4. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances, which may be imposed by other government agencies (local, state, and federal) having jurisdiction. 5. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Permittee shall take immediate corrective action, including those as may be required by this Division, such as the construction of additional or replacement stormwater management systems. 6. The permittee grants DENR Staff permission to enter the property during normal business hours for the purpose of inspecting all components of the permitted stormwater management facility. 7. The permit issued shall continue in force and effect until revoked or terminated. The permit may be modified, revoked and reissued or terminated for cause. The filing of a request for a permit modification, revocation and re -issuance or termination does not stay any permit condition. Approved plans and specifications for this project are incorporated by reference and are enforceable parts of the permit. 10. The issuance of this permit does not prohibit the Director from reopening and modifying the permit, revoking and reissuing the permit, or terminating the permit as allowed by the laws, rules and regulations contained in Session Law 2008- 211, Title 15A NCAC 2H.1000, and NCGS 143-215.1 et.al. 11. The Campus site is on the north side US Hwy 158 in Crawford Township in Currituck County. The Campus project consists of 83.94 acres that are part of over 600 acres of county owned property. The 600 acres is currently occupied by the airport, the Cooperative Extension Office, the YMCA community center, and Maple Commerce Park, which is currently under construction. The Park project initially contained 76.42 acres that was delineated based on the existing large drainage ditch that separates this area from the existing site for the YMCA and the Cooperative Extension Office, which is covered under an existing stormwater permit, and the area dedicated for airport expansion including setbacks. The project area was been expanded to 83.94 acres to take in the area north of the original project. On -site wetlands have been delineated and will not be impacted by construction. The tract is currently zoned HM (Heavy Manufacturing), GB (General Business), and A (Agricultural). The Campus area is mostly woods with some existing farm land. Existing wells for the municipal water system utilities are located on the airport, west of the Park. In the future, additional wells are planned along the Hwy 158 frontage of the Park. The Master Plan for the Park includes the Regional Aviation and Technology Training Center, a future Fire Station, and a variety of recreational facilities that will be constructed in phases. Please note that the area immediately behind the Training Center has been excluded from the Campus project area. This is due to the apron and taxiway connection being funded as part of the airport. Any permitting necessary will be obtained by the airport engineers, Talbert and Bright, Inc. Land disturbing activities associated with the first phase of the Park will include construction of two streets and the first site, the Regional Aviation and Technology Training Center. The extension of Maple Parkway will extend from the existing terminus at the Currituck Family YMCA, to the Training Center. Gravity sewer and waterline will be installed along Maple Parkway to provide service to the Training Center. College Way (formerly referred to as New Airport Road) will cross the end of Maple Parkway at the Training Center and will extend out to Hwy 158, Shortcut Road to the south and to the existing Maple Park parking lot to the north. A waterline will also be installed along the west side of College Way to Hwy 158 where it will connect to an existing main. The roads will be 24' wide with roadside swales for stormwater collection. Construction of the Training Center site will include two buildings; required parking, sidewalks, and utilities; and a variety of stormwater BMP's. Stormwater Management The overall Park will contain approximately 10-15% coverage at build out. There will be approximately six areas that we identify as high density pockets. Stormwater draining from the roads and other low density areas near the roads, such as recreational fields, will be collected in grass lined swales and directed to discharge points at each end of the proposed roads where the water will leave the site and drain to the North River swamp. The high density pockets will each have BMP's to provide the appropriate treatment for the runoff from those areas. For design and permitting of Phase 1 of the Campus, all areas outside the high density pocket of the Training Center are considered to be Drainage Area 1. Drainage Area 1 encompasses the majority of the Park and consists of 61.98 acres. This drainage area has been reduced from the originally permitted area as the extension of College Way has made it possible for a portion of the future softball field area to be drained toward the extended roadside swales that will now drain north in Drainage Area 3. Impervious area within this drainage area will consist of 79,811 sf of roadway and 18,926 sf of sidewalk that is currently designed. Future coverage of up to 70,000 sf is included in the permit application for the addition of paths, sidewalks, small buildings and other miscellaneous features of the recreational facility that will not constitute high density pockets. Additional high density pockets will be permitted out of this drainage area in the future. The design and permitting of additional high -density pockets will require modification of the original stormwater permit. The site for the Regional Aviation and Technology Training Center is the only high density pocket currently under design and is considered to be Drainage Area 2. This drainage area is 6.53 acres. The stormwater treatment system for this site will utilize three infiltration basins and one wet detention basin. The infiltration basins have been designed to NCDENR guidelines, but will not be permitted. They will provide pretreatment and assist with attenuation of the increase in site runoff. The design of the stormwater BMP's is based the on a soils report prepared GET Solutions, Inc., date October 21, 2011. A copy of this report is attached as part of the appendix. According to the soils report, the infiltration rates for the soils to the north and east of the proposed building range from 0.629 to 6.325 inches per hour. Seasonal High Water Table estimates range from elevation 