On September 25, 2016, Chemtura Corporation ("Chemtura") entered into a merger
agreement with LANXESS Deutschland GmbH, a limited liability company under the laws of
Germany ("LANXESS"), and LANXESS Additives Inc., a Delaware corporation and an indirect,
wholly -owned subsidiary of LANXESS ("Merger Subsidiary"). On April 21, 2017 (the "Closing
Date"), the Merger Subsidiary merged with and into Chemtura, with Chemtura surviving the
merger. As a result of this transaction, Chemtura was renamed "LANXESS Solutions US Inc."
on or about the Closing Date.
This transaction does not affect the ownership or day-to-day operations of the above -
referenced facility. The legal entity formerly known as Chemtura Corporation will continue to
own and operate the facility after the Closing Date as a subsidiary of LANXESS and will
maintain the same Tax Identification Number (52-2183153).
Please update your records to identify LANXESS Solutions US Inc. as the owner,

Form and legal documentation of the name change. The agency has previously acknowledged

Chemtura holds an individual stormwater permit NCS000311 for the facility. Dee Browder of MRO inspected the facility in
January 2009 as part of their permit renewal process. Dee noted that the permittee was compliant with the permit
requirements but that representative outfall status should be granted.
The current permit in BIMS lists only one stormwater outfall to Catawba Creek. The permit requires monitoring for nitrate,
nitrite, total nitrogen, total phosphorous, and pH semi-annually. Robert Patterson of Stormwater Permitting is named as the
permit writer. Perhaps Robert could elaborate on whether potential groundwater contamination was a factor in the required
stormwater monitoring at the facility.
MRO can certainly inspect the facility's stormwater permit again but it appears it may more of an inactive hazardous waste
site issue due to residual contamination.

I responded to the initial email about this site so allow me to put in my two cents.
I don't think DNBP (4,6-Dinitro-2-sec-butylphenol, CAS No.:88-85-7) is made in the US anymore. I found about 25
suppliers/manufacturers in India and China. Bis(n-butyl)phtha late (DnBP), is used for cellulose plastics, food wraps, adhesives,
perfumes, cosmetics - about a third of nail polishes, glosses, enamels, and hardeners contain it, together with some
shampoos, sunscreens, skin emollients, and insect repellents.
Chemtura (a successor to Crompton & Knowles) filed for bankruptcy in March 2009 but is still operating; they've got about $2
billion in environmental cleanup liabilities nationwide. They're a multi -division company based in Connecticut.
EPA has two settlement agreements with them covering a total of 18 sites nationwide. This site in Gastonia is NOT one of
them but they have one nearby at the Jadco Hughes Superfund site in Belmont, NC. The company is listed as a large quantity
generator in NC.

Hello:
As a follow up to our previous communication several months ago regarding pollutants being covered up, I am providing
specific details of the exact location at the plant site where this pollution may be found. The address of the facility is 214 West
Ruby Ave., Gastonia, NC 28054. The company name is Chemtura Corporation.
Just outside the northwest exit of Building #4 there is an Employee Smoking Area (a metal carport). It is located on a gravel
covered area. When there is heavy rainfall the yellow DNBP seeps up from the ground. As the gravel sinks and settles it is
replaced with fresh gravel in order to keep people from seeing the yellow stained water.
Just east of this area, about 30 to 40 feet, there is an 8" to 12"
high wall where a railroad car pump station used to be. The yellow water is VERY evident here when it rains. A sample could
easily be taken for testing.
In the area where the railroad tracks used to be, there once sat two tank cars for years. These cars leaked DNBP waste water
and they were eventually pumped dry, cut up and disposed of. I feel certain the soil under the asphalt is contaminated.
There is a large storm water outfall area just north of these areas.
It is covered with rolls of roofing material and sealed with tar. This was not installed to prevent storm water from seeping into
the ground but to prevent the contaminated water from seeping up from the ground.
I understand that these are serious allegations and as such I do not take them lightly. I know for CERTAIN that management
has known about this for YEARS and has chosen only to cover up the problem.
I ask again for you to PLEASE keep all of this information strictly confidential as I have indeed made an issue of it several times
and I am certain that it will cost me my job if they figure out that someone has reported it. I have reported a few safety issues
within the past six months and so by doing this I am already on thin ice, so to speak.
I am the sole provider for my family (including small children) and losing my income would be financially devastating. If there
is any way to do a "random audit" of the facility and check these areas specifically it would be in my best interest.

WASHINGTON — The U.S. Environmental Protection Agency (EPA), the U.S. Justice Department, and the United States
Attorney for the Southern District of New York today announced that Chemtura Corporation has agreed to resolve its
liabilities at contaminated sites across the U.S. for approximately $26 million. The agreement settles Chemtura's
environmental liabilities under the Comprehensive Environmental Response, Compensation and Liability Act (CERCLA,
commonly known as Superfund), and for violations of the Clean Air Act (CAA), the Clean Water Act (CWA), and the
Emergency Planning and Community Right -to -Know Act (EPCRA).
Chemtura, based in Middlebury, Conn., is a giohal producer of specialty chemicals, polymer products, and crop protection
chemicals, and a leading U.S. supplier of pool and spa chemicals. The company operates in more than 40 countries and
its predecessors include Crompton & Knowles Corporation, Uniroyal Chemical Corporation, Witco Corporation, and Great
Lakes Chemical Corporation.
Chemtura and 26 of its affiliates filed for protec'ion under Chapter 11 of the U.S. Bankruptcy Code on March 18, 2009 in
the U.S. Bankruptcy Court for the Southern District of New York. At the time of bankruptcy filing, the company was
potentially responsible for cleanups at numerous Superfund sites, including remediation activities in the states of
Alabama, California, Connecticut, Delaware, Florida, Kentucky, Louisiana, Maryland, Mississippi, New Jersey, New York,
North Carolina, Pennsylvania, South Carolina and Texas.
Chemtura will pay approximately $26 million in cash and allowed claims for 17 properties, 12 of which are on EPA's list of
the most serious hazardous waste sites requiring cleanup. Much of the money paid to the United States will be used by
EPA to pay for future cleanup work; more than $8 million will be used to address environmental cleanup and restoration
work at the Diamond Alkali Superfund Site in New Jersey. Chemtura will continue to honor its cleanup work obligations at
the Laurel Park, Inc. Superfund Site in Naugatuck, Conn. The settlement agreement does not resolve Chemtura's
environmental liabilities arising out of the Gowanus Canal Superfund Site. Those liabilities, which are expressly excluded
from the scope of today's settlement, remain the subject of ongoing negotiation.
The settlement also resolves a claim for penalties under CERCLA, CAA, CWA and EPCRA due to violations stemming
from a May 2004 fire at Chemtura's Bio-Lab, Inc. facility in Conyers, Ga. The U.S. Treasury will receive approximately
$785,000 for these penalties.
The settlement agreement will be lodged with the bankruptcy court for a period of fifteen days before its entry to provide
public notice and to afford members of the public the opportunity to comment on the settlement.
