Stormwater Permit SV 7071211 for a stormwater treatment system consisting of two
infiltration basins serving Outer Banks Blue, LLC located at 3732 N. Croatan Hwy., Kitty
Hawk, NC expires on December 28, 2021. This is a reminder that permit renewal
applications are due 180 days prior to expiration. We do not have a record of receiving
a renewal application.
Please submit a completed permit renewal application along with a $505.00 fee for
permit renewal within the required time. Permit application forms for renewal can be

On July 7, 2016 a stormwater compliance inspection was conducted at the Outer Banks Vacation Rentals
site at 3732 N Croatan Hwy in Kitty Hawk, NC. State Stormwater permit SW7071211 was issued on
December 28, 2007 for the construction and operation of two infiltration basins systems to treat
stormwater runoff from impervious surfaces on the site for a proposed bank. The permit was originally
issued to R&E Development, LLC. A search of the Dare County tax records shows that the property
covered under this permit is now owned by Outer Banks Blue, LLC. A search of the North Carolina
Secretary of State's website lists you as Manager of this LLC. North Carolina General Statutes and the
Coastal Stormwater rules require that this property be covered under a stormwater permit.
Please submit a completed permit ownership change application. There is no fee required for the first
ownership change application. Permit application forms for ownership change can be found on our
website at http://deg.nc.gov/about/divisions/energy-mineral-land-resources/energy-mineral-land-
perm its/stormwater-permits/forms.

III. REQUIRED ITEMS
A request to transfer a permit will not be approved by the Division of Water Quality (DWQ) unless all
of the applicable required items listed below are included with the submittal. Failure to provide the
listed items may result in processing delays or denial of the transfer.

5. If the proposed permittee is a firm, partnership, association, institution, corporation, limited liability
company, or other corporate entity, provide documentation showing the authority of the named
representative to act on behalf of the proposed permittee.
6. The $40.00 processing fee. If this is an initial transfer from the original permittee the processing
fee is not required. Subsequent ownership transfers will require the $40.00 processing fee.

The Washington Regional Office received a completed Stormwater Application for the subject project on
December 13, 2007. Staff review of the plans and specifications has determined that the project, as proposed, will
comply with the Stormwater Regulations set forth in Title 15A NCAC 21-1.1000. We are forwarding Permit No.
SW7071211 dated December 28, 2007 to R&E Developments, LLC. for the construction and operation of two
infiltration basins to serve the Bank of Commonwealth, Kitty Hawk development located on southwest corner of the
intersection of US 158 and First Flight Run in Kitty Hawk, North Carolina.
This permit shall be effective from the date of issuance until December 28, 2017, and shall be subject to the
conditions and limitations as specified therein. Please pay special attention to the Operation and Maintenance
requirements in this permit. Failure to establish an adequate system for operation and maintenance of the stormwater
management system will result in future compliance problems.
If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to
request an adjudicatory hearing upon written request within thirty (30) days following receipt of this permit. This
request must be in the form of a written petition, conforming to Chapter 150E of the North Carolina General Statutes,
and filed with the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27699-6714. Unless such
demands are made this permit shall be final and binding.

This permit shall be effective from the date of issuance until December 28, 2017 and shall be subject to the following
specified conditions and limitations:
DESIGN STANDARDS
1. This permit is effective only with respect to the nature and volume of stormwater described in the application and
other supporting data.
2. This stormwater system has been approved for the management of stormwater runoff as described in Section 1.6
of this permit. The stormwater control has been designed to handle the runoff from 30,723 square feet of
impervious area.
3. The tract will be limited to the amount of built -upon area indicated in this permit, and per approved plans.
4. The runoff from all built -upon area within the permitted drainage area of this project must be directed into the
permitted stormwater control system.
5 The following design criteria have been provided in the infiltration basins and must be maintained at design
condition:

6. The following items will require a modification to the permit:
a. Any revision to the approved plans, regardless of size
b. Project name change
C. Transfer of ownership
d. Redesign or addition to the approved amount of built -upon area
e. Further subdivision of the project area.
In addition, the Director may determine that other revisions to the project should require a modification to the
permit.
The Director may notify the permittee when the permitted site does not meet one or more of the minimum
requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written
time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall
provide copies of revised plans and certification in writing to the Director that the changes have been made.
II. SCHEDULE OF COMPLIANCE
The permittee will comply with the following schedule for'construction and maintenance of the stormwater
management system.
a. The stormwater management system shall be constructed in its entirety, vegetated and operational
for its intended use prior to the construction of any built -upon surfaces except roads.
b. During construction, erosion shall be kept to a minimum and any eroded areas of the system will be
repaired immediately.
2. The facilities must be properly maintained and operated at all times. The approved Operation and
Maintenance Plan must be followed in its entirety and maintenance must occur at the scheduled intervals.
3. The permittee shall at all times provide the operation and maintenance necessary to assure the permitted
stormwater system functions at optimum efficiency including, but not limited to:
a. Semiannual scheduled inspections (every 6 months)
b. Sediment removal
C. Mowing and revegetation of side slopes
d. Immediate repair of eroded areas
e. Maintenance of side slopes in accordance with approved plans and specifications
f. Debris removal and unclogging of outlet structure, orifice device and catch basins and piping.
4. Records of maintenance activities must be kept and made available upon request to authorized personnel of
DWQ. The records will indicate the date, activity, name of person performing the work and what actions were
taken.
5. This permit shall become voidable unless the facilities are constructed in accordance with the conditions of
this permit, the approved plans and specifications, and other supporting data.
6. Upon completion of construction and prior to operation of this permitted facility, a certification must be
received from an appropriate designer for the system installed certifying that the permitted facility has been
installed in accordance with this permit, the approved plans and specifications, and other supporting
documentation. Mail the Certification to the Washington Regional Office, 943 Washington Square Mall,
Washington, North Carolina, 27889, attention Division of Water Quality.
7. A copy of the approved plans and specifications shall be maintained on file by the Permittee for a minimum of
five years from the date of the completion of construction.
III. GENERAL CONDITIONS
1. This permit is not transferable. In the event there is a desire for the facilities to change ownership, or there is
a name change of the Permittee, a formal permit request must be submitted to the Division of Water Quality
accompanied by an application fee, documentation from the parties involved, and other supporting materials
as may be appropriate. The approval of this request will be considered on its merits and may or may not be
approved.
2. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to
enforcement action by the Division of Water Quality, in accordance with North Carolina General Statute 143-
215.6(a) to 143-215.6(c).
3. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules,
regulations, or ordinances which may be imposed by other government agencies (local, state, and federal)
which have jurisdiction.
4. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the
Permittee shall take immediate corrective action, including those as may be required by this Division, such as
the construction of additional or replacement stormwater management systems.
5. The permitee grants DENR Staff permission to enter the property during normal business hours for the
purpose of inspecting all components of the permitted stormwater management facility
6. The permit may be modified, revoked and reissued or terminated for cause. The filing of a request for a
permit modification, revocation and reissuance or termination does not stay any permit condition.
7. An application for permit renewal must be submitted at least 180 days prior the expiration of this permit along
with the appropriate processing fee.

This office received a Coastal Stormwater permit application and plans for the subject project on December
13, 2007. A preliminary review of the project indicates that before a State Stormwater permit can be issued the

fol wing additional information is needed.
. Revise page 2 of 4 of the Stormwater Management Permit Application Form for receiving stream.
Receiving stream appears to be Kitty Hawk Bay with Classification SC (while the Albemarle Sound has
classification SB);
V 2. The North Arrow is shown on Vicinity maps, but not on plans. Provide new set of plans with north arrow
shown;
V -' The Bypass structure is not required since this project stores more than double the required volume,
however the vegetative filter is still required. Please provide on somewhere on downslope of the Basin
number 2;
V 4. Both Infiltration basin supplements are filled out by hand. These are the new interactive supplements and
they have to be filled out electronically and than printed out. Please provide new ones;
5. Provide two sets of signed and sealed corrected sheets and documents.
The above requested information must be received in this office prior to January 1, 2007 or your
application will be returned as incomplete. The return of this project will necessitate resubmittal of all required
items including the application fee. If you need additional time to submit the required information, please mail
or fax your request for time extension to this office at the Letterhead address.
You should also be aware that the Stormwater Rules require that the permit be issued prior to any
development activity. Construction without a permit is a violation of 15A NCAC 21-1.1000 and North Carolina
General Statute 143-215.1 and may result in civil penalties of up to $10,000 per day.

Stormwater Management Plan
Design Narrative
November 4, 2007
The above referenced project is a redevelopment of an existing Real estate office into a financial
bank with bank offices on the second floor and leased offices on the third floor, with associated
parking and infrastructure. The site is located off of US Highway 158 in Kitty Hawk, Dare
County, North Carolina.
The stormwater management plan is broken down into two sub -drainage areas. The first consists
of an infiltration basin near the corner of US 158 and First Flight Run. This infiltration basin
recieves runoff from the eastern and northern portion of the proposed building and a small
portion of asphalt near the entrance to the site from First Flight Run. The Second Drainage area
consists of an infiltration building at the rear (western edge) of the property. This basin receives
runoff from the remainder of the proposed building and the majority of the asphalt/curbing from
the site. Stormwater runoff from proposed impervious surfaces will be conveyed to the
stormwater retention system via a combination of sheet flow and stormwater catch basins/pipes.
The proposed Stormwater management system also incorporates pipes to provide hydraulic
connections, providing equalization of the basins. The entire system provide in excess of the ten
year two hour storm, conservatively assuming that 95% of all stormwater is conveyed to the
proposed basin system. Stormwater in excess of the proposed detention basins capacity will
overflow out of catch basins at the entrance to the site off of US Highway 158 and into the
NCDOT highway drainage system adjacent to U.S Highway 158. The soils present at the site
(Newhan Fine Sand) provide very high rates of infiltration which are more than adequate to meet
the criteria for the required draw down of the basins. Listed depths to the seasonal high water
table for Newhan fine sands are listed in the UDSA's Soil Survey of Dare County North Carolina
as in excess of six feet below the land surface. Soil borings conducted at the site agreed with this
published data Based on existing elevations at the site and both published and soil boring
information, a seasonal high water table elevation of 3.5 msl (NAVD 88 datum) was calculated
and used for design purposes.

