A Division of Energy, Mineral, and Land Resources file review has determined that
Stormwater Permit SW7100111 for a stormwater treatment system consisting of a wet
detention basin to serve Paradise Golf located at 3300 N Croatan Hwy, Kill Devil Hills,
NC expires on December 31, 2021. This is a reminder that permit renewal applications
are due 180 days prior to expiration. We do not have a record of receiving a renewal
application.
Please submit a completed permit renewal application along with a $505.00 fee for
Permit renewal. Also, it was noted in the file review that a designer's certification that the
project was constructed in accordance with the approved plans as required by the
permit has not been submitted. Please include this with your application. Permit
application forms for renewal can be found on our website at:

Dear Mr. Vinson:
Please find the enclosed Stormwater Management certification for Paradise Golf in Kill Devil
Hills. As you may recall, the project utilized a pond that was previously built to accommodate
stormwater runoff from the site during initial construction (approximately 1991). Please note that
there were 2 deviations from the plan. The plan included a bulkhead along the east side of the
pond due to erosion problems that occurred over the years and limited available land due to the
existing right of way. During construction, the bulkhead was installed slightly landward due to
the presence of existing utilities serving the site. This reduced the overall pond surface area
from 0.41 acres to 0.38 acres, which remains nearly double the required surface area of 0.20
acres. Approximately 2,151 sf f additional coverage was also installed in the form of widened
sidewalks. The issued permit had included 3,800 sf of additional "future" coverage in
anticipation of planned golf course modifications (not yet designed), so the current coverage
remains below the permitted coverage. However, I have also attached.calculation showing the
pond (as -built) conditions exceed NCDENR requirements with the coverage in addition to future
coverage. We will provide additional documentation as needed when the golf course work
begins design. If you have any further questions regarding any portion of this submittal, please
do not hesitate to call me.

The Washington Regional Office received a complete Stormwater Management Permit Application for
the modification and redevelopment of Paradise Golf on October 6 2010. Staff review of the plans
and specifications has determined that the protect, as proposed, will comply with the Stormwater
Regulations set forth in Title 15A NCAC 2H .1000. We are forwarding Permit No. SW7100111 MOD,
dated October 15, 2010, for the construction of the subject project.
This permit shall be effective from the date of issuance until October 15, 2020, and shall be subject to
the conditions and limitations as specified therein. Please pay special attention to the Operation and
Maintenance requirements in this permit. Failure to establish an adequate system for operation and
maintenance of the stormwater management system will result in future compliance problems.
If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right
to request an adtudicatory hearinupon written request within thirty (30) days followin receipt of this
permit. This request must be in t9e form of a written petition, conforming to Chapter A013 of the
orth Carolina General Statutes, and filed with the Office of Administrative Hearings, P.O. Drawer
27447, Raleigh, NC 27611-7447. Unless such demands are made this permit shall be final and
binding.

wet detention pond in compliance with the provisions of 15A NCAC 2H.1000 (hereafter
referred to as the "stormwater rules') and the approved stormwater management plans
and specifications, and other supporting data as attached and on file with and approved
by the Division of Water Quality and considered a part of this permit.
The Permit shall be effective from the date of issuance until October 15, 2020 and shall
be subject to the following specific conditions and limitations:
1. DESIGN STANDARDS
1. The built -upon area permitted to drain to the existing wet detention pond is
109,347 square feet that includes existing and off -site impervious area.
2. To the extent practicable, the project has provided stormwater control measures
in accordance with the stormwater rules. Those control measures are:
a. Wet detention basin
b. Those measures as more fully described in Section 1.5 of this permit.
3. Approved plans and specifications for projects covered by this permit are
incorporated by reference and are enforceable parts of the permit.
4. All stormwater collection and treatment systems must be located in either
dedicated common areas or recorded easements. The final plats for the project
will be recorded showing all such required easements, in accordance with the
approved plans.

