The basic infrastructure was constructed by the permittee, but the project has now changed ownership. The Corps of Engineers has also recently updated the wetland jurisdictional determination on the property, which resulted in the need for a refinement of the site plan. We are therefore requesting approval for a State Stormwater Permit Name/Ownership Change, along with a minor modification to the development plan. A summary of the request follows: Ownership: The original permittee, Bentwater Development Group, LLC has agreed to the transfer. The Permit Name/Ownership Change Form has been signed by Ray E. Hollowell, Jr., Manager of Bentwater Development Group, LLC. The form has also been signed by the new owner, Kinnakeet Shores 16, LLC by its registered agent, William H. Cannon. Name: The project name will be changed from Pamlico Plantation to Kinnakeet Shores Phase 16. Modification/Refinement: The development plan is substantially the same as the plan that was approved in 2007, with 51 building sites oriented around the lake as previously proposed. A new wetland delineation resulted in the need to refine several of the building sites to avoid some jurisdictional wetland areas. As a result, the built- P.O. Box 1068 • 3512 N. A copy of the refined site plan that the updated tabulation is based on is also included. Certification: We have prepared an as -built survey and partial engineering certification that covers the basic site infrastructure. Water and sewer lines, roadways, collector swales, the lake and its outlet control pipes have been constructed, and the project is now ready for the commencement of individual site development for the 51 homes. This permit is effective only with respect to the nature and volume of stomwater described in the application and other supporting data. 2. This stonmwater system has been approved for the management of stormwater runoff as described on page 3 of this permit, the Project Data Sheet 3. A maximum of 324,143 sf (See Attachment "A") of built upon area is allowed on this 22.87 acre site. 4. All stormwater collection and treatment systems must be located in either dedicated common areas or recorded easements. The final plats for the project will be recorded showing all such required easements, in accordance with approved plans. 5. In addition, the Director may determine that other revisions to the project should require a modification to the permit 9. The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made. 11. SCHEDULE OF COMPLIANCE The permittee will comply with the following schedule for construction and maintenance of the stormwater management system. a. The stormwater management system shall be constructed in its entirety, vegetated and operational for its intended use prior to the construction of any built -upon surfaces except roads. b. During construction, erosion shall be kept to a minimum and any eroded areas of the system will be repaired Immediately. 2. The facilities must be propedy maintained and operated at all times. The approved Operation and Maintenance Plan must be followed in its entirety and maintenance must occur at the scheduled intervals. 3. The permittee shall at all times provide the operation and maintenance necessary to assure the permitted stormwater system functions at optimum efficiency including, but not limited to: a. Semiannual scheduled inspections (every 6 months) b. Sediment removal C. Mowing and revegetation of side slopes d. Immediate repair of eroded areas e. Maintenance of side slopes in accordance with approved plans and specifications f. Debris removal and unclogging of outlet structure, orifice device and catch basins and piping. 4. Records of maintenance activities must be kept and made available upon request to authorized personnel of DWQ. The records will indicate the date, activity, name of person performing the work and what actions were taken. 5. This permit shall become voidable unless the facilities are constructed in accordance with the conditions of this permit, the approved plans and specifications, and other supporting data. 6. Upon completion of construction and prior to operation of this permitted facility, a certification must be received from an appropriate designer for the system installed certifying that the permitted facility has been installed in accordance with this permit, the approved plans and specifications, and other supporting documentation. This permit is not transferable. In the event there is a desire for the facilities to change ownership, or there is a name change of the Permittee, a formal permit request must be submitted to the Division of Water Quality accompanied by an application fee, documentation from the parties Involved, and other supporting materials as may be appropriate. The approval of this request will be considered on its merits and may or may not be approved. 2. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to enforcement action by the Division of Water Quality, in accordance with North Carolina General Statute 143- 215.6(a) to 143-215.6(c). 3. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances which may be imposed by other government agencies (local, state, and federal) which have jurisdiction. 4. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Permittee shall take immediate corrective action, including those as may be required by this Division, such as the construction of additional or replacement stormwater management systems. 5. The permit may be modified, revoked and reissued or terminated for cause. The filing of a request for a permit modification, revocation and reissuance or termination does not stay any permit condition. 