A Division of Energy, Mineral, and Land Resources file review has determined that
Stormwater Permit SW7090224 for a stormwater treatment system consisting of a wet
detention pond serving the South Park Athletic Complex located at 112 Capital Trace,
Elizabeth City, NC expires on December 30, 2021. This is a reminder that permit
renewal applications are due 180 days prior to expiration. We do not have a record of
receiving a renewal application.
Please submit a completed permit renewal application along with a $505.00 fee for
permit renewal. Permit application forms for renewal can be found on our website at:

NCOENR - Division of Water Quality - dated December 29, 2008
1. Delineate wetlands on site or provide a note on plans that none exist.
SS Response: There are no wetlands on site. A note has been added to the grading
plan indicating there are not wetlands.
2. Revise the Temporary Pool Elevation on sheet L-5.4 (Wet Detention Basin Construction
Details). The detail shows elevation of 5.70, white the Supplement and the Calculations
show elevation of 5.97.
SS Response: The old calculations are void. The revised details now match the revised
Supplemental Forms and calculations.
3. Clarify if the "Future Parking Area", as shown on plan sheet L-2.1 is included in the
Proposed Impervious area and if the pond is sized using this additional impervious area.
SS Response: The future parking area has been removed and new parking/roadway has
been added. This new impervious area is- now included in the revised wetpond
calculations.
4. Please be advised that per Session Law 2008-211, for Low Density Option in non -SA waters,
the stormwater runoff from the development sha[L be transported primarily by vegetated
conveyances. The conveyance system shall not include a stormwater collection system.
The low density permit condition further limits the use of piping on site except those
minimum amounts necessary to direct runoff beneath an impervious surface such as a road
or under driveways. Please revise the tow -density portion of this project, which currently
shows significant amount of piping, to minimize the use of piping.
SS Response: The piping in the fields are designed to provide positive drainage
between the baseball fields. Standing water in this area is a safety hazard as welt as a
nuisance issue. The concept for this plan was preliminary approved by Scott Vinson
with DWQ on 1-7-08. The BMP manual states "Use of vegetated conveyances to the
maximum extent practicable". We have complied with the tow -density requirements
for the drainage area 1.2.
5. Provide 2 sets of signed and seated plan sheets and documents.
SS Response: The revised plan sheets and calculations are enclosed in this submittal.

This office received a Coastal Stormwater permit application and plans for the subject project on
November 14, 2008. A preliminary review of your project indicates that before a State Stormwater
permit can be issued the following additional information is needed:
1 . Delineate wetlands on site or provide a note on plans that none exist.
2. Revise the Temporary Pool Elevation on sheet L-5.4 (Wet Detention Basin Construction
Details). The detail shows elevation of 5.70, while the Supplement and the Calculations
show elevation of 5.97.
3. Clarify if the "Future Parking Area", as shown on plan sheet L-2.1 is included in the
Proposed Impervious area and if the pond is sized using this additional impervious area.
4. Please be advised that per Session Law 2008-211, for Low Density Option in non -SA

all required items including the application fee. If you need additional time to submit the required
information, please mail or fax your request for time extension to me at the Letterhead address and
include the application number on the request. The request must include justification for the amount of
additional time needed. The request will only be granted for justifiable delays that are unforeseen and
beyond the owner or consultant's control.
You should also be aware that the Stormwater Rules require that the permit be issued prior to
any development activity. Construction without a permit is a violation of 15A NCAC 21-1.1000 and North
Carolina General Statute 143-215.1 and may result in civil penalties of up to $25,000 per day.

REMARKS EncLosed are the revised items needed for the Stormwater Management Permit review. We
understand that the original deadline for review was not met. This review wiLl start over and new comments may be
addressed. The new fee ($505) is being processed by our client and wilt be mailed (over night) as soon as we receive it.
I have responded to all of your orginal comments and the response is included in this submittal. I am including a revised
stormwater application (only sheet 2 has changed). I am also including a revised supLimental form based on the new

System Operation and Maintenance Agreement, for Low Density
portion of this project. One Low Density supplement will be sufficient
for both low density areas.
2. Clarify if the "Future Asphalt Trail" and "Future Road", as shown on
plans are included in the Proposed Impervious area for the Low
Density portion of this project. If not, please be advised that any
change to approved plans and permit (including this future trail and
road) would require a Modification to Stormwater permit.
3. Provide 2 sets of signed and sealed plan sheets and documents.

SS Response: This information can be found on the previous submittal under section 3
of the Stormwater Management Permit Application Form. The total area for drainage
area #1.2 (which includes the swales) is 544,936 sf. This includes 25,700 sf. (or
4.30%) of impervious area.
4. Is the future parking going to the basin?
SS Response: The future parking does go to the basin and is included in the water
quaiity/detention calculations.
5. Where do the future trails go?
SS Response: The trials go into the swaies included in drainage area #1.2.

A low density project is one that meets the appropriate criteria for built upon area and transports stormwater

collection system as defined by 15A NCAC 2H .1002(18). Low density requirements and density factors can be
found in Session Law 2008-211, 15A NCAC 2H 1000, Session Law 2006-246, and the DWQ BMP Manual.

The following checklist outlines design requirements per the North Carolina Administrative Code Section 15A
NCAC 2H. 1000, NCDENR BMP Manual (2007), Session Law 2006-246, and Session Law 2008-211.
Please indicate the page or plan sheet numbers where the supporting documentation can be found. An
incomplete submittal package will result in a request for additional information. This will delay final
review and. approval of the project. Initial in the space provided to indicate that the following requirements
have been met and supporting documentation is provided as necessary. If the applicant has designated an agent
on the Stormwater Management Permit Application Form, the agent may initial below. If any item is not met,

V. SWALE SYSTEM MAINTENANCE REQUIREMENTS
Mowing will be accomplished as needed according to the season. Grass height will not exceed six inches
at any time; and grass will not be mowed too close to the ground or "scalped".
2. Swales will be inspected monthly or after every runoff producing rainfall event for sediment build-up,
erosion, and trash accumulation.
3. Accumulated sediment and trash will be removed as necessary. Swales will be reseeded or sodded
following sediment removal.
4. Eroded areas of the swales will be repaired and reseeded. Swales will be revegetated as needed and in a
timely manner based on the monthly inspections. Side slopes must be maintained at the permitted slope.
5. Catch basins, curb cuts, velocity reduction devices, and piping will be inspected monthly or after every
significant runoff producing rainfall event. Trash and debris Will be cleared away from grates, curb cuts,
velocity reduction devices and piping.
6. Swales will not be altered, piped, or filled in without approval from NCDENR Division of Water Quality.

project, at same time we granted a 15 days extension, with the new due date for

been received; therefore your application is being returned to you as incomplete
(attached). The plans, calculations and soils report will be returned under separate
cover only if requested.
Please be advised that construction of the proposed facilities without a valid
permit is a violation of 15A NCAC 21-11.1000 and North Carolina General Statute

by any means including piping or swales, and direct it to the pond.
B. Check the proposed pond design to make sure it meets or exceeds the minimum design
criteria for surface area, volum4 and drawdown.
