Julie and Chad:
I had our consultant inspect the one AST in the tank farm to confirm its status. The attached picture of the tank shows it
does not have a valve or piping on the bottom discharge line. The only piping on the tank is associated with a level
gauge.
Trex has sent a request to Detrex to rescind the NPDES permit. We are currently waiting on their response.

Having Detrex sigh the rescission request would be the simplest path. We wouldn't technically be able to rescind the
permit unless the owner (Detrex, in our records) requests it. But if that's not possible, it would still be good to have a
request from Trex, if only to document that Trex doesn't wish to keep the permit active. Rather than require Trex to go
through the motions of transferring ownership of the permit, only to then rescind it, we would just inactivate the
permit. This would have pretty much the same effect as rescission — the facility would not be shown as having an active
permit, so billing would cease, as would all the requirements associated with the expired permit.
Before we would proceed with rescission or inactivation of the permit, we would need to know that the stainless steel
AST was drained, as Chad pointed out.

To follow up on our conversation from a few minutes ago, please find attached the "Permit Rescission Form' for NPDES
industrial stormwater permits. If a company official with Detrex could complete this form, it would be helpful in
resolving the current Individual Stormwater Permit (NCS000213) still associated with this facility. Since the responsible
party for the facility has changed to Trex Properties, I'm not sure if any additional steps may need to be taken in the
permit rescission process. I've copied Julie Ventaloro with the Raleigh Permitting Office of the NCDEQ Division of
Energy, Mineral and Land Resources for additional input or guidance.
As we discussed, industrial activity has ceased at this property and current activities involve groundwater and soil
remediation. During my site visit I observed that all materials exposed to stormwater have been removed, with the
exception of the stainless steel AST that is located outdoors within the concrete secondary containment dike. Do you
have any documentation that this tank has been drained of its contents and decontaminated? Thank you again for your

The Detrex facility located at 3114, and 3124 Cullman Avenue is now owned by Trex Properties, LLC. To my knowledge,
the company is still solvent. Our contact for Trex is:

The AST that is still on site was not a permitted Hazardous Waste Storage Tank. Most likely, it was a product solvent
tank and should be empty at this time. Trex completed final closure of the hazardous waste operations at the facility in
June 2016. 1 suggest you contact David Craig with facility specific questions.

Hi Andrew,
I was recently contacted by the stormwater permitting office about the existing/expired NPDES permit
for the Detrex facility on Cullman Avenue in Charlotte. Ideally, the permitting office would like to close
out the permit with a rescission request submitted by the company. I spoke to Andrew Decristofaro
about the facility, and he was unsure if the company was still solvent at this time but recommended
contacting you for the current facility status and to see if you had contact info for the current facility
contacts.
Although this is a minor concern compared to what else is occurring on the property, I noticed that one
AST is still present on site within secondary containment. Do you know if the contents of this have been
cleared out?

Thanks, Chad. I'm not sure of the best way to move forward. I guess ideally, they would request a rescission of their
stormwater permit. Chad or Zahid — Do you know if there's a way to get a hold of the facility and recommend they
request rescission? I would just need verification from one of you that there really are no materials exposed to
stormwater remaining on the site.
If they don't request rescission, we can pursue revocation of their permit since they haven't paid fees and their permit is
expired. We generally prefer to have the permittee request rescission, but revocation is an option if we need it.

From my understanding, the facility has not been active from a production/recycling standpoint in at least three
years. You are correct about the current issues on site, as the site had significant soil and groundwater contamination of
PCE and TCE. We've been involved with sampling efforts of the adjacent receiving stream, Little Sugar Creek, where
we've found TCE levels well in excess of the WQ standards.
I've had limited involvement with this facility, but at last check the company was still solvent during the initial stages of
the clean-up process. In addition to administrative penalties, I think the facility is facing potential civil/criminal action
for intentionally dumping the materials on site.
From speaking to a coworker about the site this morning, it sounds like all items previously exposed to stormwater have
been removed from the site. I'm happy to look into the site further if you need any more detailed information.

I've got one more facility I'm looking into in Charlotte. Hoping you'll know something about it. NCS000213 Detrex
Corporation at 3114 Cullman Ave, Charlotte. We haven't had any communications with them in quite a while. Their
permit is long expired, and they are years overdue on fees. Online searching shows they've changed ownership. It also
appears as though there may be some ongoing issues with illegal abandoning of hazardous waste.
Do you know what's going on at that site? Still active?