The permittee shall at all times provide adequate erosion control measures in
conformance with the approvedErosionControl Plan.
The permittee shall submit all information requested by the Director or his
representative within the time frame specified in the written information request.
The permittee shall construct the stormwater control measures as shown on the
approved plans.
The permittee shall at all times provide the operation and maintenance
necessary to assure the permitted stormwater system functions at optimum
efficiency including, but not limited to:
a. Semi-annual scheduled inspections (every 6 months).
b. Sediment removal.
C. Mowing and revegetation of side slopes.
d. Immediate repair of eroded areas.
e. Debris removal and unclogging of outlet structure, orifice device, catch
basins and piping.
5. The permittee shall submit to the Director and shall have received approval for
revised plans, specifications, and calculations prior to construction, for any
modification to the approved plans, including, but not limited to, those listed
below:
a. Any revision to the approved plans, regardless of size.
b. Project name change.
C. Transfer of ownership.
d. Redesign or addition to the approved amount of built -upon area.

e. Further subdivision, acquisition, or selling of the project area. The project
area is defined as all property owned by the permittee, for which
Sedimentation and Erosion Control Plan approval was sought.
6. The Director may determine that other revisions to the project should require a
modification to the permit.
7. The Director may notify the permittee when the permitted site does not meet one
or more of the minimum requirements of the permit. Within the time frame
specified in the notice, the permittee shall submit a written time schedule to the
Director for modifying the site to meet minimum requirements. The permittee
shall provide copies of revised plans and certification in writing to the Director
that the changes have been made.
8. Records of maintenance activities must be kept and made available upon
request to authorized personnel of DWQ. The records will indicate the date,
activity, name of person performing the work and what actions were taken.
9. A copy of the approved plans and specifications shall be maintained on file by
the Permittee at all times.
10. Upon completion of construction, prior to issuance of a Certificate of Occupancy,
and prior to operation of this permitted facility, a certification must be received
from an to
designer for the system installed certifying that the permitted
facility has been installed in accordance with this permit, the approved plans and
specifications, and other supporting documentation. Any deviations from the
approvedplans and specifications must be noted on the Certification. A
modification may be required for those deviations.
III. GENERAL CONDITIONS
1. Failure to abide byy the conditions and limitations contained in this permit mayy
subject the Permittee to an enforcement action by the Division of Water Qualityy,
in accordance with North Carolina General Statutes 143-215.6A to 143-215.6C.
2. The permit issued shall continue in force and effect until revoked or terminated.
3. The permit may be modified, revoked and reissued or terminated for cause. The
filing of a request for a permit modification revocation and reissuance, or
termination does not stay any permit condition.
4. The issuance of this permit does not prohibit the Director from reopening and
modifying the permit, revoking and reissuing the permit, or terminating the permit
as allowed by the laws, rules, and regulations contained in Title 15A of the North
Carolina Administrative Code, Subchapter 2H.1000; and North Carolina General
Statute 143-215.1 et. al.
5. The permittee shall submit to the Director and shall have received approval for
revised plans, specifications, and calculations prior to construction, for an
yy
additions, deletions or redesign of the previously permitted amount of built -upon
area proposed regardless of the size of the modification.
The permit is not transferable except after notice to and approval by the Director.
The Director may require modification or revocation and reissuance of the permit
to change the name and incorporate such other requirements as may be
necessary. A formal permit request must be submitted to the Division of Water
Quality accompanied by the appropriate fee, documentation from both parties
involved, and other supporting materials as may be appropriate. The approval of
this request will be considered on its merits, and may or may not be approved.
The permittee is responsible for compliance with all permit conditions until such
time as the Director approves the transfer request.

7. The issuance of this permit does not preclude the Permittee from complying with
any and all statutes, rules, regulations, or ordinances which may be imposed by
other government agencies (local, state and federal) which have jurisdiction.
The permittee grants permission to DENR Staff to enter the premises during
normal business hours for purposes of inspecting the facility.
9. The permittee shall notify the Division of any name, ownership or mailing address
changes within 30 days.
10. Unless specified elsewhere, permanent seeding requirements for the stormwater
control must follow the guidelines established in the North Carolina Erosion and
Sediment Control Planning and Design Manual.
11. This permit shall be effective from the date of issuance until February 5, 2020.
Application for permit renewal shall be submitted 180 days prior to the expiration
date of this permit and must be accompanied by the processing fee.