7.25 to 9. An average of elevation 8.0 has been applied to this area and the Infiltration Basins have a bottom elevation of 10.0 to provide the required two feet of separation. Each been designed to store a minimum volume equal to 1.5" to 2" runoff from the related drainage area. All three basins are designed to be off-line and have bypass structures that allow runoff in excess of the storage volume to be routed beyond the basins. The bypasses from each basin are collected and routed to a swale that drains to the wet detention basin. The soils report indicates that the soils to the south of the proposed building are less permeable that those to the north and are not suitable for infiltration basins. The seasonal high water table in this portion of the site ranges from 7' to 8.5' with existing ground elevations ranging from 8.5' to 11.5'. The lack of permeability and the elevation of the water table make wet detention the most practical form of stormwater treatment in this area. The permanent pool elevation has been set at elevation 7.0'. The detention pond is designed for 90% TSS removal and storage of the first 1.5" of runoff. The detention pond design also meets the County's requirement limiting post development runoff to predevelopment levels during the 10yr rainfall event. This is accomplished by routing the bypass drainage from the Infiltration Basins the detention pond and controlling the release of stormwater with a multi -stepped weir structure. The detention pond will discharge into the roadside swale for New Airport Road. Drainage Area 3 contains 15.43 acres in the northern portion of the Park. This is the area that has been added since the stormwater permit for the project was issued. It has now been included in the Park project as the county decided to extend College Way to the existing Maple Park parking lot. The roadway that has been designed in this drainage area contributes 23,492 sf of impervious area. According to the master plan for the park, the only other development planned for this drainage area in the near future is a storage area for park maintenance. That site has not been designed at this time, but we have allotted 45,000 sf of future coverage within the drainage area for a total impervious area of 68,492 sf or 10.19% impervious. Future development plans will be submitted for review for compliance with the Park stormwater permit as they are developed. All of the runoff from Drainage Area 3 is routed to a large existing 6.6 acre lake that is currently receiving runoff from Maple Park. The drainage from the roadway extension is being tied into an existing swale that drains to the lake. Currituck Community Park May 29, 2012 Erosion Control This project will utilize standard erosion and sediment control measures to minimize any development impacts during construction. Standard erosion and sedimentation control measure specified include but are not limited to: Gravel construction entrance, silt fence, rock check dams, rip -rap pipe protection, inlet protection, and seeding and mulching. The wet detention basin will be used as a sediment basin during the construction process and will be restored to design conditions at the end of the construction process. The pond drawdown device will be equipped with a skimmer to provide surface drawdown until the site is fully stabilized. The total area within the limits of disturbance is calculated to be 24 acres. All proposed swales/ditches have been designed with nonerosive runoff Flow velocities during the 10yr rain event with the exception of Swale #4 which is the swale discharging into the existing lake. During the 10yr rain event, Swale #4 has an estimated discharge velocity of 4.2 fps. Decorative spray fountains will be allowed in the stormwater treatment system, subject to the following criteria: a. The fountain must draw its water from less than 2' below the permanent pool surface. b. Separated units, where the nozzle, pump and intake are connected by tubing, may be used only if they draw water from the surface in the deepest part of the pond. c. The falling water from the fountain must be centered in the pond, away from the shoreline. d. The maximum horsepower for a fountain in this pond is 1/6 horsepower. 7. The facilities shall be constructed as shown on the approved plans. This permit shall become void unless the facilities are constructed in accordance with the conditions of this permit, the approved plans and specifications, and other supporting data. Upon completion of construction, prior to issuance of a Certificate of Occupancy, and prior to operation of this permitted facility, a certification must be received from an appropriate designer for the system installed certifying that the permitted facility has been installed in accordance with this permit, the approved plans and specifications, and other supporting documentation. Any deviations from the approved plans and specifications must be noted on the Certification. A modification may be required for those deviations. 9. If the stormwater system was used as an Erosion Control device, it must be restored to design condition prior to operation as a stormwater treatment device, and prior to occupancy of the facility. 10. The permittee shall submit to the Director and shall have received approval for revised plans, specifications, and calculations prior to construction, for any modification to the approved plans, including, but not limited to, those listed below: a. Any revision to any item shown on the approved plans, including the stormwater management measures, built -upon area, details, etc. b. Project name change. C. Transfer of ownership. d. Redesign or addition to the approved amount of built-uponarea or to the drainage area. e. Further subdivision, acquisition, lease or sale of all or part of the project area. The project area is defined as all property owned by the permittee, for which Sedimentation and Erosion Control Plan approval or a CAMA Major permit was sought. f. Filling in, altering, or piping of any vegetative conveyance shown on the approved plan. 11. The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made. The permittee shall submit final site layout and grading plans for any permitted future areas shown on the approved plans and receive approval prior to the start of construction. 13. A copy of the approved plans and specifications shall be maintained on file by the Permittee at all times. 