6. The Pemnittee, at least six (6) months prior to the expiration of this permit, shall submit in writing a request for an extension along with appropriate application fee. This permit is effective only with respect to the nature and volume of stormwater described in the application and other supporting data. 2. This stormwater system has been approved for the management of stormwater runoff as described on page 3 of this permit, the Project Data Sheet. 3. A maximum of 324,143 sf (See Attachment "A") of built upon area is allowed on this 22.87 acre site. 4. All stormwater collection and treatment systems must be located in either dedicated common areas or recorded easements. The final plats for the project will be recorded showing all such required easements, in accordance with approved plans. 5. Approved plans and specifications for this project are incorporated by reference and are enforceable parts of the permit. In addition, the Director may determine that other revisions to the project should require a modification to the permit. 9. The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made. It. SCHEDULE OF COMPLIANCE The permittee will comply with the following schedule for construction and maintenance of the stormwater management system. a. The stormwater management system shall be constructed in its entirety, vegetated and operational for its intended use prior to the construction of any built -upon surfaces except roads. b. During construction, erosion shall be kept to a minimum and any eroded areas of the system will be repaired immediately. The facilities must be properly maintained and operated at all times. The approved Operation and Maintenance Plan must be followed in its entirety and maintenance must occur at the scheduled intervals. 3. The permittee shall at all times provide the operation and maintenance necessary to assure the permitted stormwater system functions at optimum efficiency including, but not limited to: a. Semiannual scheduled inspections (every 6 months) b. Sediment removal C. Mowing and revegetation of side slopes d. Immediate repair of eroded areas e. Maintenance of side slopes in accordance with approved plans and specifications f. Debris removal and unclogging of outlet structure, orifice device and catch basins and piping. 4. Records of maintenance activities must be kept and made available upon request to authorized personnel of DWQ. The records will indicate the date, activity, name of person performing the work and what actions were taken. 5. This permit shall become voidable unless the facilities are constructed in accordance with the conditions of this permit, the approved plans and specifications, and other supporting data. 6. Upon completion of construction and prior to operation of this permitted facility, a certification must be received from an appropriate designer for the system installed certifying that the permitted facility has been installed in accordance with this permit, the approved plans and specifications, and other supporting documentation. A copy of the approved plans and specifications shall be maintained on file by the Permittee for a minimum of five years from the date of the completion of construction. III. GENERAL CONDITIONS 1. This permit is not transferable. In the event there is a desire for the facilities to change ownership, or there is a name change of the Permittee, a formal permit request must be submitted to the Division of Water Quality accompanied by an application fee, documentation from the parties involved, and other supporting materials as may be appropriate. The approval of this request will be considered on its merits and may or may not be approved. 2. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to enforcement action by the Division of Water Quality, in accordance with North Carolina General Statute 143- 215.6(a) to 143-215.6(c). 3. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances which may be imposed by other government agencies (local, state, and federal) which have jurisdiction. 4. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Permittee shall take immediate corrective action, including those as may be required by this Division, such as the construction of additional or replacement stormwater management systems. 5. The permit may be modified, revoked and reissued or terminated for cause. The filing of a request for a permit modification, revocation and reissuance or termination does not stay any permit condition. 6. The Permittee, at least six (6) months prior to the expiration of this permit, shall submit in writing a request for an extension along with appropriate application fee. Post Office Box 1068 Kitty Hawk, North Carolina 27949 Re: Storm Water Modeling Pamlico Preserve Residential Group Development Avon Township, Dare County, North Carolina Protocol Project No. 07-28 Dear Mr. Bissell: The subject property will capture storm water in a proposed lake that will be created via dredging and is located in the central portion of the project. The drainage basin area has been determined to be 877, 253 ftz or 20.14 acres. The total design volume of storm water to be captured and transmitted by the basin is 41, 670 ft' or 31 I, 710 gallons. The ability of the basin to receive and transmit the storm water volume during the required 24-hour period and be able to perform this is of concern to the Division of Water Quality. Protocol Sampling Service, Inc. has modeled the impact of the storm water on the basin and the expected recovery time. Aquifer testing conducted in July 1986 on the project revealed a highly transmissive aquifer of 6,490 ftz/day with a aquifer thickness of 75-feet. The aquifer coefficients from the 24-hour aquifer test was entered into the Artificial Recharge computer program authored by Dave Molder, D.K. Sunada and Jim Warner with Colorado State University also known as the Colorado Mound Model, (January 1984). The