Important maintenance procedures:
- Immediately after the wet detention basin is established, the plants on the
vegetated shelf and perimeter of the basin should be watered twice weekly if

- No portion of the wet detention pond should be fertilized after the first initial
fertilization that is required to establish the plants on the vegetated shelf.
- Stable groundcover should be maintained in the drainage area to reduce the
sediment load to the wet detention basin.
- If the basin must be drained for an emergency or to perform maintenance, the
flushing of sediment through the emergency drain should be minimized to the
maximum extent practical.
- Once a year, a dam safety expert should inspect the embankment

Existing Conditions: The 4.43 acre site is located on US-158 in Kill Devil Hills, Dare
County. The Natural Resource Conservation Service Soil Survey for Dare County has
mapped the soils the site consist of Corolla Fine Sand (COB) and Newhan Fine Sand (NeC),
and has noted typical permeability rates for each to exceed 20 inches per hour. The site
varies in elevation, with the majority of the area between 6.0 and 10.0 feet above mean sea
level (NAVD 1988). The property is within a flood zone of "AE-8" and "V. Initially developed
in (approximately) 1993, the site originally contained three 18-holes miniature golf courses
and a ±3,600 sf building containing the golf course service area. This construction also
included a pond with an outlet control structure to provide a controlled slow -release of the
runoff contained within the pond. The outlet discharges this runoff into the US-158 closed
drainage system. The elevation of the discharge pipe has been surveyed at 7.3, which
controls the permanent pool for the pond. The permanent pool has been observed at lower
elevations, providing additional storage for rainfall events within the pond. The property
owner utilizes the pond for irrigation, and typically discharges water into the pond that is
obtained from on -site wells during dry seasons in order to maintain an acceptable water
level within the pond. In early 2010, a stormwater management permit (SW7100111 dated
2/5/2010) was sought and issued in order to demolish one of the 18-hole courses and
construct a go-cart track, storage building and enclosed bumper cart ("spin zone") facility
This construction included a 3,800 sf allocation for anticipated future renovations to the
remaining golf courses. In May construction was complete and a designer's certification was
issued providing documentation of an additional 2,151 sf of coverage being added during
construction for expanded sidewalks and maintenance, as well as a slight decrease in the
pond area (0.41 acres to 0.38 acres) due to the adjust of final bulkhead locations resulting
from conflicts with existing utilities.
Proposed Development: I.G. Holdings intends to reconfigure the two 18-hole miniature golf
courses as previously planned for. This work will include the complete removal of the
existing courses and associated walkways. Two new courses will be installed in the same
general area and will include decorative fountains as well as miniature rivers and ponds as
typically found in courses of this nature. These water features are closed loop (do not
discharge onto the site or stormwater pond unless extreme amounts of rainfall are
encountered) and therefore not considered as coverage such as pools. Drainage from the
golf course will not be collected by a closed drainage system, but rather will be allowed to
drain freely via sheet flow. Most of this runoff will infiltrate into adjacent grounds, which are
highly permeable and will maintain a minimum of 30 inches above the groundwater table.
However, such runoff would ultimately be conveyed to the pond if infiltration were not
possible and therefore is being accounted for within the pond.

NCDENR DWQ Stormwater Management Runoff Compliance: The project currently
holds NCDENR stormwater management permit as noted above. The permit maintains
compliance with NCDENR regulations by accommodating runoff from within the site as well
as off site sources (public right-of-way) in the pond constructed for stormwater management
during the original development of the site. In order to accommodate these improvements,
an additional 7,330 sf of coverage is being sought to be included in this permit, which
includes 2,330 sf as shown in the design drawings, plus a contingency of 5,000 sf for
variations during construction. The pond will not require modifications in order to
accommodate this work.

management (SW7100111) for Paradise Golf. The high density permit was issued on
February 5th of this year when a go-cart track was added to the existing minigolf facility.
At that time, additional coverage was included in order to accommodate future planned
renovations to the golf course. However, much of this allocation was used during the
construction of the go cart track in order to accommodate additional walkways.
Therefore, a minor modification is being sought to allow greater coverage within the site.
The existing pond is large enough to the additional impervious surfaces both with