Enclosed is a copy of the Follow-up Compliance Evaluation Inspection (CEI) report for the inspection
conducted at the subject facility on September 9, 2009, by Ms. Alivah Turner of Charlotte -Mecklenburg
Storm Water Services (CMSWS). This inspection was conducted as pan of cooperative working
agreement between Mecklenburg County and the Division of Water Quality. In addition, the inspection was
conducted on behalf of the City of Charlotte in compliance with the City's NPDES Permit. NCS0002401 Part
II Section Fl. Thank you for your assistance and cooperation during the follow-up inspection.
The follow-up inspection found that the Detrex Corporation facility has implemented the corrective actions
as stated in the subject facility's Notice of Violation response letter dated April 14, 2009. The corrective
actions include:
The permittee has removed the sink and piping from the facility, alleviating the illicit discharge that
was observed during the initial stortnwater inspection and
Updating and implementing the Stormwater Pollution Prevention Plan in compliance with the subject
facility's general stormwater permit.

Inspection Summary:
Facility Description.
The Detrex Corporation facility conducts collection and storage of hazardous waste materials. The facility has five
employees and operates five days a week, Monday - Friday, 8:00 am - 5:00 pm. The permittee conducts testing on
solvents before they are sent to be landfilled. All activities are conducted indoors and not exposed to stormwater.
Compliance History:
The permittee/facilitydoes not have any prior compliance issues with the INC Division of Water Quality. According to
Mecklenburg County Water Quality Program (MCWQP) files, on August 12, 1993, a spill occurred on site due to a
punctured drum. The material was cleaned up with absorbent pads and did not reach surface waters.
A stormwater Inspection was conducted on March 11, 2009 by Ms. Aliyah Turner of Charlotte - Mecklenburg Stormwater
Services (CMSWS). A Notice of Violation was issued on March 31, 2009 by the North Carolina Division of Water Quality.
Industrial Operations/City of Charlotte Stormwater Ordinance Review:
During the inspection, an illicit connection was observed. Further investigation of the illicit connection revealed that it was
a discharge pipe from the facility's sink in the storage area. All wastewater must be piped to the sanitary sewer system.
During the follow-up stormwater inspection on September 9, 2009, it was revealed that the permittee has removed the
sink and piping from the facility.

3. Impairment: Little Sugar Creek (11-137-8a, 11-137-8b, 11-137-8c) is on the 303(d). 11-137-8a is the closest
to the facility and is on the 303d list for Standard violation: Fecal Coliform and Impaired biological integrity.
11-137-8b for Standard violation: Fecal Coliform and Impaired biological integrity. 11-137-8c for Standard
violations: Fecal Coliform and Tubidity and Impaired biological integrity. Sources for each of the reaches
include Urban Runoff/Storm Sewers and Municipal.
The basinwide plan described the 03-08-34 watershed. The four streams (Irwin Creek [AU# 1 1-137-1], Little
Sugar Creek [AU# 11-137-8], McAlpine Creek [AU# 11-137-9a and 11-137-9c], Sugar Creek [AU# 11-137a
and 11-137b]) and their smaller tributaries collectively drain the metropolitan center of Charlotte in
Mecklenburg County. The watershed receives large amounts of point and nonpoint pollution from the urban
areas, severely impacting stream health in each of the streams. Similar habitat conditions are found at all
sample sites within this watershed, sand/silt substrate, Section B: Chapter 5 - Catawba River Subbasin 03-08-34
151 severe bank erosion, and disturbed or nonexistent riparian vegetation. Elevated levels of both fecal
coliform bacteria and turbidity indicate impairment by urban runoff and wastewater discharges in all four
streams. Water quality in general has remained low but stable over the last planning cycle. In 2002, declines
were noted on Sugar Creek (B-2) and Little Sugar Creek (B-3), but this decline was most likely due to the
severe drought. Sugar Creek has a TMDL for fecal coliform.
4. Threatened and Endangered: Based on the Natural Heritage Virtual Workroom there are no federally
endangered species near the facility and receiving stream.
5. Location: C stream
6. Industrial Changes Since Previous Permit: Detrex Corporation (DTRX) owns two buildings located at 3114 and
3124 Cullman Avenue. Prior to June of 2002, DTRX operated out of both buildings. As seen by the enclosed
figures with the application, the 3124 address is a warehouse for storing USDOT containerized products and
the 3114 address is utilized for the operation of the RCRA Part B Permit (TSDF).
In June of 2002, DTRX sold the product portion of its business and related transportation equipment to the
former president of the division. The transition from a single entity to two entities was seamless and did not
alter overall operations as they existed prior to the transfer. Former DTRX personnel now work for Parts
Cleaning Techologies (PCT). Under a management agreement PCT provides the manpower DTRX need to
operate its permit.
Detrex has and continues to operate under its RCRA Part B Permit (TSDF) at 3114 Cullman Ave. Under our
pennit, this site accepts, stores, and reclaims halogenated solvents via a distillation unit. In addition, the
Facility accepts and stores other hazardous, non-RCRA, non -hazardous, and other solid waste streams, in
conjunction with the TSDF operation. All wastes are contained within the building at 3114 Cullman Ave. or on
trailers located between the buildings. No wastes are disposed of on site. All activities associated with the
TSDF operations occur within the building except for the transfer of waste and product into the building under
applicable DOT regulations.
The new entity PCT, operates their local office out of 3124 Cullman Ave. for warehouse distribution DOT
containerized products, cleaning of parts supplied by customers, and as a base for their fleet associated with the
transportation of parts, products, and waste materials. They continue to sell process chemistry to companies
who clean their own parts using halogenated solvents. The main products sold by PCT are Trichloroethylene,
Tetrachloroethylene, and N-Propyl Bromie. The PCT also sells a very limited volume of 1,1,1-Trichloroethane,
as this material is no longer in production and the available supply is dwindling.

Bulk products sold by PCT continue to be stored at 3114 Cullman Ave due to the location of existing storage
tanks. Most bulk storage tanks are located inside of the building. The amount of material stored in the outside
tank farm has been reduced by decommissioning and in most cases removing the storage tanks. As of the
submission of this request for renewal of the NPDES permit, there is only on active storage tank remaining in
the diked lank fame. The outside tank is utilized by PCT for the storage of Tetrachloroethylene.
7. Analytical Monitoring Notes: No analytical monitoring was required in the previous permit.
The industry (SIC code 2899) is covered in the EPA Multi -Sector General Permit in Sector C but there are not
parameters recommended for monitoring. COD has been added to the monitoring as a potential pollutant.
8. Qualitative Monitoring Notes: Visual observations were done from 3/23/09 to 11/1 1/04. All of the entries say
"clear; no sheen, phase separation, discoloration, or strange odors."

Revised Permit Recommendations: Analytical Monitoring:
I . Adding COD as a parameter.
2. pH has been added to the analytical monitoring requirements.
3. All analytical monitoring has been set to semi-annually during a representative storm event as defined in Part II
Section B. The permittee must also document the total precipitation for each event. If no discharge occurs
during the sampling period, the permittee must submit a monitoring report indicating "No Flow" within 30 days
of the end of the six-month sampling period. Additionally, samples must be taken a minimum of 60 days apart,
as specified in Table 2.
4. Benchmarks for analytical monitoring have been added to this draft permit. Exceedances of benchmark values
require the permittee to increase monitoring, increase management actions, increase record keeping, and/or
install stormwater Best Management Practices (BMPs) in a tiered program. If the sampling results are above a
benchmark value, or outside of the benchmark range, for any parameter at any outfall then the facility shall
follow the Tier 1 guidelines which require a facility inspection within two weeks and implementation of a
mitigation plan within two months. If during the term of this permit, the sampling results are above the
benchmark values, or outside of the benchmark range, for any specific parameter at a specific discharge outfall
two times in a row (consecutive), then the facility shall follow the Tier 2 guidelines which require a repetition
of the steps listed for Tier 1 and also immediately institute monthly monitoring for all parameters at every
outfall where a sampling result exceeded the benchmark value for two consecutive samples.
5. The permittee is required to collect all of the analytical and qualitative monitoring samples during
representative storm events as defined in Part II Section B. Qualitative monitoring is required regardless of
representative outfall status.
6. The permittee is responsible for all monitoring until the renewal permit is issued. See Footnote.l of Tables 1,
4, and 5.
7. The flow reporting requirement has been removed per DWQ revised strategy. (The total rainfall parameter is in
this permit, however.)
8. Vehicle maintenance monitoring has been revised to semi-annually in order to coincide with analytical and
qualitative monitoring.
Other Proposed Changes to the Previous Permit:
l . Additional guidance is provided about the Site Plan requirements. The site map must now identify if the
receiving stream is impaired and if it has a TMDL established. It must also describe potential pollutants in each
outfall. The map requirements are stated more explicitly.' And, the site plan must contain a list of significant
spills that have occurred in the past three years and also must certify that the outfalls have been inspected to
ensure that they do not contain non-stormwater discharges. Additional information is provided in Part II
Section A.
2. Additional requirements for the Stornwater Management Plan have been specified in Part lI Section A. More
details regarding secondary containment are provided.
3. Additional requirements for the Stormwater Pollution Prevention Plan have been specified in Part II Section A.
The plan must also be updated annually to include a list of significant spills and to certify that the outfalls do
not contain non-stormwater discharges.
4. The facility must now implement a semi-annual Facility Inspection Program of the site's stormwater

