A Division of Energy, Mineral, and Land Resources file review has determined that
Stormwater Permit SV 7091002 for a stormwater treatment system consisting of a wet
detention pond serving Currituck Assisted Living located at 141 Moyock Landing Drive,
Moyock, NC expires on December 30, 2021. Renewal applications are due 180 days
prior to expiration. A review of the Currituck County tax records shows that the property
is currently owned by Moyock Propco Holdings, LLC.
The Coastal stormwater rules and the NC General Statutes require a stormwater permit
for this project. Stormwater permits are not automatically transferred when property is
sold. The stormwater permit is currently issued to Currituck Health Investors, LLC.
Please submit a completed permit renewal application and a stormwater ownership
transfer application along with a $505.00 processing fee. Permit application forms for
renewal and ownership transfer can be found on our website at:

ruies/stormmvater-progi-am/post-construction. North Carolina General Statutes and the
Coastal Stormwater rules require that this property be covered under a stormwater

Enclosed please find the Designer's Certification for the above referenced project.
Please note that the pond was surveyed and inspected for dimensional and elevation accuracy
on April 2, 2010 and found to comply with the design. At that time, the banks were not
vegetated and the wetland plants had not been installed. Last week, a visual inspection was
performed to verify that permanent vegetation had been established on the side slopes and that
the wetland plants had been installed. During that inspection, sedimentation in the forebay rip
rap was observed. The pond has not been checked to see if sedimentation has reached the 1'
allowed depth.

Enclosed per your request for additional information letter dated October 22, 2009, please find
the following items:
Two (2) copies of revised referenced plans. Note that the dumpster location has moved
and additional pavement added (some also removed). The previous Future Impervious
Surface Area of 5,000 sf has been adjusted down to 4,441 sf to account for additional
pavement wedge at dumpster and additional sidewalk at storage building. This
reduction keeps the overall total impervious on site unchanged. See Site Data, Sheet 2,
No. 3, for revised impervious data.
2. Two (2) copies of revised page 3 of 6 of the Stormwater Permit Application. The values
in the table reflect the same future impervious allotment reduction and overall impervious
as noted in 1. above.
3. Two (2) copies of the revised Project Description.
4. Two (2) copies of the support calculations for the Wet Detention Basin Supplement for
the 1-yr, 24-hr, Pre -development & Post -development values.
A copy of the USACE blueline determination (Action ID SAW-2009-01629) dated
10/13/2009. Per this document the blueline portion of the ditch passing along the west
boundary of the project site ends 45 feet south of the south end of the field culvert at the
south line of the 24 acres parcel on the south side of Moyock Landing Drive (which is
approx. 450 feet south of Moyock Landing Drive). The project site is on the north side of
Moyock Landing Drive.

Currituck Health Investors, LLC is proposing to construct an assisted IivirfdiKt, _ ,�,:e Bite
in Moyock Township of Currituck County. The site is located on Moyock Landing Road. It is currently
vacant and is zoned GB (General Business).
Development will include the construction of one (1) building, (1) accessory building, required
parking, an underground piped drainage system in conjunction with grassed swales, required utilities,
sewer pump station, the installation of required landscaping, and a wet detention basin.
The proposed buildings will contribute 35,221 sf of impervious area. The parking and driveways
will contribute 49,107 sf, the dumpster pad 400 sf, and sidewalk and patios will contribute another 8,648
sf for a total of 93,376 sf of impervious coverage.
Drainage Area 1 encompasses 4.65 acres (202,485 sf) of the site including most proposed on -
site impervious areas. The only impervious areas not draining to the detention basin are a portion of the
entrance drive and a portion of the County required sidewalk along the front of this site. It is not practical
for all of these areas to drain to the detention basin. These small areas that are not directed to the basin
will be part of Drainage Area 2. Drainage will be collected in a combination of underground piping and
grass lined swales that will route all runoff to the proposed detention pond which is designed for 90% TSS
removal. The design impervious area is 45.34% of the drainage area. To have the flexibility to add future
building, pavement or sidewalk additions, the proposed wet detention basin has been sized to accept
runoff from approximately 4,441 sf of additional impervious area. The maximum onsite impervious area
will be 47.53% of the drainage area.
Drainage Area 2 contains the remainder of the 6 acre tract. Only the portion of the entrance drive
and portion of the required sidewalk mentioned above is on -site impervious and located in this drainage
area. Open space areas around the perimeter of the site will sheet flow into the perimeter swales.
The soil evaluation was performed on July 30, 2009 by Sean C. Robey, PE and Kimberly Hamby.
The soil boring was conducted with an AMS 2-3/4" diameter 6' long hand mud auger. The boring was
performed in the northwest corner of the property where the detention pond will be located. The USDA-
NRCS WEB Soil Survey indicates the site consists of Augusta and Roanoke soils. The elevation at the
boring location is approximately 6.5'. The sandy loam topsoil was 16-18" deep. From 18" to 36" was a
massive clay. At 36", we encountered a course sand. At 42" color of the sand changed to a chroma color
less than 2 according to the Munsell Soil Color Chart. The low chroma indicates the seasonal high water
table is located at a depth of approximately 42", or elevation 3.0'. The course sand continued to at least
48" but was too wet to continue removal with the auger.
The total disturbed area for this development will not exceed 6 acres. Limits of disturbance have
been shown on the plans.