Existing Conditions: I.G. Holdings, LLC currently owns and operates Paradise
Gold on a 4.43 acre site is located on US-158 in Kill Devil Hills, Dare County. The
Natural Resource Conservation Service Soil Survey for Dare County has mapped
the soils on the site to consist of Corolla Fine Sand (CoB) and Newhan Fine Sand
(NeC), and has noted typical permeability rates for each to exceed 20 inches per
hour. Site investigation have found soil conditions to be primarily sandy and
consistent with qualities described by NRCS mapping data. Initially developed in
(approximately) 1993, the site contains three 18-holes miniature golf courses and a
_3,600 sf building containing the golf course service area and several arcade
machines. The miniature golf course holes are constructed of a permeable carpet
over sand with a gravel base. The holes have been assumed to be impermeable for
purposes of this analysis. A pond was also constructed to manage the stormwater
from the site. In addition, runoff from portions of Arch Street, Cameron Street and
US-158 appear to drain into the pond. An outlet control structure was constructed to
provide a controlled slow -release of the runoff contained within the pond. The outlet
discharges this runoff into the US-158 closed drainage system. The elevation of the
discharge pipe has been surveyed at 7.3, which controls the permanent pool for the
pond. The property owner utilizes the pond for irrigation, and typically discharges
water into the pond that is obtained from on -site wells during dry seasons. During
times when the pond permanent pool level is not being maintained by supplement
well pumping, the permanent pool has been observed at lower rates, providing
additional storage for rainfall events within the pond. The site varies in elevation,

The Washington Regional Office received a complete Stormwater Management Permit Application for
the redevelopment of Paradise Golf on January 26, 2010. Staff review of the plans and specifications
has determined that the protlect, as proposed, will comply with the Stormwater Regulations set forth in
Title 15A NCAC 2H .1000. We are forwarding Permit No. SW7100111, dated February 5, 2010, for
the construction of the subject project.
This permit shall be effective from the date of issuance until February 5, 2020, and shall be subject to
the conditions and limitations as specified therein. Please pay special attention to the Operation and
Maintenance requirements in this permit. Failure to establish an adequate system for operation and
maintenance of the stormwater management system will result in future compliance problems.
If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right
to request an adludicatory hearingg upon written request within thirty (30) days following receipt of this
permit. This request must be in the form of a written petition, conforming to Chapter 150E of the
North Carolina General Statutes, and filed with the Office of Administrative Hearings, P.O. Drawer
27447, Raleigh, NC 27611-7447. Unless such demands are made this permit shall be final and
binding.

The Permit shall be effective from the date of issuance until February 5, 2020 and shall
be subject to the following specific conditions and limitations:
I. DESIGN STANDARDS
1. The built -upon area permitted to drain to the existing wet detention pond is
102,017 square feet that includes existing and off -site impervious area.
2. To the extent practicable, the project has provided stormwater control measures
in accordance with the stormwater rules. Those control measures are:
a. Wet detention basin
b. Those measures as more fully described in Section 1.5 of this permit.
3. Approved plans and specifications for projects covered by this permit are
incorporated by reference and are enforceable parts of the permit.
4. All stormwater collection and treatment systems must be located in either
dedicated common areas or recorded easements. The final plats for the project
will be recorded showing all such required easements, in accordance with the
approved plans.

The permittee shall at all times provide adequate erosion control measures in
conformance with the approvedErosionControl Plan.
The permittee shall submit all information requested by the Director or his
representative within the time frame specified in the written information request
The permittee shall construct the stormwater control measures as shown on the
approved plans.
The permittee shall at all times provide the operation and maintenance
necessary, to assure the permitted stormwater system functions at optimum
efficiency including, but not limited to:
a. Semi-annual scheduled inspections (every 6 months).
b. Sediment removal.
C. Mowing and revegetation of side slopes.
d. Immediate repair of eroded areas.
e. Debris removal and unclogging of outlet structure, orifice device, catch
basins and piping.
5. The permittee shall submit to the Director and shall have received approval for
revised plans, specifications, and calculations prior to construction, for any
modification to the approved plans, including, but not limited to, those listed
below:
a. Any revision to the approved plans, regardless of size.
b. Project name change.

d. Redesign or addition to the approved amount of built -upon area.

