Stormwater Permit SW7070619 for a stormwater treatment system consisting of a wet
detention pond to serve a proposed Keep It Simple Suites located on Commerce Drive
in Elizabeth City, NC expires on December 7, 2021. This is a reminder that permit
renewal applications are due 180 days prior to expiration. We do not have a record of
receiving a renewal application.
If you wish to maintain this permit, please submit a completed permit renewal
application along with a $505.00 fee for permit renewal. Permit application forms for
renewal can be found on our website at: https://deq.nc.gov/about/divisions/energy-
mineral-and-land-resources/stormwater/stormwater-program/post-construction-2. North
Carolina General Statutes and the Coastal Stormwater rules require that this property
be covered under a stormwater permit if it is built. If the project has not been built, you
may request that the permit be rescinded.

This office received a Coastal Stormwater permit application and plans for the subject project on June 19,
2007. A preliminary review of your project Indicates that before a State Stormwater permit can be Issued the
following additional Information Is needed:
✓1. The submitted application lists the owner as CAO Development. Included in the submittal was a letter
from the North Carolina Secretary of State indicating the owner is CAO Properties, LLC. Please
clarify and list the correct owner on the application.
✓2. The small diameter orifice on the pond outlet structure should have some type of screen to prevent
dogging.
3. Page C3.3 of the plans shows details at several cross sections of the pond. Please Indicate on the
plan view the location of these cross sections. The forebay weir cross section does not appear to be
correct. The top of the underwater berm separating the forebay from the main pond should be
approximately one foot below the permanent pool elevation.
y 4. The vegetated shelf around the pond should be a minimum of 10 feet wide on all sides of the pond.
.-5. The landscaping plan for a wet detention pond should provide specifications for the selection of
vegetation, its installation, and the post -Installation care for the vegetated shelf and the side slopes.
The vegetated shelf should contain several diverse species of shallow water and shallow land
vegetation. Cattails are a dominant species and should not be proposed.
The above requested information must be received in this office prior to September 16, 2007 or your
application will be returned as Incomplete. The return of this project will necessitate resubmittal of all required
Items including the application fee. If you need additional time to submit the required Information, please mail or
fax your request for time extension to this office at the Letterhead address.
You should also be aware that the Stormwater Rules require that the permit be Issued prior to any
development activity. Construction without a permit is a violation of 15A NCAC 2H.1000 and North Carolina
General Statute 143-215.1 and may result in civil penalties of up to $25,000 per day,
if you have questions, please feel free to contact me at (252) W-3923.

The purpose of this report is to aid in the design and construction of the BMP facilities that is to
be located at Section B of the Pasquotank County Commerce Park in Providence Township,
North Carolina. The infiltration basin is planned to be placed at the northeast corner between
the intersection of Executive Drive North and Commerce Drive. The basin is approximately 375
ft long and 60 ft wide at grade level.
Field Exploration
The field exploration consisted of pet -forming two hand auger probes to depths of about 9 to 10
feet, utilizing a 3-inch diameter auger bucket. The auger was advanced into the ground generally
in 6-inch intervals and samples were extracted for visual inspection to determine the general soil
types. Locations of the hand auger borings are shown in Appendix 1.
Soil Classification and General Subsurface Conditions
An experienced geotechnical engineer classified each soil sample on the basis of visual -manual
procedures in accordance with ASTM Designation: D 2488. Representative soil samples from
the test borings were subjected to sieve analysis, liquid and plastic limit tests in order to
substantiate the visual classifications. The group symbols for each soil type based on the Unified
Soil Classification System (USCS) are indicated in parentheses following the soil descriptions on
the boring logs. The geotechnical engineer grouped the various soil types into the major zones
noted on the boring logs. The stratification lines designating the interfaces between earth
materials on the boring logs are approximate; in situ, the transitions may be gradual. A brief
explanation of the USCS, as well as a Reference Notes for Boring Logs sheet, are provided in
Appendix III of this report.

The result of our field explorations indicated that the BMP site was generally covered by
approximately 6 inches of topsoil. Underlying the topsoil, we encountered a layer of sandy to
clayey SILT (ML) approximately to a depth of I to 3 fi below the ground surface. Below this
layer, we encountered a layer of CLAY (CUCH) approximately to a depth of to 5 ft below the
existing grade.
Underneath this layer, we found a 1 ft thick SILT (ML) layer. Below this silt layer, we
encountered a layer of silty SAND (SM) to the end of probing depth of 9 to 10 ft. More detailed
subsurface conditions are provided on boring logs in Appendix 1I.
The water table was found to be at 5 6 and 5.7 ft below the ground surface at the completion of
drilling; and 5.4 and 5.0 ft below the ground surface, 48 hours after the completion of drilling.
This water table can vary depending on seasonal variation. We believe that the highest water
table elevation could be 3.0 feet below the ground surface.
BMP Recommendations
The geotechnical engineer also classified the soil profiles into hydrologic soil groups. This
classification was based on textures of soil according to NRCS National Engineering Handbook-
4, Appendix A: Hydrologic Soil Groups. Each of the soil layers was assigned to a hydrologic
soil group, and its approximate runoff potential and range of infiltration rate was provided based
on this reference in the following Table. Reference notes on Hydrologic Soil Groups are
provided in Appendix WV

It is strongly advised that infiltration tests be carried out with an infiltrometer at the proposed
bottom of the infiltration basin in the design and sizing of the BB4P. Since the actual infiltration
rate may vary from test results and may also decrease over time due to soil bed consolidation or
the accumulation of sediments from the storm water, a factor of safety of 2 should be applied to
the tested infiltration rate to determine the design infiltration rate.