storm water basin with an infiltration volume capacity of 265,725 ft' will dispose a 1.5-inch rainfall volume of 311,710 gallons over a 24-hour period at a rate of 1.17 gpd/ft'. The attached results printout shows that this volume will create a mound height of 0.705 feet in the center of the basin, 0.666 feet 100-feet from the center and 054 feet 200-feet from the center of the basin or the outer edge of the basin. The extremely high nansmissivity of the underlying sands accounts for the low mound height and quick dissipation of the storm water mound. The specific yield was entered as 0.15 (sand ranges from .10 to .30) and the distance to the nearest stream (Pamlico Sound) was entered as 1000 feet. Developmental activities will result in the project being permitted pursuant with Rule .1003 (d)(2), High Density Projects, with proposed built -upon area of 25% or greater, with best management practices being employed via; grassed swales and a wet detention basin. The intent of this application, to the maximum extent possible, is to employ best management practices for all proposed developmental activities. The 20.14-acre development area is located on the west side of NC 12, approximately 1,000 feet from the intersection of NC 12 and Kinnakeet Blvd. in Avon Township of Dare County, North Carolina. The proposed developmental activities will consist of the construction of approximately 1,100 lineal feet of asphalt roadway, drainage; and utility infrastructures to service the (51) unit single-family residential group development. In addition, a proposed 25-foot deep lake with approximately 265,725 square feet surface area and perimeter bulkhead is planned for the center of the property. David E. Meyer, L.S.S. of Protocol Sampling Service Inc., conducted an on -site visit in May 2007 to investigate the existing groundwater profiles through on -site soil borings. Based on the investigation of the soil profiles taken in the location of the proposed lake it was discovered that the seasonal high water table is 12" to less than 12" below the existing ground surface. Site soils are mainly composed of Corolla and Duckston fine sands on flats and small hummocks, well to poorly drained surface soils over a sandy subsoil (as per-Dafe County Soil Survey Manual dated 1979). The site can be described as being nearly level with moderate vegetation concentrated along the upland areas of the tract. High ground area is located along the perimeter of the property. Isolated "404" wetlands are located in the center of the property and encompass a majority of the tract area. The site is currently undeveloped with the exception of an existing improved roadway (Portside Drive) to access the developed areas to the south. All developmental activities are to be designed in conformity with the requirements for application and issuance of pen -nits for stonmwater management systems in pursuant with rules .1003 and .1005 in accordance with G.S. 143-215.1 and 15A NCAC 2H .0200 as set forth. These requirements are designed to control pollutants associated with Stormwater runoff applicable to development of land for residential, commercial, industrial, or institutional uses. The developmental activities described herein were designed in compliance with the requirements as set forth for stormwater management within coastal counties Rule .1005, section 2, subparagraph B: (i) No direct outlet channels or pipes to SA waters unless permitted in accordance with 15A NCAC 2 H .0126; (ii) Control systems must be infiltration systems designed in accordance with Rule .1008 of this section to control the runoff from all surfaces generated by one and one-half inches of rainfall. Alternatives as described in Rule .1008(h) of this section may also be approved if they do not discharge to surface waters in response to the design storm; (iii) Runoff in excess of the design volume must flow overland through a vegetative filter designed in accordance with Rule .1008 of this section with a minimum length of 50 feet measured from mean high water of SA waters. Design of the active stormwater management measures are based on the design criteria indicated in . I008(e) Wet Detention Pond Requirements and .1008(h) Alternative Design Criteria, under the NCDENR Division of Water Quality Administrative Code for Stormwater Management, 15A NCAC 2H.1000. The proposed developmental activities will consist of those improvements previously described in the Proposed Development section above. Based upon the existing topography of the tract, the entire post development area will be located within one watershed, (please reference attachment B for Drainage Area Delineation). Runoff from the roadway improvements will sheet flow off into the adjoining R/W swales that will convey the stormwater to a proposed lake located at the center of the development. Property line swales will also be constructed between all proposed building pads, to direct runoff from the undeveloped lots to the R/W swales and proposed lake. Riprap inlet protection will be placed at each basin inlet, and all culvert and flume irdets/outlets for velocity dissipation and to aid in sediment removal. The proposed lake at the center of the site will serve as a wet detention basin. Due to the large surface area of the pond, there will not be a need for a forebay section. The lake will be able to remove 100% of total suspended solids and will accommodate approximately 6.25 times the required runoff from a 1.5" rainfall event or approximately 9.5 inches of rainfall. In the case of a storm event exceeding 9.5 inches of rainfall, runoff from the lake will exit through the emergency outlets at the southern end of the lake. Again, it is the intent of this design to provide adequate pollutant filtration measures from stormwater runoff resulting from the proposed high -density pocket created with this development. Measures were designed, to the maximum extent possible, to treat runoff from the proposed development in accordance with best management practices and to provide sufficient protection to the adjoining surface waters. Stormwater runoff from all impervious surfaces will receive a form of pollutant and sediment removal as described in best management practices. The following information is in conformance with the regulations as specified for high -density development: 1) Proposed impervious coverage of 36.95% over the development area. 2) Provision of vegetated right-of-way and property line swales to collect and transport stormwater runoff from all impervious surfaces. 