14. This permit shall become void unless the facilities are constructed in accordance with the conditions of this permit, the approved plans and specifications, and other supporting data. 15. Prior to transfer of the permit, the stormwater facilities will be inspected by DWQ personnel. The facility must be in. compliance with all permit conditions. Any items not in compliance must be repaired or replaced to design condition prior to the transfer. Records of maintenance activities performed to date will be required. 16. Prior to the subdivision and/or sale of this project, in whole or in part, the following deed restrictions must be recorded with the Office of the Register of Deeds: a. The following covenants are intended to ensure ongoing compliance with State Stormwater Management Permit Number SW7111105, as issued by the Division of Water Quality under NCAC 2H.1000. b. The State of North Carolina is made'a beneficiary of these covenants to the extent necessary to maintain compliance with the Stormwater Management Permit. C. These covenants are to run with the land and be binding on all persons and parties claiming under them. d. The covenants pertaining to stormwater may not be altered or rescinded without the express written consent of the State of North Carolina, Division of Water Quality. e. Alteration of the drainage as shown on the approved plans may not take place without the concurrence of the Division of Water Quality. f. This project is permitted for a maximum of 305,856 square feet of built -upon area. Construction of additional built -upon area in excess of this amount will require a permit modification. g. This project may not be sold or subdivided, in whole or in part, without first receiving a permit modification from the Division. h. Construction of additional impervious areas such that low -density requirements are no longer met will require a permit modification prior to construction. An engineered system will be required to collect and treat the runoff from all built -upon area associated with the project, including that area permitted under the low density option. i. Filling in or piping of any vegetative conveyances (ditches, swales, etc.) associated with this development, except for average driveway crossings, is strictly prohibited by any persons. j. The built -upon areas shall be located a minimum of 50 feet landward of all perennial and intermittent surface waters. 17. A copy of the recorded deed restrictions must be submitted to the Division within 30 days of the date of recording the plat, and prior to selling lots. The recorded copy must contain all of the statements above, the signature of the Permittee, the deed book number and page, and the stamp/signature of the Register of Deeds. In the event of a change of ownership, or a name change, the permittee must submit a completed Name/Ownership Change form, to the Division of Water Quality, signed by both parties, and accompanied by supporting documentation as listed on page 2 of the form. The project must be in good standing with the Division. The approval of this request will be considered on its merits and may or may not be approved. The permittee is responsible for compliance with all permit conditions until such time as the Division approves the transfer request. 3. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to enforcement action by the Division of Water Quality, in accordance with North Carolina General Statute 143-215.6A to 143-215.6C. 4.. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances, which may be imposed by other government agencies (local, state, and federal) having jurisdiction. 5. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Permittee shall take immediate corrective action, including those as may be required by this Division, such as the construction of additional or replacement stormwater management systems. 6. The permittee grants DENR Staff permission to enter the property during normal business hours for the purpose of inspecting all components of the permitted stormwater management facility. 7. The permit issued shall continue in force and effect until revoked or terminated. The permit may be modified, revoked and reissued or terminated for cause. The filing of a request for a permit modification, revocation and re -issuance or termination does not stay any permit condition. 8. Unless specified elsewhere, permanent seeding requirements for the stormwater control must follow the guidelines established in the North Carolina Erosion and Sediment Control Planning and Design Manual. 9. Approved plans and specifications for this project are incorporated by reference and are enforceable parts of the permit. 10. The issuance of this permit does not prohibit the Director from reopening and modifying the permit, revoking and reissuing the permit, or terminating the permit as allowed by the laws, rules and regulations contained in Session Law 2008- 211, Title 15A NCAC 2H.1000, and NCGS 143-215.1 et.al. 11. Deed restrictions will not be necessary for this project as no parcels are to be created for transfer. Currituck County will hold the permit and control any and all development on site. It is understood that each additional phase of development creating high density pockets or changes in the routing of runoff will require a permit modification. e. Built upon calculations have been provided based on the current phase of development with general information provided based on the Master Plan. These calculations will be updated with future phases of development that are not currently under design. No individual lots will be created. g. All on -site swales have 3:1 side slopes, however; the NCDOT roadside ditch to be cleaned out currently has side slope in excess of 3:1. To perform the cleanout and keep the ditch within the NCDOT r/w, it will be necessary to have a section of ditch where the side slopes will approach 2.5:1. Swales will be inspected monthly or after every runoff producing rainfall event for sediment build-up, erosion, and trash accumulation. 3. Accumulated sediment and trash will be removed as necessary. Swales will be reseeded or sodded following sediment removal. 4. Eroded areas of the swales will be repaired and reseeded. Swales will be revegetated as needed and in a timely manner based on the monthly inspections. Side slopes must be maintained at the permitted slope. 5. Catch basins, curb cuts, velocity reduction devices, and piping will be inspected monthly or after every significant runoff producing rainfall event. Trash and debris will be cleared away from grates, curb cuts, velocity reduction devices and piping. 6.