This office received a Coastal Stormwater permit application and plans for the subject project on October 8, 2009,
A preliminary review of the project indicates that before a State Stormwater permit can be issued the following additional
information is needed.
1. The impervious area sum on page 3of6 of die application is 96,194sf although 96,257sf is listed and neither match
the total impervious area given in the submitted narrative of 92,817sf even with the 5,000sf of proposed future.
Please correct form and/or narrative as needed so that they correspond.
2. Please provide the Pre -Post development 1-yr, 24-hr peak flow calculations, corresponding to the supplement
form, that help show the discharge volume from the pond is at a rate equal to or less than the predevelopment
discharge rate for the one year, 24-hour storm.
3. Regarding the energy dissipation / rock fill in the shown "blue line stream" in the northwest corner of the
property, please verify with the Army Corps of Engineers that the shown feature is or is not subject. If it is
subject and the ACOE requires a 404 permit & subsequent DWQ 401 certification in order to allow this fill, the
State Stormwater application may need to be placed on a short temporary hold until this matter can be cleared up.
The ACOE may very likely have already made a determination at this site when the Moyock Landing Drive
culvert was installed, however I could find no record of this in our DWQ files.
The above requested information must be received in this office prior to October 30, 2009 or your application will
be returned as incomplete. The return of this project will necessitate resubmittal of all required items including the
application fee. If you need additional time to submit the required information, please mail or fax your request for
time extension to this office at the Letterhead address.
You should also be aware that the Stormwater Rules require that the permit be issued prior to any development
activity. Construction without a permit is a violation of 15A NCAC 2H.1000 and North Carolina General Statute 143-
215.1 and may result in civil penalties of up to $10,000 per day.

Currituck Health Investors, LLC is proposing to construct an assisted living facility on a 6 acre site
in Moyock Township of Currituck County. The site is located on Moyock Landing Road. It is currently
vacant and is zoned GB (General Business).
Development will include the construction of one (1) building, (1) accessory building, required
parking, an underground piped drainage system in conjunction with grassed swales, required utilities,
sewer pump station, the installation of required landscaping, and a wet detention basin.
The proposed buildings will contribute 35,221 sf of impervious area. The parking and driveways
will contribute 48,912 sf, the dumpster pad 400 sf, and sidewalk and patios will contribute another 8,284
sf for a total ofW,8.1.71sf of impervious coverage.
Drainage Area 1 encompasses 4.65 acres (202,485 sf) of the site including most proposed on -
site impervious areas. The only impervious areas not draining to the detention basin are a portion of the
entrance drive and a portion of the County required sidewalk along the front of this site. It is not practical
for all of these areas to drain to the detention basin. These small areas that are not directed to the basin
will be part of Drainage Area 2. Drainage will be collected in a combination of underground piping and
grass lined swales that will route all runoff to the proposed detention pond which is designed for 90% TSS
removal. The design impervious area isr45 07% of the drainage area. To have the flexibility to add future
building, pavement or sidewalk additions, the proposed wet detention basin has been sized to accept
runoff from approximately 5;000=sf-of-additional°impervious=areas The mazimunfonsite-impervious•area
will=be:47'53%_of,the:dra i nage=a rea,
Drainage Area 2 contains the remainder of the 6 acre tract. Only the portion of the entrance drive
and portion of the required sidewalk mentioned above is on -site impervious and located in this drainage
area. Open space areas around the perimeter of the site will sheet flow into the perimeter swales.
The soil evaluation was performed on July 30, 2009 by Sean C. Robey, PE and Kimberly Hamby.
The soil boring was conducted with an AMS 2-3/4" diameter 6' long hand mud auger. The boring was
performed in the northwest corner of the property where the detention pond will be located. The USDA-
NRCS WEB Soil Survey indicates the site consists of Augusta and Roanoke soils. The elevation at the
boring location is approximately 6.5'. The sandy loam topsoil was 16-18" deep. From 18" to 36" was a
massive clay. At 36", we encountered a course sand. At 42" color of the sand changed to a chroma color
less than 2 according to the Munsell Soil Color Chart. The low chroma indicates the seasonal high water
table is located at a depth of approximately 42", or elevation 3.0'. The course sand continued to at least
48" but was too wet to continue removal with the auger.
The total disturbed area for this development will not exceed 6 acres. Limits of disturbance have