Detrex Corporation (Detrex) has received your letter dated March 31, 2009 along with a copy of the
Compliance Evaluation Inspection (CEI) Report for the inspection conducted on our property on March
11, 2009. After a review of the various operations at the site and the Storm Water Pollution Prevention
Plan (SWP3) in operation at the time of the CEI, Detrex would like to provide the following responses to
concerns raised during the inspection.
Facility Description: As a clarification, while Detrex owns both 31 14 and 3124 Cullman Ave. it only
operates out of 31 14 Cullman Ave.
Detrex operates a Treatment Storage and Disposal Facility (TSDF) where hazardous and non -hazardous
wastes are received from offsite generators. Selected wastes are reclaimed on site via distillation while
others are shipped off site for processing and disposal; wastes are not sent to landfills. All wastes are
stored inside of buildings or in trailers with secondary containment.
Detrex leases 3124 Cullman Ave. to Parts Cleaning Technologies, LLC (PCT) for their operations. PCT
sells various solvents to dry cleaners and companies involved in metal cleaning operations. PCT also
cleans metal parts in an onsite vapor degreaser.
Although Detrex and PCT are separate entities, PCT provides the manpower to staff operations at the
TSD(: site. As both sites are owned by Detrex, and personnel from PCT are used to staff Detrex's
operations, a single SWP3 was developed for both locations.
All operations with the exception for the loading / unloading of bulk tankers are performed inside of the
buildings. Loading and unloading operations are performed in locations that have secondary containment
structures.
Industrial Operations: at the time of the inspection an illicit connection, a sink installed by a part time
employee, was observed. This illicit outfall was removed shortly after the inspection. To help ensure

future illicit connections are not installed, a review of general permit conditions and the Storm Water
Pollution Prevention Plan (SWP3) was addressed during a training session held the week of March 23`a
SWP3: Detrex is in the process of finalizing changes to the SWP3 in response to the CEI. While
portions of the revised SWP3 are already being used, full implementation of the revised plan will occur
no later than April 271h. The updated SWP3 will include a revised monitoring form, a site inspection form
specific to criteria required under the plan, a revised diagram showing the longitude and latitude of the
only site outfall, and a certification that the site has been inspected for illicit discharges.
Detrex however would like to point out that the SWP3 in place at the time of the inspection did
specifically address some non -compliant items noted in the CEI. Specifically the SWP3: required site
personnel to document qualitative monitoring prior to discharging water to the outfall (a requirement that
has been in place since the inception of the original SWP3 back in 1994), addressed the issues of
preventative maintenance and good housekeeping (although a specific inspection form was not included
in the plan), and had a site diagram showing the location of the outfall (the diagram however did not
indicate the oufall's latitude and longitude).
To demonstrate compliance with those portions of the SWP3, the following documents are being
provided in electronic format on the enclosed CD; All files are in PDF format: discharge forms for
calendar years 2006 through March of 2009, the original and updated site diagrams, a copy of the 1994
SWP3 (developed by ESE), and the initial application for the storm water permit.
Qualitative Monitoring: as Detrex specifically inspects every load of stormwater prior to discharge,
there is no need for a semiannual inspection. To ensure all criteria required under the semiannual
inspections are picked up during each inspection, the `stormwater discharge monitoring form' has been
revised to include all qualitative requirements.
In conclusion, the revisions being implemented under the revised SWP3 will ensure the site is in
compliance with all aspects of the discharge permit and it's SWP3. Detrex and PCT appreciate your

Mr. Benson,
Renewal of the Detrex permit coverage is much closer now than before. For the last 6
months we have been at full staff, and we have almost cleared up what was a very
delinquent backlog of individual permit renewals, of which Detrex was one of
approximately 150. Based on very good recent progress, I would expect Detrex to be
processed in the next three months.