Branch, located off of U.S. 158 (Croatan Highway), Kitty Hawk, Dare County,

The above site was visited by representatives of Landmark Engineering & Environmental, P.C.
to obtain information on soil profile characteristics in selected areas throughout the site. The
findings are as follows:
The soils in site area are mapped on the attached Figure 1 which is a portion of sheet 3 of
the USDA Soil Conservation Service's, "Soil Survey of Dare County North Carolina".

Based on site investigations, the soils are consistent with the soil mapping in the USDA Soil
Conservation Service's, "Soil Survey of Dare County North Carolina". A Seasonal High Water
Table, (SHWT) elevation of 3.5' msl, (NAVD 88 Datum), was determined from a boring done
off site in a lower area, allowing a 6 foot augur to reach SHWT indicators and the static water
table.

Stormwater management. This checklist is intended to (1) assist the reviewers in maintaining consistency
during the review process and (2) facilitate communication between the reviewer and applicant. It is not
intended to replace information (including other lists) which may be part of the application form,
supplements, BMP manual or the regulations. Nor is it intended to bypass best professional judgement with
respect to the sufficiency of the information submitted.
This double sided page lists those items impacting "Application Completeness". "Project Types and
Supplements" follows the checklist and provides an overview of low density, general, and high density
projects and the associated supplement forms. The latest versions of all referenced forms and documents

PROJECT TYPES AND SUPPLEMENTS
A. Low Density: Supplement SWU-104 or SWU-105
Applicability:
• Low density projects may not result in built -upon surfaces in excess of 25% or 30%, depending on
the classification of the receiving stream. For calculating density with wetlands, see guidance
memo (reference document and location).
• In low density projects, stormwater is conveyed primarily via sheet flow and swales with limited
piping for under road conveyance. Curb outlet systems may also be used in a low density project.
• No area of the project may be configured such that it constitutes a pocket of high density. In other
words, if development is concentrated such that the undeveloped land does not significantly impact
treatment of the stormwater runoff from the developed or impervious surfaces, the low density
option may not be applied to the overall project.
• Low density projects must maintain a 30 foot wide vegetative buffer. That is, any impervious
surfaces must be at least 30 feet from surface waters, measured horizontally from the structure to
the mean high water line of the surface water.
• All swales and related vegetated slopes must be 3:1 (horizontal to vertical) or flatter.
• Regulatory References: NCAC Title 15A, 02H.1005, 02H.1008(g).
SWU-104 is required for low density projects for which lot subdivision and selling is intended. All
sections of the supplement should be completed including the built -upon area per lot calculation.
Deed restrictions are required.
SWU-105 is required for low density projects in which curb and gutters are incorporated. All sections
should be completed including swale design, Table 1. Supporting calculations should also be
supplied. The maintenance agreement contained within the supplement must be signed and
notarized.
B. General Permit: SWG01, SWG02, SWG03, SWG04
Applicability:
• General permits may be issued for certain groups of similar activities, including
(1) construction of single family residences (SWG01),
(2) bulkheads and boat ramps (SWG02),
(3) clearing and grading (SWG03), and
(4) linear utility projects (SWG04).
• For these types of projects, a Notice of Intent should be submitted. Upon review and approval, a
Certificate of Coverage will be issued covering the applicant under a general permit.
• Regulatory Reference: NCAC Title 15A, 02H.1013.
C. Hiah Density: SWU-102, SWU-103, SWU-106, SWU-107, SWU-108, SWU-109
General Considerations:
All runoff from the built -upon area shall be collected by swales, piping, or other means and directed
to an engineered stormwater control device or system. Runoff shall also be collected from
contributing off -site areas.
Wet ponds and infiltration basins and trenches are commonly utilized engineered stormwater
control devices. Other options include bioretention areas, extended dry detention basins,
stormwater wetlands, off -site systems, and innovative and alternative systems.
• All systems shall be designed to meet minimum criteria, as listed in the regulations, the supplement
and in accordance with the current version of the Water Quality Section Stormwater Best
Management Practices (BMP). The current BMP manual may be viewed through a link at

• All swales and related vegetated slopes shall be 3:1 (horizontal to vertical) or less steep.
• Operation and Maintenance plans are required for each engineered stormwater management
system. Plans are included in the respective supplements and they must be signed and notarized.
• For the purposes of operation and maintenance access, all stormwater management structures
shall be located within recorded drainage easements.
• Plans for engineered stormwater control systems shall be prepared and sealed by a professional
engineer.
• Supporting calculations must also be signed, dated and sealed.
• One supplement shall be submitted for each drainage area.
