Per our discussion, below is how we calculated the on -site mitigation credit for each site. As I stated yesterday, we just want to ensure we are all on the same page and don't want to have to revisit these issues during or at the end of the monitoring period. Site 5A —1:1 -148 feet of new channel for 148 LF of credit — relocating channel for bridge construction and better tie -in at mussel habitat area Site 6 —1:1 -144 feet of new channel for 144 LF of credit — removing existing culvert, fixing perch and installing cross - vanes Site 8 — 4:1— 449 feet of new channel for 113 LF of credit — relocating channel due to road. New channel will have reduced buffers Site 9 —1:1— 40 feet of new channel for 40 feet of credit — removing existing pipe to fix perch Site 18 — 2:1— 70,feet of new channel for 35 feet of credit — relocating channel at outlet of pipe to provide a better tie -in with downstream channel Site 21—'2:1 — 396 feet of new channel for 198 feet of credit — relocating channel due to road. New channel will have small buffers Site 25,-7,14:1 — 94 feet of new channel for 24 feet of credit — relocating channel due to road. Reduced buffer on one side Site 30 =1:1— 635 feet of new channel for 635 feet of credit- relocating channel due to road. Existing channel is poor quality.. New channel will have a minimum of 50 foot buffers on both side Site 33 — 2:1— 300 feet of new channel for 150 feet of credit — relocating channel due to road. New channel will be impacted by utility easements the same as the old channel. Site 35 — 4:1— 46 feet of new channel for 12 feet of credit — relocating inlet of channel and removing old pipe. Buffer will only be about 10 feet on both sides So, we will be installing 2322 feet of new channel for 14.99 feet of credit. These are ratios we worked out with the Corp. Reducedratios generally have to do with reduced buffers due to right of way or utility constraints. I have attached our mitigation plan that discusses the existing site conditions as well as proposed site conditions.- Appendix A contains the buffer widths that will be at each site and Appendix B contains the utility impacts to the streams and buffers. Per an email from Amy Euliss dated 9/23/13, on Site 9, this channel will have rip rap on one bank and DWR cannot give credit for rip rap bank stabilization. DWR does not intend to provide credit for Sites 18 and 25 due to very short lengths. I have also attached our response to DWR's on hold letter. Also, as disussed, we would like for your condition about the monitoring to just reference our monitoring section in the mitigation plan (See section 7 of the mitigation plan). Also, your conditions references 50 foot buffers to the maximum extent practical and as you can see from our mitigation plan, we have very few sites that have a 50 foot buffer. Please let me know which sites DWR is giving us credit for and how much credit is at each site. Based on the permit conditions, we are being required to use EEP to provide 3520 LF of mitigation. Per our permit application, DWR mitigable impacts were 5498 LF. I wanted to know where the 1978 LF of on -site credit is being generated since this is more than we had proposed as credit for on -site mitigation. Public Records Law and may be disclosed to third parties Ridings, Rob From: Hemphill, Jeffrey L Sent: Thursday, December 05, 2013 4:24 PM To: Chapman, Amy; Carrillo, Sonia; Ridings, Rob Cc: Dagnlno, Carla S • Subject: R -25196 401 Review Amy I routed the conditions of the R -2519B 401 Certification internally at NCDOT and received the following comments /requests from our staff: Condition of Certification 1.: NES requests that NCDWR reference NCDOT's revised mitigation plan dated November 4, 2013 and in the permit conditions. NCDOT will conduct monitoring in accordance with that approved plan. For example, NCDOT only proposed stem counts on Sites 8, 21 and 30. For the other sites, visual monitoring of the vegetation was proposed since these sites are so small in size. If stem counts are performed on the small sites, then NCDOT will end up counting every tree that is planted. Condition of Certification 2.& 5.: NES requests that Conditions 2 and 5 be combined since they have similar information but also some seemingly contradictory requirements (50 foot wooded buffer in condition 2 and 30 foot wooded buffer with 20 feet of natural vegetation in Condition 5). In addition, the mitigation plan states that NCDOT will not be able to provide 50 foot buffers on most of the relocation sites due to utility easement restrictions, right of way constraints and roadway fill slopes. NES would also like to modify the growing season requirement for relocated streams to just onsite approval from NCDWR (If NCDWR determines vegetation is established and the new channel is stable prior to a complete growing season then this shortens construction schedules and potentially limits the amount of time NCDOT is impacting a jurisdictional resource). Condition of Certification 18.: The trout moratorium (and mussel spawning moratorium) was rescinded for the South Toe River crossing by NCWRC via email correspondence on July 7, 2013. The other moratoria are from a NCWRC Letter dated July 9, 2007: • Big Crabtree Creek (& UTs) - October 15 to April 15 (trout); • Little Crabtree Creek (& UTs) - January 1 to April 15 (trout); • Brushy Creek (& UTs) - January 1 to April 15 (trout); • Long Branch (& UTs) - January 1 to April 15 (trout); If you have any questions about this please let me know.