Description
Hydrologic soil groups are based on estimates of runoff potential. Soils are
assigned to one of four groups according to the rate of water infiltration when the
soils are not protected by vegetation, are thoroughly wet, and receive precipitation
from long -duration storms.
The soils in the United States are assigned to four groups (A, B, C, and D) and
three dual classes (A/D. B/D, and C/D). The groups are defined as follows:
Group A. Soils having a high infiltration rate (low runoff potential) when thoroughly
wet. These consist mainly of deep, well drained to excessively drained sands or
gravelly sands. These soils have a high rate of water transmission.
Group B. Soils having a moderate infiltration rate when thoroughly wet. These
consist chiefly of moderately deep or deep, moderately well drained or well drained
soils that have moderately fine texture to moderately coarse texture. These soils
have a moderate rate of water transmission.
Group C. Soils having a slow infiltration rate when thoroughly wet. These consist
chiefly of soils having a layer that impedes the downward movement of water or
soils of moderately fine texture or fine texture. These soils have a slow rate of water
transmission.
Group D. Soils having a very slow infiltration rate (high runoff potential) when
thoroughly wet. These consist chiefly of clays that have a high shrink -swell
potential, soils that have a high water table, soils that have a claypan or clay layer
at or near the surface, and soils that are shallow over nearly impervious material.
These soils have a very slow rate of water transmission.
If a soil is assigned to a dual hydrologic group (A/D, B/D, or C/D), the first letter is
for drained areas and the second is for undrained areas. Only the soils that in their
natural condition are in group D are assigned to dual classes.

THIS DEED made this the 91h day of September, 2009, by and between CTX,
Inc., a North Carolina corporation, Grantor, to Currituck Health Investors, LLC, a
North Carolina limited liability company, Grantee, whose address is 4423 Pleasant
Ridge Rd., Suite 301, Roanoke, VA 24014.
The designation of Grantor and Grantee as used herein shall include said parties,
their heirs, and successors and assigns, and shall include singular, plural, masculine,
feminine or neuter as required by context.
WITNESSETH:
THAT the Grantor, for a valuable consideration paid by the Grantee, the receipt
of which is hereby acknowledged, have and by these presents do grant, bargain, sell and
convey, unto the Grantee a fee simple interest, in and to all that certain lot or parcel of
land, and any improvements located thereon, situated in Moyock Township, Currituck
County, North Carolina, and more particularly described as follows:
All that certain lot and parcel and land shown as "Area After
Recombination- 6.00 AC" on that certain plat entitled in part
"Recombination Survey for CTX, INC." prepared by Hyman & Robe ,
dated September 1, 2009 and recorded in Plat Cabinet L- , Slide
of the Currituck County Registry.

The above -described property was acquired by the Grantor by deed recorded in
Deed Book 629, Page 84 of the Currituck County Registry.
TO I LAVE AND TO HOLD the aforesaid lot or parcel of land and all privileges
and appurtenances thereto belonging to the Grantee and his heirs and assigns forever.
And 1he said Grantor covenants with the Grantee, that Grantor is seized of the
premises in fee simple and has the right to convey the same in fee simple; that title is
marketable and free and clear from all encumbrances, and that Grantor will warrant and
defend the title against the lawful claims of all persons whatsoever except for the
exceptions herein stated.
Title to the property hereinabove described is subject to the following exceptions:
