Dear Timothy Craig,
On March 31, 2021, Chris Smith of the NC Division of Water Resources (DWR) Water Quality
Regional Operations Section (WQROS) conducted an annual compliance inspection at the
subject swine farm. The following permit condition violations were noted at your facility.
Permit Condition III. Monitoring and Reporting Requirements 22. "The Permittee shall
conduct a survey of the sludge accumulation in all lagoons every year. The survey report should
be written on forms provided or approved by the Division and shall include a sketch showing the
depth of sludge in the various locations within each lagoon. This survey frequency may be
reduced if it can be demonstrated to the satisfaction of the Division that the rate of sludge
accumulation does not warrant an annual survey. -[15A NCAC 02T.0108(b) and .1304(b)J"
During the March 31, 2021 compliance inspection annual sludge survey documentation for
calendar year 2020 was not provided to DWR WQROS staff.
You are required to take any necessary action to assure that the above violations do not
re- occur in the future. You are required to provide a written response to this Notice,
including any additional information that you wish to provide related to this incident that
you wish for the Division to consider, within 30 days of receipt of this letter.
Failure to comply with conditions in a permit may result in a recommendation of
enforcement action, to the Director of the Division of Water Resources who may issue a civil
penalty assessment of not more than twenty-five thousand ($25,000) dollars against any