e. Further subdivision, acquisition, or selling of the project area. The project
area is defined as all property owned by the permittee, for which
Sedimentation and Erosion Control Plan approval was sought.
6. The Director may determine that other revisions to the project should require a
modification to the permit.
7. The Director may notify the permittee when the permitted site does not meet one
or more of the minimum requirements of the permit. Within the time frame
specified in the notice, the permittee shall submit a written time schedule to the
Director for modifying the site to meet minimum requirements. The permittee
shall provide copies of revised plans and certification in writing to the Director
that the changes have been made.
8. Records of maintenance activities must be kept and made available upon
request to authorized personnel of DWQ. The records will indicate the date,
activity, name of person performing the work and what actions were taken.
9. A copy of the approved plans and specifications shall be maintained on file by
the Permittee at all times.
10. Upon completion of construction, prior to issuance of a Certificate of Occupancy,
and prior to operation of this permitted facility, a certification must be received
from an to
designer for the system installed certifying that the permitted
facility has been installed in accordance with this permit, the approved plans and
specifications, and other supporting documentation. Any deviations from the
approvedplans and specifications must be noted on the Certification. A
modification may be required for those deviations.
III. GENERAL CONDITIONS
1. Failure to abide b the conditions and limitations contained in this permit may
subject the Permiyee to an enforcement action by the Division of Water Quality,
in accordance with North Carolina General Statutes 143-215.6A to 143-215.6C
2. The permit issued shall continue in force and effect until revoked or terminated.
3. The permit may be modified, revoked and reissued or terminated for cause. The
filing of a request for a permit modification, revocation and reissuance, or
termination does not stay any permit condition.
4. The issuance of this permit does not prohibit the Director from reopeningg and
ating t modifying the permit, revoking and reissuing the permit, or terminFie permit
as allowed by the laws, rules, and regulations contained in Title 15A of the North
Carolina Administrative Code, Subchapter 2H.1000; and North Carolina General
Statute 143-215.1 et. al.
5. The permittee shall submit to the Director and shall have received approval for
revised plans, specifications, and calculations prior to construction, for an

additions, deletions or redesign of the previously permitted amount of built -upon
area proposed regardless of the size of the modifcation.
6. The permit is not transferable except after notice to and approval by the Director.
The Director may require modification or revocation and reissuance of the permit
to change the name and incorporate such other requirements as may be
necessary. A formal permit request must be submitted to the Division of Water
Quality accompanied by the appropriate fee, documentation from both parties
involved, and other supporting materials as may be appropriate. The approval of
this request will be considered on its merits, and may or may not be approved.
The permittee is responsible for compliance with all permit conditions until such
time as the Director approves the transfer request.

The issuance of this permit does not preclude the Permittee from complying with
any and all statutes, rules, regulations, or ordinances which may be imposed by
other government agencies (local, state and federal) which have jurisdiction.
8. The permittee grants permission to DENR Staff to enter the premises during
normal business hours for purposes of inspecting the facility.
9. The permittee shall notify the Division of any name, ownership or mailing address
changes within 30 days.
10. Unless specified elsewhere, permanent seeding requirements for the stormwater
control must follow the guidelines established in the North Carolina Erosion and
Sediment Control Planning and Design Manual.
11. This permit shall be effective from the date of issuance until February 5, 2020.
Application for permit renewal shall be submitted 180 days prior to the expiration
date of this permit and must be accompanied by the processing fee.

I will keep a maintenance record on this BMP. This maintenance record will be kept in a
log in a known set location. Any deficient BMP elements noted in the inspection will be

