Dear Mr. Jeffreys:
A Division of Energy, Mineral, and Land Resources file review has determined that
Stormwater Permit SW7060806 for a stormwater treatment system consisting of a wet
detention pond and a bioretention basin serving what was Atlantic Beverage located at
1702 Red Robin Lane, New Bern, NC expired on February 5, 2021. Renewal
applications were due 180 days prior to expiration. A review of the Craven County tax
records shows that the property is currently owned by RAJDC NC Properties, LLC.
The Coastal stormwater rules and the NC General Statutes require a stormwater permit
for this project. Stormwater permits are not automatically transferred when property is
sold. The stormwater permit was originally issued to Atlantic Beverage, Inc. Please
submit a completed permit renewal application and a stormwater ownership transfer
application along with a $505.00 processing fee. Permit application forms for renewal
and ownership transfer can be found on our website at:

Coastal Stormwater rules require that this property be covered under a stormwater
permit. Failure to maintain a permit subjects the permittee'and landowner to
assessment of civil penalties.

This office received a Coastal Stormwater permit application and plans for the subject project on August
11, 2006. A preliminary review of your project indicates that before a State Stormwater permit can be issued the
following additional information is needed:
1. Clearly delineate drainage basins on plans and show routing of stormwater to each stormwater
treatment unit.
2.. Show location of and a detail of the bypass structure for the bioretention basin that will bypass storms
greater than I inch.
3. Please complete the enclosed bioretention supplement and O&M Agreement.
4. A planting soil depth of 18 inches appears to be too shallow for planting trees, please justify.
The above requested information must be received in this office prior to November 27, 2006 or your
application will be returned as incomplete. The return of this project will necessitate resubmittal of all required
items including the application fees. If you need additional time to submit the required information, please mail or
fax your request for time extension to this office at the Letterhead address.
You should also be aware that the Stormwater Rules require that the permit be issued prior to any
development activity. Construction without a permit is a violation of 15A NCAC 21-1.1000 and North Carolina
General Statute 143-215.1 and may result in civil penalties of up to $25,000 per day.
