Request for Comments ~:ri~~` ~ F °''' ! f° ~~i~r~,k'~'7~` ~. rps,~Gri Dear Mr. Dorney: Duke Energy Corporation is planning to rebuild its existing 161,000-volt transmission line that runs from the Nantahala Hydroelectric Plant to an electrical substation in Robbinsville and continues to TVA's tie station near the Santeetlah Hydroelectric Plant. This proposed action is an upgrade of an existing electrical transmission line across US Forest Service and private lands on an existing, cleared corridor in Macon and Graham Counties, NC that has been in existence for approximately 70 years. The total line length from the Nantahala Hydroelectric Plant to TVA's tie station near the Santeetlah Hydroelectric Plant is 18.81-miles. Permits that have been acquired for the project include a Special Use Permit from the U.S. Forest and Sedimentation and Erosion Control Permits from the N.C. Department of Environment and Natural Resources. Comments from the North Carolina Division of Water Quality are required relative to the proposed action as it relates to the Alcoa Power Generating, Inc. ("APGI") Tapoco Project. APGI manages uses and activities on Tapoco Project lands and waters in accordance with a FERC-approved Shoreline Management Plan ("SMP") and Article 412 of the Tapoco Project Federal Energy Regulatory Commission ("FERC") License Number 2169. APGI must approve industrial uses/facilities of, or on, the Project reservoirs or lands within the Tapoco Project boundary through its Subdivision Access Approval, Multi-use Facility Permitting, and Industrial Approval Procedures (Appendix C of the SMP). Additionally, under Article 412, Duke Energy's planned transmission line rebuild can be categorized as "non-project overhead electric transmission lines that require erection of support structures within the project boundary, for which all necessary federal and state approvals have been obtained" and APGI is required to give FERC at least 60 days prior notice before conveying any interest in project lands. Both the SMP and the Project License require consultation with certain state and federal agencies, tribes, and others, including the North Carolina Division of Water Quality. Once APGI determines that agency consultation is complete, they will file a request for authorization to allow anon-Project use of Project lands and waters with FERC. FERC may then require, within 45 days from the filing date, APGI to file an application for prior approval. Upon satisfactory completion of the industrial approval process and the required prior FERC notice and/or approval, APGI will issue written approval for Duke Energy's planned activities within the Tapoco Project Boundary. f For your use while considering the project and its potential affects, I have enclosed a report entitled Environmental Assessment for the Nantahala-Santeetlah 161 kV Line Rebuild Project on the prot~erty ofAlcoa Power Generating, Inc.---Tapoco Division.