Construction Considerations
Precaution should be taken to prevent soil underlying the infiltration basin from compaction by
construction equipment. Basin should be excavated with light earth moving equipment,
preferably, with tracks or over -sized tires located outside the basin bottom.
Once the basin's final construction phase is reached, the floor of the basin should be deeply tilled
with a rotary tiller or disc harrow and smoothed over with a leveling drag or equivalent grading
equipment.

This report has been prepared in order to aid in the evaluation of the BMP site and to assist the
Contractor, Architect and Engineer in the design and planning of the BMP. The report scope is
limited to the specific project and location described, and the project description represents our
understanding of the significant aspects relevant to soil and foundation characteristics.

Appendix A Hydrologic Soil Groups
Soils are classified into hydrologic soil groups (HSG's)
to indicate the minimum rate of infiltration obtained for
bare soil after prolonged wetting. The HSG's, which are
A, B, C, and D, are one element used in determining
runoff curve numbers (see chapter 2) For the conve-
nience of TR-55 users, exhibit A-1 lists the HSG classifi-
cation of United States soils.
The iiTiltration rate is the rate at which water enters the
soil at the soil surface It is controlled by sin face condi-
tions HSG also indicates the transmission rate —the rate
at which the water moves within the soil. This rate is
controlled by the soil profile Approximate numerical
ranges for transmission rates shown in the HSG defini-
tions were first published by Musgrave (USDA 1955).
The four gn oups are defined by SCS soil scientists as
follows:
Group Asoils have low runoff potential and high infil-
tration rates even when thoroughly wetted They consist
chiefly of deep, well to excessively drained sand or
gravel and have a high rate of water transmission
(greater than 0.30 in/lu)
Disturbed soil pros isles
As a result of urbanization, the soil profile may be con-
siderably altered and the listed group classification may
no longer apply. In these chcumstances, use the follow-
ing to determine HSG according to the texture of the
new surface soil, provided that significant compaction
has not occurred (Brakensiek and Rawls 1983).
Group Bsoils have moderate infiltration rates when
thoroughly wetted and consist chiefly of moderately
deep to deep, moderately well to well drained soils with-,
moderately fine to moderately coarse textures. T9nese
soils have a moderate rate of water transmission (015-
0.30 in/hi)
Group Csoils have low infiltration rates when thot-
oughly wetted and consist chiefly of soils with a layer
that impedes downward movement of water and soils
with moderately fare to fire texture These soils have a
low rate of water transmission (0.05-0.15 in/hr).
Group Dsoils have high runoff potential_ They have
very low infiltration rates when thorougly wetted and
consist chiefly of clay soils with a high swelling poten-
tial, soils with a permanent high water table, soils with a
claypan or clay layer at or near the surface, and shallow
soils over nearly impervious material- These soils have a
very low rate of water transmission (0-0.05 inr/lu).
In, exhibit A-1, some of the listed soils have an added
modifier; for example, "Abrazo, gravelly," Tlus refers to
a gravelly phase of the Abrazo series that is found in
SCS soil map legends

Some soils in the list are in gr oup D because of a high
water table that et eaLes a drainage problem Once these
soils are effectively drained, they are placed in a differ-
ent group. For example, Ackerman soil is classified as
A/D. This indicates that the drained Ackerman soil is in
group A and the undrained soil is in group D.

This office received a Coastal Stormwater permit application and plans for the subject project on June 19,
2007. By letter dated August 16, 2007 additional information was requested. On September 13, 2007 a response
to the August 16, 2007 letter was received from your consulting engineer. This response has been reviewed and
before a State Stormwater permit can be issued the following additional information is needed:
1. Item # 4 of our August 16, 2007 stated that the vegetated shelf around the pond should be a
minimum of 10 feet wide on all sides of the pond. The letter of response from your consultant
received September 13, 2007 stated that the shelf was revised to 12 feet. However the cross section
'C — C' of the pond shown on page C3.3 of the revised plans still shows a 6:1 shelf that is only 6 feet
wide. Please revise plans.
2. The revised plan submitted September 13, 2007 shows a revised pond configuration that now has a
forebay that is approximately 63% of the total pond volume. The forebay should be approximately
20% of the pond volume at permanent pool elevation. Please revise.
The above requested information must be received in this office prior to December 21, 2007 or your
application will be returned as incomplete. The return of this project will necessitate resubmittal of all required
items including the application fee. If you need additional time to submit the required information, please mail or
fax your request for time extension to this office at the Letterhead address.
You should also be aware that the Stormwater Rules require that the permit be issued prior to any
development activity. Construction without a permit is a violation of 15A NCAC 21-1.1000 and North Carolina
General Statute 143-215.1 and may result in civil penalties of up to $25,000 per day.

2007. A preliminary review of your project indicates that before a State Stormwater permit can be issued the
following additional information is needed:
1. The submitted application lists the owner as CAO Development. Included in the submittal was a letter
from the North Carolina Secretary of State indicating the owner is CAO Properties, LLC. Please
clarify and list the correct owner on the application.
2. The small diameter orifice on the pond outlet structure should have some type of screen to prevent
clogging.
3. Page C3.3 of the plans shows details at several cross sections of the pond. Please indicate on the
plan view the location of these cross sections. The forebay weir cross section does not appear to be
correct. The top of the underwater berm separating the forebay from the main pond should be
approximately one foot below the permanent pool elevation.
4. The vegetated shelf around the pond should be a minimum of 10 feet wide on all sides of the pond.
5. The landscaping plan for a wet detention pond should provide specifications for the selection of
vegetation, its installation, and the post -installation care for the vegetated shelf and the side slopes.
The vegetated shelf should contain several diverse species of shallow water and shallow land
vegetation. Cattails are a dominant species and should not be proposed.
The above requested information must be received in this office prior to September 16, 2007 or your
application will be returned as incomplete. The return of this project will necessitate resubmittal of all required