Existing Conditions: The 4.43 acre site is located on US-158 in Kill Devil Hills,
Dare County. The Natural Resource Conservation Service Soil Survey for Dare
County has mapped the soils the site consist of Corolla Fine Sand (CoB) and
Newhan Fine Sand (NeC), and has noted typical permeability rates for each to
exceed 20 inches per hour. Initially developed in (approximately) 1993, the site
contains three 18-holes miniature golf courses and a ±3,600 sf building containing
the golf course service area and several arcade machines. The miniature golf course
holes are constructed of a permeable carpet over sand with a gravel base. The
holes have been assumes to be impermeable for purposes of this analysis. A pond
was also constructed to manage the stormwater from the site. In addition, runoff
from portions of Arch Street, Cameron Street and US-158 appear to drain into the
pond. An outlet control structure was constructed to provide a controlled slow -
release of the runoff contained within the pond. The outlet discharges this runoff into
the US-158 closed drainage system. The elevation of the discharge pipe has been
surveyed at 7.3, which controls the permanent pool for the pond. The permanent
pool has been observed at lower rates, providing additional storage for rainfall
events within the pond. The property owner utilizes the pond for irrigation, and
typically discharges water into the pond that is obtained from on -site wells during dry
seasons. The pond is currently bulkheaded around the perimeter facing the interior
of the site. The site varies in elevation, with the majority of the area between 6.0 and
10.0 feet above mean sea level (NAVD 1988). The property is within a flood zone of
"AE-8" and "X".
Proposed Development: I.G. Holdings intends to remove one of the 18-hole
miniature golf courses in order to construct an electric go-cart and bumper car
("spin -zone") track. Additional stormwater drainage will be provided in order to direct
runoff from this area into the existing pond in manner that will not "short circuit' the
pond and provide water quality enhancement. Additional bulkheading will be
installed around the perimeter (exterior side) of the existing pond. A swale /
stormwater overflow area will be installed along the south side of the site to convey
runoff (mostly from the adjacent right of way) to the pond and provide additional
storage on the site. Three depressed "supplemental infiltration areas" have also
been provided within the go-cart track to provide additional storage and infiltration
capabilities. These basins are provided to meet municipal requirements only and are
being excluded from state permitting. Overflow from these areas will be directed into
the existing pond. An additional allocation of 3,800 sf has been provided for an

increase in impervious area that would result from a potential future redevelopment
of the remaining 36 hole miniature golf course.
NCDENR Stormwater Management Runoff Compliance: The existing pond was
originally constructed to manage stormwater runoff from the site and has functioned
as such since construction. In order to meet requirements set forth by the Town of
Kill Devil Hills, the site is required the site to manage a 10-year, 2-hour rainfall event
(4.3 inches of rainfall). Runoff resulting from 1.5" (as required by NCDENR coastal
county stormwater regulations) of rainfall has been calculated to be a total of 12,938
cf from on and off site sources. The pond will maintain a surface area of 17,978 sf.
The overflow for the pond is being set at 8.7 feet above msl, providing a temporary
storage volume of 25,169 cf. The adjacent swale / stormwater overflow area
provides an additional 3,708 cf of storage volume below the 8.7 overflow elevation.
Using an assumed depth of 3.0 feet and a proposed (future) coverage of 44%, the
required SA/DA ratio for this is 3.72, resulting in a required surface area of 0.20
acres. The existing pond will maintain a surface area of 0.41 acres. The new
collection system will also provide additional routing of runoff through the pond. The
previously designed vegetative filter on the overflow will be re-established.

Existing Conditions: I.G. Holdings, LLC currently owns and operates Paradise
Gold on a 4.43 acre site is located on US-158 in Kill Devil Hills, Dare County. The
Natural Resource Conservation Service Soil Survey for Dare County has mapped
the soils on the site to consist of Corolla Fine Sand (CoB) and Newhan Fine Sand
(NeC), and has noted typical permeability rates for each to exceed 20 inches per
hour. Site investigation have found soil conditions to be primarily sandy and
consistent with qualities described by NRCS mapping data. Initially developed in
(approximately) 1993, the site contains three 18-holes miniature golf courses and a
±3,600 sf building containing the golf course service area and several arcade
machines. The miniature golf course holes are constructed of a permeable carpet
over sand with a gravel base. The holes have been assumed to be impermeable for
purposes of this analysis. A pond was also constructed to manage the stormwater
from the site. In addition, runoff from portions of Arch Street, Cameron Street and
US-158 appear to drain into the pond. An outlet control structure was constructed to
provide a controlled slow -release of the runoff contained within the pond. The outlet
discharges this runoff into the US-158 closed drainage system. The elevation of the
discharge pipe has been surveyed at 7.3, which controls the permanent pool for the
pond. The property owner utilizes the pond for irrigation, and typically discharges
water into the pond that is obtained from on -site wells during dry seasons. During
times when the pond permanent pool level is not being maintained by supplement
well pumping, the permanent pool has been observed at lower rates, providing
additional storage for rainfall events within the pond. The site varies in elevation,
with the majority of the area between 6.0 and 10.0 feet above mean sea level
(NAVD 1988). The property is within a flood zone of "AE-8" and "X".
