In accordance with Title 15A NCAC 21-1.100, the Stormwater Management Regulations, deed restrictions and protective covenants are required where lots will be subdivided and sold. Deed Restrictions and protective covenants are necessary to ensure that the development maintains a "built -upon' area consistent with the applicable regulations governing the density level. A DWQ file review confirms that copies of the recorded deed restrictions have not been provided to this Office. Failure to record the required deed restrictions constitutes a violation of Permit Number SW7090701 which states "Deed restrictions are incorporated into this permit by reference and must be recorded with the Office of Register of Deeds prior to the sale of any lot. In addition, a copy of the recorded restrictions must be received by this Office within 30 days of the date of recording. Recorded deed restrictions must include as a minimum certain statements related to stormwater management as outlined in both the permit and the notarized statement signed by the applicant at the time of permit request submittal. Please provide proof of these required deed restrictions to this Office at the address listed on the letterhead within 30 days of receipt of this letter. A preliminary review of the project indicates that before a State Stormwater permit can be issued the following additional information is needed. 1. On plan sheet D-2, the pond outfall weir detail shows that it will be possible for the pond to drain below the permanent pool out of the pond by means of the rip rap all the way up to the temporary pool elevation of 10.95fmsl. The pond should only be able to drain below the temporary pool elevation from the small diameter orifice and not through the rock of the overflow weir. Please move the compacted earth with filter fabric up on the overflow weir elevation to at least an elevation of 11.00finsl or above. Please submit 2 copies of the revised plan sheet D-2. 2. Please do not forget to have any plans, calculations, supplements, narrative, etc. revised; signed, sealed and dated as necessary when re -submitting. The above requested information must be received in this office prior to July 24, 2009 or your application will be returned as incomplete. The return of this project will necessitate resubmittal of all required items including the application fee. If you need additional time to submit the required information, please mail or fax your request for time extension to this office at the Letterhead address. You should also be aware that the Stormwater Rules require that the permit be issued prior to any development activity. Construction without a permit is a violation of 15A NCAC 21-1.1000 and North Carolina General Statute 143- 215.1 and may result in civil penalties of up to $10,000 per day.
