Dear Mr. Cross:
On July 10, 2013, I conducted a site inspection for the tract/project known as
Jimmies Creek Maxi -Storage, located near 502 Slaughterhouse Road New Bern, NC. The
site visit and file review revealed that the subject project has an approved Erosion and
Sedimentation Control Plan and is covered by Stormwater General Permit NCGO10000
and State Stormwater permit SW7090814.
A Construction Stormwater General Permit (NCGO10000) is issued upon the
approval of an Erosion and Sedimentation Control Plan. This permit applies to projects
that receive a Division of Land Resources (DLR) (or local delegated program) Erosion
and Sedimentation Control Plan for land'disturbance of 1 acre or greater. Specifically,
the General Permit (NCGO10000) authorizes the discharge of stormwater under the
National Pollutant Discharge Elimination System (NPDES) in accordance with Title 15A
North Carolina Administrative Code 21-1.0100 during the construction phase of the
project. The inspection for this permit revealed that construction appeared to be partially
complete and that no construction activities are currently on going at the site and the site
appeared to be stable.
State Stormwater permit SW7090814 was issued for the construction and operation of a
wet detention pond that will treat stormwater runoff from impervious surfaces on site for
the life of the project. A file review noted that we have not received a designer's
certification for this project. Condition number II. 9. states " Upon completion of
construction, prior to issuance of a certificate of occupancy, and prior to operation of this
permitted facility, a certification must be received from an appropriate designer for the
system installed certifying that the permitted facility has been installed in accordance
with this permit, the approved plans and specifications, and other supporting

documentation. Any deviations from the approved plans and specifications must be
noted on the Certification. A modification may be required for those deviations."
At the time of the inspection woody vegetation (willow trees) was observed growing on
the dikes of the wet detention pond. This woody vegetation needs to be removed.
Please be advised that you are required to comply with the terms, conditions and
limitations of your Stormwater Management Permit under Title 15A North Carolina
Administrative Code 21-1.1003 and North Carolina General Statute 143-214.7, including
operation and maintenance of your permitted stormwater system. Please advise when the
repairs have been completed. A follow up inspection will be conducted in the near future.
A designer's certification should be submitted within 30 days of receipt of this letter.
Please be advised that violations of the NPDES Stormwater General Permit or the State
Stormwater permit may be subject to a civil penalty assessment of up to $25,000.00 per
day for each violation. If you have any questions, comments, or need assistance with