Enclosed is a copy of the Compliance Evaluation Inspection (CEI) report for the
inspection conducted at the subject facility on March 11, 2009 by Ms. Aliyah Turner of
Charlotte -Mecklenburg Storm Water Services (CMS WS). This inspection was conducted as part
of a cooperative working agreement between Mecklenburg County and the Division of Water
Quality. In addition, the inspection was conducted on behalf of the City of Charlotte in
compliance with the City's NPDES Permit, NCS000240, Part II Section H. Thank you for your
assistance and cooperation during the inspection.
This report is being issued as a Notice of Violation (NOV) due to the permittee's failure
to implement the Stormwater Pollution Prevention Plan in violation of the subject Stormwater
Permit and North Carolina General Statute (G.S.) 143-215.1, as detailed in the Stormwater
Pollution Prevention Plan and Qualitative Monitoring sections of the enclosed report.
Pursuant to G.S. 143-215.6A, a civil penalty of not more than twenty-five thousand dollars
($25,000.00) may be assessed against any person who violates or fails to act in accordance with
the terms, conditions, or requirements of any permit issued pursuant to G.S. 143-215.1.

In addition, a housekeeping issue was observed during the inspection and a
recommendation regarding this issue is provided in the Industrial Operations/City of
Charlotte Stormwater Review section of the report.
It is requested that a written response be submitted to this Office by April 29, 2009,
addressing the above -noted violations in the enclosed report. In responding to the violations,
please address your comments to the attention of Ms. Allocco at the letterhead address.
The subject facility will have 90 days from the letterhead date to come into compliance
with the above -noted violations. A follow-up evaluation will be conducted by CMSWS no later
than June 29, 2009 to ensure compliance with the facility's Stormwater Permit and/or
compliance with the City of Charlotte Stormwater Ordinance.

Inspection Summary:
Facility Description:
The Detrex Corporation facility conducts collection and storage of hazardous waste materials. The facility has five
employees and operates five days a week, Monday - Friday, 5:00 am - 5:00 pm. The permittee conducts testing on
solvents before they are sent to be landfilled. All activities are conducted indoors and not exposed to stormwater.
Compliance History:
The permittee/facility does not have any prior compliance issues with the NC Division of Water Quality. According to
Mecklenburg County Water Quality Program (MCWQP) files, on August 12, 1993, a spill occurred on site due to a
punctured drum. The material was cleaned up with absorbent pads and did not reach surface waters.
Industrial Operations/City of Charlotte Stormwater Ordinance Review:
During the inspection, an illicit connection was observed. Further investigation of the illicit connection revealed that it was
a discharge pipe from the facility's sink in the storage area.
All wastewater must be piped to the sanitary sewer system.

Your facility is currently covered for stormwater discharge under NPDES Permit NCS000213. This permit expires
on June 30, 2005. North Carolina Administrative Code (15A NCAC 2H.0105(e)) requires that an application for
Permit renewal be filed at least 190 days prior to expiration of the current permit. In order to assure your continued
coverage under your permit, you must apply to the Division of Water Quality (DWQ) for renewal of your permit.
To make this renewal process easier, we are informing you in advance that your permit will be expiring. Enclosed
you will find an individual permit renewal application form, supplemental information request, and Stormwater
Pollution Prevention Plan certification.
Filing the application form along with the requested supplimental information will constitute your application for
renewal of your permit. As stated above, the application form must be completed and returned along with all
requested information by January 7, 2005 in order for the permit to be renewed by June 30, 2005.
Failure to request renewal by January 7, 2005 may result in a civil assessment of at least $500.00. Larger penalties
may be assessed depending on the delinquency of the request. Discharge of stormwater from your facility without
coverage under a valid stormwater NPDES permit would constitute a violation of NCGS 143-215.1 and could
result in assessments of civil penalties of up to $25,000 per day.

Failure to request renewal within the time period indicated may result in a civil assessment of at least S250.00.