3) Provision of a proposed lake for temporary stormwater storage for the design storm event in conjunction with 100% pollutant removal. SITE HISTORY AND PHYSICAL CHARACTERISTICS The tract is currently being developed as a residential subdivision in Avon, North Carolina. Protocol Sampling Service, Inc. of Raleigh, North Carolina was hired to perform a cursory investigation to identify the depth to seasonal high water table and if any restrictive layers are present in the proposed location of the storm water pond. SOIL INVESTIGATION The field survey was conducted on May 16, 2007. Seven (7) soil borings were advanced to between 18 inches and 24 inches below the land surface (bls) with a hand auger through the interior of the proposed storm water retention pond. Soil color was determined with a Munsell Soil Color Chart. The presence of fill or other disturbances, the depth to the seasonal high water table, soil structure and consistence were noted. All boring locations were marked in the field using the Site Plan as a guide. The borings were also checked for reduced colors, an anaerobic smell or obvious soil wetness. FINDINGS • The soil was found to have a depth to seasonal high water table of between 12 to <12-inches from north to south across the proposed pond (see attached Site Plan). Obvious signs of prolonged saturation were observed such as a dark surface horizon, mucky texture and gleyed color. • The static water table was measured in each borehole 1 hour after advancement. The water table was found at depths of <12 inches bls in each borehole. • The estimated infiltration rate through the soil surface is expected to exceed I inch/hour. Low Density: Supplement SWU-104 or SWU-105 Applicability: • Low density projects may not result in built -upon surfaces in excess of 25% or 30%, depending on the classification of the receiving stream. For calculating density with wetlands, see guidance memo (reference document and location). In low density projects, stormwater is conveyed primarily via sheet flow and swales with limited piping for under road conveyance. Curb outlet systems may also be used in a low density project. • No area of the project may be configured such that it constitutes a pocket of high density. In other words, if development is concentrated such that the undeveloped land does not significantly impact treatment of the stormwater runoff from the developed or impervious surfaces, the low density option may not be applied to the overall project. Low density projects must maintain a 30 foot wide vegetative buffer. That is, any impervious surfaces must be at least 30 feet from surface waters, measured horizontally from the structure to the mean high water line of the surface water. • All swales and related vegetated slopes must be 3:1 (horizontal to vertical) or flatter. • Regulatory References: NCAC Title 15A, 02H.1005, 02H.1008(g). SWU-104 is required for low density projects for which lot subdivision and selling is intended. All sections of the supplement should be completed including the built -upon area per lot calculation. Deed restrictions are required. SWU-105 is required for low density projects in which curb and gutters are incorporated. All sections should be completed including swale design, Table 1. Supporting calculations should also be supplied. The maintenance agreement contained within the supplement must be signed and notarized. B. General Permit: SWG01, SWG02, SWG03, SWG04 Applicability: • General permits may be issued for certain groups of similar activities, including (1) construction of single family residences (SWG01), (2) bulkheads and boat ramps (SWG02), (3) clearing and grading (SWG03), and (4) linear utility projects (SWG04). • For these types of projects, a Notice of Intent should be submitted. Upon review and approval, Certificate of Coverage will be issued covering the applicant under a general permit. • Regulatory Reference: NCAC Title 15A, 02H.1013. C. High Density: SWU-102, SWU-103, SWU-106, SWU-107, SWU-108, SWU-109 General Considerations: All runoff from the built -upon area shall be collected by swales, piping, or other means and directed to an engineered stormwater control device or system. Runoff shall also be collected from contributing off -site areas. Wet ponds and infiltration basins and trenches are commonly utilized engineered stormwater control devices. Other options include bioretention areas, extended dry detention basins, stormwater wetlands, off -site systems, and innovative and alternative systems. • All systems shall be designed to meet minimum criteria, as listed in the regulations, the supplement and in accordance with the current version of the Water Quality Section Stormwater Best Management Practices (BMP). The current BMP manual may be viewed through a link at http://h2o.enr.state.nc.us/su/Forms Documents Main.htm • All swales and related vegetated slopes shall be 3:1 (horizontal to vertical) or less steep. • Operation and Maintenance plans are required for each engineered stormwater management system.
